The City Council may amend the tentative budget and reduce (but not increase) the proposed millage rate. If the City Council changes the tentative millage rate, then the following steps must be followed: re-compute the proposed rate publicly announce the percent, if any, by which the re-computed rate is more or less than the rolled-back rate (which percentage shall be characterized as the percentage decrease or increase in property taxes tentatively adopted by the City Council). In this first public hearing, the first substantive issue to be discussed shall be: the percentage change in the millage over the rolled-back rate, and the City Council shall hear comments regarding the millage rate and explain the reasons for the change from the rolled-back rate The public shall be allowed to speak and to ask questions prior to adoption of the proposed millage rate. The City Council shall adopt its millage rate prior to adopting its budget by separate motions. RECOMMENDED ACTION Move to adopt a tentative millage of 6.900 mills which is one and ninety-three one hundredths percent (1.93%) more than the rolled back rate of 6.7691 mills; Move to accept the 1~t reading of Ordinance 0-97-63 which establishes a millage rate of 6.900 mills which is one and ninety-three one hundredths percent (1.93%) more than the rolled back rate of 6.7691 mills; publish the appropriate budget ad on Friday, September 19, 1997; and set the final public hearings on budget for Wednesday September 24, 1997 at 7:00 p.m. at City Council Chambers. ORDINANCE NO. O-97~65 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA ADOPTING A I PROPOSED MILLAGE RATE OF 6.900 FOR THE CITY'S GENERAL OPERATING FUND FOR THE FISCAL YEAR i BEGINNING OCTOBER 1, 1997 AND ENDING SEPTEMBER 30, 1998; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. i WHEREAS, a budget has been prepared estimating expenses and revenues of the City of Sebastian, Indian River County, Florida, for the ensuing fiscal year, with detailed information, including revenues to be derived from sources other than ad valorem levy, and the administrative staff of the City has made recommendations as to the mount necessary to be appropriated for the ensuing fiscal year; and WHEREAS, the City Council has met and considered the recommendations, the suggested budget, and the proposed millage necessary to be levied to carry on the government of the City for the ensuing year; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, THAT: Section 1. The proposed millage rate necessary to be levied against ad valorem valuation of property subject to taxation in the City of Sebastian, Indian River County, Florida, to produce a sufficient sum which together with departmental and other revenues will be sufficient to pay for appropriations made in the budget for the fiscal year is hereby set at 6.900 mills. Section 2. A copy of the budget shall be published in one issue of a newspaper published in Indian River County, Florida, at the same t/me the public will be notified of a public heating to be held on the 24th day of September, 1997 at 7:00 P.M. for the purpose of setting a final tax levy and final budget. Section 3. The proposed millage rate is 1.93 percent above the computed rolled back rate. I Section 4. If any clause, section, or other part of this Ordinance shall be held by any Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or I invalid part shall be considered as eliminated and shall in no way affect the validity of the other provisions of this Ordinance. That the applicant install dead end sigm~and street name signs approved by the city engineer at the intersection of~y street and Chello Avenue. b. That the applicant construct a barrier at the south end of the temporary cul- de-sac on Easy Street approved by the city engineer. ¢. That the applicant instal! guardrails along Easy Street where Easy Street cross~he existing ditch north of the subdivision approved by the city career. d.
