They now have expressed an interest in leasing a three acre parcel at the Sebastian Municipal Airport and have requested to make a presentation to city Council. Currently we are investigating possible construction of a approx. 11,000 sq.ft, hangar/office facility. one alternative for AMERICAN AVIA/ION EXPORT would be to purchase the existing F.B.O. of J & S Aviation in Sebastian, with immediate expansion in form of a maintenance hangar within %'5e vicinity of the existing building, incorporating all future developments. Future activities will include the importation of various new aircraft and their product support. AMERICAN AVIATION EXPORT has no intentions at the present time of serving the domestic market, minimizing local aircraft traffic and noise. Most of our activities would be limited to the refurbishment and modification of aircraft with only a few aircraft in progress at 'any given time. The Community Development Director did not have written permission from the property owners to relocate the trees.. I expressed concerns with overseeing the relocation and the expense of watering the trees for 30 days. If it is City Council's desire for the City to establish a policy for relocating trees from private property before lots are cleared, I would like to recommend the following p~ocedures. 1. That at the time of permitting the owner may in writing elect to donate treesl, if any)to the City within ten days following the permit applicatzon. 2. Retain a licensed arborist to make an evaluation of the trees to determine viability, health and quality and to make recommendation to the feasibility of relocating the trees. He would identify conditions of planting to insure a high success rate of survival such as fertilizing, root pruning or defoliating. If root pruning is required then the owner should be contacted to allow the City an additional 30 days to relocate the trees or deny the request. 3. Retain a licensed contractor to relocate the trees to City Property. 4. Irrigate the tree daily for the first 30 days or as recommended by the arborist. Public works personnel is limited see attached duty roster projected for Fiscal 93694. As indicated, all Public Works personnel have been assigned without backup support or replacements. To irrigate the transplanted trees will place a hardship on the functioning capability of the public works department if too many trees are transplanted within the same time period. If the replanting can be accomplished with a water supply in close proximity then a temporary irrigation system can be~mployed to accomplish the final step. The Council must decide whether the cost and use of City personnel can be justified to support such an activity. Cost verses benefits does not have an exact formula but it is dependent on each individuals perception for the worth of the benefit. Because staff cannot know how important this issue is to each Councilmember, I feel it is appropriate to consider the pros verses the cons. The cost fdr transplanting is less but it demands more , time for manpower per tree and does not allow for planned landscaping. The work involves the placement of stabilizing material such as marl and the .concrete slab. It does not include the cost for clearing because,,specific sites have not been selected nor the cost of goal which Will be installed by the Public Works Department. ' It is anticipated that the clearing and grubbing would be issued for an amount that is site specific which would be__handled through the purchase order proceedures. The contractor has indicated a commitment to complete the work with 5 calendar days, however, I wish to revise the time to 15 days. This was because the cost estimator inadvertantly misread the statement as being number of days needed to prior to notice to proceed. I had reviewed the cost for the installation for the basketball courts and compared that to my original estimates of January 21st, 1993. The results of my comparison indicates that my original cost estimates were $1200 and $2200 less than the bi~s received. It was City Council's concern at that time that my cost estimates were excessive and unrealistic which prompted the bidding procedure. ~ I feel that discussion should take place between City Council and Staff to determine if the bids are reasonable or if we should go back out to bid. It was my intention to inventory City owned property in areas spread throughout the City to cover a larger area for neighborhood basketball courts. The locations are as follows: 1. I have read the report and based on my review, the information contained in the report is comprehensive describing the plan of action for the groundwater treatment. The report identifies a time frame of approximately . one year for the cleanup to take place with a remedial monitorin~ and maintenance to occur for the following year. They have provided an estimated cleanup cost which-is expected to be $151,600. $103,000 is ear marked for the purchase and installation of the groundwater ptunp, treatment systems, system startout, sample monitoring, maintenance and preparation of record drawings. The remaining $48,000 during the rest of the year will be for sampling, monitoring and maintenance. The following year sampling and monitoring, site rehabilitation, I completion report is expected to be $15 000 bringing the two year cost to $166,600. ' Upon completion,, to the satisfaction of Department of Environmental Protection, a final complete groundwater samples will be taken, the equipment shall be removed and a well to ~bandonment is expected to cost $8000 bringing the total project cost to $174,600. This report identify.,s that~is an estimate as based on past ex?erience and that a more~urate~cost breakdown can be prepared prior to construction. I feer-~ there is plenty of room for considerable savings by doing the following: 1. Going out to bid for the construction drawings and permitting for another environmental agency. --.. o Purchase and installation of the groundwater equipment could be less if the city is able to obtain used equipment. ! ! The City has spent $5,265.62 for~ctural services to r~construct the rear drainage ditch. The drainage ditch is deeper than 10 feet located within a 20 ft drain~ee easement. This has caused the side slopes of the d~'~ ~e extremely Steep and has encroached on private property in some areas. The block is about 50% built out limiting access for maintenance. Th~s is a rare problem. Most large drainage ditches are located within a dr..ainfige r~ght of.way with easements~ ~ro~mmng acces~ zor mamn~enance As the block ~'bncznues to for maintenance will be to fill the build out our only recourse ditch and redig it to the steep cross sections. '-- During the City's last attempt to remove silt from the ditch bottom, truckloads of fill were placed into the ditch. This allowed a trackhoe to reconstruct the cross section of the ditch. Following the excavation, sod was placed to stabilize the side banks. The system functioned well initially, alleviating the flooding problem. Following moderate rainfalls, however, the Public Works Department has been called back to dirt blockages in ditch where the side bank had failed, filling the bottom of the the ditch and backing water up into the streets. Because the soil conditions are poor, consisting chiefly of clay material, it is impossible to stabilize the side banks of the ditch. Therefore, to eliminate the continual expense of redigging and sodding the rear ditch I feel that it is imperative that this rear drainage ditch be piped for the following reasons. 1. No existing drainage right of way exists. 2. The'20 foot Drainage easement is insufficient to allow proper maintenance and cross slope 3. Poor soil conditions do not allow proper stabilization of the ditch bank. Eliminate the continual maintenance costs 5. To alleviate flooding conditions It is anticipated that the cost to install the conveyance system would be approximately $26,000 if the City purchased the pipe and rented a trackhoe as compared to $33,000 for contractor to purchase the pipe and have it installed. The cost benefit ratio can be expressed in terms of cost per LF or approximately $37.00 per LF. The apparent benefit would be minimal maintenance requiring just periodic inspections of the system and mowing where vacant lots are located. The life expectancy of the pipe would be approximately 100 years. The Council has expressed interest in piping rear drainage ditches. As the city blocks become built out it will be more difficult to maintain rear ditches and piping may become the solution. For the council's education, if a special assessment were to be considered the cost for this bl%ck would equate to approximately $1500 per lot considering a typical 80 foot wide residential lot. The budget for this fiscal year 93/94, ailocated $100,000 for the replacement of the drainage pipes along Schumann Drive in unit .9. That revenue will be spent this year for the drainage system which has been designed and permitted." Funding for this proje-c~ could be available from the capital project's fund. Park Improvements for the Riverfront has a budget amount of $120,000. Funds could be transferred from Parks to Drainage Improvements to cover this expense. The Assistant city Attorney, Rick Torpy, advised the Construction Board that state law would only permit a single, $5,000 bond, for each individual contractor which would be payable to the..Governor of the State of Florida. The Construction Board determined that a $5,000 bond would not be sufficient and would generally penalize the majority of contractors that fulfill their contract obligations. Mr. Shroyer is now requesting City Council to review a proposal to set up a fund and charge $100.00 to all contractors and an additional fee of $50.00 on all permits. This fund then would be administered by the Construction Board to review claims from homeowners regarding quality of materials and workmanship after their initial one-year warranty. Although Mr. Shroyer's concept is admirable, and we all wish to protect the homeowner as much as possible, the City Attorney needs to advise City Council whether or not this type of proposal could even be considered. Page 2 The City Council should be proud of the existing Building Department personnel and Construction Licensing Board for its existing posture and pro-active response to contractor licensing and inspections of all construction within the City of Sebastian. Shroyer~ 1(])/'18/93 To insure the homeowners in the city of Sebastian that 0uality materials and competent workmanship will be used in and for construction, remodeling~ or major repairs upon land classified as RE40, RS10, RS15~ RS20, the city council could enact an ordznance which will allow the Construction Board to arbitrate claims between homeowners and contractors in the second year after the completion of construction, remodeling, o~'major repairs. Also the city Council could setup a fund administered by the Construction Board to compensate homeowners for repairs in the second year thru the tenth year after the completion of work by contractors licensed by the city of Sebastian. The source for the fund could be from, (a) and additional fee of one hundred (100.00) dollars on all contractors applying for a license in the city, (b) and additional fee of fifty (50.00) dollars on all permits f_or construction, remodeling~ or major repairs issued (homeowners who prove that they have preformed the work themselves, could have this fee refunded after the work has past inspection). Assuming that most contractors usually .oive a one (1) year warranty on ail work and materials~ and assuming that most problems are usually resolved durin~ the first year., no action would be taken on any claim between any homeowner and contractor during the first year after the completion of the work. During the second year~ if the claim was prooeri~, submitted during the ¥irst year and the claim has no~ been resoived~ the homeowner wou~id be allowed to bring their claim to the Construction Board. The Board would review the evidence with the principal parties, after determining that there was not any neglect on the part o¥ the homeowner., could order the contractor to make the necessary repairs. The Board then, if warranted, could either fine the contractor or revoke his license. ~ After the first year and thru the tenth year evidence of the claim and three (3) estimates of the cost of repairs would be presented to the Board. The Board after reviewing the evidence submitted~-by the homeowner, and cletermining that there was not any neglect on the part of the homeowner~ and determining that there was inferior materials or workmanship used on the part of the contractor, could then authorize payment from the escrow account, using the table in exhibit (A) as a guide ~or payment. The Board could then review the evidence with the contractor and if warranted~ either fine the contractor or revoke his ! i tense.
