I move we approve the Pelican Island Jaycees use
of the Yacht Club at the half fee.

B. Agenda Items
Eric. John, 136 Sue Avenue, Whispering Palms,
requested that FDOT extend their Master Plan to cover
Whispering Palms.
Jeff Horne arrived at the meeting at this time so
Council addressed his item.
Mr. Horne explained the request of Mrs. Lutkemeler
for a fence adjacent to the Schumann Park basketball
court to protect her property.
A brief discussion ensued and Council instructed
staff to look into the cost of erecting such a fence
and bring it back to a future meeting.

Vice Mayor Oberbeck requested an overlay to review
and Councilman McCollum requested that the City
Attorney provide a comment as to the city's liability
if Mrs. Lutkemeier put up "no trespassing" signs.
The City Attorney advised that any fence not be
placed too close to the court or the city might be
considered negligent.

Review ProDosed FDOT Improvements to U.S. 1
Medians (no backup.)
Christopher LeDew, District Safety Engineer, District
4, FDOT, gave a history of the Master Plan for U.S.
Highway 1 and presented illustrations.
A brief discussion ensued and Vice Mayor Oberbeck
recommended certain amendments. Mr. LeDew said he
would inform the City Manager of any changes that are
made and would provide the City Council with a set of
final plans for review.
Review Ordinance No. O-91-01 - Political Signs -

Subsequent to discussion and amendments to the
proposed ordinance to remove certain restrictions on
private properties, motion was made as follows:

Discussion took place on possibly requiring an access
to the rear of the property. The Director of
Community Development recommended that although an
additional access would not be a requirement of the
Code, Council express its concern for an alternate
access in its motion and stated that the applicant is
aware that this is a concern of staff.
MOTION by Oberbeck/Powell
I move we direct the City Attorney to draft a
resolution for the preliminary plat for Collier Creek
PUD and waive Section 20A-17.1 and allow the
construction of the sidewalk on one side and bring it
to the attention of the developer that I'd like to
see some form of egress to the rear of the property
along the property lines for a safety factor when he
submits his building plans.

Springs; discussion took place on final plats for
River Oaks, Creek Island and San Sebastian Lakes; and
Randy Mosby, Mosby and Associates, responded to
questions from Council.

I move to direct the City Manager to go out to
bid for the centerline striping for Easy Street,
Main, Fleming Street and Barber Street.
In response to the City Manager, Vice Mayor Oberbeck
reiterated that his motion included centerline and
stop bars but excluded edging. The City Manager
requested that staff be allowed to use its judgment
regarding including other types of painting such as
arrows, etc.

Other Matters
Mayo~ Conyers requested updates on proposed cemetery
maintenance and stated that the City Attorney would
give a written opinion on signature of contracts.
The City Manager said the bid notice for cemetery
maintenance is nearly completed.
COUNCIL MATTERS
A. Vice Mayor Oberbeck
Vice Mayor Oberbeck said he had received a letter
from an employee regarding employee holiday
celebrations and would submit it to the Clerk's
office for distribution to Council for next week.

Councilman Rondeau. Council extended its regards to
him and offered any assistance it may lend.

Councilman Powell requested an update on the HRS
letter of non-compliance. The City Manager said he
would report under his matters.

10. CITY ATTORNEY MATTERS
The City Attorney read a certified letter he received
from Harry Thomas, Jr. regarding a past auto accident
which requests him to direct the Police Department to
issue a citation, which he stated, he does not have
the authority to do. Council concurred that he take
no action but that the City Manager forward the
letter to the Chief of Police.

The City Attorney said he would be attending an
institute from January 7 through January 11, 1991 and
that Attorneys Torpy and Driscoll will attend the
January 9, 1991 City Council meeting.

compliance from HRS regarding fuel and oil storage
tanks at the city garage and recommended that Council
authorize him to draft a compliance letter to advise

HRS that the city is preparing to go to bid to
correct violations and that the city will implement
better record keeping at the facility.
Vice Mayor Oberbeck stated that Envirex of Vero Beach
is willing to do an operational audit at no cost to
the city and turned over the name to the City
Manager.
Mayor Conyers commended City Council and staff for
producing such a large amount of activity in 1991.
Being no further business, Mayor Conyers adjourned
the meeting at 9:12 p.m.

This is in response to your request for the City to construct a
fence along the rear property line of your property located at
the interseotion of Kildare and Schuman. I have reviewed this
request with the City Council at the Workshop Meeting of October
3, 1990. We feel that the City should not construct such a fence
at our expense in that it would serve a very limited public
purpose. While we wish to be g6od neighbors with you, we cannot
honor your request at this time.

BASKETBALL COURT ADJACENT TO PROPERTY AT THE CORNER OF
SCHUMANN DRIVE AND KILDARE STREET.
In reference to your letter dated October 5, 1990, I would
request to be placed on the agenda for City Council at the
earliest possible time. As agent for Mrs. Lutkemeier, I feel it
is imperative that we reach a more equitable agreement as to
placing a fence around the basketball court immediately behind
Mrs. Lutkemeier's property.
As there is no fence around the basketball court now, there
is nothing preventing a stray basketball from doing damage to
Mrs. Lutkemeier's property. Also, we feel the City is placing
Mrs. Lutkemeier in a liability position unnecessarily as a
youngster could be injured while retrieving a ball from her
property, thereby leaving Mrs. Lutkemeier open for a lawsuit. We
all know that it doesn't take much today for some people to file
a lawsuit.
I do note that the original request, of which I was not a
part, asked that the City erect a fence along the rear property
line of the residence. I agree that it is difficult to justify
such a request as it does not correct the problem at hand. I
believe it would be more appropriate to request that the City
erect a chain link fence, ten (10) feet in height, around the
basketball court. This would practically eliminate any
possibility of an errant basketball leaving the basketball court.,
thereby protecting Mrs. Lutkemeier's property, and removing the
need for any youngster to chase a ball either onto Mrs.
Lutkemeier's property or into the street. Also, I think it is a
common enough practice that the City encloses its recreation
areas in a fence to request that the same be done in this
instance.

SUMMARY STATEMENT
At the September 26, 1990 Regular City Council meeting, the City
Attorney was instructed to review possible restrictions on
political signs in certain areas of the city.
A recommendation from Planning and Zoning was placed on the
December 12, 1990 Regular City Council meeting agenda, however,
subsequent to discussion on the matter, the City Attorney had
drafted a proposed ordinance for review and the Director of
Community Development recommended that the item be deferred to
the January workshop.
The proposed ordinance was distributed for Council review on
December 13, 1990.
Please note that paragraph five on page four of the proposed
ordinance does not indicate a bond amount. The City Attorney
requested input from staff on this item and the City Clerk feels
that the current $25.00 sign bond is sufficient.
RECOMMENDED ACTION
If Council concurs with the ordinance, set first reading on
January 9, 1991 and public hearing on January 23, 1991.

WHEREAS, the City Council has determined that it is in the
best interest of its residents and the public to prohibit the
placement of political signs on all publicly owned property,
including streets, rights-of-way, easements and everything affixed
thereto and thereover, in order to protect the motoring public from
distraction and items blocking their vision, to avoid sight
pollution, to avoid litter and to provide better aesthetic quality
in the City of Sebastian~ and
WHEREAS, the City Council has determined that the regulation
of political signs in residential districts and non-residential
districts should be imposed to reduce litter, reduce sight
pollution and to improve the aesthetics of the City of Sebastian
for the welfare of the public~ and
W~.P~AS, the City Council had directed the City Staff and the
City Attorney to review the regulation of political signs and
surrounding communities in order to prepare regulations which would
accomplish the goals of the City Council of the City of Sebastian
to protect the welfare of the public while considering regulations
of other communities in the area.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN,
INDIAN RIVER COUNTY, FLORIDA, that:
Section 1. Section 20A-15.3 of the Sebastian Land Development
Code is hereby amended in part to read as follows~

defeat of any candidate seeking any political
office, or urging the passage or defeat of any
ballot measure, but does not include any billboard
owned or maintained by a co,..ercial firm or
advertising company.
Public Property. All publicly owned property,
including streets, rights-of-way, easements, and
everything affixed thereto and thereover."
Section 2. Section 20A-15.6B of the Sebastian
Land
Development Code is hereby amended in its entirety to read as
follows:

be posted on or over any public property, as
defined in Section 20A-15.3.
Political Signs in Residential Districts.
Political signs in residential districts are
allowed subject to the following provisions:

Post~nq Time Limits. It shall be unlawful
for any person to post a political sign more
than thirty (30) days prior to the election
in which the candidate's name or the issue
will appear, and it shall be unlawful to fail
to remove a political sign within five (5)
days after the election in which the
candidate is eliminated or elected or the
issue is approved or disapproved.

Removal Bond. Prior to the placement of a
political sign or signs, a bond or cash
payment of $ shall be
posted with the City. The security may be
forfeited in whole or in part for any of the
following=
(a)
Failure to remove all signs within
the applicable five (5) day period for
removal;
(b)
Placement of signs upon public property
or upon any tree, utility pole, or
similar object.
(c)
Placement of signs upon private property
without the express consent of the
property owner.
(d)
Authorizing placement of a sign or
allowing a sign to remain in violation
of this section for more than two (2)
days after notification of the violation
by the building official or his
designee.
Prima Facie Evidence. Political signs placed
in violation of this section which advertise
a particular candidate or ballot measure
shall be prima facie evidence of the
placement or authorization of the placement
of the sign by the candidate or the president
of the committee supporting or opposing the
ballot measure, as applicable.
Removal of Illegal $iqns. The building
official shall order the immediate removal of
any political sign found posted within the
City in violation of this section. If the
sign is not removed within two (2) days, the
building official or his authorized agents
shall remove the political sign.
Reimbursement for Removal E.x~ense. The
candidate or the president of the committee
supporting or opposing the ballot measure, as
applicable, shall reimburse the City for any
and all expenses of removal incurred by the
City over and above any bond or cash deposit
coverage.

9. Violations. Any violation of the provisions
o£ this paragraph shall be subject
punishment by a fine not to exceed Five
Hundred and 00/100 Dollars ($500.00), or by
imprisonment in the county Jail not to exceed
sixty (60) days, or by both such fine and
imprisonment."
Section_~. CONFLICT. Ail Ordinances or parts of Ordinances
in conflict with the provisions of this Ordinance insofar as they
conflict are hereby repealed.
Section 4. CODIFICATION. It is the intention of the City
Council of the City of Sebastian, Indian River County, Florida, and
it is hereby provided that the provisions of this Ordinance shall
become and be made a part of the Land Development Code of the City
of Sebastian, Florida~ that the sections of this Ordinance may be
renumbered or relettered to accomplish such intention~ and the word
"Ordinance" may be changed to "Section," "Article" or other
appropriate designations.
S.ection 5. SEVERABILIT~. In the event a court of Competent
Jurisdiction shall hold or determine that any part of this
Ordinance is invalid or unconstitutional, the remainder of the
Ordinance shall not be affected and it shall be presumed that the
City Council of the City of Sebastian did not intend to enact such
invalid or unconstitutional provision. It shall further be assumed
that the City Council would have enacted the remainder of this
Ordinance without said invalid and unconstitutional provision,
thereby causing said remainder to remain in full force and effect.
Section 6. EFFECTIVE DATE. This Ordinance shall become
effective immediately upon its adoption.

SUMMARY STATEMENT
At its regular meeting of November 14, 1990, the City Council adopted
Resolution R-90-46 which, approved the Preliminary Development Plan for
Chesser's Gap Plan Unit Development. Due to the engineering and
restraints from St. Johns Water Management and the City of Sebastian
concerning the storm water requirements for the subdivision, the applicant
must construct three retention areas (lakes) to satisfy these
requirements. Due to the amount of the fill that must be removed for
these lakes, this is now considered a sand mining permit as defined within
Section 2OA-5.20 of the Land Development Code. The Planning and Zoning
Commission on December 6, 1990, recommended to the City Council to approve
the special use permit for the sand mining.
RECOMMENDED ACTION
Move to direct the City Attorney to draft a resolution for the special use
permit and set the public hearing for January 23, 1991.

SUMMARY STATEMENT
The applicant, Janee T. Morchesky, has submitted a Preliminary Subdivision
Plan and a Sand ~{ining Permit which, the Planning and Zoning Commission
has recommended approval for both applications. Due to the existing
topograph, the applicant must cut down the grade by removing 82,000 cubic
yards of sand in order to properly engineer and develop the subdivision.
The City Attorney is of the opinion that Mrs. Morchesky may proceed with
the sand mining permit application for her property excluding the out
parcel of land that is still in question, concerning whether it has been
properly annexed within the City of Sebastian. ]4rs. Morchesky and the
adjacent property owners, Jo Flatt and Tony DeCristafuro, are %{orking
together to build an industrial subdivision between both properties. Even
though the two properties will interconnect with a right-of-way, this
project has been filed separately from the adjacent property owner.

SUMMARY STATEMENT
The applicants, jo Platt and Tony DeCristafuro, have submitted a proposed
Preliminary Subdivision and a sand mining permit which, the Planning and
Zoning Commission has recommended approval for both applications. Due to
the existing topography, the applicant must cut down the grade by removing
approximately 610~ cubic yards of sand in order to properly engineer and
develop the subdivision. The applicants oX this property and the adjacent
property owner, Mrs. Morchesky, are working together to build an
industrial subdivision between both properties. Even though the two
properties will interconnect with the right-of-way, this project has been
filed separately ~rom the adjacent property owner. Until the annexation
of the out parcel for Mrs. Morchesky is cleared up, the Preliminary
Subdivision Plats will not be forwarded to City Council on both
properties.
RECOMMENDED ACTION
I-love to direct the City Attorney to draft a resolution for the sand mining
permit and set the public hearing for January 23, !991.

On March 28, 1990, the City Council approved the Preliminary Subdivision
Plat for San Sebastian Springs, Unit 4 "River Oaks". Construction of the
subdivision improvements has now been completed and the applicant, Dr.
Henry Fischer, is requesting approval for the final plat for River Oaks.
The applicant has constructed water lines for the subdivision, but the
Land Development Code (Section 20A-17.1) will require him to deposit in
escrow with the City for the purpose of constructing a treatment system
and fire hydrants, the amount of the cash or a guarantee acceptable to the
City equal to one hundred ten (110) percent of the system's estimated
construction and installation costs as certified by the project engineer.
The cash or other guarantee for water treatment should be a condition of
the approved resolution. In addition, the applicant is requesting a
waiver form Section 20A-17.1 of the Land Development Code which requires
street lighting within the subdivision. The applicant proposes to place a
note on the plat requiring all individual lots to provide driveway
lighting. This would be consistent with the Fischer Island portion of San
Sebastian Springs whereas, the City Council waived the street lighting
requirement.

SUMMARY STATEMENT
The City Attorney apprised the City Council. recently concerning a problem
with a previous adopted ordinance that annexed 10 acres of property owned
by Mrs. Janee T. Morchesky. Due to no fault by City staff, an erronous
map was utilized in the advertisement of the annexation for Mrs.
Morchesky which, represented an out parcel of land of approximately I acre
in size. The City Attorney has written to the Attorney General, Mr.
Butterworth, for an opinion concerning this matter. The applicant has
chosen to proceed with reapplying for the annexation, land use and zoning
amendment to this property. Since this land use amendment will require
the Department of Community Affairs approval and the deadline for
transmitting to the Department of Community Affairs is January 31, the
applicant wishes to proceed in this matter in case an unfavorable opinion
is forwarded by the Attorney General. The City Attorney has advised the
City Clerk's office that he would not object to taking the previous
ordinances adopting the annexation, land use and zoning amendments and
assigning new ordinance numbers and effective dates.
RECOMMENDED ACTION
Move to direct the City Clerk to prepare ordinances for first reading and
first public hearing on January 23. 1991.

Mayor Conyers asked staff to find out the costs of striping newly
paved streets within the City, especially Easy, Main and Barber.
The attached proposal from Anderson Asphalt Maintenance, whom we
have used in the past, is broken down to a unit price per item.
in reviewing this item with the Mayor, we can save considerable
money by deleting the solid white edge line. The following is a
summation of the Anderson proposal:

Attached is a proposal from Anderson Asphalt Maintenance, Inc.,
whom we have used in the past for street striping. As a minor
collector street, I do not recommend that we stripe Easy Street.
If we stripe Main Street and Barber Street, I would recommend
that we do center lines and stop bars only and delete the four
(4)inch wide solid edge line.
I would like an opportunity to review this matter with you and
