The overlay district can be considered a super zoning district. The Land Development Code regulations still apply. The overlay district imposes additional regulations on the area covered. The Committee's recommendations includes standards for architectural design, urban design, landscaping, and signs. Urban Design is the traditional setbacks, building coverage and open space requirements found in traditional zoning. The purposes of the Urban Design standards are to protect the character of the various neighborhoods in the Riverfront and to provide some variety to the entire area. The LPA and staff has reviewed the P-dverfront Advisory Committee's proposed Pdverfront Performance Overlay District, has recommend changes, and recommends approval of the Riverfi'ont Performance Overlay District. As a overlay district, Florida Statutes require two public hearings. This is the first one, the second one is scheduled for December 17, 1997. "Variance" as used in connection with the provisions of this chapter dealing with zoning, means a modification of the zoning ordinance regulations when such variance will not be contrary to the public interest and when, owing to conditions peculiar to the property and not the result of the actions of the applicant, a literal enforcement of the ordinance would result in unnecessary undue hardship. A variance is authorized only for area and size of structure or size of yards and open spaces, and may not include a variance or any use or a density incr6ase contrary to that permitted in the respective districts. Establishment or expansion of a use other,vise prohibited shall not be allowed by variance nor shall a variance be granted because of the presence of nonconformities in the zoning district or classification or in adjoining zoning districts or classifications. At the September 3, 1997 workshop, Mr. Stouts, from the Department of Community Affairs, indicated that six month extensions can be requested. The project has been delayed due to the redesigns of the Cav-Corp parking and developing additional projects which would be eligible for grant funding. The Cav-Corp parking is scheduled for site plan approval in December and the bid documents are being developed. The City Council, at the last meeting, approved the recommendations for the street lighting. Currently, it is targeted that the work will be completed by the Fourth of July. Therefore, only one extension is expected at this time. RECOMMENDED ACTION It is recommended that the City Council authorize the staff to request a six month extension to the Community Development Block Grant. At 10:28 p.m. there was a consensus of City Council to continue the workshop. The City Manager suggested Council begin by creating a new Map #6, however, Council, by consensus and following further discussion, agreed to go with Map #3 Riverfront Mixed Use land use with INS (Institutional) land use to remain in place and adding a CONS (Conservation) land use as recommended by Planning and Zoning. 3) Review Overall L~d Use Map~ There was consensus on the proposed overall land use map with the exception of minor changes previously discussed and as noted by the Director of Community Development. 4) Discuss COR (Co~mercial. Mr. Larry Paul Mr. Paul asked about airport signs and the City Manager responded that the sign shop is making them; asked about the City accepting the streets in Point-O-Woods, to which the City Engineer responded that she will review the files again and the City Manager will bring a report to Council at the first meeting in January; asked about the status of the Oyster Bay/Point water assessment problem. This developed into a lengthy discussion with input from the City Manager and City Attorney responding to Council concerns relative to re-opening the assessment and whether there were Council conflicts of interest. Mrs. Camvright requested that the City Manager obtain survey costs. Max Abrams, Oyster Point/Bay, said he wanted a definite answer from Council as to the status of his request. Discussion followed as to conflict again and Mrs. Cartwright asked for copies of Commission on Ethics letters stating there is no conflict for Mayor Barnes and Mrs. Sullivan. Mayor Barnes said any action on this matter should be delayed until he obtains hi., letter. Mr. Paul continued, stating Council must be open to growth in the City; and said Sebastian River High School Principal Fran Adams had extended an invitation for Council to tour the facility. g. CITY ATTORNEY MATFERS The City Attorney said she was working on the shared parking ordinance, and suggested a workshop; however, it was decided to put it on the December 3, 1997 regular meeting agenda. PURPOSE AND RESPONSIBILITIES: . Purpose. The Sebastian Recreational Advisory Board shall provide recommendations on the development of recreational facilities and the creation and expansion of recreational programs, evaluate proposed recreational requests, and promote cooperation and coordination between the various recreational interests, the City and the County. B. Responsibilities. The Sebastian Recreational Advisory Board shall: Prepare an annual work program outlining the activities of the Advisory Board for the following fiscal year. The proposed work plan shall be presented to the City Council for approval by July 1 of each year. The work plan may include: The preparation of polid'y recommendations to the City Council. Studies of existing City and County facilities and programs. The development of short and long range plans for facilities,' programs, and land acquisition. The evaluation of recreational facility and program requests. Promote and develop cooperation and coordination between the City, Indian River County and the Indian River County School Board. 3. Encourage public input and participation. 4. Conduct studies as requested by the City Council. Prepare recommendations regarding city and county recreational facilities and programs. Such recommendation shall be forward to the City Manager for distribution to the City or:to Indian River County. SECTION 3. ORGANIZATIONAL STRUCTUI~: Members. The Sebastian Recreational Advisory Board shall consist of nine regular members and two alternate members, all of Whom are residents of the City of Sebastian. SECTION 4. STAFF SUPPORT. The Public Works Department shall provide staff support to the Sebastian Recreational Advisory Board. SECTION 5. The road was closed and immediate action was taken to replace the pipe as quickly as possible. The Annual Culvert RepIacement Contractor was mob;li:,ed to effect the replacement and repairs. Currently, the City has budgeted $400,000 for pipe replacemem. The City entered into an agreement with C.R. McLellan to carry out the pipe replacement program. City Contractor, C. R. MCLellan, has a purchase order #1829 in the mount of $123,007.25 for various culvert replacements. The cost for the Chesser Ave. pipe replacement was $8,883. This expenditure will be added to the existing purchase order as a change order for a new purchase order amount of $I31,890.25 with the additional funding coming from the budgeted $400,000.
