Resolution No. R-96-73 EXPENDITURE REQUIRED: AMOUNT BUDEGETED: APPROPRIATION REQUIRED: SUMMARY STATEMENT The City Council on September 27, 1995, approved Resolution 95-57, which granted a special use permit for overnight camping to Skydive Sebastian. The permit was for ten RV spaces and a 30' X 30' tent camping area. The need for tent camping has exceeded the applicant's previous estimate of the space required. Therefore, the applicant has file an application to expand the tent camping area. An additional 10' X 120' tent camping area is proposed immediately south of the RV spaces. The area between the two parking lots is proposed to be a tent camping area. Two other tent camping areas are located in the stormwater management systems to the east of the parking located on the northwest portion of the property. One RV space has been eliminated. The Planning and Zoning Commission has held a public hearing on this request and found that the requested special use permit is not detrimental to the public safety, health or welfare nor is it injurious to other properties or improvements within the immediate vicinity and that the proposed use is consistent with the purpose and intent of the airport industrial zoning district and the use is similar with the uses allowed in such a district. The Planning and Zoning Commission has recommended approval of the requested special use permit with conditions. RESOLUTION NO. R-96 - 73 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, FINDING THAT THE USE IS NOT DETRIMENTIAL TO THE PUBLIC SAFETY, HEALTH AND WELFARE AND IS CONSISTENT WITH THE PURPOSE AND INTENT OF THE AII:I.PORT INDUSTRIAL ZONING DISTRICT; GRANTING A SPECIAL USE PERMIT TO SK-YDIVE SEBASTIAN OF SOUTH FLORIDA, INC. FINDINGS OF FACTS: The City Council of the City of Sebastian, after considering the evidence presented at the hearing, finds as follows: The requested expansion of the tent camping area at Skydive Sebastian is not detrimental to the public safety, health or welfare or ~'injurious to other properties or improvements within the immediate vicinity; and, The proposed use consistent with the purpose and intent of the airport industrial zoning district and the use similar in nature and compatible with uses allowed in such a district. SECTION 2. APPROVAL: The City of Sebastian hereby approves a special use permit for Skydive Sebastian of South Florida, Inc. to operate an overnight camping facility accessory to its skydiving operations located at 400 West Airport Drive, Sebastian Florida 32958, as depicted on the Mosby and Associates, Inc.'s site plan entitled Master Plan Site Improvements, Sheet 1 of 2, dated June 1996 and revised September 25, 1996. SECTIONS. ADDiTIONAL CONDITIONS: The applicant, in order to conduct a special use on the property described in this Resolution, must comply with conditions as follows: o The applicant shall provide the city a letter from the Indian River County Health Department approving the expanded camping capacity. The applicant shall comply with all the conditions of the previously approved site plan. Security personnel shall be provided 24 hours a day any time a camper is using the facility. Lighting to be provided for the camp area must be approved by the FAA. Signs are to be posted indicating camping area rules. Said rules shall be approved by the Ah-port Manager. A public telephone shall be maintained for use by the users of the camping area. The limits of the camping area is described on the site plan entitled "Master Plan Site Improvements, Skydive Sebastian" sheet 1 of 2, dated 8/18/96. A pass shall be provided to every camper to be displayed on their windshield or on the tent, with proper identification shown prior to the issuance of the pass. No fees shall be collected for the pass. Access to the camping areas shall be restricted by maintaining the vegetati0~around the area. No camping in the expanded tent camping areas (beyond the previously approved 30 X 30 area) shall be permitted prior to a modification to the airport lease between the City of Sebastian and Skydive Sebastian of South Florida, Inc. 12. The applicant shall post "No Trespassing" signs on the north and south sides of the property to discourage trespassing on adjacent property. 13. The applicant shall construct a four foot high chain link fence on the south side of the property from the building labeled existing building, bathroom/snack bar east to the taxiway. 14. 15. The applicant shall provide the City, quarterly, a copy of all campground registrations and the time records of the security personnel. SEVERABILITY: If any section or part of a section of this Resolution is declared invalid or unconstitutional, the validity, force and effect of any other section or part of a section of this resolution shall not thereby be affected or impaired unless it clearly appears that such other section or part of a section of this Resolution is wholly or necessarily dependent upon the section or pan of a section so held to be invalid or unconstitutional. SECTION 5. CONFLICTS: All Resolutions or parts thereof in conflict herewith are, to the extent of such conflict, superseded and repealed. SECTION 6. EFFECTIVE DATE: immediately upon is adoption. This is located in the general marine commercial (GMC) zoning district. The GMC zoning district allows residential uses as a special use. There are two criteria for a special use permit: 1) Will the special use permit be detrimental to the public safety, health or welfare or be injurious to other properties or improvements within the immediate vicinity in which the property is located? and 2) Is the proposed use consistent with the purpose and intent of the general marine commercial zoning district and is the use similar in nature and compatible with uses allowed in such a district? The proposed residential use is less intensive than the existing approved restaurant and marina. For example, the traffic impacts will be far less than the restaurant. In addition the location of a residence in a commercial area may have a benefit of reducing crime by presence of people in the area around the clock. Therefore, the proposed use will not be detrimental or injurious. Residential uses are specifically allowed in the general marine commercial zoning district as a special use. This implies that the use is consistent with the purpose and intent of the district. The Riverfront Advisory Committee has been reviewing the zoning districts found in the riverfi-ont area. That committee has conceptually approved the recommendation of the establishment of a single zoning district for the entire area. This district would specifically include residential uses as well as commercial uses. The location of residential and commercial in the same building is comemptated. The proposed special use for a residence over the restaurant is consistent with the proposal being developed by the Riverfront Committee. The Planning and Zoning Commission has held a public hearing on this request and found that the requested special use permit is not detrimental to the public safety, health or welfare nor is it injurious to other properties or improvements within the immediate vicinity and that the proposed use is consistent with the purpose and intent of the general marine commercial zoning district and the use is similar with the uses allowed in such a district. ADDITIONAL CONDITIONS: The applicant, in order to conduct a special use on the property described in this Resolution, must comply with conditions as follows: The existing site plan shall be modified and. approved by the Planning and Zoning Commission of the City of Sebastian showing the residence and the required two parking places and carport or garage. If a carport is used, a minimum sixty square foot storage area shall be included. SECTION 4. SEVERABIL1TY: If any section or part of a section of this Resolution is declared invalid or unconstitutional, the validity, force and effect of any other section or part of a section of this resolution shall not thereby be affected or impaired unless k clearly appears that such other section or part of a section of this Resolution is wholly or necessarily dependent upon the section or part of a section so held to be invalid or unconstitutional. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows: 1. FINDINGS OF F~CT. The City Council, SECTION considering follows: after the evidence presented at the hearing, finds as (1) The granting of the special use permit will not be detrimental to the public safety, hea!th or welfare or be injurious to other properties or improvements within the i~ediate vicinity in which the property is located; and, (2) The use requested is consistent with the purpose and intent of the Airport and Industrial Facilities District, and can be demonstrated to be similar in nature and compatible with the uses allowed in such district. The land is located in an Airport and Industrial Facilities District and the subject property address is 400 West Airport Drive,-..Sebastian, Florida 32958. SECTION 3. ADDITIONAL CONDITIONS: The applicant, in order to conduct a special use on the property described in this Resolution, must comply with conditions as follows: (1) Security personnel to be provided 24 hours any time a camper is using the facility.
