Origin: Finance Acting City Manager Date Submitted: 9/01/94 For Agenda Of.' 9/07/94 Exhibits: - Resolution R-94-44 EXPENDITURE REQUIRED: N/A AMOUNT BUDGETED: N/A APPROPRIATION REQUIRED: N/A SUMMARY In accordance with Chapter 200, Florida Statutes, the City Council is holding this public hearing on the proposed millage rate. The City Council may amend the tentative budget and reduce (but not increase) the proposed millage rate. If the City Council changes the tentative millage rate, then the following steps must be followed: · recompute the proposed millage rate publicly announce the percent, if any, by which the recomputed rate is less than the rolled-back rate (which percentage shall be characterized as the percentage decrease in property taxes tentatively adopted by the City Council). In this first public hearing, the first substantive issue to be discussed shall be: the percentage change in the millage over the rolled-back rate and the specific purpose for which ad valorem tax revenues are being decreased The City Council shall hear comments regarding the millage rate and explain the reasons for the change from the rolled-back rate. The public shall be allowed to speak and to ask questions prior to adoption of the proposed millage rate. The City Council shall adopt its tentative millage rate prior to adopting its tentative budget by separate motions. RECOMMENDATION Move to adopt the tentative millage rate of 6.900 mills which is ninety seven one hundredths percent (.97%) less than the rolled-back rate 6.9678 mills. RESOLUTION NO. 94-44 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA ADOPTING A PROPOSED MILLAGE RATE OF 6.900 FOR THE CITY'S GENERAL OPERATING FUND FOR THE FISCAL YEAR BEGINNING OCTOBER, 1, 1994 AND ENDING SEPTEMBER 30, 1995; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a tentative budget has been prepared estimating expenses and revenues of the City of Sebastian, Florida, for the ensuing year, with detailed information, including revenues to be derived from sources other than ad valorem levy, and the administrative staff of the City has made recommendations as to the amount necessary to be appropriated for the ensuing year; and WHEREAS, the City Council has met and considered the recommendations, the suggested tentative budget, and the proposed millage necessary to be levied to carry on the government of the City for the ensuing year; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, THAT: Section 1. The proposed millage rate necessary to be levied against ad valorem valuation of property subject to taxation in the City of Sebastian, Florida, to produce a sufficient sum which together with departmental and other revenues will be sufficient to pay for appropriations made in the tentative budget for the fiscal year is hereby set at 6.900 mills. Section 2. A copy of the tentative budget shall be published in one issue of a newspaper published in Indian River County, Florida, at the same time the public will be notified of a public hearing to be held on the 21st day of September, 1994 at 7:00 P.M. for the purpose of hearings or criticisms of the tentative budget and millage. This meeting is for the purpose of setting a final tax levy and final budget. Section 3. The proposed millage rate is .97 percent below the computed rolled back rate. Section 4. If any clause, section, or other part of this Resolution shall be held by any Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part shall be considered as eliminated and shall in no way affect the validity of the other provisiofis of this Resolution. Section 5. All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 6. This Resolution shall become effective upon its passage and adoption. Section 2. All delinquent taxes collected during the ensuing fiscal year as proceeds from levies of operation millages of prior years are hereby specifically appropriated for the use of the General Fund. Section 3. All monies appropriated for Capital projects during the preceding fiscal years and final payment has not been made are specifically re-appropriated for each project as work-in-progress. Section 4. If any clause, section, or other part of this Resolution shall be held by any Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part shall be eliminated and shall in no way affect the validity of the other provisions of this Resolution.
