WHEREAS, the City Council of the City of Sebastian, Florida, desires to amend the Land Development Code to allow antique shops and second hand shops as a permitted use in CG zoning districts; and WHEREAS, the City Council of the City of Sebastian, Florida, believes that it is in the best interests of the health, safety, and general welfare of the community to so amend the Land Development Code. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, THAT: Section t,,~ The Land Development Code of the City of Sebastian, Florida, is hereby amended by changing Section 20A- 2.5.C.13 to read as follows: 13. Flea markets and pawn shops. Retail sale of goods in an establishment which provides booths, stalls, or other marketing areas to more than one retailer within the same business establishment, or pawn brokerage services. Section 2. The Land Development Code of the City of hereby by changing Section 20A- Sebastian, Florida, is amended 6.1.C.18 to read as follows: 18. Flea markets and pawn shops: Applicable zoning districts. Flea markets and pawn shops shall be permitted as a conditional use within the CG zoning district. Conditional use criteria. Flea markets and pawn shops will be allowed in the CG district provided the following criteria are met: (1) All sales activity and storage shall be in an enclosed structure. (2) (3) No structure shall be located within fifty (50) feet to any lot line abutting a residential district. No off-street parking or loading area shall be located closer than fifteen (15) feet to any property line abutting a residential district. Section B. The Land Development Code of the City of Sebastian, Florida, is hereby amended by changing Section 20A- B.10.B and C to read as follows: B. Permitted uses. In this district, as a permitted use, a building or premises may be used for only the below stated uses. Ail applicable provisions of this code shall be satisfied, including site plan review and performance criteria. Permitted uses: Cultural or civic activities, places of worship, public or private not-for-profit administrative services, public or private 'not-for-profit clubs, business and professional offices, general retail sales and services (including antique shops and second-hand shops), limited commercial activities, parking garages, plant nurseries, restaurants, (excluding drive-ins), trade and skilled services, transient quarters, vehicular sales and related services, retail gasoline sales, medical services, and accessory uses. In this district as a conditional use a building or premises may be used for only the following conditional uses upon compliance with applicable conditions stated in Article VI and all other applicable provisions of this Code, including site plan review and performance criteria. The Planning and Zoning Commission shall ascertain if such conditions and provisions are satisfied. Appeal of such decisions shall be heard · by the City Council. Conditional uses: Adult entertainment establishments, bars and lounges, child care facilities, drive-through facilities, farmer's market, funeral homes, hotels and motels, indoor theaters and other enclosed commercial amusements, flea markets and pawn shops, nursing homes (including rest homes or convalescent homes), public and private utilities, public parks and recreation areas, public protective and emergency services, restaurants (drive-in), vehicular service and maintenance, veterinary medical services, whole-sale trades and services, and accessory uses. It is the intention of the City Council of the City of Sebastian, Florida, that the provisions of this Ordinance shall become and be made a part of the Land Development Code of the 3 City of Sebastian, Florida, and that the sections of this Ordinance may be renumbered, relettered, and the word "ordinance" may be changed to "Section", "Article", or such other word or phrase in order to accomplish such intention. Section 5. All other Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. section 6. If any clause, section, or other part or application of this Ordinance shall be held by any Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part or application shall be considered as eliminated, in no way affecting the validity of the remaining portions or applications, which shall remain in full force and effect. Section 7. EFFECTIVE DATE. Mr. Johnson advised that the Citizens' Advisory Task Force (CATF) met this evening and unanimously recommend going forward with the grant application. Walter Barnes, 402 Azine Terrace, Sebastian, expressed concern for use of CAVCorp as a parking lot and suggested that public input be obtained. Ruth Sullivan, 1200 Indian River Drive, Sebastian, member of CATF, expressed concern for the lack of input time given to the public and task force and the effect of implementation of the trust fund on future taxes. She requested item E (Ordinance No. 0-95-08) be tabled for a couple of days to allow time to look into it. Discussion took place on tax increment financing. Robert Johnson explained that taxes already derived are placed in a trust fund, stated it is not mandatory to establish TIF districts, however, other applicants have implemented them. He suggested the ordinance could be approved at this time and back out at a later time if necessary. George Reid, 202 Delmonte Road, Sebastian, member of CATF, said he had strong reservations about using $265,000 in grant funds to make CAVCorp a parking lot. He suggested utilizing Fellsmere Road as part of the whole park parcel. Dave Dabrowski, Indian River Drive, Sebastian, member of CATF, said more people utilize CAVCorp than utilize Riverview Park. Vice Mayor Corum inquired whether landscaping was being considered for the parking area. The City Manager said the plan was to extend the aesthetics of the current park into CAVCorp. The extension of the bike path along Easy Street and-a bike path on Englar from Barber to Schumann which has not been awarded to a contractor also is included. 3 Bids were opened on March 28, 1995 at 2:00 p.m. with Ranger Construction being the low bidder. This bid was required because Dickerson who has the Indian River Commodities Contract advised us that they would not honor the contract price for the City of Sebastian due to the problem encountered with the Barber Street Railroad crossing. Ranger Construction has done work for the City before and we have found them to be reliable and capable to respond within a resonable amount of time. However, should the Contractor not perform the installation according to the schedule or fail to satisfactorily meet the requirements of the St. John's Permit the City reserves the right to call upon the second lowest bidder to perform the work. Should the second lowest bidder not be able to perform the work on a timely basis, the City shall contact the third lowest bidder until a Contractor is found to perform the work. The Contractor under Agreement with the City shall be charged any additional amount of costs incurred by the City exceeding the unit price in the Contract for the work performed by the replacement contractor. Failure of the Contractor to pay the charge will result in a breach of this Agreement by the Contractor, rendering it null and void. If the contract is terminated as a result of Contractor's default, Contractor shall pay to the City as liquidated damages the difference between the unpaid balance of the Contract sum and the cost to the City of completing the contracted work.
