SUMMARY STATEMENT
At its regular meeting of June 18, 1992, the Planning & Zoning Commission
approved a site plan for Sebastian Inlet Marina subject to all parking
stalls being 10 foot wide. Mr. Collins filed an appeal with the City
Manager and asked that the matter be held in ~beyance until the matter of
the abandonment of Central Avenue was approved and ready for construction.
In 1991, the City Council reviewed a similar request from Damien Gilliams
and Richard Fey of Channel 68 Marina. Mr. Fey had requested from the
Planning &-zoning Commission to modify his approved site plan to allow 9
foot stalls instead of 10 foot wide parking stalls. The Planning & Zoning
Commission turned down Mr. Fey's request and the appeal was brought
forward to the City Council. The City Council approved the 9 foot stalls
after determining the marina was located in the Sebastian Riverfront
District which is unique to the other commercial districts and in order to
help facilitate the development of the riverfront, it was determined that
the 9 foot stalls would be in harmony with the intent of the Land
Development Code.

Mr. Collins's original request ~o the Planning & Zoning Commission
indicated 9 foot stalls only in the area of the new proposed parking area
where North Central was to be abandoned. If the appeal is granted, Mr.
Collins would like to have the ability to use 9 foot wide stalls
throughou~ the parking area.
RECOMMENDED ACTION

Dear Rob,
Confirming our discussion on Monday, July 20, 1992, Sebastian
Inlet Marina and Trading Company will continue to hol~ in
abeyance its appeal of the decision by the Planning and ~oning
Commission to require parking spaces ten feet wide in that
portion of our site east of Indian River Drive.
As you know, the continuance of the Central Avenue issue makes
it logical, as you suggested several weeks ago, to wait before
formally presenting our appeal, since these matters are both
related to our overall site design.
We continue to strive to develop our property within the
constraints of economic prudence and in harmony with the
interests of the City of Sebastian. Your continuing interest
and assistance are, as always, very much appreciated.

Mrs. Corum expressed concern about the ordinance
being in conflict with the Comprehensive Land Use
Plan by allowing higher density for mobile home
developments. The Director of Community Development
responded ~hat building setbacks will remain the

Mayor Powell explained his reasons for placing this
item on the agenda and expressed certain concerns.
Mayor Powell requested that lights be adjusted at the
Little League field, and said he was asked again
about installation of a ramp at the pond near Blossom
Drive.
The City Manager said he had spoken to the'Mayor
today and t_hat both had pledged to work together in a
better manner, and he responded to concerns regarding
the Personnel Director's salary.
Mayor Powell called recess at 8:16 p.m. and
reconvened the meeting at 8:32 p.m. Ail members of
City Council were present.
Mayor Powell noted that this meeting is being
video%aped and will be broadcast on Friday.
Mr. Oberbeck reiterated that staff and Falcon Cable
had set up the videotape program; inquired about the
status of t~he Sebastian Lakes agreement and water and
sewer; and stated that the FOP is holding a
Policemen's Ball at the Community Center this
Saturday night to benefit local causes.

Mrs. Corum spoke on cable rates and suggested that
the City Manager's contract be renegotiated in the
future.

Riverview Park North so that it cannot be disposed
of easily. The City Attorney said it was possible

1981 and City Council concurred to direct staff to
review this.

relative to the City Manager and urged people to
identify themselves.

questioned in what manner approval was given for the

The City Manager introduced Personnel Director, Wendy
Widmann; said he had received calls relative to the
proposed removal of the left hand turning lane on
U.S. 1 adjacent to Jefferson Street and requested
City Council input. Mr. Reid expressed concern about
traffic illegally turning into True Value off of Main
Street. City Council concurred to direct the City
Manager to contact FDOT.
The City Manager said the videotaping was merely a
test and that discussion of the matter would be
placed on the workshop agenda.
The City Manager said staff is not quite ready to
place the tree protection ordinance on the next
workshop agenda and requested City Council input.
The City Attorney said he was not clear about what
City Council wants and suggested that the item be
workshopped to gain a consensus.
It was the consensus of City Council that this item
be placed on the April workshop agenda to review
Planning and Zoning Commission recommendations and
direct staff further.

the meeting at 8:10 p.m. All members were present.
Mr. Oberbeck requested that Charles Stachel be
allowed to speak on agenda item 93.087 "Hardee Park
Walking Path Surface", since, prior to the meeting,
Mr. Stachel was unaware that it was on the agenda due
to incomplete public agendas.
The City Manager and Assistant Finance Director i
briefly explained =he source of the Golf Course
deficit and the reasons for looking at changes to I
membership tee times.
.A lengthy City Council discussion ensued relative
alternatives presented by staff.
In response to Mr. Oberbeck, the City Manager said a
committee has been formed to conduct interviews for a I
Manager/Pro.

required to encumber certain dollars in the general
fund to meet provisions of the bond covenant until
such time as operating revenues increase.
Discussion continued relative to better management
and measures to increase revenues. City Council
members were disinclined to limit membership play.

Council and the public will be further analyzed by
staff.

of the above-referenced ordinance.
CONCLUSIONS OF LAW
The above-referenced individual was found to be in violation
of said ordinance and no fine would be levied if the Violator
places the numbers within five (5) days of today's date. If
violation is not brought into compliance, a flat fine of $100.00 is
issued.

WHEREA~, the Los Angeles Dodgers have been hold.lng =heir
spring training in Veto Beach and Indian River County .since 194S;
and
WHEREAS, approximately $25 million dollars is generated
into ~he local economy annually by ~he Los Angeles Dodgers; and
WHEREA~, ~he Los Angeles Dodgers have proven =o be good
community neighbors by ~heir participation and suppor~ of local
programs and events including =he United Way of Indian River
County; and
WHEREAS, t. he former Clemans Elementary School was adopted by
=he Los Angeles Dodgers and renamed Dodger~own Elementary wi~h
=he Los Angeles Dodgers supporting activities and renovations at
=he school.
NOW, THEREFORE, BE IT RESOLFED BY TH~ CITY COUNCIL OF T~E
CITY OF SEBASTIAN, INDIAN RIVE~ COUNTY, FLORIDA, as follows:
~ 1. The weekend of March 13 and 14, 1993 is hereby
designated as "Go Dodger Days" in t_he City of Sebastian.
SECTION 2. The City Council urges the citizens of the City
of Sebastian ~o support =he Los Angeles Dodgers in all =heir
endeavors.

The City of Sebastian has received a request from the Craft Club
of Sebastian for use of Riverview Park for shows. The Craft Club
has held shows at Riverview Park since 1988.
Requested dates are as follows: 4/3/93 with rain date of
4/4/93 and 5/1/93 with rain date of 5/2/93.
Historically this request has always been approved by Council and
unless otherwise applied for to City Council, the following are
established rules for use of Riverview Park.
1. $100 security deposit.
2. No vehicles in the park.
3. Applicants provide sufficient waste receptacles and clean up
after event.
4. No alcohol beverages are permitted within the park.
5. Ail displays must be clear of the sidewalks and entranceways.
6. Any goods for sale must be handmade by members of the
organization.

SUMMARY STATEMENT
The City of Sebastian, Public Works Department has
cleared an overgrown drainage ditch along Blocks 437, 445
and 405 approximately 184,000 SF including three side
ditches. The work is now complete and will require seed
and mulch.
The cost will be $.025 per sq ft for a total of $4600.
Because Nail Farms is a sole source for seeding and
mulching and the ditch needs to be-completed as soon as
possible to prevent ditch bank erosion, I recommend that
they be permitted to seed and mulch the side slopes and
top of bank of this outfall ditch.
Pursuant to City Code Section 2-64 (j), "The City Council
may waive the bidding procedure on specific contract for
good cause."
RECOMMENDED ACTION
MOve tO approve a waiver of normal bidding procedures and
approve the expenditure of $4600 to Nail Farms for seed
and mulch of the outfall drainage ditch behind Blocks
405,437, and 445, unit 10 Sebastian Highlands.

SUMMARY STATEMENT
Six bids were received for the golf course teemower. Lewis Equipment Company
submitted a no-bid. Lesco, the apparent low bidder, failed to meet the following
specs - horse power, leak detector and bedknife to reel adjustment. Pifer failed
to meet the following specs - leak detector and bedknife to reel adjustment.
RSI failed to meet the following specs - power steering, engine and bedknife to
reel adjustment. And finally, Nucrane failed to meet the following specs - horse
power, leak detector and bedknife to reel adjustment. The only bidder to meet
or exceed all of the specifications was Hector Turf with the bid on a Toro model
#3100. Toro has an excellent service after sales and the parts are more readily
available, and the golf course has had an excellent performance record with the
Toro equipment in the present fleet. Adequate funds are available and budgeted
for this expenditure.
RECOMMENDED ACTION
Move to aware the bid for the golf course teemower to the best bidder, Hecto~
Turf of Deerfield Beach, in the amount of $12,990.00.

I would recommend we accept the bid of $12,990.00 for
a Toro mower from Hector Turf.'This is not the lowest bid but
the other four do not meet certain specifications. The bid from
Nucrane fails to meet the following specs.- bedknife to reel
adjustment, leak detector and horse power. The bid from Debra
fails to meet the following specs.- power steering, engine and
bedknife to reel adjustment. The bid from Pifer fails to meet
the foliowing specs.- leak detector and bedknife to reel adj-
ustment. The bid from Lesco fails to meet the following specs.-
horse power, leak detector and bedknife to reel adjustment.
We presently have two Toro mowers mowing the greens
and tees. Ail of the reels are interchangeable from mower to
mower. This would not be possible with a mower other than a
Toro. I have had very good service from Hector and the Toro
mower is a top of the line well.built machine.

On November 12, 1992 City Engineer, Daniel C. Eckis and I met
wi~h Indian River County, Public Works Director, James W. Davis.
At that meeting we discussed two (2) projects: Indian River
Drive and Gibson Street. At its January Workshop Meeting, t_he
City Council reviewed a staff report on Indian River Drive and no
action by City Council is necessary at this time. Mr. Davis has
recently responded to our request to work together =o improve
approximately 1,300 lineal.feet of Gibson Street. Mr. Davis and i
propose a 50%/50% joint funding for paving this portion of Gibson
Street. If =he City Council concurs in principle, I will ask Mr.
Davis to place a similar item on the Agenda for the Board of
County Commissioners.
RECOMMENDED ACTION
Move to direct staff to formally request Indian River County to
fund 50% of the proposed improvements to Gibson Street.

Indian River Drive - Whereas County Staff is of the opinion
that ~he extensive improvements proposed along Indian River
Drive bythe City would best be managed and implemented if the
jurisdiction of the roadway within the City limits was vested
with the City, the County Staff will cooperate to %he best of
our ability to complete the work requested and expeditiously
review any permit applications for work in County right-of-
way. Be advised that the Cou/%ty considers the Department of
Transportation Greenbook Criteria regarding roadside
structures. Safe pedestrian crossings and clear zones are
desirable.
Some of the work items in your letter have already been
completed such as tree stump removal, etc..

removing many of the Australian Pine tree stumps which were the
result of the 1989 Christmas freeze, there are still several
stumps which need to be removed.

open ditches would need regrading or culvert pipe. Enclosed is a
report from City Engineer Daniel C. Eckis, P.E. outlining t_he
locations of low shoulders and ditches.

The City, in our continuing effort to enhance the river front
area, may be requesting permits for improvements which may
include the following:
A. Placing existing over head telephone and power lines
underground. Fortunately, there 'are very few over head
facilities within T~he Indian River Drive right-of-way.
B. To install "'theme" street lighting.
C. To construct a sidewalk/bike path inthe west right-of-
way. ....
D. To .~onstruct a boardwalk, at approkimately the same
elevation as ~ne pavement, in the east right-of-way. It may be
necessary to bridge certain sections of this boardwalk to
maintain the level with Indian River Drive and to install hand
rails for safety in certain sections. However, we wish to
preserve and enhance the view of the Indian River and would
therefore not wish to elevate the walking surface .above the
elevation of Indian-River Drive. Further, we .may wish to keep
both the bike path and boardwalk near the outer edge of the
right-of-way in order to avoid potential conflicts with
underground utilities.
We recognize that the issuance of permits will depend upon the
final design of the improvements and subject to sound
engineering. However, at this time, we are asking you to approve
the concept of underground .utilities, "theme" lighting bike path
and boardwalk. '

would provide 50% funding and the County would provide 50%
funding. If approved by both City and "*County, the road would be
improved in fiscal year 1993-94.
We anticipate ~mhat t_he extensio~ of Gibson Street south to Main i
Street through the Saint Sebastian PUD would be effected by the
developer of that tract and may be eligible for impact fee
credits. We recognize tha~ any impact fee credits would be I
negotiated between the developer and Indian River County.
I would like to develop a joint recommendation along the lanes
outlined in this letter. Our joint recommendation would then be
reviewed and considered by the Indian River County Commission and
the Sebastian City Council. .

SUMMARY STATEMENT
The City has been fortunate to test the ability of a
bulldozer for ditch cleaning in various locations
throughout the City. We have determined that the dozer has
met (and exceeded) our expectations of cleaning vegetation
from moderate to dense tree removal from drainage ditches.
The manufacturer has agreed to deduct the rental price of
$2,000 for five months or S10,000 from the selling price of
S49,000 for the dozer which would require an additional
expenditure of $39,000. Finance has indicated that funds
would be available through the Capital Projects Fund,
Drainage Improvements line item. Since the rent paid will
apply to the purchase, this equipment would be a sole
source purchase. Pursuant to Section 2-92 (j) of the City
Code: "The City Council may waive or modify the bidding
procedure on specific contracts for good cause"
RECOMMENDED ACTION
Move to waive normal bidding procedures and approve the
purchase of the model 550 Dozer from Case Power and
Equipment for $39,000.

The Dozer Purchase
In October of 1992, the Public Works Department was allowed
three new Maintenance Worker I's as approved by the City
Council. Internally, we moved personnel from lower
classifications to higher classifications, which left three
openings. We were fortunate to hire a Maintenance Worker I
with 18 years of experience with General Development
Corporation in the Palm Bay area. He suggested that the City
tr~ a small dozer to clean out the drainage ditches.
We contacted Case Power and Equipment and negotiated .a rental
fee for $2,000 per month. It was a used dozer, approximately
three and one half years old with only 200 hours. Their
purchase price was $27,000. We decided to rent the machine
on a trial basis to see how well it would work in our
drainage ditches and determine if it would be a feasible
purchase.
On October 28th, the machine was delivered and we began
cleaning out ditches in unit 5 behind Blossom Drive,
Chelsea Avenue, Evernia Street, and Potomac Avenue.
The ditches were narrow and located in 20 feet drainage
easements. The equipment worked well and we had a positive
response from residents who actually came out and applauded
our efforts. We had cleaned out approximately 12,000 LF
within a month which calculates to approximately 2.3 miles
per month. If you take into consideration the 20 foot
wide easement a better analysis would be the number of miles
by the width of the ditch or 46 mile-feet per month.
This machine was well suited for the ditches and ! was
amazed on how fast the dozer was able to clear the vegetation
and get the water flowing in areas that were previously
unaccessible due to development of house on both sides. We
were able to push the vegetation and muck to vacant lots
where our backhoe removed the vegetation or placed it as
spoil on top of the bank. Early on, the machine looked
promising and we discussed the possibility of purchasing
verses renting the machine. I was cautioned that this type
of maintenance is more costly ~han convetional equipment.
However, se~icing the equipment could not be done locally.
It would have to be shipped to Orlando for the ma3or service,
such as turning the pins, or undercarriage repair.
So we decided to work the dozer in different types of
ditches, to determine it's full capability. We started at
Stonecrop along Ma3estic Avenue and then through the rear
ditch, east of Laconia Street up to Barber. This ditch was
approximately 8,200 feet long located within a 30 foot wide
drainage right of way with moderate vegetation except for the
bottom of the 'ditch, which was overgrown. We completed
clearing the bottom of this ditch in 7 days or 4.5 miles per
month which would calculate to 135 mile-feet per month.
would like to note that one of the comments that I received
on my daily progress reports from the Assistant Public Works
Director was that when the dozer got to Barber Street the
water rushed out from the culvert like a ~welve inch water
main had been broken and the water on the other side of
Barber Street dropped 12 inches within just a few hours.
After seeing how much work was done with the dozer, I knew it
would be cost effective so I started pulling the information
about the dozer including the maintenanoe cost and
tried to get the best deal i could for the City. In December,
I wanted to make a report for the City Council on the
progress of the dozer and to receive the Council's blessing
on it's purchase. But I became bogged down with other
priorities such as equipment purchases for my departments,
the sign shop renovations, the Wentworth ditch project, the
Community Center renovations, Ruth Sullivan's property
dispute, the Contaminated Soil negotiations and sidelot
drainage requests. Needless to. say, I was unable to prepare
the information to the City Council at that time. However,
we did contact the Case dealer and express our interest in
purchasing the Dozer, if we could obtain City Council
approval. He agreed to work with us and deduct the rental
amount to date or reduce the selling price by S4000 from
$27,000 to $23,000.
Our next test'area would be our biggest challenge. We had
50 feet of right of way with 20 foot of drainage easements on
each side. This ditch was located behind Joy Haven down by
Barber Street. This ditch had never been cleaned out. There
were Pine Trees up to 14 inches in diameter. We started on
the ditch December 17th and completed it on January 18th,
we removed the vegetation and graded the banks with about
nine hundred cubic yards of fill. Within a three week period
our progress was approximately 0.4 miles per month which
would calculate to 36 mile-feet per month.
During this ditch cleaning operation, Case recalled their 450
for a demonstration. They replaced it with a 550, a
little bigger machine, but it had the same track width. This
machine worked better on the larger ditches and it still
could operate on the small d/tches. We asked about its cost
and Case said it would be S49,000. We felt that the 450 was
a better deal. However, on January 19th, before we could
approach City Council for a purchase request the dealer
called to pick up the 450 because they had sold it. So we
asked about another 450 they had, it was older with 1900
hours and they wanted $25,000 for that machine. We used
it starting on January 4th on the Skyline ditch at Barber
Street. But it had mechanical problems, so Case picked it up
and returned the 550, and we completed~he ditch on March
3rd. The ditch was $400 LF with a 50 foot right of way and
we were able to clean the ditch out at approx/mately 0.82
miles per month or 45 mile-feet per month. The 550 dozer is
a new machine, the City put all the 125 hours on this
machine. Because Case sold the 450 without checking first
with us they have a~reed to deduct all of the rent payments,
S10,000 from the selling price of $49,000.
We contacted Case Power to determine the maintenance schedule
for this piece of equipment and the cost associated with the
maintenance repairs. The first ma3or repair will be to turn
the pins that the tracks ride on. This would be done at
approximately 750 hours for a cost of $650 which includes
transporting the dozer to Orlando. The second repair would
be to replace the undercarriage which would occur at
approximately 1700 hours and ~ould cost approximately $6,500
including transportation. Therefore, our first year costs
including oil filters and grease would be approximately $750
and our second year cost would be $7,300. As based
on the number of hours that we have placed on the machine to
date, we would expect to operate the dozer at approximately
1300 hours per year.
In the four month period that we have rented the dozer we
have cleared approximately six miles of drainage ditches.
Comparing the operation of a backhoe for cleaning ditches,
I recall a ditch cleaning operation in which the backhoe had
moved approximately 400 feet within four hours. Calculating
the mile-feet per month the backhoe was capable of cleaning
approximately 18.2 mile-feet per month. This would be
similar to the ditches that were cleaned out with minimal
amount of vegetation. However, taking the average of the
three systems identified above or 72 mile-feet per month the
dozer operates at a rate that is approximately 4 times faster
than the backhoe.
The dozer is well suited for ditch cleaning operations in our
area and the manufacturer has agreed to deduct the amount
paid in rentals paid for the two dozers towards the Purchase
of the new 550 machine. I feel, if it is at all possible,
and if the funds are available, that we act to purchase the
machine before the end of this month, March 31, 1993.

Because of the concerns of ci~_izens who live in ~he vicinity
of Wave Street, includ/ng Tulip, Carnation and George street
i contacted our Traffic Consultants, Kimle~Horn~o discuss
=he possibility of a %-raffic study pursuant to T/~e Wave
Street opening. Steve Godfrey from Kimley Horn at-tended the
meeting with myself, Robe~-t S. McClar~, Ci%~ Manager, Fritz
Stellar and another citizen. Prior to our meeting we
appraised the %-raffic consultant wi~h T_he ¢once.--ns of ~he
citizens and based on his suggestion from his past
experiences with similar %-ype of problems, he suggested that
we establish a framework on which ~he S~udy would be based.
His .concern was T-hat once the repor~ is complete would the
Citizens accept the repor~ based alone on T_he traffic counts
and surveys necessary to evaluate this situation. Throughout
the entire meeting there was a good sense of cooperation and
understanding on both the City and residents parts and it was
agreed that a traffic count of 2S00 vehicles per day was
considered to be an acceptable level of service for a local
street. However, at the close of the meeting ~he citizens
expressed that there was not a need for the City to do the
report that they, as a citizens group, would be monitoring
the traffic to determine what ty~e of increase would accually
occur. During the meeting several good issues were
established as follows:
I) IT was apparent =hat t=affic was now occu=ing from the
Schumann Drive area =b_rough Englar to George to Strait then
to CR 512. This traffic will be dive_-ted to Wave Street once
Wave is opened.
2) The Cit~ feels ~hat it is imperative to have a second
point of ingress and egress =o ~he Shopping Center
3) Due to T. he cost of ~.he road being $25,000 if a major
problem did occur at sometime in ~he rupture T. he road could'be
closed
4) Once Easy street is extended and S. Fleming Drive
intersection /s oonst-ructed ~-he ~raff!c now ~=raveling from
~he Schumann Drive area would have an alternate route to T_he
Shopping Center and would no longer use the Wave S~reeT
Entrance.
5) The City could monitor~he traffic flow both prior to and
after Wave Street was opened to determine any /ncrease in
levels with sem/ annual counts to be taken to mon/tor traffic
in that area.
6) The ¢it~ will look at alternate traffic control measures
such as T/~ru~affic for Melrose, "No thru ~ruck" signs, and
other acceptable ~afftc control methods to minim/ze the
negative input on the George Street, Tulip S%-~eet
neighborhood.
