Thus, Mr. Christino and Ms. Jordan will be voting in their places. V. Approval of Minutes -- May 5, 2022 Mr. Alvarez asked if all the Commissioners have had a chance to review the Minutes of the May 5th 2022 meeting. All indicated they had. There being no comments or corrections, Mr. Alvarez called for a motion. A motion approving the Minutes of May 5, PLANNING AND ZONING COMMISSION/LOCAL PLANNING AGENCY PAGE 2 MINUTES OF JULY 7, 2022 2022 as presented was made by Ms. Kautenburg, seconded by Mr. Simmons, and approved unanimously via voice vote. VI. Public Hearinas -- None VII. Unfinished Business -- None VIII. Public Input -- None IX. New Business A. Discussion -- Land Development Code Amendment -- Medium Density Residential Development (MDR), Draft RM-10 (Residential Multi -Family, 10 units/acre) Zoning District and Attainable Housing Ms. Bosworth stated that this meeting is being held this evening because staff wanted to start off with a discussion rather than coming before the Commission dealing with this matter with a public hearing. As staff was putting together this new zoning district as required by the Comprehensive Plan, they had some items when putting together the ordinance that they felt they wanted to run past this Commission first to see if we are on the right track and if the Commission members feel this is a good direction to begin to address attainable housing. Following this evening's input from the Commission, staff will create an ordinance, and they will schedule a public hearing for the LPA with the Commission's input tonight integrated into the ordinance. Reviewing some of the information that was given to the Commissioners tonight regarding attainable housing, she opined that this is a good starting point from which to proceed. She also stated that Kelley Klepper and Monet Moore from Kimley-Horn & Associates are present, and they will participate in the discussion. They have put together a Power Point with some slides that will relate to the discussion tonight. Mr. Klepper introduced himself and Ms. Moore. He explained that tonight is a workshop, and he is looking for the Commissioners' input. He stated that the Comprehensive Plan will be discussed. Though there are no modifications to be made to the Plan, this will give us the legal basis to move forward with the implementation of the RM-10 and some of the other standards. The Code itself is what implements the Plan. He reviewed how there was a series of policies that came out as part of the Comprehensive Plan, including an update to the land -use element that provided for the lead-in to the MDR. Mr. Klepper made a Power Point presentation (SEE ATTACHED) which covered several aspects and examples of the types of housing that could be implemented going forward. PLANNING AND ZONING COMMISSION/LOCAL PLANNING AGENCY PAGE 3 MINUTES OF JULY 7, 2022 He emphasized that what is suggested does not in any way change anyone's existing property development approvals or rights. This is one additional tool that the City has at its disposal to help achieve attainable housing that is missing in Sebastian —providing densities that can be a bit more cost effective from a development perspective and also provide a better usage of the City's infrastructure from a level -of -service perspective. There was an extended discussion among the Commissioners, Mr. Klepper, Ms. Moore, and Ms. Bosworth regarding the proposed RM-10 zoning district. Following this discussion, it was the consensus of the Commissioners that they liked the proposed regulations and criteria, and that this is a good first step in the process of implementing attainable housing in Sebastian. Following the discussion, Mr. Klepper suggested that the Commissioners talk to others about this matter and provide input to the Community Development staff so that they can give those comments to Kimley-Horn. That way, he and his staff can include those suggestions when they bring this matter back to the Commissioners. Ms. Kautenburg thanked everyone for putting this presentation together. X. Other Matters: • A platted, 40-foot wide drainage Right -of -Way owned by the city runs parallel along the subdivision's north boundary line. The applicants have agreed to allow the city access along the private Terra Lane, and extend that access into Parcel 3 by creating a 25-foot ingress/egress easement, both adjacent to the ditch, for yearly maintenance activities performed by the city. Formal dedication language establishing this access will need to be added to the Final Plat. 4 • Laconia Street, in this area of Sebastian Highlands, is a one-way roadway until it reaches the Gladiola Avenue intersection, with vehicles travelling south to north. The Terra Estates access from Laconia Street is designed as a left -in, left out only entrance. As such, appropriate signage and stripping has been indicated on the plat, and specific details will be provided with the subdivision construction drawings. An Environmental Analysis of the property was submitted with the application. Wetland areas exist within the very western portion of Parcel 3 in proximity to the St. Sebastian River. This area of the parcel is not conducive to development, and most likely will remain as a preservation or conservation area. Numerous Gopher Tortoise burrows were found, however, within the proposed street area, and on Parcels 1 & 2. Relocation of the tortoises through proper jurisdictional permitting must occur before permitting for construction and land clearing in these areas can be approved. • Although the subdivision proposes only three residential lots, a letter from the IRC School Board regarding available school capacity is still required. 14. Conclusion: The proposed three -lot subdivision is consistent with the Comprehensive Plan, the Code of Ordinances and the Land Development Code. 15. Recommendation: Staff recommends that the Planning and Zoning Commission find the Terra Estates Preliminary Plat to be consistent with the Comprehensive Plan, the Code of Ordinances and the Land Development Code, and that they forward their recommendation of approval to City Council with the following conditions: 1. The subdivision's Final Plat must include dedication verbiage that allows the City of Sebastian access over Tract A and the 25-foot ingress/egress easement that is depicted on Parcel 3 in order to allow for maintenance activities of the city's adjacent 40-foot wide drainage ROW. 2. A School Capacity Availability Determination Letter (SCADL) is received from the IRC School Board before construction begins. 3. An updated Gopher Tortoise survey is submitted with the Landclearing Permit.
