SUMMARY STATEMENT
The Golf Course Superintendent sent out bid notices for 22 tons of 12-2-12 fertilizer with
Ronstar pre-emergent herbicide. Bid notices were sent out to eight vendors. We received
four bid proposals out of the eight sent out. The total cost of this purchase will be divided
between the fertilizer and chemical accounts in the maintenance budget. Below is a list of
the bid tabulations.

SUMMARY STATEMENT
Three bids were opened and read at 2:00 P.M. on February 22,
1994. The apparent low bidder is B and T Sod as shown on the Bid
Tabulation Form. B and T Sod supplied the City last year with
sod and we have had great success with their service, quality of
material and installation. In addition, their sod installers will
rake the areas to a proper grade prior to the installation..
Sod placement occurs on a need basis. Funding for sod placement
is available from the Capital Pro3ects Fund for BSSC and Drainage
Improvement and from the Local Gas Option Tax Fund for street
maintenance.
RECOMMENDED ACTION
Move to award the Sod contract to B and T Sod Company for one
year starting March, 1994 thru March 1995.

SUMMARY STATEMENT
Pursuant to the City Council's direction at its regular meeting of
May 22, 1991, the City of Sebastian Building Department requires a tree
removal permit to be obtained prior to removal of trees.
The applicant, Ameron Homes, is requesting removal of 1 specimen pine
tree and 4 specimen oak trees, located at 74 Joyhaven Dr. (Lot 17, Block
460, Sebastian Highlands Unit 17). The trees are located in the proposed
area of where the house, well, septic & drainfie].ds will be located.
RECOMMENDED ACTION

NOTICE

The Florida scrub Jay is provided protection under the
Endangered Species Act of 1973 (Act), as amended (16 U.8.C.
1531-1543), and by regulations promulgated thereunder (50
CFR Part 17). Section 9 of this federal statute and the
implementing regulations prohibit the "take" of any
endangered or threatened species. Take is defined to mean
harass, harm, pursue, hunt, shoot, wound, kill, trap,
capture or collect, or to attempt to engage in any such
conduct. Harm and harass are further defined in tile Code of
Federal Regulations~ harass is defined as an intentional or
negligent act or omission which creates the likelihood of
injury to wildlife by annoying it to such an extent as to
significantly disrupt normal behavioral patterns which
include, but are not limited to, breeding, feeding, or
sheltering. Harm is further defined as an act which
actually kills or injures wildlife. Therefore, any activity
or omission, including disruption or modification of habitat
occupied by scrub Jays, which significantly alters the
behavior of the jays or creates tile likelihood of injury or
death to the birds, m~y constitute a violation of Section 9
of the Act.

SUMMARY STATEMENT
A list of streets to be overlaid as part of the street
improvement program for FY 93/94 is enclosed for your review~
Dickerson Paving will be contracted by the City to place the
Asphalt. They are on Indian River County's paving contractor's
list under the Commodities contract. The City will be paying
29.96 per ton for asphalt to be spread in place. Staff proposes
that Pursuant to City Code Section 2-64 (j) "The City Council may
waive or modify bidding procedures on specific contracts for Good
cause" It is anticipated that adequate funds will become
available during the fiscal year for the street improvements
identified by funding from the County Option Gas Tax Fund.
During the budget hearings Council had approved a budget of
$140,000 for blacktop with $20,000 anticipated to be purchased by
the asphalt patch crew leaving $120,000 for overlay. The
beginning year balance was estimated at $2,340. However, year to
date beginning balance is $131,350. Total available funds for
overlay projects would be the sum of $130,000 plus $120,000 for a
total of $250,000. The amount spent, year to date as of February
4th, 1994 is $52,000 leaving an available fund balance of
$198,000. It is anticipated that the Melrose project will be
$35,500 for a total fund available of $162,500. The City would
not engage in any street improvements until there was adequate
funds available for each street. Should funds become available
for additional street improvements then staff would return to
City Council for approval.
RECOMMENDED ACTION
Move to approve the proposed street improvement program for the
streets identified 1 thru 15 for a total expenditure of $162,500.

On March 10, 1993 the Sebastian City Council reviewed a staff
recommendation to improve approximate%y 1,300 lineal feet of
Gibson Street. As you know, this poz~cxon of Gibson Street is a
County right-of-way but abuts the City to the east all but two
lots to the west. . .
The Sebastian city Council KS formally requesting .Indian River
County to fund 50% of the proposed improvements to G[b~on Street.
For your information, I have enclosed a copy of the Cfty Council
agenda item and backup material. Therefore, we respectfully
request you to agenda this matter for action by the Board of
County Commissioners at your convenience. Please let ~e know
when this matter will be scheduled for review by the Boara.

Dear Mayor Powell:
I am writing to determine if the Sebastian City Council is
interested in participating with Indian River County in the
development of a county-wide scrub jay Habitat Conservation Plan
(HCP).
At its regular meeting on February 8, 1994, the Board of County
Commissioners voted to authorize county staff to seek federal
funding to develop a county-wide scrub jay HCP. At that time, the
Board authorized staff to contact the Sebastian City Council to
determine the Council's interest in participating in the HCP
development process.
I look forward to your response. If needed, I am available to
attend a Council meeting to answer any questions. Please do not
hesitate to contact me if you have any questions on this or other
