SUMMARY
The Riverfront Advisory Committee has recommended the adoption of a performance overlay
district for the Pdverfi-ont Area. The overlay district can be considered a super zoning district.
The Land Development Code regulations still apply. The overlay district imposes additional
regulations on the area covered.
The Committee's recommendations includes standards for architectural design, urban design,
landscaping, and signs. Urban Design is the traditional setbacks, building coverage and open
space requirements found in traditional zoning. The purposes of the Urban Design standards are
to protect the character of the various neighborhoods in the Riverfront and to provide some
variety to the entire area.
The LPA and staff has reviewed the P-dverfront Advisory Committee's proposed Pdverfront
Performance Overlay District, has recommend changes, and recommends approval of the
Riverfi'ont Performance Overlay District.
As a overlay district, Florida Statutes require two public hearings. This is the first one, the
second one is scheduled for December 17, 1997.

Hear and decide requests for variances. Hear and authorize upon
appeal such variance from the terms of the ordinance as will not be
contrary to the public interest when, owing to special conditions, a
literal enforcement of the provisions of the ordinance would result
in unnecessary and undue hardship.
"Variance" as used in connection with the provisions of this chapter
dealing with zoning, means a modification of the zoning ordinance
regulations when such variance will not be contrary to the public
interest and when, owing to conditions peculiar to the property and
not the result of the actions of the applicant, a literal enforcement of
the ordinance would result in unnecessary undue hardship. A
variance is authorized only for area and size of structure or size of
yards and open spaces, and may not include a variance or any use
or a density incr6ase contrary to that permitted in the respective
districts. Establishment or expansion of a use other,vise prohibited
shall not be allowed by variance nor shall a variance be granted
because of the presence of nonconformities in the zoning district or
classification or in adjoining zoning districts or classifications.

which the board is required to pass under any such ordinance.
2. Criteria for determining special exceptions. Prior to granting
any special exceptions, the bo~-d of adjustment shall adhere-to the

.. Procedures for processing variances. A variance from the terms of these

processed as a new case.
Stay of proceedings. An appeal to the board of adjustment stays all work
on the premises and all proceedings in furtherance of the action appealed
fi.om, unless the administrative official fi.om whom the appeal is taken
certifies to the board, after the notice of appeal is filed with him, that by
reason of facts stated in the certificate, a stay would cause imminent peril
to life and property. In such case, proceedings shall not be stayed other
than by a restraining order which may be granted by the board of
adjustment or by a court of record on application, on notice to the
Community Development Director or administrative official from whom
the appeal is taken and on due cause shown.
Public hearing. All proceedings shall be conducted only after public
heating with due notice pursuant to Section 20A-11.
Recommendation filed On all proceedings held before the board of
adjustment, the Community Development Director shall review the
application and file a recommendation on each item. Such
recommendations shall be received, heard and filed prior to final action on
any item before the board, and shall be part of the record of the application_

10 section or paxt of a section of this Ordinance shall not thereby be affected or impaked unless it
11 clearly appears that such other section or part of a section of this Ordinance is wholly or
12 necessarily dependent upon the section or part of a section so held to be invalid or
13 unconstitutional..
14 Section 6. CONFLICT. This Ordinance shall prevail over all other Ordinances
15 which are in conflict with this Ordinance. If any clause, section, or part or other application of
16 this Ordinance shall be held by any Court of competent jurisdiction to be unconstitutional or
17 invalid, such unconstitutional or invalid part or application shall be considered as eliminated and
18 in no way affecting the validity of the remaining portions or applications remaining in full force
19 and effect.

SUMMARY
The Community Development Block Grant has a two year time limit unless extended. The City's
grant expires in January. At the September 3, 1997 workshop, Mr. Stouts, from the Department
of Community Affairs, indicated that six month extensions can be requested.
The project has been delayed due to the redesigns of the Cav-Corp parking and developing
additional projects which would be eligible for grant funding.
The Cav-Corp parking is scheduled for site plan approval in December and the bid documents are
being developed. The City Council, at the last meeting, approved the recommendations for the
street lighting.
Currently, it is targeted that the work will be completed by the Fourth of July. Therefore, only
one extension is expected at this time.
RECOMMENDED ACTION
It is recommended that the City Council authorize the staff to request a six month extension to the
Community Development Block Grant.

Warren Dill, inquired about Council's intent to delete COR and replace it with CL with an allowance
for residential. The Director of Community Development said residential would be proposed as a
special use in CL.

Mr. Dill cautioned Council about setting a 2010 deadline for sandmining in the City due to an
existing sandmine operation. Following some discussion, it was the consensus of Council to delete
the 2010 reference in all areas of the proposed plan. The Director of Community Development said
paragraph b on page 24 will need to be reworded and an exemption added for existing sundmines.
The Director of Community Development reiterated that the hearing on the proposed Comprehensive
Land Use Plan amendments will be December 10, 1997.

Following a lengthy discussion relative to prohibiting certain uses by imposing zoning restrictions, '
the importance of preserving certain residential areas and the fact that there is currently a mix of

the City Manager suggested Council isolate the areas it would like to preserve, determine the areas it
agrees could be more commercial and then look at areas that can be mixed use.
At 10:28 p.m. there was a consensus of City Council to continue the workshop.
The City Manager suggested Council begin by creating a new Map #6, however, Council, by
consensus and following further discussion, agreed to go with Map #3 Riverfront Mixed Use land
use with INS (Institutional) land use to remain in place and adding a CONS (Conservation) land use
as recommended by Planning and Zoning.

Mayor Barnes said, despite opinions expressed recently, Council is working very hard on the
Riverfront;

Mrs. Cartwright suggested that the City present a plaque to the Chamber for its efforts in the holiday
events; inquired when median work on US 1 adjacent to Park Place would begin, to which the City
Manager responded that work should begin in January; asked that a grass triangle on Laconia be
marked with reflectors, to which the City Manager responded he would contact Leunar; and wished
everyone a Happy Thanksgiving.
E. Mr. Larry Paul
Mr. Paul asked about airport signs and the City Manager responded that the sign shop is making
them; asked about the City accepting the streets in Point-O-Woods, to which the City Engineer
responded that she will review the files again and the City Manager will bring a report to Council at
the first meeting in January; asked about the status of the Oyster Bay/Point water assessment
problem. This developed into a lengthy discussion with input from the City Manager and City
Attorney responding to Council concerns relative to re-opening the assessment and whether there
were Council conflicts of interest.
Mrs. Camvright requested that the City Manager obtain survey costs.
Max Abrams, Oyster Point/Bay, said he wanted a definite answer from Council as to the status of his
request.
Discussion followed as to conflict again and Mrs. Cartwright asked for copies of Commission on
Ethics letters stating there is no conflict for Mayor Barnes and Mrs. Sullivan. Mayor Barnes said
any action on this matter should be delayed until he obtains hi., letter.
Mr. Paul continued, stating Council must be open to growth in the City; and said Sebastian River
High School Principal Fran Adams had extended an invitation for Council to tour the facility.
g. CITY ATTORNEY MATFERS
The City Attorney said she was working on the shared parking ordinance, and suggested a workshop;
however, it was decided to put it on the December 3, 1997 regular meeting agenda.

The City Manager reported on the installation of a culvert pipe by the City during installation of
water mains on Louisiana Avenue at a cost of less than $5000 utilizing the same contractor;
discussed the need to work with Indian River County on the problem with clogged baffle boxes on
CP. 512; discussed an ongoing drainage problem in the area between Barber and Roseland and the
need to redirect this ouffall; and said there were two unanticipated pipe failures on Chesser and
Columbus that must be addressed immediately.

Mayor Barnes suggested a measure to prevent people from parking road tractors, and following some
discussion, itwas decided to add "road tractor as defined in 20A-5.16.1" to line 6 of page 6 of thc
ordinance, Mr. Taracka noted that the reference to "48" hours had been changed to "24" previously.
City Council concurred with both corrections.
Time ran out and Mayor Barnes adjourned the meeting at I i:00 p.m. This public hearing will be

SUMMARY
On October 22, 1997 the Council passed Resolution No. R-97-72 establishing the
Sebastian Recreation Advisory Board. The City solicited volunteers through phone calls and a
newspaper notice. The City received eligible applications from six people fi.om the eight
organizations listed in the Resolution (none fi.om the Art Club or the Craft Club). Three eligible
applications were also received from people outside the organizations listed in the resolution.
RECOMMENDATION
Interview all the eligible applicants, and appoint to appropriate positions
for three year terms.

A RESOLUTION OF THE CITY OF SEBASTIAN, iNDIAN RIVER
COUNTY, FLORIDA, ESTABLISHING TF[~ SEBASTIAN
RECREATIONAL ADVISORY BOARD; PROVIDING FOR
REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS;
CONFLICTS; AND PROVIDiNG FOR AN EFFECTIVE DATE.
WHEREAS,-The City Council desires to establish a recreational advisory board
to provide recommendations on the development of recreational facilities and the creation
or expansion of recreational programs and to promote cooperation and coordination
between the various recreational interests, Indian River County and the City; and
WI:r~-REAS, The City established the Sebastian Recreation Advisory Committee
to provide recommendations to the City Council on developing the purpose and role of
such a Advisory Board; and
W]EE~S, The Sebastian Recreation Advisory Committee has prepared the
recommendations contained in this resolution,
NOW, THEREFORE, BE IT RESOLVED BY ~ CITY COUNCIl. OF
TI:W. CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLOIRDA, as follows:
SECTION1. ESTABLIS]ffl~E~ OF T]~ CITY OF SEBASTIAN
RECREATIONAL ADVISORY BOAR.D: The City Council of the City of Sebastian,
hereby establishes the Sebastian Recreational Advisory Board.
SECTION 2. PURPOSE AND RESPONSIBILITIES: .
Purpose. The Sebastian Recreational Advisory Board shall provide
recommendations on the development of recreational facilities and the creation and
expansion of recreational programs, evaluate proposed recreational requests, and
promote cooperation and coordination between the various recreational interests,
the City and the County.
B. Responsibilities. The Sebastian Recreational Advisory Board shall:
Prepare an annual work program outlining the activities of the Advisory
Board for the following fiscal year. The proposed work plan shall be
presented to the City Council for approval by July 1 of each year. The
work plan may include:
The preparation of polid'y recommendations to the City Council.
Studies of existing City and County facilities and programs.
The development of short and long range plans for facilities,'
programs, and land acquisition.
The evaluation of recreational facility and program requests.
Promote and develop cooperation and coordination between the City,
Indian River County and the Indian River County School Board.
3. Encourage public input and participation.
4. Conduct studies as requested by the City Council.
Prepare recommendations regarding city and county recreational facilities
and programs. Such recommendation shall be forward to the City Manager
for distribution to the City or:to Indian River County.
SECTION 3. ORGANIZATIONAL STRUCTUI~:
Members. The Sebastian Recreational Advisory Board shall consist of nine regular
members and two alternate members, all of Whom are residents of the City of
Sebastian. All members shall be appointed by the City Council and the Advisory
Board shall consist, . whenever possible, of the following:

president or his/her designee of the Craft Club of Sebastian

Officers. The Advisory Board shall elect a chairman and vice-chairman.
C. Procedures. The Advisory Board shall adopt rules of procedures.
Meetings. The meetings shall be at the call of the chairman, vice chairman or as
established by a majority of the Board at a meeting of the Board.
E. Subcommittees. The Advisory Board may form subcommittees.
SECTION 4. STAFF SUPPORT. The Public Works Department shall provide
staff support to the Sebastian Recreational Advisory Board.
SECTION 5. CONFLICTS: Ail Resolutions or parts thereof' in conflict herewith
are, to the extent of such conflict, superseded and repealed.
SECTION6. EFFECTIVE DATE: This Resolution shall take effect
immediately upon ks adoption.

SUMMARY
After a significant rainfall on the evening of November 20, 1997, Chesser Ave. caved-in above a
deteriorated culvert pipe. The road was closed and immediate action was taken to replace the
pipe as quickly as possible. The Annual Culvert RepIacement Contractor was mob;li:,ed to effect
the replacement and repairs. Currently, the City has budgeted $400,000 for pipe replacemem.
The City entered into an agreement with C.R. McLellan to carry out the pipe replacement
program. City Contractor, C. R. MCLellan, has a purchase order #1829 in the mount of
$123,007.25 for various culvert replacements. The cost for the Chesser Ave. pipe replacement
was $8,883. This expenditure will be added to the existing purchase order as a change order for a
new purchase order amount of $I31,890.25 with the additional funding coming from the
budgeted $400,000.
RECOMMENDED ACTION
Move to authorize a change order to C.R.McLeIIan, increasing P.O. #1829 to $131,890.25.
