Persons who desire to make a presentation or present #'tfor,nation or comment on an application or item must register with the CiO, Clerk or Board
secretary prior to the time in the meeting at which such item is to be heard in accordance with R-97o21. (meeting procedures)
Affected Parties are the Applicant, City Staff and Persons Entitled to Notice Under Code or Statute. A homeowners or property owners association
whose members include an affected paro' shall be granted affected paro' status by the Cio' Council/Board provided the association has been
established pursuant to Florida Law. A certificate of good standi~gfrom the Florida Secretary of State 'S office attd a resolution of the board of the
association authorizing said representation shall be ~led with the City Clerk's office prior lo the entio' 's request to be granted affected paro' status.
Affected Parties May Request Extension of Time from Cio' Council/Board and may object to the introduction of any evidence, whereupon, the presiding
officer may rule upon the objection to the admissibility of any evidence. The City Council/Board members may ad~Trm or overrule the ruling. Persons
addressing Council/Board shall identify any educational, occupational or other experience which may be relevant to the matter.
Disclosure of ex-parte communication in land-use matters is not required and such non-disclosure shall not be deemed prejudicial to the decision of
the Cio' Council/Board. All decisions of the City Council/Board on land use matters must be supported by substantial, competent evidence in the
record pertinent to the proceeding irrespective of such communications.
A person who appears before the decision making body who is not an affectedparo' may be allowed to testify before the decision mala'ng body, may be
requested to respond to questions from the decisiott making body but need not be swor~t as a witness and is not be subject to cross-examination and is
not required to qualify as an expert witness. The decisiott maki~tg body shall assig~ weight and credibility to such testimony as it deems appropriate.

~UMMARY
This agenda item involves a problem associated with a ditch that rum along the side of the property
owned by Mr. and Mrs. Barton. As noted by the survey the ditch encroaches substantially into
their property. From top of bank to top of bank, the ditch is approximately 20 feet wide. At its
deepest, the ditch is eight feet deep.
As the Council may recall, the City currently budgets $30,000-$50,000 annually within the capital
budget for these particular problems. It has been estimated that to replace the existing pipe under
the road and to enclose the existing ditch with a pipe would be $24,421. Unfortunately, those
funds for this year have been expended.
Alternatives would be to:
o Take no action - home owner regrade the ditch
· Two adjacent property owners fund the installation with City Providing permit
· Appropriate the needed funds
· Have City crews regrade ditch
It should be noted that the entire width of the easement is only 5 feet on each side of the property
line for a total width often feet. The easement width is totally inadequate for the size of the ditch
in order to meet a minimum of a 3:1 slope.
Currently, there are a number of other people who~ hav_e_se.~fi~m_3,s who would be in front
of the Barton' priority Wise.

SUMMARY STATEMENT
With the departure of Mr. Robert Massarelli, Community Development Director, a determination
relative to the operation of the department is necessary. It is my opinion that the operation needs
to be restructured to capture some efficiencies. ~
I would recommend that the building operation headed up by Building Official, George BonaCci,'
be broken out as a separate department with the responsibility of administrating and enforcing the
appropriate building and housing codes of the City. That would include all duties associated
with contractor licensing and certification, review of construction plans, issuance 6f bUilding
permits and the inspection of the respective construction permits and the enforcement of
associated building codes. The department would be headed up by Mr. Bonacc~i as the direct____~or
wa'th two building inspectors and three office pers~
The other portion of the Community Development Department would be entitled the Planning
and Code Enforcement Department. I would propose that Mr. Tracy Hass would head up the
department as the director. In addition to Mr. I-lass, Mrs. Jan King would function as a planning
and zoning manager. There would be two existing clerical positions which would be assigned to
the department and there would be two code enforcement officers. The function of the
department would be the administration and enforcement of the City's Land Development Codes
and development review for various advisory boards and the City. Council. The.... department
would also review applications for individual building permits, and the department would be the
enforcement hand of the City's codes.

The reorganization as proposed would eliminate one position from the current departmental
structure, namely that of the Director of Community Development. I have discussed this
proposal with Mr. Bonacci, Mr. Hass and Mrs. King. All are in agreement that this
reorganization would work. This is primarily the result of the completion of a number of' large
and complex tasks. Those tasks were the completion of the River Front Study and its adopted
plan, the completion and submittal of ',he EAR related comprehensive plan amendments, and the
drafting and submittal of the Land Development Code Amendments to the Planning and Zoning
Commission. Not all the work is totally completed, but it has been substantially finished. This
would lessen the demands on existing staff tbr the tbreseeable future

If, the Count! Membe~ we. re to agree to such reorganization, I would request the fight fill ~
planner posmon rain me future. This would be if the load anticipated exceeded what is!
anticipated. This would make both Mr. Hass and Mrs. King feel more comfortable should the~'-
demands exceed their level of productivity. Such .hiring would only be done under the approval
of the City Council and funding for that position being appropriated only at the same time by the
Council.
If the Council is in support of this concept, I will developed detailed job descriptions for the
Council's review and approval. In the interim, I will direct the staff as constituted to begin
preparation of separate budgets.
RECOMMENDED ACTION
Accept the proposal for reorganization of the Community Development Departmem into a
Building Department and a Pl~nlng and Code Enforcement Department with the City Manager
to bring back to the Council appropriate job..des~fiptions for its review and approval.

The board shall be composed of seven regular members, and at city council's discretion, up
to t~wo alternate members. All members shall be appointed by the city council and the board

SUMMARY
Mr. Chuck Mechling, Onsite Management Group, has applied for a special use permit for a sand
mine to excavate stormwater management lakes at Collier Club PUD Subdivision. The design of
the lakes was approved by City Council at the preliminary plan approval.
The amount of material Which muStbe excavated for the lakes exceeds the requirement for fill on
the property. Therefore, fill must be removed from the site.
The amount of fill to be removed is approximately 40,000 cubic yards. Since the amount of fill to
be removed from the site exceeds 5,000 cubic yards, the proposed activity is, by definition, a sand
mine and requires a permit.
The Planning and Zoning Commission has recommended approval with conditions.
RECOMMENDED ACTION
Hold a public hearing and approve Resolution R-98-25
Manager's Note: Since this project recluires access out onto the County R/W, Roseland Road,
Council may want to include an additional condition relative to Indian River County approval

A RESOLUTION OF THE CITY OF SEBASTIAN, iNDIAN RIVER
COUNTY, FLORIDA, GRANTING A SPECIAL USE PERMIT AND
MINiNG PERMIT TO MR. HAROLD ADAMS FOR A SAND MiNE
AT THE COLLIER CREEK ESTATES SUBDMSION;
PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF

WBEREAS, Mr. Chuck Mechling, Onsite Management Group, has applied for a
special use permit for a sand mine to excavate stormwater management lakes at Collier
Creek Estates; and
WHEREAS, the Planning and Zoning Commission has reviewed the application
for the special use permit and has found that the propOsed Sand mine will not be
detrimental to the public safety, health, or welfare nor will it be injurious within the
immediate vicinity in which the property is located and that the proposed use is consistent
with the purpose and intent of the PUD-R zoning'district and is similar in nature and
compatible with uses allowed in the PUD-R zoning district; and

and recommends the City Council approve the application for a sand mine to excavate the
stormwater lakes at Collier Club PUD with conditions; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLOIRDA, AS
FOLLOWS:

mine will not be detrimental to the public safety, health, or welfare nor will it be injurious
within the immediate vicinity in which the property is located and that the proposed use is
consistent with the purpose and intent of the PUD-P, zoning district and is similar in
nature and compatible with uses allowed in the PUD-R zoning district.
SECTION 2. APPROVAL. The City Council of the City of Sebastian approves

The hours of operation shall be 7:00 A.M. TO 5:00 P.M. Monday through
Friday. This includes excavation and hauling of material from the site.
2. The property to be excavated shall be posted "no trespassing".
The required compliance and restoration bonds shall be posted.
The applicant shall place permanent project boundary comers, with
intermediate stakes at a minimum of three hundred feet and all limits of
excavation shall be staked, marked and maintained with visible flags in the
field, in accordance with approved plans for the permit.

capacity needed for fill on lots within the subdivision. The areas to be
mined are for future on-site drainage retention lakes. According to the
Land Development Code Section 20A~5.22(f), excavation of greater than
five thousand (5,000) cubic yards requires a sand mining permit.

Recommendation: Staff recommends the city council approve the
sandmining permit for Collier Club with the following conditions:
