WIIE~S, the City Council of the City of Sebastian, Florida, desires to amend the
Land Development Code relating to the size of a garage or carport in the Marine Commercial
and Residential Zoning District; and
WI~REAS, the City Council of the City of Sebastian, Florida, believes that it is in the
best interests of the health, safety, and general welfare of the community to do so,
NOW THEREFORE, BE IT ORDAINED BY ~ CITY COUNCIL OF ~
CITY OF SEBASTIAN, FLORIDA, TllAT:
Section 1. Section 20A-3.11.D. of the Land Development Code, City of Sebastian,
Florida is hereby amended to read as follows:
Minimum living area: The minimum floor area required for a single-family
dwelling, excluding porches, terraces, attached garages, carports and other
unenclosed areas, shall be one thousand (1,000) square feet.

Every single-family dwelling unit shall be required to provide a garage or
carport. If a carport or similar unenclosed vehicle storage structure is

provided then the principal structure shall contain a fully enclosed utility
storage area of at least sixty (60) square feet which shall be designed as an
integral part of the principal structure. If a fully enclosed garage is
provided then no utility structure shall be mandated. The ~
carp_on shall have a minimum interior clear dimension of ten (!.0) feet by
twenW (20) feet.
Duplex: 750 square feet per unit; efficiencies: six hundred (600) square
feet per unit; one bedroom unit: seven hundred (700) square feet per unit;
two (2) bedroom unit: eight hundred fifbf (850) square feet per unit; three
(3) bedroom unit: one thousand (1,000) square feet per unit; and each
additional bedroom: add one hundred (100) square feet per bedroom
addition.
Section 2. CODIFICATION. It is the intention of the City Council of the
City of Sebastian, Florida, that the provisions of this Ordinance shall become and be made a
part of the Land Development Code of the City of Sebastian, Florida, and that the sections of
this Ordinance may be renumbered, relettered, and the word "ordinance" may be changed to
"Section", "Article", or such other word or phrase in order to accomplish such intention.
Section3. CONFLICT. All other Ordinances or parts of Ordinances,
Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the e~ent of
such conflict.

Section 4. SEVERABILiTY. If any clause, section, or other part or
application of this Ordinance shall be held by any Court of competent jurisdiction to be
unconstitutional or invalid, such unconstitutional or invalid part or application shall be
considered as eliminated, in no way affecting the validity of the remaining portions or
applications, which shall remain in full force and effect.
Section 5. EFFECTIVE DATE. This Ordinance shall become effective
immediately.

(b) Rear yard: Rear yards that do not front the Indian River - 25 feet.
Notwithstanding the foregoing, drainage and submerged lands
protection provisions of this Code shall be complied with.

(c) Side yard: 15 feet. Provided, however, that if the side is adjacent
to a residential district or adjacent to existing residential uses, a

of this code shall be complied with. If the use is residential on the

(d) Minimum distance between principal structures on the same lot: 20
feet.

When an accessway intersects a public right-of-way or when the subject
property abuts the intersection of two (2) or more public rights-of-way, all
landscaping within the triangular area described bclw:: in subsection 20A-

AppBcable zoning districts. Drive-in restaurants shall be permitted
as a conditional use within the following zoning district: CG.
Conditional use criteria. Drive4n restaurants will be allowed
provided the following conditions are met:
(1) No more than two (2) curb cuts shall be permitted on any
single street frontage. Curb cuts shall be limited to a
maximum width of fifty (50 feet and shall be located no
closer than thirty-five (35) feet removed from property

lines. A fifteen (15) foot separation shall be maintained
between curb cuts.
(2) No building, structure or off-street loading or parking area
shall be located closer than thirty (30) feet to any residential
use or district.
(3) All travel lanes and driveways shall be interpreted as off-
street parking, and as such shall conform to the landscape
requirements of this chapter.

Section 1. Section 20A-5.47. of the Land Development Code, City of Sebastian,
Florida is hereby created to read as follows:
Sec. 20A-5,47. Mini-storage facilities.
A.
Purpose. The purpose of this section is to provide for opportunities for the
development of mini-storage facilities within the city while minimizing the impact
of such facilities on the surrounding properties.
General regulations of mini-storage facilities.
The minimum site size for a mini-storage facility shall be two acres.
The maximum imerior area of each unit shall be 400 square feet.
The maximum height of the buildings shall be 12 feet.

4. The setbacks of the respective zoning district shall be used except in no
case shall the setback be less than twenty feet.
5. The rear and side lot lines shall be screened with a type "A" opaque screen.
6. There shall be no outside storage.'
7. An office may be included provided it does not exceed 400 square feet in
area.
8. No occupational licenses other than for the main use (storage) shall be
permitted.
9. No sales, garage sales, manufacturing or repair is permitted. However this
does not preclude the use as a depot for such purposes as a franchised
distribution, the temporary storage of personal property used and stored in
residences, offices, retail stores, service establishments, professional offices
and other commercial uses, or for contractor supplies.
10. There shall not be any storage of flammable, toxic, highly combustible or
other hazardous materials or substances.
11. No water or sewer service shall be provided to the individual storage units.
Self-service Storage Facilities
1. Self-service storage facilities for the storage of only domestic and
household goods or personal and noncommercial goods can be considered
as a special use permit in the following districts: CG, PUD(C), and IN. In
addition to the requirements of Section 20A-2.6., the use shall meet the
following requirements:

The maximum interior area for a self-service storage facility shall be
150 square feet.
The maximum height of the building shall be 10 feet.
Outdoor storage is prohibited.
All outdoor lights shall be shielded to direct light and glare only
onto the self-service storage facility premises.
The maximum size of a self-service storage facility shall be two
acres.
The setbacks of the respective zoning district shall be used except
in no case shall the setback be less than twenty feet.

An office may be included provided that it does not exceed 400
