Aeenda Item Title: Approval by City Council of an Emergency Purchase in accordance with the
City Code of Ordinance Section 2-10 (c) (4) a. and authorize the City
Manager to execute the appropriate documents with AST Florida
Environmental for the removal of 2 in -ground fuel tanks on the Harbor
Lights Property.
Recommendation: Staff recommends that City Council approve and authorize the City Manager
to execute the appropriate documents to expedite the removal of 2 in -ground fuel tanks on the Harbor Lights
Property.
Background: On September 7" City staff began the demolition process of the Harbor
Lights Motel. Towards the end of this process on Thursday, September 151s staff located two in -ground fuel
tanks that were previously covered in front of the Office area. These fuel tanks were not found in a previous
environmental survey done in 2018 and are not registered with the Florida Department of Environmental
Protection. Staff was able to get AST Florida Environmental to quickly come on -site to provide a cost
estimate and provide their expert opinion on the current conditions. AST Florida Environmental was a recent
City contractor that removed a similar tank from the Working Waterfront property during the recent
construction project. Due to the current condition with the tanks now being exposed staff feels that this
process needs to be expedited due to the sudden unexpected turn of events that can cause an immediate
danger to the public health or safety. More specifically, the tanks now being exposed presents an increased
risk of rain and ground water entering the tanks and potentially increasing the possibility of ground
contamination in the immediate area. Therefore, pursuant to City Code of Ordinance Section 2-10 (c) (4) a.,
staff believes it is in the best interest of the City to declare the existence of an emergency procurement
condition and suspend the necessity to obtain additional cost estimates which will substantially delay moving
forward with this process.

Dear Mr. Benton:
AST Florida Environmental Inc., (AST) is pleased to submit this cost fee proposal to conduct Tank
Closure Assessment activities on the above referenced property. The proposed tasks for the property
are based on information obtained from a site visit performed on 14 September 2022. According to
the onsite reconnaissance, two unregistered tanks consisting of approximately 500-gallon single
walled steel gasoline and/or diesel storage tanks are located on the property. The scope of the Tank
Closure Assessment will include oversight of proper removal of the UST by AST and a Florida
licensed Pollutant Storage System Contractor (PSSC), as well as coordination with the Brevard
County Department of Environmental Resources and completion of sampling and analytical
procedures outlined in Chapter 62-761, Florida Administrative Code (F.A.C.). AST will prepare a
Tank Closure Assessment Report (TCAR) including conclusions and recommendations for additional
work if necessary which will be signed and sealed by a Florida Licensed Professional Geologist. Any
encountered impacted soils or groundwater assessment or remediation will be addressed as needed
but the cost is not included in this proposal. A Site Assessment or remedial action of soil or
groundwater contamination is not a part of this proposal.
AST proposes at this time the following to include but not to be limited to:
Scope of Work:
i Assist with Tank Registration with the Florida Department of Environmental Protection and
Local and State Notification of all Site Activity. Indian River County/FDEP Permits or Review fees
are not a part of this proposal;
• Utility clearances will be performed be others before any onsite work commences. A site -
specific Site Safety Plan will be written and all onsite AST personnel will be required to read and sign
the Safety Plan prior to commencing work. Site work excavations were all based on a modified level
"D". Appropriate AST personnel will be certified including, but not limited to, OSHA HAZWOPPER
certified;
Oversee excavation of any asphalt and/or soils surrounding the UST's sufficient to expose the top
and sides of the tanks using client's onsite equipment and operator. Clients' equipment and operator
will remove and load tank for transport;

• Perform the degassing and cutting of the UST if necessary, the plan calls for addressing two tanks
and potential associated piping which may require additional soil sampling from that defined below;
• Perform and oversee the removal of any liquid, soil or sludge contents inside the UST's using a
vacuum and/or vac -con truck. One day onsite to remove up to 500 gallons of contaminated water and
sludge/soil transportation & disposal at a Iicensed waste receiving facility;
• Perform the removal, waste manifest and transport of the tank from the site by a licensed
Pollutant Storage System Contractor (PSSC), clean soil fill replacement is not a part of this proposal
and may be required to place monitoring well(s);
• Soil samples will be collected from the surficial depth interval of 0-2' below land surface (bls) to
the groundwater table where applicable and from inside the tank pit(s). All samples will be field
analyzed by an Organic Vapor Analyzer (OVA) and observed for odors or staining. Collection of a
minimum of one (1) soil sample from the excavation for every 200 square feet of the base of the
excavation and one soil sample minimum every 20 feet from the sidewalls for organic vapor
screening;
• Five (5) soil confirmation samples will be collected from at a minimum of the above -mentioned
areas for laboratory analysis for the presence of Kerosene Analytical Group parameters (KAG) which
consists of EPA Methods 8260/8270 (Purgeable Haiocarbons/Aromatic Volatile Organic
Compounds), FL -PRO (Total Recoverable Petroleum Hydrocarbons), EDB and lead (soil vs
groundwater parameters) Samples will be placed on a normal approximately 10-day turnaround time
(expedited samples will cost double);
• Direct push placement of one (1) temporary groundwater -monitoring well to be placed in the tank
farm area. After waiting the required development period one (1) set of groundwater samples will be
collected analyzed for the presence of KAG parameters. Samples will be placed on a normal
approximately I0-day turnaround time (expedited samples will cost double) (two days onsite);
• The results of the field investigation activities, findings, waste manifests, conclusions and
recommendations for further work, if any, will be provided in a written Tank Closure and Assessment
Report (TCAR) signed and sealed by an EPA -defined Environmental Professional and/or Florida
Registered P.G.
The above -stated tasks for the removal of the two (2) approximately 500-gallon UST and closure
assessment activities will be completed for a fee as follows:
AST field labor, insurance, clerical, mobilization, equipment and supplies. $3,610.00
Cutting, cleaning and removing tank contents $2,700.00
Disposal of pumped material/petro/water (500 gallons@ $0.50 per gallon) $250.00
Tank removal, PSSC oversite, transport and manifested disposal $3,240.00
Place groundwater monitoring well
$1,500.00
Laboratory costs soil and groundwater samples. $2,700.00

TOTAL
*This cost proposal was prepared assuming that the client's contractor will provide an onsite excavator,
and tank loader.
This proposal does not include any soil or groundwater assessment or disposal beyond that described
above. In the event that contaminated soil or groundwater material is identified or unforeseen
circumstances require additional time and materials, AST hourly labor rates are $100/hour. No additional
work will be performed without prior written authorization from the Client. AST is not responsible for
any damage to property or landscaping as a result of standard work practices as required by this Scope of
Work.
The above listed tasks will be completed on a specified fee basis for a total of $.00* using standard
laboratory turnaround time of approximately ten working days. Any planned portion of the SOW that
does not occur will be subtracted from the final payment. The fee for this cost proposal is good for thirty
(30) days from the date of issue.
If any unforeseen circumstances occur, you will be notified immediately and no work will be performed
that exceeds the above cost estimate without your prior authorization. If additional meetings, reports,
estimates, consultation or other services are requested by the client or others on behalf of the client (i.e.,
client's attorneys, other representatives) beyond the above outlined scope of services, the additional
requested services will be invoiced on a time and materials basis and may cause exceedence of the above
cost estimate.
This letter will serve as a contract between AST Florida Environmental Inc., and the client. Payment for
services is due upon receipt of invoice and a 1.5 percent late fee per month will be assessed on unpaid
balances due over 30 days. As the client, you agree to pay any and all attorney fees that are required to
collect unpaid balances due over 60 days. All suits at law or in equity for any breach of the agreement or
for default in payment shall be instituted and maintained in any court of competent jurisdiction in
Okeechobee County, Florida.
Please sign the attached acceptance sheet, and return by mail or email, along with the required retainer in
the amount of $8,000.00, to be applied to out-of-pocket laboratory and contractor expenses. Following
authorization, the field work will commence immediately, with laboratory analyses and report preparation
within approximately 5-6 weeks, as described above.

TERMS:
AST Florida Environmental Inc. will complete the work described above in a timely manner
unless delayed by client's request, lack of information, or intervening factors beyond our control.
Client assures AST that it has permission to work on the subject property and will advise AST of
proper procedures for accessing subject property. AST is not responsible for any landscape or
structural damage to the property resulting from normal operations as defined in this Scope of
Work.
AST will maintain a minimum $1,000,000 errors and omissions (professional liability) insurance;
$1,000,000 per occurrence and $2,000,000 aggregate liability insurance for the duration of the
project. If any additional insurance requirements are necessary, please return the specifications
with the signed proposal. They will become a part of this contract as agreed by both parties.
A retainer of $8,000.00 is required; the retainer will be subtracted from the balance due and is
required to initiate work, The final report will be held pending final payment.
If additional meetings, reports, estimates, consultation or other services are requested by the client
or others on behalf of the client (i.e., client's attorneys, other representatives) beyond the above
outlined scope of services, the additional requested services will be invoiced on a time and
materials basis and may cause exceedence of the above cost estimate. Any additional items will
be charged per unit rates if applicable and approved.
Any findings, conclusions and/or recommendations for this report proposal will be based solely
upon any sample testing and analysis conducted as part of this contract. Any other documents,
environmental site assessment reports, findings, conclusions, recommendations, etc. not
conducted solely by AST will be considered as supplemental to, in support of, or as a baseline
environmental background only for this report.
This proposal does not constitute a Site Assessment. Any future/additional Site Assessment
investigation derived soils, groundwater, free -product, etc., generated should be properly
stockpiled placed directly in 55-gallon drums, labeled, dated and sealed, or placed on and covered
with 10-mil visqueen for prompt proper disposal. Any future laboratory costs will depend on type
of waste, and disposal costs dependent on laboratory results.
Payment is due immediately upon receipt of the invoice; after 30 days the client agrees to pay 1,5
percent late fee per month or portion thereof on unpaid balances. Unpaid balances after 60 days
from the date of the invoice may result in work stoppage until overdue accounts are resolved.
Failure to pay within 60 days from the date of invoice will be considered to be a breach of
contract and AST may cease work and withhold all work product immediately without penalty
from the client.
Client agrees to pay all legal fees and other collection costs incurred by AST, to collect unpaid
invoices.
