A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY,
FLORIDA, APPROVING THE PRELIMINARY PLAT FOR A PROJECT KNOWN
AS TERRA ESTATES, A 3-LOT RESIDENTIAL SUBDIVISION CONSISTING OF
8.8 ACRES LOCATED ON THE WEST SIDE OF LACONIA STREET, SOUTH OF
GLADIOLA AVENUE AND ADJACENT TO THE CITY'S DRAINAGE RIGHT-OF-
WAY; PROVIDING FOR CONFLICTS HEREWITH; PROVIDING FOR
SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the owner of the subject land has filed an application for approval of a
preliminary plat for a subdivision (mown as Terra Estates: and
WHEREAS, the preliminary plat has been reviewed by city staff and appropriate
jurisdictional agencies, and has been found to be in compliance with applicable State and City codes
and regulations; and
WHEREAS, the Planning and Zoning Commission of the City of Sebastian held a public
hearing on July 21, 2022, and recommended approval of the Preliminary Plat for Terra Estates, with
conditions, by a vote of 7-0;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
SEBASTIAN, as follows:
Section 1. PRELIMINARY PLAT APPROVAL. The City Council of the City of
Sebastian, Florida does hereby approve the preliminary plat for Terra Estates Subdivision prepared
by James W. Mills, P.E., bearing a signature and seal date of July 14, 2022, as maintained on file
with the Community Development Department, subject to the following conditions:
a. The subdivision's Final Plat must include dedication verbiage that allows the
City of Sebastian access over Tract A and the 25-foot ingress/egress
easement that is depicted on Parcel 3 in order to allow for maintenance
activities of the city's adjacent 40-foot wide drainage ROW;
b. A School Capacity Availability Determination Letter (SCADL) is received
from the IRC School Board before construction begins;
c. An updated Gopher Tortoise survey is submitted with the Landclearing
Permit;
d. Additional one-way directional traffic signage be added to the intersection of
Laconia Street and Gladiola Avenue, if determined necessary by the City
Engineer; and
e. The subdivision is required to connect to sewer within I -year from when a public sewer utility
system is installed in the area and made available for the dunce lots to correct.
Section 2. CONFLICT. All resolutions or parts of resolutions in conflict herewith are
hereby repealed.
Section 3. SCRIVENER'S ERRORS. Sections of this ordinance may be renumbered
or re -lettered and corrections of typographical errors which do not affect the intent may be
authorized by the City Manager, or the City Manager's designee, without need of public hearing, by
filing a corrected or re -codified copy of same with the City Clerk.
Section 4. EFFECTIVE DATE. This Resolution shall take effect immediately upon its
adoption.
The foregoing Resolution was moved for adoption by Councibnember
Dodd The motion was seconded by Comcilmember
McParti,an and, upon being put to a vote, the vote was as follows:

The Mayor thereupon declared this Resolution duly passed and adopted this 20 day of August,
