Following large price discrepancies, due to some of the
contractors having knowledge of existing deliterious site
conditions for the installation of pilings, staff wishes
to rebid the boardwalk to the vendors that submitted bids
to the City for the original design concept as prepared
by Mosby and Associates.
RECOMMENDED ACTION
Move to reject all bids and direct staff to rebid the
boardwalk to the contractors that responded to the first
bid advertisement.

There were extreme variations in prices due to information
available to .some of the bidders but not all of the bidders.
In addition, there was confusion as to the bidding documents
and the addendum to alter the original design from on grade
boardwalk to a pier supported boardwalk.
Several of the builders were concerned with the boardwalk
being placed on grade and not being pile supported which lead
to the addendum provision. After the addendum had been
issued, one or more of the builders identified a potential
problem for the installation of the piers since, many years
ago, Riverview Park east was constructed using pieces of
broken concrete curbing and other deliterious material that
could interfere with the installation of the pilings. Based
on this information, we are requesting to rebid the boardwalk
without the pilings, and going back to the original design
concept for the boardwalk to be placed on grade but that the
pressure treatment of the wood be for ground contact and that
blocking be provided on ten foot centers of the stringers to
keep the boardwalk from buckling.

Council reviewed ~e i~de~endent audi~ repo~ Eot ~e fiscal year
ended Septe~er 30, 1992. The audit repo~ indicated an operating
loss ~or ~e Golf Course Ente~rise ~nd of ~106,391. This is a
violation of the bond covenant which re~lres ~hat operating
revenues meet or exceed 100% of operating e~enses.. There are
several ways ~ correct =his deficit including raising ra~es,
reducing e~endltures, a co~ination o~ raising rates and reducing
e~enditure, or a ~odification of policies ~o genera=e ~ore
money
without raising rates. The bottom line, however, is ~hat it must
I be corrected or ~he City Council may need to face the unpleasant
reality of appropriating General Fund dollars to subsidize the Golf
operation.
Course I point out that Capital Expenditure items are
m considered an increase in assets and are not accounted for as an
operating expense. Therefore, this bond covenant requirement
relates only to operating revenues and operating expenses and
e~clud~ Ca_pi%al Imp~~. ~
The City Council each year has closely scrutinized the budget
requests for all departments including the Golf Course operation.
Any significant reduction in operating expenses could make the Golf
Course less playable, and therefore less competitive with other area
facilities, thus increasing the gap in the operating loss.
Likewise, any significant increase in rates could reduce play and
also have the effect of widening the gap of operating losses. The
more logical approach would appear to be in altering the schedules
and policies.
Currently, the Mens' Association has an $: 00 a.m. shotgun every
Monday except during the months of February, March and April. It
also has an 8:00 a.m. shotgun start every Wednesday. The Ladies'
Association has a shotgun start every Tuesday and the men's and
ladies combined have a shotgun start every Thursday. This equates
to a highly disproportionate share of member play at the Golf
Course, especially during the peak winter season when members play
for an $8.00 cart fee (in addition to their annual membership dues)
and non-members play for $28.00 per round. Reduction. to the prime
times being reserved for golf course members during the peak playing
season would appear to be in everyone's best interests, including
the members. By generating more revenue during the peak season of
four months, the rates for members and the public the other eight
months can remain lower and more competitive wi~h other courses. It
is no secret that member play is highly subsidized by non-member
greens fees.
There are at least three alternatives:
Eliminate association play during the four month peak
season.
Reduce association play during the peak season e.g.
once per month from December 15th to April 15th.
Offer an alternative to members such as a discounted nine
hole rate for the back nine holes in the peak morning hours.
While the staff has the authority to alter these playing conditions
without approval of City Council, we also believe that this matter
of policy be reviewed by the City Council before initiating changes.
~ECOMMENDED ACtiON
Review the alternatives to increasing revenues without increasing
rates for the Sebastian Municipal Golf Course.

At its regular meeting of February 10, 1993, the City Council reviewed the
request from Carlin J. Parker to change the Land Development Code
regarding the prohibition of small commercial utility trailers within a
residential zone. The City Council asked staff to provide suggestions to
amend the Land Development Code allowing such small utility trailers with
some type of screening. Below are my recommendations:
1.
Section 20A-5.16(C)(2) currently states, "The recreational vehicle is
not used for residential, office or commercial purposes.',
PROPOSED AMENDMENT: The recreational vehicle is not used for
residential, office or commercial purposes ~ commercial utility
trailers and commercial boats that meet the requlrements of ~
8 of this section may be permitted to be stored in a resi~-~ntial
zone
provided the following'conditions are met: ~
Th__~e commercial utility trailer shall be screened b_~ either
vegetation or a 6 foot stockade fence from the view of the
adjacent pro~rt~ owners or the publicr-~t-o--~-way.
Any boat used for commercial purposes may be stored within a
residential zone provided there is no unloadi~ or loadinq of anv
material or fish and must be screened by vegetation or a 6 foot
high stockade fence from the adjacent ~ owners and public
right-of-way. ~

Section 20A-6.1(C)(14) of the Land Development Code regarding home

should also be changed to .allow the same provision as
proposed above. Therefore, Section 20A-6.1(C)(14)(b)(1) currently
states, "A home occupation shall be carried on entirely within a
dwelling and only by members of the family permanently living
therein. No person other than the members of the family residing on
the premises .shall be ~ngaged in such home occupation. No more than
one-~ommercial vehicle s'hall be kept or parked on the premises in
conneciton with such home .occupation and such vehicle shall not have
a carrying weight in excess of three-quarters of a ton and shall not
exceed twenty (20) feet in length.'

At its regular meeting of November 4, 1992 the City Council approved
Resolution R-92-45 which approved a new agreement regarding Sebastian
Lakes Plan Unit Development's request for a time extension and the
requirement of improvements to Laconia Street and dedication of certain
rights-of-way for Roseland Road.
As you are aware of various verbal reports at the City Council meetings,
representatives from the Sebastian Lakes owners have done some due
diligents in the beginning regarding this agreement but, the City has not
received a signed agreement to our satisfaction nor has there been any
monies or deeds brought forward to the City of Sebastian.
Therefore, pursuant to Section 20A-4.9(E)(3)(i) of the Land Development
staff recommends the City Council hold a public hearing to consider
terminating the approval of the Conceptual Development Plan and initiate
the rezoning of the property to an appropriate zoning classification.

The Maintenance of side lot drainage ditches has been a
major thorn in the side of the public and Public Works.
In extreme cases, where the ditch is siz feet or greater
in depth, and has houses on both sides, it is virtually
impossible for any maintenance equipment to operate on
the banks of the ditch to keep the ditch open and
flowing. Resolution No. R-88-37 was established to
allow homeowners to construct culvert pipes in their
side lot drainage ditches at their sole expense.
Recently the city had reduced the maintenance
responsibility by the homeowners, and did agree to pay
for the additional cost for culvert pipes larger than
24" in diameter. Due to these changes in policy, our
department has received some requests from homeowners
for a similar type of City participation in the cost of
installation of side lot culvert pipes.
To this end, I have prepared a memorandum describing
several alternatives which resulted in establishing a
flat fee for homeowners to pay $15.00 per LF. This in
effect would be the break even cost for the City to
install a 24" pipe which on the typical sidelot drainage
pipe would be approximately $1,800. This would provide
for moderate incentive for the homeowners as
compared to the contractor's price of approximately
$18.00 per LF.
RECOMMENDED ACTION
Discuss with staff the information outlined in the
engineer's memo dated 2-24-93 and receive public input.

Side Lot drainage ditches
I had received requests from two property owners to have
their side lot drainage ditch piped with cost participation
from the City. Because, the City does not have a
formal polic~ that allows the City to participate with the
installation costs of side lot culvert pipes, I was unable
to accommodate them. I did explain, that in the past the
City Council had approved the additional cost of culvert pipe
greater than 24" in diameter, which was determined to be the
average pipe size.
There are a considerable number of residents throughout the
Sebastian Highlands living adjacent tO sidelot drainage
ditches making similar requests. I felt there is a need for
the City to consider establishing a policy which would
provide for City participation. The City could stand to
benefit from culvert installation in those areas that have
extreme cross slopes, houses on both sides or that are
virtually impossible for maintenance equipment to operate
within the easements.
Recently, the Public Works Department responded to a
resident who expressed great concern for the erosion that was
occurring adjacent to their home. The problem resulted from
ditch cleaning efforts which achieved a higher runoff rate by
the removal of vegetation. This was an extreme case in which
the side lot drainage ditch was approximately ten feet below
the finished floor elevations of the homes on either side.
We responded to stabilize this situation and had hoped to
approach City Council with a request to'have the side lot
culvert pipe installed. However, before this formal request
could be made, severe rainstorms wiped out our temporary
corrective measures. Therefore, the City had to backfill the
entire ditch and then excavate the ditch to the proper cross
section because there was not enough room to work the ditch
from either side. The cost associated with reconstructing
the ditch in this fashion would have been approximately half
the cost to install the culvert pipe. The only difference
would have been the cost of the material.
The City should consider cost participation with residents
for the installation Of side lot culvert pipes, when the
future maintenance costs can be offset. Side lot drainage
ditches come in all sizes and shapes varying in depth from a
couple of feet to ten feet or greater. This can complicate
the evaluation for the degree of participation if based on
common obstacles such as houses on both sides, extreme
depths, water continuously flowing due to a large drainage
area, overhead or underground utilities, etc.
So, how can one determine if there is a fair and equitable
method in which the City can participate to a greater degree
for the extreme side lot ditches as to opposed to a shallow
side lot ditch which would be piped for convenience or
cosmetic purposes, which the city should not participate.
I did try to establish methodology by identifying different
degree of cases wi~h either little impact or ma3or impacts by
evaluating the maintenance costs in a pay 'back period to be
within ten years. However, ~his became rather complicated,
and I was not sure all the possibilities that could occur
in the field could be identified.
Therefore, based on a recommendation by the City Manager, I
approached the problem to establish a flat rate. This
seemed more sensible if it could be logically and
economically supported, to be not only in the best interests
of the Ci~, but to motivate homeowners to a higher level
without making installation costs too attractive which would
cause this department to be flooded with applications.
Therefore, I ran through an analysis for the installation of
an average side lot drainage culvert pipe. The cost for
installation would be approximately $18.00 per LF as
established in my July 3rd, 1991 memo for the Evaluation of
Culvert Pipe Installation (attached) and would cost
approximately $2,200.
As shown on the table of my July Srd memo, the material cost
of the pipe was $11.75 L.F. However, using the Indian River
Counties Commodity Contract, 24" RCP would cost the City
$8.17/LF. Adding this cost with the cost of excavation of
$6.30, the total cost would be $14.47/LF or if we use the
unit price of $15.00/LF, the cost for full installation would
be $1,800 for 120 L.F.
It is my position that either price is fair from the City
standpoint with the first price being the same as
the installation price from a contractor. However, this would
not be an incentive to a resident to install the pipe.
Whereas the lower unit price map be just the incentive that
would motivate more residents to pipe their side lot ditches.
Additionally, to held solve future side lot drainage problems
with the construction of new homes, an ordinance could be
drafted which would enforce the original construction
drawings that requires side lot drainage ditches to maintain
a cross slope of no steeper than one and one half horizontal
to one foot vertical. This would require, that in some 'cases,
a portion of the ditch would be on private property up to the
building pad. The building would then be located five feet
from the top of bank.

SUMMARY STATEMENT
The Hardee Park ~ogging trail was constructed by the City
of Sebastian using limerock base m~terial. The Jogging
trail has held up reasonably well from the daily use
with little or no maintenance. Several of the residents
utilizing the jogging trail have contacted our parks
department requesting repairs to washouts and rocky
areas. Those requested repair areas have exposed
aggregate from the lime rock material and is a general
nusiance to the walkers and Joggers.
Staff has discussed the possibility of resurfacing the
jogging trail utilizing different material that would be
compatible with the residents and also with the parks
department for maintenance. The types of materials
discussed were as follows:
1. Limerock, rolling and compacting.
2. Placement of an asphalt wearing surface
3. Wood mulching surface
4. A red clay/sand mix, material similar to ballfields.
After some discussion the clay/sand mix material seemed
more favorable because it would provide a softer but firm
surface for walking and jogging. More maintenance would
be required more than for limerock. But this could be
accomplished with a drag that could be transported from
Barber Street Sports Complex to Hardee Park on a weekly
or bi-weekly basis.
Further, the grass at Hardee Park is Bahia, which is not
as aggressive as Bermuda, and could be controlled by a
growth retardent chemical.
Prior to the installation of the jogging surface, the
existing washouts would be studied by the Public Works
Department to determine a solution to prevent future
erosion. The jogging trail would then be monitored on a
regular basis for any further erosion which could be
corrected. The cost of the material would be
approximately $18.00 a CY to have it delivered or $9,000
to $10,000.
RECOMMENDED ACTION
Request discussion between staff and City Council members
and allow public input on ~he Hardee Park Jogging Trail.

SUMMARY STATEMENT
A request for water coolers from walkers and 3oggers at
Hardee Park was received in the Public Works Department
several months ago to install water coolers that are
similar to the ones located at the Golf Course. Due to
the lack of personnel and sub3ect to vandalism, staff
considered another alternative to provide safe drinking
water at the Park, which would consist of a well, and
water treatment system that could be constructed to
provide water to water fountains and in the future it
could be the source for potable water for restroom
facilities.
RECOMMENDED ACTION
Request discussion w/th staff and public input on the
installation of a public water supply system.

At your request, we are hereby submitting our proposal to provide
professional engineering services for the above subject project.
Our breakdown scope of work would include the following:
1. Project coordination with the City of Sebastian.
Project coordination with the well driller and water treat-
ment equipment supplier.
Evaluation of the water treatment flow demands for Hardee
Park.
Evaluation of the raw water quality from the well. Water
quality sampling will be required in accordance with the
Florida Department of Environmental Regulations. The cost
of this service is not included in this proposal.
5. Design of the water treatment equipment.
Preparation of the water treatment equipment permit con-
struction drawings.
.Preparation of the Florida Department of Environmental
Regulations' permit application.
Final submittal and coordination with the Florida Department
of Environmental Regulations.
We propose to provide the herein described services for a
fee of $1,500.00, excluding direct costs.

At its Regular Meeting of January 13, 1993, the Sebastian City
Council discussed a number of recreational issues including the
development of a 7.3 acre ex'tension of the Barber Street Sports
Complex, location and construction of basketball courts, and the
development of tennis and racquetball courts. At the February 3,
1993 Workshop Meeting, the City Council reviewed site plans for
the 7.3 acre extension to the Barber Street Sports Complex.
Generally, the consensus of the City Council at these two
meetings was:
1. The 7.3 acre extension of the Barber Street Sports
Complex would include basketball courts and shuffleboard in
addition to the soccer/football multipurpose fields.
2. Basketball courts may be an appropriate neighborhood
activity.
3. Tennis courts should be constructed at one complex.
We have recently drawn a conceptual site plan for a tennis -
racquetball courts complex for park tract "D" located at Barber
Street and surrounded by Acorn and Adams. This 3.81 acre tract is
identified in the City's Comprehensive Plan as a future
neighborhood park or special facility. This site is ideally
suited for this type of complex because of its location on a
major collector. The population guidelines as reported in
"Outdoor Recreation of Florida" 1989, page 100, recommends
(1) tennis court per 2,000 population.
Another potential site for additional tennis courts and
racquetball would be the curren~ Schumann Park which is the
location of two (2) existing tennis courts. ~owever, the
residential area around this park is nearly built out and i am
not sure =hat a change in use would be well receiwed by the
neighborhood. Further, this park if not developed into additional
tennis facilities, would continue to be used as a ~ootball and
soccer practice area as well as a neighborhood park.
Review the proposed conceptual site plan for a tennis -
racquetball complex.

SUMMARY STATEMENT
Henry Fischer and Son~ Incorporated has agreed to honor
their unit price bid for bike path installation as awarded
at the City Council meeting March 13, 1991 for Bike Path
Improvements. The unit price is fair and competitive as
determined from fair bidding process and funds are
available from the Park Improvement funds. We would like to
extend the bike path to completely encircle the lake. Staff
is also in the process of preparing documents for the
paving of the walking/jogging trail at Hardee park.
RECOMMENDED ACTION
Move to direct staff to coordinante with Henry Fischer and
Sons for the installation of the bike path around Lake
Street Park.

citizens are to be commended f. or ~heir interest in providing
healthy recreational opportun.itles. The City has a number of
small lakes and waterways 'which are utilized by small vessels
including Lake Hardee, Collier Creek Waterway, Schumann Lake,
Waterway, Elkcam Waterway, Easy Street Lake., and others.

The types of boats utilizing ~hese facilities do not require a
launching facility. Further, the City does allow fishing off of
City owned property on all of ~hese waterways and lakes but has
constructed fishing docks into locations in the Indian River.
Therefore, I do not believe ~hat a boat launch or a dock at the
Blossom Lake would be appropriate. However, I do believe that
~he property can and should be improved to facilitate the type of
use contemplated by the citizens letters. The City could
stabilize an area, maintain a lower stand of grass and clear
underbrush and place park benches in convenient locations.
