Map.o£area EXPENDITURE REQUIRED: AMOUNT BUDGETED: None None Agenda No. q'7- ~'~' ~/ Department Origin: City Manager Date Submitted' January 30, 1997 For Agenda of January 31, 1997 IAPPROPRIATION REQUIRED: None SUMMARY STATEMENT Along with the proposed development of Grate's Landing at the comer of Palmetto and Louisiana Avenues, are proposed extensions of water and sewer necessary to service the site. In order to provide water, the County is proposing to nm a waterline adjacent to Louisiana Avenue from Fellesmere Road to Main Slxeet. The cost of this water line is to be shared proportionately by abutting property owners along Louisiana Avenue. Indian River County Utilities has asked for a representative from the City to be present at an assessment hearing to be held Tuesday, February 4, 1997, by the Board of County Commissioners. In order that the City Council be properly represented on this ~, a resolution has been prepared, which if adopted could be presented to the County Commissioners. The proposed water line installation is in keeping with the lnterlocal Agreement between the City and Council which was entered into as a result of the utilities transfer between the City and County along with Ordinance No. 95-25 which authorizes the County to use assessments within the incorporated areas of the City for utility projects. While this project is not within the Highlands water line phases, it is within the incorporated area as contemplated under the Interlocal Agreement and Ordinance 95-25. The assessment rate of $.1079 per square foot is less than any other assessment undertaken (Indian River Drive Water Assessment - $.1136 per square foot & Highlands Phase [ - $. 149 per square foo0. The availability of a wa~r line will increase public safety through in~ fire protection and through the availability of a potable water supply ~stem in areas with septic tanks. And finally it furthers the objectives of the City's Comprehensive Plan for Housing. RECOMMENDED ACTION Adopt the resolution and authorize the City Manager to appear on behalf of the City Council at the County Commission meeting on February 4, 1997. RESOLUTION NO. R-97-9 A RESOLUTION OF THE CITY OF SEBASTIAN, UN'DIAN RIVER COUNTY, FLORIDA, SUPPO.RTLNG THE INSTAI,I~ATION OF A PROPOSED WATERLINE TO BE PLACED ALONG LOUISIANA AVENUE BETWEEN FELLESMERE ROAD AND 'MAIN STREET iN THE CITY OF SEBASTIAN BY INDIAN RIVER COUNTY UTILITIES AND THE USE OF ASSESSMENTS TO PAY FOR THE CAPITAL COST OF INSTALLATION. WHEREAS, On September 20, 1995, the City Council of the City of Sebastian has entered into an Interlocal Agreement with the Board of County commissioners of Indian River County to provide potable and wastewater facilities for the incorporated areas of the City of Sebastian; and WIfEREAS, SECTION 4.04 of the Interlocal Agreement between the City of Sebastian and Indian River County called for 'the adoption of an ordinance to provide t'or assessments to be used by either the City or the County to provide for the expansion and installation of potable water and waste water facilities; and WHEREAS, the City of Sebastian did adopt Ordinance No. 95-25 on September 27, 1995, providing for the assessment of properties for said improvements; and WHEREAS, it is more desirable from a public health perspective to have the ava/lability of a potable water supply Wstem when there is no availability of a centrally treated waste water system; and WHEREAS, a central water supply system provides additional fire protection and potential reductions in fire insurance premiums; and WHEREAS, a proposed 70 unit low and moderate income housing facility for the elderly has generated an immediate need for a potable water supply; and WHEREAS, the Comprehensive Plan for the City of Sebastian through Objective 3-1.1 calls for the promotion of affordable housing and adequate sites for low and moderate income housing and WItEREAS, Policy 3-I. 1.2 under Objective 3-1.1 of the Comprehensive Plan provides for the coordination with Indian River County Utilities to promote the timely extension of water and waste water facilities to residential areas as necessary; and WBEREAS, The Board of County Commissioners of Indian River County is conducting a public heating on Tuesday, February 4, 1997, to consider the assessment of fees for the installation of a water line running between Fellesmere Road and Main Street along Louisiana Avenue; and WltEREAS, the assessments are deemed to be reasonable relative to other water line assessment projects within the City; and WHEREAS, it is the desire of the City Council to express their support 'for the installation of the water line by Indian River County; NOW, TI:I~REFORE, BE IT RESOLVED by the City Council of the City of Sebastian, Indian River County, Florida that the City of Sebastian is fully supportive of the water line installation along Louisiana Avenue between Fellesmere Road and Main Street in the City of Sebastian and the imposition of assessments on the benefiting properties abutting Louisiana Avenue. This section stipulates goals, objectives, and implementing policies for the Housing Element pursuant to ¶163.3177(6)(f), F.S.. and §9J-5.010(3)(a-c), F.A.C. GOAL 3-1: HOUSING. ALLOCATE I.AND AREA FOR ACCOMMODATING A SUPPLY OF HOUSING RESPONSIVE TO THE DIVERSE HOUSING NEEDS OF THE EXISTING AND PROJECTED FLITURE POPULATION AND ASSIST THE PRIVATE SECTOR IN PROVIDING AFFORDABLE QUALITY HOUSING IN NEIGI-IBORHOODS PROTECTED FROM INCOMPATIBLE USES AND SERVED BY ADEQUATE PUBLIC FACILITIES. OBJECTIVE 3-1.1: PROMOTE AFFORDABLE HOUSING AND ADEOUATE SITES FOR LOW AND MODERATE INCOME HOUSING. Assist in providing the projected need for 1145 additional low and moderate housing units for the period 1990 through 1995. This total includes 1028 owner-occupied units and 117 rental units. In order to meet the low and moderate income need for the period 1996 through 2010, an additional 1174 housing units will be needed. This total consists of 1049 owner-occupied units and 125 rental units. Tables II1-9 and 1II-10 in the Comprehensive Plan, Housing Element Data Inventory and Analysis provides the methodology for the projections cited in this objective. The City of Sebastian shall assist in providing for the projected total additional housing need for the period 1990 through 1995 of .1621 housing units, including both low and moderate income housing needs and all other housing demands. This total includes 1338 owner-occupied units and 283 rental units. In order to me6t the overall need for additional housing units' from 1996 through 2010 the City shall assist in providing for a projected 6093 housing units, including low and moderate as well as all other additional housing needs. This total includes 5030 owner occupied housing units and 1063 rental housing units. Policy 3-1.1.1: Technical Assistance, Information and Referral Services. Provide technical assistance, information and referral services to the private sector in order to maintain a housing production capacity sufficient to meet the projected housing market demand and continue to advance fair housing and elimination of discrimination in housing. Policy_. 3-1.1.2: Developing Public/Private Partnerships. Develop local government partnerships with the private sector in order to improve the efficiency and ea'pand the capacity of the housing delivery system. Actions shall include coordinating with indian River County and the General Development Utilities Corporation in order to promote the timely extension of water and wastewater services to residential areas as necessary. Similarly, the City shall also coordinate the installation of community facilities supportive to housing resources. Policy 3-1.1.3: Affordable Housing.for Low and Moderate Income Households. By September 1990 the City shall amend its land development regulations in order to include principles and criteria for locating low and moderate income housing. The City shall continue to promote access to a broad range of housing opportunities with a full complement of urban services through cooperation and coordination with the private sector and Indian River County. The City of Sebastian acknowledges the need for affordable low and moderate income housing and has provided one of the County's largest concentration of affordable homesites. Sites for affordable housing for low and moderate income households shall be approved if such sites have access to the following facilities, services and/or activity centers: o Serviced by potable water and central wastewater systems; Accessible to employment centers, including shopping centers which accommodate stores offering household goods and services needed .on a frequent and recurring basis; ...... Located on a paved street accessible to a major street (i.e., included in the City's major thoroughfare plan); Accessible to public parks, recreation ares, and/or open space systems; and Located on sites having adequate surface water management and solid waste collection and disposal. The City shall promote the use of federal, state, and local subsidy programs, including Sec. 208 funding, to meet the need for affordable housing. The City Department of Community Development shall meet with the Indian River County Planning Director and the Director of the Indian River County Housing Authority and by the end of 1991 draft a program for annual evaluation of affordable housing needs within the incorporated and unincorlSorated areas. The program shall include annual assessments, including recommended actions for the ensuing year. The annual assessment of affordable housing needs shall be presented to the City Planning and Zoning Board and the City Council for action. Furthermore, the City shall participate in Treasure Coast Regional Planning Council initiatives directed toward educating local governments of new techniques especially prograrn~ applicable to the region and/or the County, for promoting affordable housing. In drafting updated land development regulations, the City shall ensure that regulatory techniques and review procedures do not create barriers to affordable housing. The City shall also promote nondiscrimination in access to housing within the City by promoting fair housing laws and practices. WHEREAS, On September 20, 1995, the City Council of the City of Sebastian has entered into an Interlocal Agreement with the Board of County commissioners of Indian River County to provide potable and wastewater facilities for the incorporated areas of the City of Sebastian; and WHEREAS, SECTION 4.04 of the Inteflocal Agreement between the City of Sebastian and 'Indian River County called for the adoption of an ordinance to provide for assessments to be used by either the City or the County to provide for the expansion and installation of potable water and waste water facilities; and WHEREAS, the City of Sebastian did adopt Ordinance No. 95-25 on September 27, 1995, providing for the assessment of properties for said improvements; and WHEREAS, it is more desirable from a public health perspective to have the availability of a potable water supply system when there is no availability of a centrally treated waste water system; and WHEREAS, a central water supply system provides additional fire protection and potential reductions in fire insurance premiums; and WHEREAS, a proposed 70 unit low and moderate income housing facility for the elderly has generated an immediate need for a potable water supply; and WHEREAS, the Comprehensive Plan for the City of Sebastian through Objective 3-1.1 calls for the promotion of affordable housing and adequate sites for low and moderate income housing; and WHEREAS, Policy 3-1.1.2 under Objective 3-1.1 of the Comprehensive Plan provides for the coordination w/th Indian River County Utilities to promote the timely extension of water and waste water facilities to residential areas as necessary; and WHEREAS, The Board of County Commissioners of Indian River County is conducting a public heating on Tuesday, February 4, 1997, to consider the assessment of fees for the installation of a water line running between Fellesmere Road and Main Street along Louisiana Avenue; and WHEREAS, the assessments are deemed to be reasonable relative to other water line assessment projects within the City; and WHEREAS, it is the desire of the City Council to express their support for the installation of the water line by Indian River County; NOW, THEREFORE, BE IT RESOLVE'I) by the City Council of the City of Sebastian, Indian River County, Florida that the City of Sebastian is fully supportive of the water line installation along Louisiana Avenue between Fellesmere Road and Main Street in the City of Sebastian. and the imposition Louisiana Avenue. of assessments on the benefiting properties abutting The foregoing Resolution was moved for adoption by Councilmember The motion was seconded by Councilmember __ and, upon being put to a vote, the vote was as follows: Mayor Louise R. This section stipulates' goals, objectives, and implementing policies for the Housing Element pursuant to ¶163.3177(6)(f), F.S., and §9J-5.010(3)(a-c), F.A.C. GOAL 3-1: HOUSING. ALLOCATE LAND AREA FOR ACCOMMODATING A SUPPLY OF HOUSING RESPONSIVE TO THE DIVERSE HOUSING NEEDS OF THE EXISTING AND PROJECTED ~E POPULATION AND ASSIST THE PRiVATE SECTOR IN PROVIDING AFEORDABLE QUALITY HOUSING IN NEIGHBORHOODS PROTECTED FROM INCOMPATIBLE USES AND SERVED BY ADEQUATE PUBLIC FACILrFIE3. OBJECTIVE 3-1.1: PROMOTE AFFORDAB!-R HOUSING AND ADEQUATE SITES FOR LOW AND MODERATE INCOME HOUSING. Assist in providing the projected need for 1145 additional low and moderate housing units for the period 1990 through 1995. This total includes 1028 owner-occupied units and 117 rental units. In order to meet the low and moderate income need for the period 1996 through 2010, an additional 1174 housing units will be needed. This total consists of 1049 owner-occupied units and 125 rental units. Tables III-9 and III-10 in the Comprehensive Plan, Housing Element Data Inventory and Analysis provides the methodology for the projections cited in this objective. The City of Sebastian shall assist in providing for the projected total additional housing need for the period 1990 through 1995 of 1621 housing units, including both low and moderate income housing needs and all other housing demands. This total includes 1338 owner-occupied units and 283 rental units. In order to meet the overall need for additional housing units' from 1996 through 2010 the City shall assist in providing for a projected 6093 housing units, including low and moderate as well as all other additional housing needs. This total includes 5030 owner occupied housing units and 1063 rental housing units. Policy 3-1.1.1: Technical Assistance, Information and Referral Services. Provide technical assistance, information and referral services to the private sector in order to maintain a housing production capacity sufficient to meet the projected housing market demand and continue to advance fair housing and elimination of discrimination in housing. Policy 3-1.1.2: Developing pu...blic/Private Partnerships. Develop local government partnerships with the private sector in order to improve the efficiency and expand the capacity of the housing delivery system. Actions shah include coordinating with indian River County and the General Development Utilities Corporation in order to promote the timely extension of water and wastewater services to residential areas as necessary. Similarly, the City shall also coordinate the installation of community facilities supportive to housing resources. Policy 3-1.1.3: Affordable Housing for Low and Moderate Income Households. By September 1990 the City shall amend its land development regulations in order to include principles and criteria for locating Iow and moderate income housing. The City shall continue to promote access to a broad range of housing opportunities with a full complement of urban services through cooperation and coordination with the private sector and Indian River County. 3-1 I The City of Sebastian acknowledges the need for affordable low and moderate income housing and has provided one of the County's largest concentration of affordable homesites. Sites for affordable housing for low and moderate income households shall be approved if such sites have access to the following facilities, services and/or activity centers: Serviced by potable water and central wastewater systems; Accessible to employment centers, including shopping centers which accommodate stores offering household goods and services needed on a frequent and recurring basis; " ' Located on a paved street accessible to a major street (i.e., included in the City's major thoroughfare plan); Accessible to public parks, recreation ares, and/or open space systems; and Located on sites having adequate surface water management and solid waste collection and disposal. The City shall promote the use of federal, state, and local subsidy programs, including Sec. 208 funding, to meet the need for affordable housing. The City Department of Community Development shall meet with the Indian River County Planning Director and the Director of the Indian River County Housing Authority and by the end of t991 draft a program for annual evaluation of affordable housing needs within the incorporated and unincorporated areas. The program shall include annual assessments, ineludhag recommended actions for the ensuing year. The annual assessment of affordable housing needs shall be presented to the City Planning and Zoning Board and the City Council for action. Furthermore, the City shall participate in Treasure Coast Regional Planning Council initiatives directed toward educating local governments of new techniques especially programs applicable to the region and/or the County, for promoting affordable housing. In drafting updated land development regulations, the City shall ensure that regulatory techniques and review procedures do not create barriers to affordable housing. The City shall also promote nondiscrimination in access to housing within the City by promoting fair housing laws and practices. OBJECTIVE 3-1.2: MAINTAIN HOUSING STOCK FREE OF SUBSTANDARD'UNITS.
