WHEREAS, the REALTORS Association of Indictn River County proclaims April
1995 as Fair Housing month; crud
WHEREAS, it is the goal of the REALTORS Association of indicm River County
to promote the theme for the month of April 1995 as 'Fair Housing Opens Doors'; ond
WHEREAS, the ye~-long campaign is a public aw~eness campaign airned at
the citizens of Indian River County; and
WHEREAS, the campaign will educate individuals and families, who currently
rent or want to trade-up, about the value of home ownership; and
WHEREAS, the campaign will inform the public about financing opportunities
and homes available within their price range; and
WHEREAS, the goal of the theme 'Fair Housing Opens Doors' is to welcome
buyers to the market, and show them that buying ct home is one of the most important
investments Americans make; and
WHEREAS, real estate activity in the United States contributes enormously to
our economic and social well-being; and
WHEREAS, home ownership is the foundation of this country's prosperity, and it
allows citizens to put down roots and develop o commitment to community
development; and
WHEREAS, the REALTORS Association of Indian River County encourages all
the people of Ind/cm River County to take advantage of the current market conditions

At its regular meeting of March 22, 1995, the City Council approved th
first reading of Ordinance 0-95-05, an Ordinance amending the Lan
Development Code to permit antique shops and second hand shops in th
Commercial General zoning districts. The public hearing was set fc
April 12, 1995.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA,
AMENDING THE LAND DEVELOPMENT CODE TO PERMIT
ANTIQUE SHOPS AND SECOND HAND SHOPS IN CG
ZONING DISTRICTS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING FOR
CONFLICTS; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Council of the City of Sebastian, Florida,
desires to amend the Land Development Code to allow antique shops
and second hand shops as a permitted use in CG zoning districts;
and
WHEREAS, the City Council of the City of Sebastian, Florida,
believes that it is in the best interests of the health, safety,
and general welfare of the community to so amend the Land
Development Code.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, FLORIDA, THAT:
Section t,,~ The Land Development Code of the City of
Sebastian, Florida, is hereby amended by changing Section 20A-
2.5.C.13 to read as follows:
13. Flea markets and pawn shops. Retail sale of goods in an
establishment which provides booths, stalls, or other marketing
areas to more than one retailer within the same business
establishment, or pawn brokerage services.

Applicable zoning districts. Flea markets and pawn
shops shall be permitted as a conditional use
within the CG zoning district.
Conditional use criteria. Flea markets and pawn
shops will be allowed in the CG district provided
the following criteria are met:
(1) All sales activity and storage shall be in an
enclosed structure.
(2)

No structure shall be located within fifty
(50) feet to any lot line abutting a
residential district.
No off-street parking or loading area shall be
located closer than fifteen (15) feet to any
property line abutting a residential district.
Section B. The Land Development Code of the City of
Sebastian, Florida, is hereby amended by changing Section 20A-
B.10.B and C to read as follows:
B. Permitted uses. In this district, as a permitted use, a
building or premises may be used for only the below stated uses.
Ail applicable provisions of this code shall be satisfied,
including site plan review and performance criteria.
Permitted uses: Cultural or civic activities, places of
worship, public or private not-for-profit administrative services,
public or private 'not-for-profit clubs, business and professional
offices, general retail sales and services (including antique shops
and second-hand shops), limited commercial activities, parking
garages, plant nurseries, restaurants, (excluding drive-ins), trade
and skilled services, transient quarters, vehicular sales and
related services, retail gasoline sales, medical services, and
accessory uses. (Ord. No. O-93-01, ~ 32, 2-24-93)
C. Conditional Uses. In this district as a conditional use
a building or premises may be used for only the following
conditional uses upon compliance with applicable conditions stated
in Article VI and all other applicable provisions of this Code,
including site plan review and performance criteria. The Planning
and Zoning Commission shall ascertain if such conditions and
provisions are satisfied. Appeal of such decisions shall be heard
· by the City Council.
Conditional uses: Adult entertainment establishments, bars
and lounges, child care facilities, drive-through facilities,
farmer's market, funeral homes, hotels and motels, indoor theaters
and other enclosed commercial amusements, flea markets and pawn
shops, nursing homes (including rest homes or convalescent homes),
public and private utilities, public parks and recreation areas,
public protective and emergency services, restaurants (drive-in),
vehicular service and maintenance, veterinary medical services,
whole-sale trades and services, and accessory uses. (Ord. No. 0-93-
01, § 66, 2-24-93)
Section 4. It is the intention of the City Council of the
City of Sebastian, Florida, that the provisions of this Ordinance
shall become and be made a part of the Land Development Code of the

City of Sebastian, Florida, and that the sections of this Ordinance
may be renumbered, relettered, and the word "ordinance" may be
changed to "Section", "Article", or such other word or phrase in
order to accomplish such intention.
Section 5. All other Ordinances or parts of Ordinances,
Resolutions or parts of Resolutions in conflict herewith are hereby
repealed to the extent of such conflict.

application of this Ordinance shall be held by any Court of
competent jurisdiction to be unconstitutional or invalid, such
unconstitutional or invalid part or application shall be considered
as eliminated, in no way affecting the validity of the remaining
portions or applications, which shall remain in full force and
effect.
Section 7. EFFECTIVE DATE. This Ordinance shall become
effective immediately upon its adoption.

SUMMARY STATEMENT
At its regular meeting of March 22, 1995, the City Council approved the
first reading of Ordinance 0-95-06, an Ordinance amending the Land
Development Code to require new construction to provide a formboard
survey to insure all construction meets required setbacks, and to
require a final survey prior to the Certificate of Occupancy being
issued. The public hearing was set for April 12, 1995.

OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA,

WHEREAS, the City Council of the City of Sebastian, Florida,
desires to amend Section 26.32 of the Code of Ordinances to require
a formboard survey rather than a slab survey for building permit
applications, and to require a final survey prior to issuance of a
certificate of occupancy; and

believes that it is in the best interests of the health, safety,
and general welfare of the community to so amend Section 26.32.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, FLORIDA, THAT:
Section 1.
Section 26.32(6) of the Code of Ordinances,
City of Sebastian, is hereby amended to read as follows:
(6) A survey prepared by and executed by a qualified surveyor
showing all lot lines and easements shall accompany all
applications for building permits on the subject lot or parcel of
land on which the proposed construction is planned. ~,

Mayor Firtion opened the second public hearing on the
community Development Block Grant at 7:12 p.m.
Robert Johnson, Clark, Roumelis & Associates, Inc.,
presented a status report on the grant application,
listing the three proposed activities, i.e., parking
lot improvements, lighting, and supplementation to
the Yacht Club pier improvements.
Mr. Johnson advised that the Citizens' Advisory Task
Force (CATF) met this evening and unanimously
recommend going forward with the grant application.
Walter Barnes, 402 Azine Terrace, Sebastian,
expressed concern for use of CAVCorp as a parking
lot and suggested that public input be obtained.
Ruth Sullivan, 1200 Indian River Drive, Sebastian,
member of CATF, expressed concern for the lack of
input time given to the public and task force and
the effect of implementation of the trust fund on
future taxes. She requested item E (Ordinance No.
0-95-08) be tabled for a couple of days to allow time
to look into it.
Discussion took place on tax increment financing.
Robert Johnson explained that taxes already derived
are placed in a trust fund, stated it is not
mandatory to establish TIF districts, however, other
applicants have implemented them. He suggested the
ordinance could be approved at this time and back out
at a later time if necessary.
George Reid, 202 Delmonte Road, Sebastian, member of
CATF, said he had strong reservations about using
$265,000 in grant funds to make CAVCorp a parking
lot. He suggested utilizing Fellsmere Road as part
of the whole park parcel.
Dave Dabrowski, Indian River Drive, Sebastian, member
of CATF, said more people utilize CAVCorp than
utilize Riverview Park. He suggested building parks
where people need them.

Sal Neglia, Sebastian, objected to using CAVCorp as a
parking lot.
Vice Mayor Corum inquired whether landscaping was
being considered for the parking area.
The City Manager said the plan was to extend the
aesthetics of the current park into CAVCorp. Robert
Johnson said design has to be finalized and can be
changed after a public hearing.
Mayor Firtion closed the public hearing at 7:50 p.m.

discussed the swearing in of new Council members,
seating of the City Attorney on the dais, and
presence of police officers at Council meetings.
Herbert Sturm, 549 Saunders Street, Sebastian, said
City Council received an amended order on August
12, 1992, which in his opinion, was not legal since
it was never voted on by the Code Enforcement Board.

He requested a workshop to discuss Code Enforcement
matters; and requested that the facts on Pine
Street be "laid on the table".

challenged City Council to run the City like a
business, that it set priorities and follow up.
Mayor Firtion announced that an agenda would be
prepared for a future workshop relative to proposed
accomplishments for the City of Sebastian.
Mayor Firtion called recess at 8:15 p.m. and
reconvened the meeting at 8:27 p.m. Ail members
except Mrs. Damp were present. Mrs. Damp arrived at
8:29 p.m. following the reading of the consent
agenda.

was feasible, if this City Council deems it
applicable, that a committee could be formed to review

Mrs. Damp announced an Easter Seals fundraiser at
Skydive Sebastian on March 25 and 26.

The city Manager said there will be a Board of
Adjustment meeting prior to the April 5, 1995 Regular
meeting. He suggested that City Council workshops be
conducted on the second and fourth Wednesdays at 6
p.m.

hereby establishes uniform administrative procedures which shall
guide all Consultant Selection Committees in evaluating and
selecting architectural, engineering, landscape architecture or
land surveying services and projects for the City of Sebastian
which exceed the minimum threshold amounts established in Section
287.055, Florida Statutes. The City Council shall appoint a
Consultant Selec:ion Committee (Committee) for each project
requiring the use of the competitive selection process in obtaining
professional services under Section 287.055, Florida Statutes. Ail
proceedings of each Commit=es shall be open to the public.
~ 2. PUBLIC ANNOUNCEMENt: The City Manager shall
announce, in a uniform and consistent manner, each occasion when
professional services are required for the City of Sebastian if the
cost of such services exceeds the threshold established in Section
287.055, Florida Statutes. The public announcement shall include
a general description of the project and the manner in which
professional consultants may apply to the City for the purpose of
furnishing services on the projects.
~ 3.__._ COMPETITION SELECTION PROCESS: The competitive
selection process shall be conducted as follows:
A. The Committee appointed to select the professional
services for any project or proposal shall evaluate the current
statements of qualifications and performance data on file with the
City for the project, together with those which may be submitted by
other firms regarding the proposed project, and shall conduct
discussions with, and may require public presentations by, no less
than five (5) firms, regarding their qualifications, approach to
the project, and ability to furnish required services. In the
event =hat less than five (5) firms make proposals for the project,
=he Committee may limit its discussions uo those firms which have
made application to the City.
B. The Committee shall select in order of preference no less
than five (5) firms, if at leas~ five (5) Eirms apply, deemed to be

WltEREAS, the City Council is desirous of establishing a Special Committee to
provide the necessary supervision and control for the 4th of July Celebration; and
WltEREAS, the City Council has designated the Riverview Park area as the location
for the festival during the celebration period; and

current fiscal year an annual operating budget for the General Fund, a sum of $5000 for the

S~Y STATEMENT
This years street improvement program will be reduced to
approximately $92,000. This reduction is due to the costs
associated with the engineering and repair of the Fleming Street
bridge, and cost overrun for the Pine Street project. This program
includes the resurfacing of Pine Street which is a carry over from
last year and several streets in the Highlands as included on the
attached breakdown sheet. The extension of the bike path along Easy
Street and-a bike path on Englar from Barber to Schumann which has
not been awarded to a contractor also is included. 3 Bids were
opened on March 28, 1995 at 2:00 p.m. with Ranger Construction
being the low bidder. This bid was required because Dickerson who
has the Indian River Commodities Contract advised us that they
would not honor the contract price for the City of Sebastian due to
the problem encountered with the Barber Street Railroad crossing.
Ranger Construction has done work for the City before and we have
found them to be reliable and capable to respond within a resonable
amount of time.
RECOMMENDED ACTION

BID: TYPE S-3 ASPHALT INSTALLED
The City of Sebastian is seeking bids for Type S-3 asphalt
concrete including hauling and spreading by an approved
mechanical spreader.
Annual bid may be renewed for two (2) additional one year periods
subject to vendor acceptance, satisfactory performance and
determination that renewal will be in the best interest of the
City. Notification of intent to renew will be mailed sixty (60)
calendar days in advance of expiration date of this award.
Ail of the above material shall be in accordance with the Florida
State Department of Transportation specifications.
Contractor shall be responsible for traffic control and advance
warning signs, furnish sufficient material, equipment and
personnel to install the asphalt in an uninterrupted manner
without frequent delays, so that a smooth, uniform surface is
provided. Prospective bidders must contact the City Clerk'S
office in person, by mail at the above address, or by telephoning
(407) 589-5330 for bidding documents and specifications.
Bids will be publicly opened and read aloud at 2:00 P.M. on

As you can see from the bid tabulation, four bids were received for
the above City project. The low bidder was Treasure Coast Marine.
The funds for this project will come from two sources. The City
General fund budget and the Florida Boating improvement fund. An
appropriation of funds will not be necessary for the cost overage
due to the fact that we also had budgeted monies for interior yacht
club renovations of $9,500. These renovations will be put on hold
until the next budget year and the $9,500 will be used to cover the
cost overrun for this project.
RECOMMENDED ACTION
Move to award the bid to Treasure Coast Marine in the amount of
$72,609. for the Yacht Club Pier Renovations.

SEALED BIDS
Bids shall be enclosed in a sealed envelope which shall show
the date and time for the opening of the bids, the name of

Although the City of Sebastian is exempt from Federal and
State Sales and Use Taxes, vendors or contractors doing
business in Sebastian are not exempted from paying sales tax
to their supplier for materials to fulfill contractual
obligations with the City nor shall any vendor/contractor be
authorized to use the City's Tax Exemption Number in
securing such materials.
NO BID
Where more than one item is listed, any items not bid upon
must be indicated "NO BID". Failure to bid on an item may
cause the entire bid to be disqualified. A "NO BID" item
should be accompanied by an explanation of why it was not
bid.
CONFLICT OF INTEREST
The award is subject to provisions of State Statutes and
City Ordinances. Ail Bidders must disclose with their bid
the name of any officer, director, or agent who is also an
employee of the City of Sebastian. Further, all Bidders
must disclose the name of any City employee who owns,
directly or indirectly, an interest of ten percent (10%) or
more in the Bidder's firm or any of its branches. Should
the successful Bidder permanently or temporarily hire any
City employee who is, or has been, directly involved with
the Bidder prior to or during performance of the resulting
contract, the contract shall be subject to immediate
termination by the City.

LEGAL REQUIREMENTS
Contractors must show their current occupational license and
be up to date. The Bidder shall submit with the bidding
documents one (1) copy of all licenses as required by the
bid documents. Prior to bid submission, all bidders must be
up to date with their Sebastian Competency Card or State
Certification with the Sebastian building Department (407)
589-5518. Failure to submit evidence of licenses shall
result in the rejection of the big. Federal, State, and City
laws, ordinances, rules and regulations that in any manner
affect the items covered herein apply. Lack of knowledge by
the Bidder shall in no way be a cause for relief from
responsibility.

Contractors doing business with the City are prohibited from
discriminating against any employee, applicant, or client
because of race, religion, color, disability, national
origin, gender, or age with regard to but not limited to the
following: employment practices, rates of pay or other
compensation methods, and training selection.

In the event of addition errors, the extended totals will
prevail and the Bidder's total will be corrected
accordingly. Bidders must check their bid proposal where
applicable. Failure to do so will be at the Bidder's risk.

WITHDRAWAL
If, within two business days after the Bids are opened, and
Bidder who files a duly signed, written notice with the City
Clerk's Office, and promptly, thereafter, demonstrates to
the reasonable satisfaction of the City that there was a
material and substantial mistake in the preparation of the
Bid, that Bidder may withdraw his/her bid.

INSTRUCTIONS FOR BIDDERS
DRUG-FREE WORKPLACE
The Drug-Free Workplace form, in accordance with Section 20
of the Agreement and as attached hereto, shall be submitted
with the Bid Form.
BID GUARANTEE
The Bidder warrants that the unit prices, terms, and
conditions quoted in his/her bid will be firm for acceptance
for a period of not less than sixty (60) days from the bid
opening date. Such prices will remain firm for the period
of performance of resulting purchase orders or contracts
which are to be performed over a one year period.
AWARD
The contract will be awarded to the lowest responsible
Bidder or Multiple Bidder(s) whose bid, conforming to the
specifications and Instructions For Bidders, will be most
advantageous to the City in consideration of price and other
factors as determined by the Bid Review Committee.
20, REJECTION OF BiDS
The City reserves the right to reject any and all Bids, to
.waive any and all informalities not involving price, time,
or charges in the work and to negotiate contract terms with
the successful Bidder, and the right to disregard all non-
conforming, non responsive, unbalanced, or conditional Bids.
More than one Bid from an individual, firm, partnership,
corporation, or association under the same or different
names, will not be considered. Any or all proposals will be
rejected if there is reason to believe that collusion exists
among the Bidders and no participants in such collusion will
be considered in future proposals for the same work.

YACHT CLUB PiER MODIFICATIONS
FOR THE CITY OF SEBASTIAN
PERFORMANCE BOND - A Performance Bond shall not be required
under this contract. However, should the Contractor not
perform the installation according to the schedule or fail
to satisfactorily meet the requirements of the St. John's
Permit the City reserves the right to call upon the second
lowest bidder to perform the work. Should the second lowest
bidder not be able to perform the work on a timely basis,
the City shall contact the third lowest bidder until a
Contractor is found to perform the work. The Contractor
under Agreement with the City shall be charged any
additional amount of costs incurred by the City exceeding
the unit price in the Contract for the work performed by the
replacement contractor. Failure of the Contractor to pay
the charge will result in a breach of this Agreement by the
Contractor, rendering it null and void.
If the contract is terminated as a result of Contractor's
default, Contractor shall pay to the City as liquidated
damages the difference between the unpaid balance of the
Contract sum and the cost to the City of completing the
contracted work.
BID BONDS AND PAYMENT BOND - Neither Bond shall be required
for this Contract.
PAYMENT - The Contractor, upon submitting the invoice for
payment, shall identify the sites, work performed, and
date(s) the work was performed.

SUMMARY
During the past five years, the transfer of the property known as "Barber Street" abutting
Park Place and intersecting with U.S.#i, has bounced around from owner to City to Attorney
to title company and so on. We have £mally reached the point where everyone is satisfied
and the City can accept the property.
The ability to serve Park Place and the surrounding area with water and sewer from the City
system has been hampered by a lack of utility fight-of-way and the appropriate easements.
The attached documents provide to the City the land required for Barber Street right-of-way
and abutting easements for utility lines.
RECOMMENDATION
Authorize the Mayor and City Clerk to execute the appropriate right-of-way Deed and Grant
of Easement from Nelson Hyatt to the City of Sebastian. ~

in consideration of the' sum of one dollar, ($1.00) and other
valuable considerations to them in hand paid by the party of the
second part, the receipt whereof is hereby acknowledged, have
granted, bargained and sold, and by these presents do grant,
bargain and sell to the said party of the second part, its
successors and assigns, an easement for public utilities and
drainage maintenance purposes over the property described in
Exhibits "A and B" attached hereto, and an easement for drainage
purposes over the property described in Exhibit "C" attached
hereto.
And the said parties of the first part do hereby fully warrant
the title to said lands, and will defend the same against the
lawful claims of all persons whomsoever.
