R-98-12 - Certificate of Canvassing Board A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, PERTAINING TO THE MUNICIPAL ELECTION; PROVIDING FOR CANVASSING OF ELECTION RETURNS; PROVIDING FOR DECLARATION OF RESULTS; DIRECTING THE CLERK TO ENTER THE RESULTS OF THE ELECTION IN THE OFFICIAL MINUTES OF THE MEETING OF THE CITY COUNCIL; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. Pres~lltation of Plaques to Mayor Waiter Barnes and Vi.ce Mayor Richard Taracka, bv City Manager The City Manager presented plaques to Mayor Walter Barnes and Vice Mayor Richard Taracka. C. Investiture 0f N~atly_ l~l~:~l 0tlici41s by_City Clerk The City C~k swore in newly flfleeted City Council Members Martha Wininger and Chuck Neuberger, who then took their places at the dais. Mr. Barnes and Mr. Taracka left the dais at this time and the gavel was handed over to senior Councilmember, Mrs. Cartwri~t. D. Election of Mayor Mrs. Cattwfight welcomed the new Council members and called for nominations for Mayor. Mrs. Wininger nominated Mm. Sullivan; and, there being no other nominations, Mrs. Sullivan was elected Mayor and handed the gavel. E. Election Qf Vice_May0.1: Mayor Sullivan called for nominations for Vice Mayor. Mr. Neuberger nominated Mrs. Wininger; and, there being no other nominations, Mrs. Wininger was elected Vice Mayor. DRAFT Special City Council Meeting March 16, 1998 Page Two Mayor Sullivan wished everyone a happy St. Patrick's Day and announced the St. Sebastian Church Las Vegas night fundraiser, the Kroegel house fundraiser in Riverview Park sponsored by Jane Castle. She then called for a motion to adjourn. MOTION by Wininger/Cartwfight I move to adjourn. VOICE VOTE on the motion carried 5-0. 5. The City Council shall then declare the results of the election and enter them in the minutes of the special meeting." Recommeod¢cl fiction: Adoption of Resolution No. R-98-12, certificate of canvassing board, by current City Council members. 2) Presentation of Plaques to Former. City Council Members Prior to the sweating in of new officials, the City Manager will present plaques to outgoing members, Mayor Barnes and Vice Mayor Taracka, who will then leave the dais. 3) Investiture of Newly Elected City Council Mgllll~ers: Summary Statement: In accordance with Section 2.04(b) of the City Charter, "The term of each newly elected council member shall begin on the Monday following the election, at a special meeting of the city council to be held for the purpose of swearing in such newly elected officials. Ifa regular meeting is to be held the Monday following the election, the newly elected officials shall be sworn in at the conclusion of such meeting." Section 4.08(c) continues, "Any oath of office required to be administered to the newly elected council members shall be administered at such special meeting or at the next city council meeting where the newly elected council members are in attendance." R~commended Action: The City Clerk will swear in newly elected City Council members and the new members will take their places at the dais. 4) lglection of Mayoi: Summary Statement: In accordance with Section 2.06 of the City Charter, "...after the seating of any newly elected council members, at the first scheduled city council meeting subsequent to the second Tuesday in March, the new city council shall, as the first order of business, elect a ma~yor_from among its members. The incumbent mayor or in his or her absence, the vice-mayor o~h his or her absence, the seniOr member of city council, shall ask for nominations for mayor~dfier all nominations have been made, the nominations shall be closed. The city clerk shall then call the roll of the council members and each council member shall cast an a tt~ative vote for the counci! member of their choice. The council member that receives a majority of the votes cast on the first ballot, balloting with sequential roll calls shall continue until a council member receives a majority vote. Council members shall not nominate themselves. Only elected council members shall be eligible for the office of mayor. (1) If there is no mayor seated on the new or existing city council, a temporary city council chairperson may be elected from the incumbent members of the city council for the purpose of electing a mayor as set forth above. (2) In the event there is only one nomination and second for mayor, the nominee shall be seated as mayor." /~nR~:or~ended Actioll: The senior member of Council shall ask for nominations for mayor and then close ominations. The City Clerk will then call the roll on each nominee and each Council member shall vote in the affirmative on nominee of his/her choice. The first nominee that receives a majority of affmnative votes shall be elecl~d mayor. 5) Election of ¥ice Mayor Summary Stat?ro~Rt: In aecordan~ with Section 2.06(c), "~4t thefirst regularly scheduled city council meeting subsequent to the second Tuesday in March, the city council shall elect a vice-mayor from among its members. The term of the vice-mayor shah be for one year or until his or her successor is elected. The vice-mayor shah be elected using the same procedure as for the election of the mayor." Recommended Action: The newly elected mayor shall ask for nominations for vice-mayor. The City Clerk will then call the roll on each nominee and each Council member shall vote in the affirmative on nominee of his/her choice. II-98-I2 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, PERTAINING TO THE MUNICIPAL ELECTION; PROVIDING FOR CANVASSING OF ELECTION RETURNS; PROVIDING FOR DECLARATION OF RESULTS; DIRECTING THE CLERK TO ENTER THE RESULTS OF THE ELECTION IN THE OFFICIAL MINUTES OF THE MEETING OF THE CITY COUNCIL; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Mayor of the City of Sebastian, pursuant to Section 4.05 of the City Charter, issued a Proclamation on January 28, 1998, calling a general election on March 10, 1998, for the purpose of selecting two (2) City Council members; and WHEREAS,the City Council of the City of Sebastian, pursuant to Section 4.07 of the City Charter, adopted Resolution No. R-98-01 on January 28, 1998, specififing Precincts 12, 14, 15 and 16 as the official polling places for the City of Sebastian for the general election, and naming the offices to be filled; and WHEREAS, the City Council affarmed the Canvassing Board for the City of Sebastian on January 28, 1998; and WHEREAS, the City Clerk of the City of Sebastian, pursuant to Section 100.021 of the Florida Statutes, has caused to be published notice of the general election on December 9 and 19, 1997, in the Veto Beach Press Journal, a newspaper of general circulation; and WHEREAS, the City Clerk has posted notice of the general election on the official announcement board located at City Hall; and WHEREAS, Precincts 12, 14, 15and 16 of the City of Sebastian, Indian River County, Florida, held a general election on March 10, 1998; and WHEREAS, the Canvassing Board has verified said returns and has found the same in proper form. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that: SECTION1, DECLARATION. The City Council of the City of' Sebastian, Indian River County, Florida, hereby accepts the returns provided by the Canvassing Board for the City of Sebastian for the general election, held on March 10, 1998, in Precincts 12, 14, 15, and 16 of the City of Sebastian, as attached hereto as Exhibit "A". SECTIO. b[ 2. RECORDING. The City Clerk is hereby directed to enter the results of the general election in the official minutes of the City Council meeting during which this Resolution is adopted. ~ECTION 3. CONFLICT. All resolutions or parts of resolutions in conflict herewith are hereby repealed. SECTION 4. EFFECTIVE DATE. This resolution shall take effect immediately upon its passage.
