The City Attorney suggested that to temporarily suspend the board, a resolution would be sufficient, or, if Council wished to abolish the board, it must do so by ordinance. He further suggested that City Council could first adopt a resolution while the ordinance is being prepared if it wishes to abolish the board. Mr. Oberbeck suggested that perhaps volunteers could be found and several members of the audience raised their hands. The City Attorney noted City residency is a requirement% Residents were directed to come into City Hall tomorrow to submit applications. Mr. Oberbeck suggested the motion be changed to state only intent until such time as backup is received. The Assistant City Attorney noted that if the motion could be interpreted to commit to appropriation of any funds, he cautioned against it. Mrs. Corum added "with no expenditures from the City on the Habitat Conservation Plan" to the motion. Mrs. Damp concurred with the addition. Wally Kramer, Micco, addressed City Council on the proposed plan. Mr. Oberbeck suggested that the County be invited to make a presentation of the plan to City Council before Council votes to participate. Mr. Freeland requested to hear about revisions recently made by U.S. Fish and 'Wildlife. Brian Toland, U.S. Fish and Wildlife, said on closer inspection he determined that the number of platted lots could be reduced to 200 in Unit 17. Mr. Freeland asked that the motion be amended and Mrs. Corum and Mrs. Damp added "no more than 200 single family platted lots and property to be negotiated to be acquired". In response to the City Attorney, the Director of Community Development listed deficiencies in the plat. Attorney Warren Dill, representing applicant Henry Fischer, noted that the plans were redesigned at the request of the Utilities Director, and have now been resubmitted in original form, less the cul-de-sac and certain lots eliminated by the sandmine, to expedite approval and to alleviate additional cost to the applicant. He requested approval subject to submittal of construction drawings prior to any development. The Director of Community Development inquired whether City Council is willing to tentatively approve without construction drawings. City Council discussion followed on the provision in the Land Development Code for submittal of construction drawings prior to preliminary plat approval. The City Attorney said there is enough leniency in the Code to allow City Council to get around the language until such time as the language' is amended. Attorney Dill requested that approval be given with two conditions: 1) that all technical requirements of the Code are met and 2) subject to providing necessary construction drawings prior to construction and final plat approval. Special City Council Meeting May 18, 1994 Page Three The Director of Community Development noted that the preliminary plat must be brought back and approved in the form of a resolution. Court color to be dark green. Regulation markings to be done with white textured line paint. SPECIAL PROVISIONS FOR TENNIS COURT RESURFACINQ A. CONTRACTOK QUALIFICATIONS Bids will only be considered from firms regularly engaged in this type of work and who have an established reputation in the construction and resurfacing of tennis courts. The contractor shall furnish, to the satisfaction of the owner, proof of previous experience in all-weather tennis court construction and resurfacing. B. EXPERIENCE The contractor will submit a list of all-weather tennis courts he has constructed or resurfaced during the past two (2) years. A complete list is required. The llst should contain: owner, location, number of courts, and year constructed or resurfaced. C. MATERIALS Ail materials used shall be from a manufacturer that has regularly engaged in the manufacturing of these products for a minimum of five (5) years and must meet the product specifications attached. The manufacturer will provide written nformation to the owner that all products used are 100% acrylic aytex systems (no vinyl or vinyl combination systems) and are free of asbestos fillers. This system is composed of a color concentrate and a neutral nonpigmented acrylic with round sand. A color concentrate mixed with local sand will not be considered equal. If other than the standard specified, the contractor shall submit at least four (4) days prior to the bid date, at his own expense, a complete typewritten list of all such proposed substitutions together with sufficient data, drawings, samples, literature, and other detailed information as will demonstrate to the satisfaction of the owner that the proposed substitute material is equal in quality and utility to that originally specified. If the owner considers tests necessary to determine the quality and utility of any proposed material, such test shall be made at the expense of the contractor by an established and unbiased testing laboratory approved by the owner. This specification requires the provision of a complete surfacing system of specially formulated materials, each compatible with the other, which, when properly installed, will produce a high- quality of all-weather surface. Under no circumstances will a sUrfacinG system comprised of several products produced or manufactured from different sources be considered. D. METHODS OF CONSTRUCTION The filler and finish courses shall be applied by squeegees and brooms. Mechanical spray equipment and spreaders will not be permitted. All materials will be delivered to the job site in their original unopened containers where they will be checked by the owner. All methods of construction must be submitted to the owner for approval. Upon their second pass the equipment injects an emulsified asphalt as it remixes and grinds the material providing for a base material that meets F.D.O.T. standards. The base material is rolled and compacted to the required densities, then the street is overlayed with asphalt. In the past, we have used Asphalt Recycling to do similar work on a portion of Laconia Street. They were a subcontractor for Martin paving when Martin paving had Indian River Counties Commodities Contract. This year Dickerson is identified on Indian River County CoAm,~odities Contract for the placement of asphalt. Unfortunately, they do not have a mixing machine nor a subcontractor to provide that service. We have contacted several paving companies in the area and vendors to determine if similar machines and emulsified asphalt were available and have determined that this contractor and their supplier Marianna Asphalt are a sole source. We had anticipated to begin the project within the first week of June and will require City Council's approval to contract with this contractor and vendor for their services and supplies. Because of the time constraint problems for this project, we are unable to proceed through the normal bidding procedures and therefore request a bid waiver. This section of the code does not provide authority for staff to waive any of the required conditions. Sebastian General Parmership, B.F.T., is requesting a waiver regard/ag the requirement to install a street light at the intersection of Wave and Fleming Streets in the Chesser Gap subdivision. The particular provision of the code is paragraph N. "Street Lighting" of Section 20A-17.1, which states in part: "Street lights shall be installed at each street intersection, at mid-block locations where the distance between intersections exceeds nine hundred (900) feet..." You may recall that Wave Street was ~i6t a connecting street under the original plans of the subdivision. This modification was accomplished-at the request of the City Council. Wave Street was not part of our preliminary plat approval. 1) Fleming Street, in Chesser's Gap and throughout Sebastian, is a public street, not a private street, and is owned by the City of Sebastian, and should be maintained by the City of Sebastian as part of the City's thoroughfare road system. Fleming Street, in Chesser's Gap, is part of the County's thoroughfare road system. 2) The action of opening Wave Street has increased through traffic along Fleming Street in Chesser's Gap. Much of this traffic does not stop at our development. 3) Property owners along public thoroughfare streets do not maintain the streets or street lights at their own expense. This contract was with the certified public accounting firm of Hoyman, Dobson & Company, P.A. Under the provisions of FS 473.317, the City Council may extend the current expired contract one more year at a negotiated dollar amount, or the City Council may direct staffto advertise for a multi year independent audit service. The chief advantage of the City Council and staff for retaining the current auditors is their familiarity with the financial system of the City. The Finance Department has made great progress in recfifTing previous problems in the City's accounting system. However, there are several areas still requiring change and upgrading. When new auditors are selected, they are not familiar with the past problems and as a result, considerable time is utilized by City staff to educate and guide the auditors through the process. It would therefore, be advantageous to staff to retain the current auditors one more year and then advertise for this service.
