Origin: Finance Finance Director ~~ Date Submitted: 09/13/96 For A~enda of: '~9/18/96 Exhibits: Ordinance NO 0-96-28 EXPENDITURE REQUIRED: $0 AMOUNT BUDGETED: $ 0 APPROPRIATION REQUIRED: $0 SUMMARY STATEMENT In accordance with Chapter 200.065, Florida Statutes, the City of Sebastian is holding this public hearing on the proposed millage rate of 6.900 mills which is 0.93% below the rolled-back rate of 6.965 mills. The City Council may amend the tentative budget and reduce (but not increase) the proposed millage rate. The public shall be allowed to speak and to ask questions prior to adoption of the proposed millage rate. The City Council shall adopt its millage rate prior to adopting its budget by separate motions. RECOMMENDED ACTION Move to adopt Ordinance No. 0-96-28 and the proposed millage rate of 6.900 mills which is ninety-three one hundredths percent (.93%) less than the rolled back rate of 6.965 mills. ORDINANCE NO. 0-96-28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA ADOPTING A PROPOSED MILLAGE RATE OF 6.900 FOR THE CITY'S GENERAL OPERATING FUND FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1996 AND ENDING SEPTEMBER 30, 1997; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a budget has been prepared estimating expenses and revenues of the City of Sebastian, Indian River County, Florida, for the ensuing year, with detailed information, including revenues to be derived from sources other than ad valorem levy, and the administrative staff of the City has made recommendatioziS as to the amount necessary to be appropriated for the ensuing year; and WHEREAS, the City Council has met and considered the recommendations, the suggested budget, and the proposed millage necessary to be levied to carry on the government of the City for the ensuing year; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, THAT: Section 1. The proposed millage rate necessary to be levied against ad valorem valuation of property subject to taxation in the City of Sebastian, Indian River County, Florida, to produce a sufficient sum which together with departmental and other revenues will be sufficient to pay for appropriations made in the budget for the fiscal year is hereby set at 6.900 mills. Section 2. A copy of the budget shall be published in one issue of a newspaper published in Indian River County, Florida, at the same time the public will be notified of a public hearing to be held on the 18th day of September, 1996 at 7:00 P.M. for the purpose of setting a final tax levy and final budget. Section 3. The proposed millage rate is .93 percent below the computed rolled back rate. Section 4. If any clause, section, or other part of this Ordinance shall be held by any Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part shall be considered as eliminated and shall in no way affect the validity of the other provisions of this Ordinance. Section 5. All Ordinances or parts of Ordinances in conflict herewith axe hereby repealed to the extent of such conflict. Section 6. This Ordinance shall become effective on October 1, 1996. Section 7. The budget of the City of Sebastian, Indian River County, Florida, for the Fiscal Year beginning October 1, .1996 and ending September 30, 1997, a copy of which is attached hereto and more particularly identified as Exhibit "A", "B", "C", "D", "E", "F", "G", "H", and 'T', are hereby adopted and the appropriations set out therein are hereby made to maintain and carry on the government of the City of Sebastian, Indian River County, Florida. Section 2. All delinquent taxes collected during the ensuing fiscal year as proceeds from levies of operation millages of prior years are hereby specifically appropriated for the use of the General Fund. Section 3. All monies appropriated and encumbered for Capital projects during the preceding fiscal years and final payment has not been made are specifically re- appropriated for each project as work-in-progress. Section 4. If any clause, section, or other part of this Ordinance shall be held by any Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part shall be considered as eliminated and shall in no way affect the validity of the other provisions of this Ordinance.
