The Staff and the Local Planning Agency has spent the last year on preparing amendments to the plan. The City Council has held three workshops on the amendments. The adoption of the plan's amendments are by ordinance. The Council holds the first reading of the ordinance. At the same time, a "transmittal" public hearing is held. After the hearing, the draf~ plan's amendments are sent to the Department of Community Affairs for review and comment. Approximately sixty days later, objects, recommendations and comments are received. The plan is amended as needed and an "adoption" public hearing is held. The ordinance second reading is completed and the ordinance is adopted. WHEREAS, the City Council of the City of Sebastian, Florida, desires to amend the 13 City of Sebastian's Comprehensive Plan; and 14 WI:IEREAS, the City Council of the City of Sebastian, Florida, believes that it is in the 15 best interests of the health, safety, and general welfare of the community to do so, 16 NOW TItEREFORE, BE IT ORDAINED BY TIlE CITY COUNCIL OF ~ 17 CITY OF SEBASTIAN, FLORIDA, THAT: 18 Section 1. CODIFICATION. SEVERABILITY. If any section or part of a section of this Ordinance is declared invalid or unconstitutional, the validity, force and effect of any other section or part of a section of this Ordinance shall not thereby be affected or impaired unless it clearly appears that such other section or part of a section of this Ordinance is wholly or necessarily dependem upon the section or part of a section so held to be invalid or unconstitutional.. Section 4. CONFLICT. This Ordinance shall prevail over all other Ordinances which are in conflict with this Ordinance. If any clause, section, or part or other application of this Ordinance shall be held by any Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part or application shall be considered as eliminated and in no way affecting the validity of the remaining portions or applications remaining in full force and effect. Section5. EFFECTIVE DATE. This Ordinance shall go into effect mediately upon its passage and adoption and authentication by the signature of the presiding officer and Clerk of the City Council. POLICY 1-1.3.2: GENERAL PATTERN OF INDUSTRIAL LAND USE. The City of Sebastian Ai~i{.'hmi'i'~:hvirofis contains V::o ~ principal areas for future industrial activity:. I) the airport-and airport environs; 2) the northeszt induaU'ial corridor located between Gib~on Stmot and tho Florida East-Coast (FEC) Railroed. A secondary industrial concentration is situated along the FEC Railroad at CR 512. l_~sser concentrations of industrial development are situated along other segments of the FEC Railroad. A high priority shall be given to rese~g strategically located lands adaptive to the unique location requirements of industry. Industrial sites shall generally be allocated m areas accessible to rail corridors or near airport facilities. Areas delineated on thc Future Land Use Map for medium density residential development shall be developed, rcdeveloped and/or maintained as stable medium density resideu~l neighborhoods. Medium density residential development ranges up to a maximum of cigh: (~) ~ units per acre and generally averages six (6) units per acre. The medium density designation is intended to provide su.fficient land area for developments of medium demqity re.,sidential development adequately supported by public services and facilities and compatible with existing and anticipated futura land uses. The medium density policy designation incluc[es a mixlure of single and multiple family structure types. Supportive commuRity facilities aud accessory land uses may be located within areas designated MDtL The City land development regulations ~1~11 provide regulatory procedures for considering such. uses. Review of specific densities of developments shall be directed toward preserving stability of established residential areas. Sites for medium demity residential dcvelopmems should be located so tlmt they provide a smooth transition between lower density residential areas and areas developed and/or designated for other more intense uses. Generally, medium density areas should be located between the perimeter of low density residential areas and areas of high density residential concentrations. Mobile home residential development shall be permitted on sites appropriately zoned for mobile home development. The density of the mobile home parks or subdivisions shell be permitted up to a maximum of five (5) units per acre; ~spccific site densities must be consistent with the policy, map and standards · , ~.27,~.,~,~..-:~,z~.::~:;~,,,:::;~ ,~-,-,-,::~::-'-~::~ of the Comprehensive Plan and ~!i~~.~ Zomng Ordinan~. Mobile homes slmli be reviewed as reasonable development options but the applicant shall provide plans for mobile home development which assure that the development contains a significant open space buffer. Natural landscaping, including a landscaped berm where appropriate, upper story tree canopy and lower story shrubbery, and/or an aesthetic decorative wall or fence to effectively screen the mobile home development from adjacent residential development which exists or may potentially exist in the future. OBJECTIVE l-Z2: ?,~.LOCATiNG COMMER~ DEVELOPMENT. The Furore Land Use Map shall identify the allocation of commercial land for: 1) offices; 2-) limited commercial developmen~~'*~;; ~) general commex~ial developmen~ ~~ and 4) ~~~ manne waterfront development. The allocation of land for commercial development shall be compatible with goals and objectives identified in the Comprehensive Plan and consistent with supportive research and analysis. The policies stated below provide an explanation of ~he purpose, intent and character of the commercial land use designations. POLICY 1 2.~.1~-COMMERCIAL OFFICE/RESIDENTIAL (COR)-. The Commercial Offi~idential (COR) policy designation is a land use designation designed to accommodate business and professional offices as ~vell as freo standing resi~ntial 5~'uctures.
