HomeMy WebLinkAbout09-15-2022 Union MinutesCITY OF SEBASTIAN INTERNATIONAL UNIT OF POLICE ASSOCIATIONS, AFL-CIO NEGOTIATIONS MINUTES OF THE MEETING SEPTEMBER 15, 2022 Present: Nicholas Voglio, Union Representative, Local 6053, International Union of Police Associations, AFL-CIO Paul Carlisle, City Manager, City of Sebastian Ken Killgore, Administrative Services Director, City of Sebastian Manny Anon, Jr., City Attorney, City of Sebastian Cynthia Watson, Human Services Director, City of Sebastian Dan Acosta, Chief of Police, City of Sebastian Detective Ken McDonough, Union Representative Terrence Pizzuti, Secretary, Sebastian PDA Matthew Radock, Corporal, Sebastian PD Janet Graham, Recording Secretary Mr. Carlisle opened the meeting and identified it as the first union negotiation meeting. The date is September 15, 2022. The time is 9:06 a.m. Everyone at the negotiating table identified themselves. Mr. Carlisle stated that there were tentative agreements on the original PBA contract. Mr. Voglio stated he provided to the City an edited copy of the Bargaining Agreement that he had received, and it was agreed between the parties that this is the copy that would be worked off of today. Mr. Voglio stated that anything appearing in the Union's contract in bold is new. There are some strikethroughs of certain language. He asked who is responsible for posting the legal notice and where would it be posted. Ms. Watson said it is posted near the entrance to City Hall, and it is also posted over at the Police Department. Mr. Carlisle wanted to clarify, if the paragraphs/articles have nothing in bold, there are no changes to those items. Mr. Voglio agreed. Mr. Carlisle added that if, when he reviews the proposed document, he finds something that was not bolded, that wording can be re -reviewed. Mr. Voglio agreed. Below are the Articles of the Collective Bargaining Agreement that were tabled at the first meeting on June 8, 2022 and are addressed at this meeting. Agreement -- Tentatively Agreed Preamble — Tentatively Agreed Article 1, Recognition -- Tentatively Agreed Article 2, Organizational Survey -- Tentatively Agreed Article 3, No Strike or Lockout -- Tentatively Agreed 4, Non -Discrimination -- Tentatively Agreed PAGE 2 Article 5, Dues Deduction -- Tentatively Agreed Article 6, Equal Employment Opportunity/Affirmative Action -- Tentatively Agreed Article 7, Labor Management Communications -- Tabled until the next meeting Article 8, IUPA Representation -- Sections 8.2, 8.4 and 8.5 will be tabled until the next meeting. All other language in this Article is tentatively agreed upon. Article 9, Bulletin Board -- Tentatively agreed Article 10, Personnel Records — Tentatively Agreed Article 11, Rights of Law Enforcement Officers While Under Investigation, Internal Investigations, and Obligations to the Public -- Sub -section A (14) Suggested to be moved to Article 46. Article 12, Legal Benefit -- Tentatively Agreed Article 13, Management Rights -- Tentatively Agreed Article 14, Discipline and Discharge -- Tentatively Agreed Article 15, Rates of Pay -- Tabled until the next meeting Article 16, Temporary Assignment -- Tabled until the next meeting Article 17, Assignment Pay -- Tabled until the next meeting Article 18, Injury Pay and Light Duty Assignments -- Tentatively Agreed Article 19, Call Back Pay -- Tentatively Agreed Article 20, On -Call Pay -- Tentatively Agreed with changes to the last line i.e. delete the word etc. and replace with "hurricanes or declared national disasters." Article 21, Court Appearances -- Tentatively Agreed Article 22, Bereavement Pay -- Tentatively Agreed Article 23, Military Leave -- Tentatively Agreed PAGE 3 Article 24, Jury Duty -- Tentatively Agreed Article 25, Voting Time/Political Activity -- Tentatively Agreed Article 26, Longevity Pay -- Tabled until the next meeting Article 27, Basic Workweek and Overtime -- Tentatively Agreed Article 28, Holidays -- Tabled until the next meeting Article 29, Seniority -- Tentatively Agreed Article 30, Layoff and Recall -- Tentatively Agreed Article 31, Promotional Examinations -- Tentatively agreed except for Section 31.7 where it states "...Assistant Administrative Services Director — HR Manager." it should read "...Human Resources Director." Article 32, Probationary Personnel -- Tentatively Agreed Article 33, Vacation Leave -- Tabled until the next meeting Article 34, Sick Leave -- Tabled until the next meeting Article 35, Personal Leave -- Tabled until the next meeting. Article 36, Leave of Absence -- Tentatively agreed with a correction in Section 36.8 in the second line where it reads "...be paid at the same step..." It should read "...paid at the same rate..." Article 37, Grievance Procedure -- Tentatively Agreed Article 38, Arbitration -- Tentatively Agreed Article 39, Performance Rating Review -- Tentatively Agreed Article 40, Group Health Insurance -- Tentatively agreed except in Section 40.1 where it states "twenty-five ($25.00) per month..." should read "no less than twenty- PAGE 4 five ($25.00) per month..." A sentence should be added which states, "The employee cost may change based on annual renewal rates." There was discussion between Detective McDonough and Ms. Watson regarding the increases in insurance rates. Ms. Watson stated that the City has no control over what rates come in from Florida Blue regarding percentages or what those rates are going to be for each class. Mr. Carlisle further explained how insurance rates are arrived at. Article 41, Clothing Maintenance, Equipment and Vehicles -- Tabled until the next meeting Article 42, Education Reimbursement -- Tentatively agreed except: In Section 42.6 the word "Florida" should be inserted. In Section 42.7 Mr. Carlisle asked that in the second line the term "...three years..." be changed to "two years..." Article 43, Health & Safety -- Tabled until the next meeting Article 44, Training -- Tentatively Agreed Article 45, Off -Duty Employment -- Tentatively Agreed Article 46, Substance Abuse Testing -- Tabled until the next meeting Article 47, Savings Clause -- Tentatively Agreed Article 48, Retirement -- Tentatively agreed except for: Section 48.3 should read, "For members hired on or after October 1, 2011 should be added to that sentence. Article 49, Duration of Agreement, Dates -- Tentatively Agreed Discussion ensued regarding the date for the next meeting. It was agreed that the next meeting would be held on September 23rd at 9:00 a.m. The meeting ended at 10.18 a.m. jg
