The current policy of the CiD, Council regarding side yard stormwater drainage includes a
provisima for joint financial participation. At the present rime, the homeox~mer pays S15 a foot
for the drainage pipe and the City provides the labor. The s~,stem is working well,, in fact too
well!
However, we do not have a policy regarding the assistance for homeox~mems who have unique
front or rear yard drainage problems, and / or carmot fiscally afford to carry the burden of total
cost by themselves. In this regard, we have an example that illustrates the probl~rrL
Mr. a~d Mrs. Dave Costa of 499 Concha Drive have a rather deep front yard swvale and the
degree of slope prevents Mr. Costa from mowhag the swale. He clmms that he is partially
d/sabled and therefore, carmot utilize the mower on the slope. He also cla/ms that he carmm
afford the cost to hire someone to do kis yard. He would like to have the CiD~ place perforated
pipe into the swale which xxS/] allow the slope to be altered maough that it would remove the
restriction. I have explained to Mr. Costa that the City does not engage m assisting citizens
with front yard drainage swale problems. We only have a rear and side yard potic?? m place.

This agreement is entered effective this day of
, !9 , by and between T_he City of Sebastian,
Indian River County, Florida, a municipal corporation organized
and existing under the laws of the State of Florida, (hereinafter
referred to as "Cit~") and
(owner of Lot gl) and
( owner of Lot #2 ) (hereinafter col lec~ive ly referred to as
"owners" )
WHEPuTJ%S, the owners own adjacent property as set forth in
Exhibit "A" of this Agreement; and
WHEP~EA~, the Owners desire to install a culver~z pipe on the
public utility easement between their proper~y; ~nd
WHEREAS, the Owners wish to obtain the economic and
maintenance advantage of retaining the cit~, or the City's
designee, for the purpose of installing said culvert pipe.
NOW, THE2~EFORE, the Cit~ and the Owners hereby agree as
follows:
1. The Owners agree that the Cit~, or its designee, is
hereby granted permission to install linear feet of
(diameter of pipe) reinforced concrete pipe,
cover same, and contour the surface for surface drainage in the
utility easement on the lot line of Lot gl and the
lot line of Lot g2, in accordance with the requirements
of the City of Sebastian (said lots being more particularly
described and attached as Exhibit "A" of this Agreement).
2. The Owners agree to pay to the Cit~, after obtaining a
permit, and prior to any work being performed, $15.00 per linear
foot of culvert pipe installed, for a total price of $
3. The owners agree that the Cit~ has the absolute right to
re_cuire the removal, replacement, and/or repair of said pipe, the
reopening of the ditch, or other corrective measures as are
deemed necessary by the Cit~. The Owners further agree that the
Owners shall be responsible for removing any vegetation, fencing,
or other obstructions, within one week of receiving %rr_itten
notice from the Cit~, should the Ci=~ require access to the
easement for the perforr, ance of necessary maintenance or repairs.
4. The Owners, jointly and severally, shall indemnify and
hold the cit~, its council members, officers, agents, employees
and represennatives, ha_~mless from any and all liabilities,
costs, damages, ac=ions, attorneys' fees (including attorneys'
fees to enforce the provisions of this agreement), and expenses
from any and all claims or causes of action for bodily injury,
death and property damage arising from or in connection with the
work performed by r_he Cit~ hereunder, or by reason of any claim
or dispute of any person or entity for damages from any cause
directly or indirectly related to any action or failure to act
by the Cit~, whether negligent or otherwise, its employees,
representatives, subcontractors, suppliers or agents.
5. In consideration of the cost savings provided to the
undersigned o~ners by ~he Cit~, the receipt and sufficiency of
-which are hereby acknowledged, the undersigned, individually, and
on behalf of their heirs and assigns, hereby releases the Cit~,
its council members, officials, officers, employees and
representatives, from any and all cla~.~s, actions, causes of
action, suits, demands, injuries, damages, conT2racts, monies,
attorneys fees, or claim~ of any nature or description
whatsoever, including, but not limited to, those claims that
arise from intentional acts, negligence, contracts, and statutory
claims, which now exist, or which might hereafter accrue.
6. This agreement shall be governed by the laws of the
State of Florida. Venue in any action arising herefrom shall be
Indian River County, Florida.

The provisions of Section 287.055 of the F-lorida Statutes, also lmown as the "Consultants'
Competitive Negotiation Act (CCNA)'are vet3- specific. I have previously provided to you an
outline of those restrictions and a recommended procedure 'to follow in the process. However,
due to time conslamints and the fact that mx- recommended review procedure did not include
the City Council, the attached proposed Resolution is prepared for your consideration.
The new prozed~e, if adopted,, would require the CiD~ Council to appoint a five (5) member
consultant selection committee and the committee would utilize the poinI system review

287. 055, Florida Statutes. The City Cocci! shall appoint a
Consultant Selection co~i=~ee (Co--it%ce) for each project
re_cuiring the use of the competitive selection process in obtaining
professional services under Section 287. 055, Florida Statutes. All
proceedings of each Committee shall be open to the public.
~ECTION 2 · PUBLIC ~NOUNCF=~ENT: The City Manager shall
announce, in a unifoL-m ~nd consistent manner, each occasion when
professional services are required for the city of Sebastian if the
cost of such services exceeds the t/~reshold established in Section
287.055, Florida Statutes. The public announcement shall include
a general description of T_he project and t_he manner in which
professional consultants may apply to the city for the purpose of
furnishing services on the projec~as.
SECTION 3. CO~rPETITION SEI~CTION PROCESS:

statements of qualifications and performance data on file with the
City for the project, together with those which may be submitted by
other firms regarding the proposed project, and shall conduct
discussions with, and may require public presentations by, no less
than three (3) firms, regarding ~,heir qualifications, approach to
the project, and ability ~o furnish required services. In the
event tha~ less than three (3) firms make proposals for the
project, the Committee may limit its discussions to t_hose firms
which have made application to ~he City.
B. The Committee shall select in order of preference no less
than three (3) firms, if at least three (3) firms apply, deemed to

be the most highly qualified ~o perfo-~m the required services. In
determining whether a firm is _~ualified, the Co~nnittee shall
consider such factors as the ability of the professional personnel;
~-hether a firm is a certified minority business enterprise; past
perfo.--mance; willing to meet time and budget require~ments;
location; recent and current project workloads of t_he firm; ~nd the
volume of work previously awarded to each firm by the City. The
Committee shall furnish its selection of the professional firms to
~he City Council for approval.
C. In evaluation of ~he firm's qualifications for the
project, t_he Committee shall consider, but not be limited to, the
capacities, adequacy of persornuel, past record, experience, whether
the firm is a certified minority business in accordance wi~h the
Florida Statutes, and such other factors as may be determined by
~he Selection Committee to be applicable to its pa~-ticttlar project.
D. Each Committee will consider the attached ~xhibit "!" as
the evaluation fo-~m for ~nalyzing the experience of the
professionals and content of each proposal. The Committee,
however, is authorized to delete any criteria in the evaluation
fo.~m or add criteria if it is pe.~tinent to the requirements for the
pa~-ticular project wkich the City is considering. The criteria
adopted by the Com~mi~tee must comply with the general guidelines
es~b!ished in Sections B and C. Each Committee is directed to
establish ~he ntunber of points which will be assigned for each
element on the evaluation form according to expertise and
professional capabilities needed for ~he project.
SECTION 4. SE~EP~BILITY: If any section or pa_~ of a section
of this Resolution is declared invalid or unconstitutional, ~he
validity, force and effect of any other section or par~ of a
section of this Resolution shall not thereby be affected or
impaired ttnless it clearly appears that such other se~ion or part
of a section of this Resolution is wholly or necessarily dependent
upon the section or part of a section so held to be invalid or
unconstitutional.
SECTION 5. CONFLICTS: This Resolution shall prevail over all
other Resolutions which are in conflict with ~his Resolution. If
any clause, section or other part or application oft_his Resolution
shall be held by any Court of competent jurisdiction to be
unconstitutional or invalid, such unconstitutional or invalid part
or application shall be considered as eliminated and in no way
affecting the validity of the remaining portions or applications
remaining in full force and effect.

The 4th of July Committee should be selected and a Chairperson elected or appo/nted. In
addidon~ the Police Chief and Public Wot 'k~ Director should be members of the Committee,
together with one member of Cig' Council Mr. John MEek has been the recent Chairperson
and Mr. Wayne Kxoe~e has volunteered in the evem Mr. Malek declines to continue
participation as the "Chair".
BACKGROUND
The purpose of having a Committee formed by the CiD' is to proxdde accountabiii~' for the
revenue and ex~penclit-m'es. We either have the fun~ identified wdthin o~ accounting ~,s~em
or we contract v~-ith another non-profit civic organization to proxfide thc City with a 4th of
July Commiuee and celebration. Last year the Ci~, of Sebastian received financial assistance
fromm the CounD' and we should e~pect this gesture aga/n, /.f an)' money is prox'ided to
another commumr,.' xxfithin the Count'. The ideal situation would be To contract with the
Chamber of Commerce and have the "Chamber" perform as the City's publicity and formal
advertising enri~,. The 4th of Juls' celebration would then become just one of man5' acti~
sponsored by the Chamber for the Ci~' residents during the year. (~.~.
The Chamber Board of Directors have de. cide~ th~, th~ do not x~mnt m undertake this special
responsibility. If we are to h~ve a 4th of July activity for the comm~miO~ at large and ut/lize
City property and public funds, we need some type of organ~:mtional control and
ac. countability for the disbursement of public funds. Thi~ can be accomplished by u~li~ng
the City Finance Depm'tment for accountability and a Committee established by City
Council, or a contract with an entity that can provide the same .r~pe of service as the
Chamber of Commerce on behalf of the CIO,. If the CiO, does not contract, then we should
nominate a Committee and move forwar& I would recommend John Malek as the
Chalrperso~, and appoint one member from City Counc~ the Police Chief,. Finance Director
and the Director of Public Works to assist the Cha/rpersom Additionally, volunteers from
the comm,mlty should be encouraged and appointed by City Council, bm at the same time
limit the Committee to seven (7) individual~.

meetings be held on Che second and rough Wednesdays of each
month and workshops be held as needed prior to regular meetings.
