This letter is to request an extension of the site plan
for San Sebastian Springs - West, an 80 acre residential
development.
This project is 75% complete in digging lake, the roads
are bedded up, with 25% of project remaining to be done.

SUMMARY STATEMENT
The CitE Council approved the preliminarg plat for San Sebastian Springs West on October 28, 1987.
The actua/ construction of the subdivision is active and is approximately 75% comp/eted.
Section 20A-16.4(E) of the Land DE,elect Code requires a/1 prel/m/narg plats to be c~p/eted within
18 manths from the date of approval, unless the a~Dlicant ~quests an extension 90 days pr/or to the
expiration of the prelimi~ plat.
EVen though this ~equest is not within the ~ restraints, I can not find any documantat~on that
the applicant was informed of this re~t.
Since the subEivision regulations have not been amanded f,u,, the original date of approva2 (10/28/87),
I would recom~and a 12 m3nth extension be granted.
RECOMMENDED ACTION

The City Council approved Ordinance 0-88-45 on December 7, 1988 for the Sebas~an Lakes P.U.D.. The
approval of the P.U.D. included a tmmporarg R.V. storage facility for twelve (12) m~nths. The R.V.
facility was to z~locate from the exterior boundaries of the P.U.D. to a suitable location that would
not be visible frcm the adjacent neighboring properties. The e~gineer for Sebast/an Lakes has r~quested
to extend the use of the R.V. area until June 7, 1990.
RECOMMENDED ACTION
Move to grant the tmmporarg use of the R.V. storage facility until June 7, 1990.

Dear Mr. Cooper:
it has recently come to our attention that City Ordinance 0-88-q5 includes a paragraph
providing a temporary storage for RV vehicles. The permitted use for this purpose ends
December 7, 1989. Since we only received a copy of this ordinance a few days ago, we
request that the storage permit be extended to June 7, 1990 in order to give the owner
time to make other arrangements for RV storage on his property.

AN O~DINANCE AMENDING O~DiNANCE NO. 202-8, THE SAM~
BEING AN ORDINANCE OF THE CITY OF SE~STIAN, INDIAN
RIVER COUNTY, FLORIDA, IN EXISTENCE BEFORE THE ADOPTION
OF THE LAND DEVELOPMENT CODE OF T~ CITY OF SEBASTIAN;
PERTAINING TO THEAMENDMENT OF A CONCEPTUAL DEVELOPMENT
PLAN; IMPOSING RESTRICTIONS AND CONDITIONS; PROVIDING
FOR REPEAL OF ORDINANCES OR PA~TS OF ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council, in Ordinance No. 202-8, had
previously approved the Conceptual Development Plan submitted by
Arrowhead Lake Estates, a Florida General Partnership, and the
Preliminary Development Plan submitted Arrowhead Lake Estates,
subject to stipulations which the City council determined to be
in the best interests of the City of Sebastian; and
WHERF2%S, the applicant, Sebastian Lakes Associates, has
submitted a proposed amendment to the Conceptual Development
Plan; and
WHEREAS, the Staff and the Planning and Zoning Commission
has reviewed the proposed amendment to the Conceptual Development
Plan submitted by sebastian Lakes Associates, and has recommended
its approval with some stipulations; and
WHEREAS, the City Council has reviewed the proposed
amendments to the Conceptual Development Plan and has held a
Public Hearing on such amendments; and
WHEREAS, the City Council has found and determined that the
proposed amendments to the Conceptual Development Plan meet the
requirements of the Land Development Code of the City of
Sebastian, Indian River County, Florida, subject to the
stipulations which were recommended by the Staff and the Planning
and Zoning Commission, and has determined that the proposed
amendments to the Conceptual Development Plan, with the
stipulations, are in the best interests of the City of Sebastian
and should be approved subject to such stipulations.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows:
SECTION 1. That the existing Section II of Ordinance No.
202-8 is hereby repealed in its entirety and the following
Section II to Ordinance No. 202-8 is hereby created to read as
follows:
"SECTION II
(a) The proposed Revised Conceptual Development Plan, as
submitted by the applicant, Sebastian Lakes Associates (the
"Applicant"), is hereby adopted and approved and shall be carried
out in every manner consistent with the requirements of all
regulations and ordinances of the City of Sebastian, but shall be
sub~ect to all of the following conditions:
1. Compliance With Land Development Code.
The Applicant shall comply with ell provisions of the Land
Development Code of the City of Sebastian.
2. Transportation Improvements.
A. The Applicant shell transfer funds to an escrow
account with Indian River County, Florida, in an amount
sufficient to pay for the obtaining of complete signalization of
the intersection of County Road 512 (Fellsmere Highway) and
Roseland Road, prior to the issuance of any building permits in
the commercial zone. The Applicant shall sct in good faith in
working with the Planning end Building Staffs of Indian River
County, Florida, in determining the smount of funds needed for
the complete signalization of such intersection.
B. The Applicant shall construct the improvements to
Laconia Street at their expense. Such improvements shell extend
from County Road 512 (Fellsmere Highway) to Grandeur Avenue. The
improvements shall include~ (1) e sixty (60) foot right-of-way
which shall be deeded to the City of Sebastian~ the construction
of additional roadway whereby Laconia Street shall become a two
(2) lane road, thus requiring new construction of one-half (1/2)
of said roadway and a complete total overlay of asphalt whereby
the completed two (2) land road shall have a width of twenty-four
(24) feet~ and (3) the construction of the extension of Roseland
Road from County Road 512 (Fellsmere Highway) to a point
approximately three hundred (300) feet south of County Road 512
to allow access to the first phase of the commercial area and the
library site. All of the foregoing improvements shall meet the
specifications promulgated by the Florida Department of
Transportation and shall be completed prior tO the issuance of
any certificates of occupancy in Phase I of the commercial
development.
C. The Applicant shall provide, at its expense, all
other improvements required by Indian River County, Florida,.
D. The remainder of the Roseland Road extension es
described in the amended Conceptual Development Plan submitted by
the Applicant shall be completed prior to issuance of any
certificates of occupancy in Phase II of the commercial zone.

The Applicant shall be permitted to utilize the area
indicated on the amended Conceptual Development Plan as a
temporary RV storage area for a period of one (1) year from the
effective date of this Ordinance.
4. Development Schedule.
A development schedule indicating the approximate starting
and completion dates has been submitted to the City of Sebastian
as a part of the amended Conceptual Development Plan. If
subsequent changes in the schedule are proposed in the future,
such changes shall be submitted to the City of Sebastian in an
expeditious manner to assure effective communications concerning
any potent£al problems or issues associated with the development.
(b) It is acknowledged that Tract D of the Planned Unit
Development contained in the original Conceptual Site Plan has
previously been approved for final plat by the City Council, and
Tract G of the Planned Unit Development contained in the original
Conceptual Site Plan has previously been approved for e
Preliminary Development Plan. Therefore, Tracts D and G are not
affected by the amendments to the Conceptual Site Plan which is
hereby adopted.
SECTION 2. CONFLICT. Ail ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3. ~.
In the event a court of competent jurisdiction shall hold or
determine that any part of this Ordinance is invalid or
unconstitutional, the remainder of the Ordinance shall not be
affected and it will be presumed that the City Council of the
City of Sebastian did not intend to enact such invalid or
unconstitutional provision. It shall further be assumed that the
City Council would have enacted the remainder of this Ordinance
without said invalid and unconstitutional provision, thereby
causing said remainder to remain in full force and effect.
SECTION 4. ~.
This Ordinance shall take effect immediately upon final
passage.

SUMMARY STATEMENT
At the final negotiating session with the C.W.A., held on August 1,
1989, I agreed to review and evaluate various requests for new
personnel and re-classification of certain existing positions after a
review of the financial statement of September 30, 1989. I agreed to
meet with representatives of the C.W.A. by November 30, 1989. On
November 21, 1989, I met informally with the C.W.A. and reviewed
requests for re-classifications and new personnel as well as
discussing some concerns about the job descriptions for Maintenance
Worker I, II and Iii classifications. In reviewing the departmen~
head requests in conjunction with year end operating statements, it is
my conclusion that some $80,000 could be added to general operating
expenses for personnel and that some $35,000 in operating expenses
for personnel could be added to the Golf Course Fund. My
recommendations as well as the department head justifications are
outlined in the attached documents. Any approval of these by the City
Council would be subject to approval of a budget amendment approved by
the City Council.
RECOMMENDED ACTION
Move to concur with request of City Manager in approving new personnel
positions and in re-classifying certain existing personnel positions,
subject to approval of a budget amendment appropriating funds for

Informal meeting between CWA and City Manager regarding the City
Manager's recommendations in re-classifications for positions
within the CWA Bargaining Unit.
City Manager will recommend that the Maintenance
Worker I position in the Street Department for the
Street Sign Shop be re-classified to a Maintenance
Worker II.
City Manager will recommend that the Maintenance
Worker II in Park Department be re-classified to
Maintenace Worker III upon opening of Phase I (Sr.
League and Little League) at the Barber Street
Sports Complex (approximately 2/1/90).
The City Manager will not recommend re-
classification for the Maintenance Worker II
position in Building Maintenance at this time.
It is understood that City Manager may make other
recommendations for new or re-classifications for
positions from the listing in his memo to CWA dated
11/20/89.
The City Manager (although Management Rights) will

It cannot be overemphasized that training is critical to the operation of
a police agency. The more the better. A police officer cannot be
overtained in general items. He/she can be wrongly trained or ._poorly
trained, but never does an officer end the training process."
"It w~uld be possible to fill pages on this matter. Suffice it to state
that if the Sebastian Police Department is going to improve it must set
training as a key and concentrate efforts on upgradin§ its officers."
"A training coordinator position should be created at the Lieutenant
level (this also opens tw~ promotional opportunities). This _position
would be responsible for developing a trainin§ program and for conductin§
field training for new officers."
I agree with the above statement except for the rank recc~mendation. I
feel this position would call for the rank of Sergeant not that of a
Lieutenant and that this would open only one position for promotion. I
also feel that this position could be used for additional
responsibilities such as Community Relations, Crime Watch, School
Resource Officer and Crime Stoppers Officer.

POLICE D~CITVE
IMPACT STATemENT:
During Fiscal Year 1988/89, this City experienced
increased rates in crime trends. The crime rate for
1987/1988 has increased by 32%, and with the
continued increase in the population of Sebastian
(The 1980 census showed a population of 2,200. The
current estimates of population is 8,800 with a 1990
projection of 11,900) this trend of increased crime
will climb, especially if the drug problem and use
of crack cocaine continues to increase.
Trends in law enforc~nent are clear with regard to
the threat posed by narcotics laws violators. ~lese
criminals are in our community and frequent our City
on a constant basis. To believe otherwise is
ignoring the reality of the ever increasing drug
problem.
With the addition of this Detective, the Department
will have the capacity to aggressively investigate
and prosecute narcotics law violators.
A realiqnment of responsibilities within the
Criminal Investigations Section would find this
Detective assiqned with one of the existing three
investigators (to be selected) to form a two person
element specifically targetted against the illicit
narcotics trade.

During Fiscal Year 1988/89, this City experienced

In 1988, this Department answered 15,073 calls for
police service, also during this time this Department
had twenty-two sworn officers.
For the year, 1989, October 10, this Department has
answered 35,879 calls for police service with only
twenty sworn officers.
With the addition of four sworn officers we will be
able to provide adequate police services to the
coca, unity.
Additions to the staff of the police department are
going to be expensive, but one need only weigh the
cost of crime against the improvements and it becomes
clear that these officers will be a necessary
investment.

During Fiscal Year 1988/89, this Department
experienced a phenomenal increase in police calls for
service. During the calendar year 1988, this
Depa~h,~nt responded to 15,073 calls for service. So
far this year, as of May 11, 1989, we have responded
to 10,793 calls for service, which means that by the
end of December 1989, the Department will have
answered well over 42,000 calls for police service.
This is an increased work load on the administrative
personnel as well.
The record clerks have to handle each of these reports
loggin§, typing, filing and placing the required
information in the Criminal Justice System's computer.
This additional records clerk would also be identified
as the Criminal Investigative Unit Clerk, and would
type all C.I.U. reports prior to filing them with the
State Attorney's Office.

Pursuant to our recent conversations, this will confirm my
request to reclassify Linda Kinchen, upgrading her to an
;~inistrative Assistant position.
As we discussed, this can accomplish at least two things:
1)
It will effectively recognize the knowledge and type of
contribution she makes (and has been making for some
time now) to the Engineering/Public Works Depa~,~nts
on a daily basis; and
2)
If she is further supported by one additional clerical
person, her extensive backgound knowledge can be put to
more effective ~se in project management/coordination/
expediting type rdles.
As you know, Linda is now serving on Jury duty and is not
expected back to work full time for at least another two
w~eks. When she returns, I would like to discuss the entire
situation with her and with you at length. This to make sure
we work out and understand what the expectati~ are on all
sides.
Following that scenario and the c6mpletion of all appropriate
paperwork (including close review of the specific Job
description), I expect to ask for your formal approval of
same, probably some_time during the first two weeks of
October.

The job descriptions for Public Works Maintenance Workers I, II
and III have recently been reviewed and updated to better reflect
the use of these classifications for all Public Works
Departments. The current job descriptions generally reflect the
positions for the Street Department but do not neoessarily
reflect similar positions in the Park, Building Maintenance and
Cemetery Departments. I have drafted proposed 3ob descriptions
utilizing the Florida League of Cities "benchmark" job
descriptions and the current city job descriptions.
RECOMMENDED ACTION
Move to adopt Resolution R-89-64 adopting new 3ob descriptions
for the positions of Maintenance Worker I, Maintenance Worker II
and Maintenance Worker III.

A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, ADOPTING NEW JOB DESCRIPTIONS FOR THE
POSITIONS OF MAINTENANCE WORKER I, MAINTENANCE WORKER
II AND MAINTENANCE WORKER III; PROVIDING FOR INCLUSION
OF SUCH JOB DESCRIPTIONS IN THE CITY OF SEBASTIAN
STANDARD OPERATING PROCEDURES; PROVIDING FOR REPEAL OF
RESOLUTIONS OR PART OF RESOLUTIONS IN CONFLICT
HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE.
W H E R E A S, The current job descriptions for the
"Maintenance Worker" I, II, and III classifications adequately
reflect positions for Street Maintenance Department, but they do
not necessarily complement positions in other Public Works
Departments such as Park, Cemetery or Building Maintenance; and
W H E R E A S, The City Council hereby approves the new 3ob
descriptions entitled Maintenance Worker I, Maintenance Worker
II and Maintenance Worker III, as recommended by the City
Manager.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS:
SECTION I. The 3ob descriptions for the classifications
of Maintenance Worker I, Maintenance Worker II and Maintenance
Worker III, attached hereto as Exhibit "A", Exhibit "B" and
Exhibit "C" respectively, are hereby adopted.
SECTION II. The City Clerk is hereby directed to supply
copies of the new 3ob descriptions to the Mayor and members of
the City Council and all department heads for inclusion in the
Standard Operating Procedures for the City. The City Clerk shall

note the number and date of this Resolution on said
descriptions.
SECTION III. All Resolutions or parts of Resolutions in
conflict herewith are hereby repe~led.
SECTION IV. This Resolution shall take effective
immediately upon its adoption.

MAINTENANCE WORKER I
MAJOR FUNCTION: Unskilled and limited semi-skilled manual work
involving laboring tasks and construction and maintenance work.
Some assignments include operation of light automotive equipment.
Duties can be readily learned on the Job and are performed under
direct supervision.
ILLUSTRATIVE DUTIES: Patches holes in street with asphalt;
installs street signs; clears brush from roadside; loads and
unloads heavy material from trucks; moves equipment and large
bulky objects; maintains building facilities and grounds; may
operate tractor-mower, small truck and hand tools. Performs
related work as required.
KNOWLEDGE, SKILLS AND ABILITIES: Working knowledge of simple
tools used in maintenance and construction work and related
occupational hazards. Ability to follow and understand
instructions. Sufficient physical strength, agility to do heavy
manual labor.
EDUCATION: Sufficient education to provide ability to read
instructions. Valid Florida Driver's License required.

MAINTENANCE WORKER II
MAJOR FUNCTION: Heavy manual work involving semi-skilled
maintenance and construction tasks requiring use of tools,
equipment and light automotive equipment. Work is performed under
general supervision in accordance with specific instructions and
defined procedures.
Limited supervisory work assisting and directing the activities
of laborers. Work is reviewed in progress under general
supervision and upon completion.
ILLUSTRATIVE DUTIES: Removes, cleans, adjusts mechanical
equipment and assists in a variety of trade and craft areas;
maintains condition of tools and equipment; operates hand and
power tools, tractors, mowers and equipment; performs maintenance
on public streets, drainage, municipal buildings, equipment, or
grounds and properties.
Supervises personnel involved in construction, maintenance and
repair tasks; inspects work in progress; modifies or adjusts work
methods, assignments, crew sizes; keeps time and material
records; determines need for equipment, repair; trains and
instructs subordinates. Performs related work as required.
KNOWLEDGE, SKILLS AND ABILITIES: Working knowledge of power tools
and equipment used in street, drainage, building and grounds
maintenance and related occupational hazards. Skill in the
operation of power tools and equipment. Ability to operate
trucks, small rollers, tractors and similar automotive equipment;
to understand and follow oral and written instructions; to plan,
assign and supervise the work of several laborers. Physical

MAJOR FUNCTION: Limited skilled manual work in maintenance and
repair tasks involving advanced laboring tasks requiring special
knowledges acquired through training or work experience. May be
assigned to operate equipment on a regular basis for specific
construction and maintenance activities. General supervision
received in accordance with specific instructions and defined
procedures.
Responsible supervisory work planning, coordinating and
organizing the work of employees involved in construction,
maintenance or repair tasks. Policy guidelines are established
by supervisors but considerable independent 3udgment is
exercised; work in the operation and basic maintenance of simple,
complex and heavy trucks and maintenance equipment. Involves
responsibility for safe and efficient operation of equipment and
safety of passengers and helpers. Work is reviewed through
personal inspection and observation of compliance with
established work schedules.
ILLUSTRATIVE DUTIES: Supervises and may participate in
construction, maintenance and repair of streets, public works
pro3ects, grounds, buildings or systems equipment. Operates
complex to heavy automotive and maintenance equipment such as
large trucks, construction equipment, graders, loaders, bulldozer
and backhoes.
KNOWLEDGE, SKILLS AND ABILITIES: Knowledge of department methods,
operating rules, equipment; construction and maintenance
techniques and procedures; of related occupational hazards and

This is highly skilled work in heavy equipment operation

ILLUSTRATIVE DUTIES:.
Operates frontend bucket loader, grader, mowtrim, dumptrucks,
bulldozer, backhoe and all other equipment of public works
department including power mowers and other equipment that
is attached to ti~e large tractors.
Performs related work as required and assigned by the Public
Works Director.
MINIMUM QUALIFiCAITONS:

Considerable knowledge of operating heavy equipment and using
various types of digging and cutting machinery. Ability to
make independent judgements and follow directions both verbal
and written. Ability to interpret engineering drawing and
maps.
Education and Experience:
Five years experience operating tractor type and other types
of equipment. Prior experience as Maintenance Work II desired.
Must have a high school diploma or an equivalent combination

Due to the Growing concern for the visual character of the City
resultinG from ever increasing growth and development, the
establishment of an Architectural Review Board acting in an
advisory capacity to the Planning and Zoning Commission has been
recommended following lengthy discussion at both Regular and
Workshop PlanninG and Zoning Meetings.
RECOMMENDED ACTION
Concurrence with the PlanninG and Zoning Commission's motion to
direct staff to prepare the necessary implementing Resolution.
The Resolution would first be reviewed by the Planning and Zoning
Commission for recommendation to the City Council.

FOREWORD
October 12, 1989
This document is a wo,'kiug paper, intended as the ini.tial means of
communicating recommendations from tim Citizens for Beautiful Sebastian
Committee to the City of Sebastian Staff, Planning and Zoning Commission
and then to the City Council.
It is presented as a stand alone document so that all features are
organized in a logical sequence. It is 'recognized that its several
elements must later be selectively factored into the city's Land Develop-
ment Code.
Since city staff and sut,porting consultants are skilled in ordinance
structure, we ask that they apply their expertise to develop the final
form and content. However, this Committee does intend that either the
exact wording herein, or its essential equivalent, appear in any city
ordinance derived from these recommendations. The wording in the
Architectural Review Criteria section has been particularly chosen with
this intent in mind.
This is not to say that the contents herein are hard and fast-- the
nature of this initial document indicates flexibility. And to reach final
scope and phrasing, this Committee anticipates subsequent working
sessions and dialogue with all the city agencies involved and, equally
important, with local business and citizen interests,

ordinances of Florida cities, References are shown in square brackets.
The aim here is to utilize those approaches to civic architectural and
appearance control that have passed prior legal, civil and administrative
scrutiny in sister cities of similar size. We have no wish to set any
precedents with this document ...
This Committee solicits constructive feedback on this initial paper and
looks forward to preparing an updated and coordinated document for
subsequent implementation into city ordinances. We feel the time has
long been at band for the incorporation of architectural and appearance
standards for Sebastian's non residential developments.

RECOMMENPATIONS FOR,,~.~BASTI&.N ARCHITECTURAL REVIEW ORDINANCE
1o0 iNTENT - PURPOSE
The Sebastian Architectural Review Ordinance is intended to supplement the
Comprehensive Plan and Land Development Code of the City of Sebastian for the
following purposes:
(a) To promote and sustain the public health, safety, morals, comfort and general
welfare of the citizens of the City;
(b) To balance carefully the natural environment with manmade systems which
preserve, protect and conserve the natural environment;
(c) To attract new residents and businesses by reason of a desirable urban
environment;
(d) To minimize incompatible surroundings and visual blight which prevent orderly
community development and reduce community property values;
(e) To encourage and promote development which features amenities and excellence
in the form of variations of siting, types of structures and adaptation, to and
conservation of native vegetation and other environmental design features;
(f) Foster civic pride and community spirit by maximizing the positive impacts of
developments;
(g) To inspire creative approaches to the use of land and related physical
developments;
(h) To foster the development of a positive visual character for the City by
promoting a high degree of compatibility between land uses.
The preceding goals are intended to promote orderly growth, development
and placement of all non residential land uses so as to encourage a balanced
natural, physical and economic environment and advance the quality of life. for

1.1 DEFINITIONS
Proper Design Concepts -refer. s to architectural planning and to the analysis
of the whole structure in terms of form and composition, color, materials, and
surface decoration. It includes scale in relationship to scale of adjacent buildings,
structures and landscape. It applies to inner character of the individual project.
It applies in the same manner to alterations and advertising on the project. In
evaluating design concepts, no one will be permitted the excuse that the area
contains other unsightly buildings or structures. [Boca Raton]
2.0 ARCHITECTURAL REVIEW COMMISSION
There is hereby created an architectural review commission which shall consist
of five (5) members and one (1) alternate who shall all serve without compensation.

2,1 QUALIFICATIONS
All members of the commission shall be especially qualified by reason of
training or experience in art, architecture, community planning, property
development, real estate or other relevant business or profession, or by reason
of sound judgment to evaluate the effects of a proposed building or structure
upon property values, aesthetic compatibility and physical integration with
surrounding areas. Whenever possible the commission shall be comprised of
members with qualifications as follows:
One member should be an architect or architectural designer.
One member should be a landscape designer
One member should be a real estate professional
One member should be a land developer or contractor.
One member should be a citizen-at-large who has demonstrated a
interest or ability in artistic fields.

Additionally, all members of the commission shall be recognized as having, or shall
have demonstrated, an abiding interest in the betterment of the City of Sebastian.

2.2 APPOINTMENT
The members of such commission shall be appointed by the city council. The
commission shall elect a chairman and vice chairman from among its members. All
members shall vote. Three members shall constitute a quorum.
Of the members of the commission first appointed, one shall hold office for
the term of one year, two for the term of two years and two for the term of three
years from and after their appointment. Their successors shall be appointed for
the term of three years from and after the expiration of the terms of their
predecessors in office. If a vacancy shall occur otherwise than by expiration of
term, it shall be filled by the city council for the unexpired term. The city council
shall have power to remove any member of the architectural review commission for
cause. [Dania]
2.3 DUTIES - GENERAL
The Architectural Review Commission shall review the architectural and site
plans for all buildings and structures proposed to be constructed or revised in
non residential zoned areas to insure that buildings are aesthetically compatible

with the surrounding area, and to insure that such buildings and structures will
not adversely affect the surrounding area. [Pembroke Pines modified]
2.3.1 CONDUCT, OF BUSINESS
The Architectural Review Commission shall hold meetings when necessary, and
in a timely manner such that: (1) their recommendation will be available to the
regularly scheduled Planning and Zoning Commission meetings and, (2) their
meetings are in conjunction with the initial review procedure of a site plan by
city staff. [Pembroke Pines] Additional meetings shall be scheduled as necessary
by the chairman or by a quorum of members. [Greenacres]
The Director of Community Development shall designate a staff member to
record all minutes and transactions of meetings. [Greenacres]
All committee meetings shall be public. [Greenacres] Participation by the
applicant, his consultants, city staff and other interested parties is encouraged.

No decision of the commission shall be valid unless adopted by the majority
vote of the quorum present. No decision of the commission to recommend,
recommend with conditions or recommend denial of the site plans, in relationship
to the criteria and design standards herein, shall be valid unless such decision
receives a vote of at least three (3) members. [Greenacres]
Any applicant aggrieved by a decision of the Architectural Review Commission
shall have 10 days from the date of decision to appeal the decision to the City
Council. Appeals shall be in writing and shall be filed with the city clerk.

2.3.2 PROCEDURE"
A petitioner for a Site Plan Review (ref. Land Development Code, Section 20A-
l0) shall provide plan review packets for the Architectural Review Commission
which shall include a site plan to scale, a utility plan, architectural elevations
drawing, site vicinity sketch, landscape plan, sign details and such additional data
or photographs as the commission may believe are pertinent to the project. This
plan packet may be the same as submitted to the Planning and Zoning Commission
in accordanc~ with Section 20A-10.3 provided the information required by section
3.0 herein is included. [Greenacres modified]
The Architectural Review Commission shall meet not less than 10 days before
the submission of a site plan to the Planning and Zoning Commission. The
commission shall review the submitted plans in relation to the Criteria section (3.0)
of this ordinance and shall make findings in writing with respect thereto. The
recommendations may be approval, approval with conditions or denial. The
commission's written findings and recommendation shall be submitted to staff.

Unless plans, elevations and proposed signs for buildings or structures or
alterations thereto, have been approved by the Architectural Review Commission,
or by the City Council on appeal, no permit shall be issued for any building,
structure, sign or other development of property, or appurtenances or alterations
thereto. Architectural review may also be a requirement of a conditional use
permit, special exception or variance -- with the need being determined by the city
engineer and building official in conjunction with the chairman of the Architectural
Review Commission. [Dania modified]
When in the opinion of the city engineer and the building official, the
approval, of an application for a minor site plan does not defeat the purposes and
objectives of this section, they may approve the minor site plan in accordance with
the procedures of Land Development Code, Section 20A-10.1 (B) and (C) except that
the approval of the chairman of the Architectural Review Commission shall also be

3.0 ARCHITECTURAL REVIEW CRITERIA
The goal of this section is to ensure that all site plans and development
proposals have the highest possible appearance qualities and proper design
concepts through design concentrating on the interrelationship between structures
and their surroundings. This section establisheg the Criteria and Design Standards
that will guide the Architectural Review Commission in reviewing various aspects
of appearance within a site plan or development proposal. [Greenacres]
Architectural style is not restricted. Evaluation of the appearance of a
project shall be based on the quality of its design and its relationship to
surroundings. [Highland Park]
If the criteria herein are met, the site plan or development application shall
be approved. Conditions may be applied when the proposed building or structure
does not comply with this criteria and shall be such as to bring the subject
building or structure into conformity. If an application is disapproved, the
architectural review commission shall detail in its findings the criteria that are not
met. The action taken by the Architectural Review Commission shall be reduced to
writing and signed by the chairman and a copy thereof shall be made available to
the applicant upon request. [Dania]
3.1 SITING
The site shall be planned to accomplish a smooth transition from adjacent
properties that differ in land use and/or design philosophy by the use of site
breaks such as screens, be,'ms, fences and walls for aesthetic purposes.
[Greenacres] Site planning in which setbacks and yards are in excess of zoning
restrictions is encouraged to provide an interesting relationship between buildings.

Monotony of design in single or multiple building projects shall be avoided.
Variation of detail, form, and siting shall be used to provide visual interest. In
multiple building projects, variable siting or individual buildings may be used to
prevent a monotonous appearance. [Highland Park]
3.2 BUILDINGS AND STRUCTURES
3.2.1 OVERALL APPEARANG~
All 'facades visible to the public or adjacent property shall be designed to
create a harmonious whole. It ia not to be inferred that buildings must look alike
or be of the same style to be harmonious, Harmony can be achieved through the
proper consideration of scale, proportions, site planning, landscaping, materials and
color. [Boca Raton]
Look alike buildings are not allowed unless, in the opinion, of the Commission,
there is sufficient separation to preserve the aesthetic character of the present or
evolving neighborhood. This is not to be construed to prohibit duplication of floor
plans and exterior treatment in a planned development where, in the opinion of the
Commission, the aesthetics of the development depends upon or are enhanced by
the look alike buildings and their relationship to each other. [Boca Raton]
Building projections shall provide interest and variety through use of
windows, doors, eaves, and parapets. Building components shall have good
proportions and interesting relationships to help avoid monotonous building
elevations. Repetitious and bland elevations shall be avoided by providing
variation in details, form and siting, to promote visual interest. [Mesa, modified]
Materials shall be selected for harmony of the building with adjoining
buildings (where such structures are substantially in compliance with this section)
and shall be suitable to the type of building and design in which they are used.
Colors should be harmonious and shall use only compatible accents. Colors shall
not be garish and should blend with neighboring developments. [Hilton Head]
The quality of a new development shall not adversely affect the value of
surrounding properties. New projects shall use building materials of a similar or
higher quality than those used on adjacent properties. Details of the proposed
colors and materials shall be reflected on the building plans and color chips and
samples shall be provided. [Mesa]
FEATURES AND, COMPONENT~
Building components, such as windows, doors, eaves and parapets shall have
good proportion and relationship to one another. [Highland Park]
Building surfaces, walls and roofs that are considered garish by the
Commission will be denied approval. [Boca Raton]
Pitched roofs or the appearance of pitched roofs with a minimum slope of 5/12
are strongly encouraged. Long monotonous facade designs, including those
characterized by unrelieved repetition of shape or form or by unbroken extension
of line shall be avoided.
Buildings which are of' symbolic design for reasons of advertising will not be
approved by this commission. Symbols attached to buildings will not be allowed
unless they are secondary in appearance to the building and landscape and are an
aesthetic asset to the building project and neighborhood. [Boca Raton]
No advertising shall be allowed on any exposed amenity or facility such as
benches and trash containers. [Boca Raton]
Service areas and refuse containers shall be located to the rear of buildings.

Exterior lighting fixtures, street furniture, bike racks, and other exterior
features shall be compatible with and complementary to site and building design.

"Take out" or "pick up" windows of retail or wholesale establishments shall
not be located on a building facade that faces a public right of way, unless they
are designed as to be an aesthetic asset to the building and neighborhood. [Boca

All telephones, vending machines, or any facility dispensing merchandise or
a service on private property shall be confined to a space built into the building
or enclosed in a separate structure compatible with the main structure. [Boca
Raton] '
3.2.3 UTILITIES
l~lechanical equipment or other utility hardware on roofs, grounds or b'~ildings
shall be screened from public view with material harmonious and architecturally
compatible with the building, or they shall be located as not to be visible from any
public ways. [Highland Park] Screening shall have a height not less than the
equipment it screens. [Boca Raton Redevelopment]
All on-site electric utility, telephone, cable television lines and all other
communication and utility lines for buildings shall be placed underground.
Continuing use of overhead wires is discouraged. [l~lesa]
3.2.4 SCREENING
Refuse and waste removal areas, service yards, storage yards, delivery areas
and exterior work areas that in the opinion of the commission tend to be unsightly
shall be screened from view from public ways. Screening shall be accomplished by
the use of 90~ minimum opaque walls, fences, plantings or a combination of these
that are architecturally compatible with the building or structure. [Highland Park,

3.2.5 GASOLINE STATIONS
The following are added criteria for gasoline stations and those convenience
stores or similar establishments that have gasoline service facilities.
a. Symbolic color of th~ exterior facades or roofs may not be used unless they
are harmonious with the atmosphere of the surrounding neighborhood.
b. Exterior display of goods for sale or displays designating a service will
not be allowed, except that a display of goods and tools of a service may be
displayed on the pump island, provided the island is not considered by the
Commission to be enlarged to take advantage of this provision, and provided the
goods and tools be such that they can be used or installed at the island. For
example: An oil rack is acceptable, but a tire display is not.
c. Areas used to store materials such as mufflers, tires, packing crates or
cases, refuse and garbage, shall be screened from adjacent property and from the
public view as delineated in section 3.2.4 herein.
3.3 LIGHTING
Exterior lighting may be used to illuminate a building and its grounds for
safety purposes but in an aesthetic manner. Lighting is not to be used as a form
of advertising in a manner that draws considerable more attention to the building
or grounds at night than in the day. Lighting following the form of the building
or part of the building will not be allowed if in the opinion of the commission the
overall effect will be garish or detrimental to the environment. All fixtures used
in exterior lighting are to be selected for their aesthetic value. [Boca Raton]
Exterior lighting, when used, shall enhance the building design and the
adjoining landscape. Lighting standards and building fixtures shall be of a design
and size compatible with the building and adjacent areas. Lighting shall be
restrained in design and excessive brightness avoided. [Hilton Head]
3.4 SIGNS
[Note: This section comprises architectural and appearance
criteria for signs. It is intended to supplement the present
Sebastian sign ordinances. It is recommended the material
contained in Section 20A-15 of the Land development Code be
appropriately referenced herein; and that Section 20A-15.7(H),
"Appearance of Signs", be deemed redundant.]
Every sign shall be designed as an integral architectural element of the
building and site to which it principally relates. [Highland Park]
Free-standing signs should be designed as integral parts of the development
theme. Such should include the use of colors, materials, and features that reflect
the architectural character of the principal building or buildings. [Greenacres]
Every sign shall have good scale and proportion in its design and in its
visual relationship to buildings and surroundings. [Highland Park]
The overall effect of the configuration or coloring of signs shall not be garish.
The colors shall not conflict with the other signs already on the building or in the
immediate vicinity. [Boca Raton]
The colors, materials and lighting of every sign shall be restrained and
harmonious with the building and site to which it principally relates. [Highland
Park]
The number of graphic elements on a sign shall be held to the minimum
needed to convey the sign's major message and shall be composed in proportion to
the area of the sign face. [Highland Park]

Each sign shall be compatible with signs on adjoining premises and shall not
compete for attention. [Highland Park]
Identification signs of a prototype design and corporate logos shall conform
to the criteria for all other signs. [Highland Park]
We Strongly discourage the use of signs with internal illumination. Fl~shing,
visible moving or movable parts, moving messages, animated lights, or signs giving
the appearance of animation are disallowed. [Hilton Head, modified]
We encourage the use of signs with spot-lighting. All signs shall be designed
to shield the light from on-coming motorists and to conceal the light fixture to the
extent practicable. [Hilton Head]
3.5 LANDSCAPING
[Note: This section comprises architectural and appearance
criteria for landscaping. It is intended to supplement the
present Sebastian landscaping ordinances, it is recommended
the material contained in Section 20A-13 of the Land
Development Code be appropriately referenced herein.]
The site landscaping should be planned to accomplish a smooth transition
from adjacent properties that differ in land use and/or design philosophy by the
use of site breaks such as screens, berms, fences and walls for aesthetic purposes.

The existing natural landscape character shall be preserved whenever
possible. As an example of this, in a area containing a stand of trees, the
developer should preserve as many of those trees as possible and further
landscape in a complementary manner, rather than destroy the existing trees and
replant with a type of vegetation foreign to the immediate natural environment.
Relocation of existing trees is encouraged as opposed to their destruction. [Hilton
Head]
Parking areas shall be treated with decorative elements, building wall
extensions, plantings, berms or other innovative means so as to screen parking
areas from view from public ways. These areas and traffic ways shall be enhanced
with landscaped areas containing trees or tree groupings. [Hilton Head]
In areas where general planting will not prosper, other materials such as
fences, walls, and parings of wood, brick or stone shall be used. Carefully
selected plants shall be combined with such materials where possible. Plants that
are indigenous to the area and others that will be hardy, harmonious to the design,
and of good appearance shall be used. [Hilton Head]
There shall be an automate/d irrigation system provided for all landscaping.

The owner shall be .responsible for the maintenance of all landscaping.
Landscaping shall be maintained in a good condition so as to present a healthy,
neat and orderly appearance at least equal to the original installation and shall be
kept free from refuse and debris. Any dead vegetation and landscaping material
shall be promptly replaced with healthy, living plantings. [Boca Raton]

All landscaping materials shall be guaranteed by the owner of the premises
for a period of one year after the certificate of occupancy is granted. [Boca
Raton]
Interior areas of parking lots shall contain planter islands located so as to
best relieve the expanse of paving. We encourage parking layouts having no more
than 12 parking spaces in a row without a planter island. [Boca Raton modified]
Interior areas of vehicular use shall contain planter islands located so as to
best relieve the expanse of pavement. [Boca Raton]
BUILDING AND STRUCTURE I~IAiNTENANCE
The exterior of all commercial property shall be maintained so as to prevent
deterioration or blight.
(1) All exterior surfaces shall be free of chipping, pitting, cracking, discolor-
ation, peeling or fading.
(2) All exterior signs shall be in good repair and free of chipping, pitting,
cracking, peeling, fading or discoloration. Lighted signs shall have all lights
working.
(3) Doors and windows shall be free of cracked or discolored glass or
corroded frames.
(4) All awnings shall be without tears or holes and be free of dirt, discolor-
ation, fading, or cracking. Any lettering or painted surface on awnings shall
conform to paragraph (2} above. All hardware, supports, and poles shall be
straight, free of rust and in good condition.
(5) If any property is vacant for more than 30 days, all glass surfaces visible
to the public shall be clean and screened from the inside with a clean, neat-
appearing, opaque material and shall be kept in such condition until property is
occupied.
(6) All sidewalk overhangs attached to commercial buildings shall be structur-
ally sound and free of rust, discoloration, peeling, chipping, cracking, fading,
sagging or dirt. All lettering or signage overhangs shall conform to the require-
ments provided in paragraph (2) above.
(7) No air conditioner or heating or cooling device shall be installed so as
to be visible from the street, or so as to discharge condensation onto or so as to
discolor the building, sidewalk or street. [Surfside, items 1 - 7 above]

This view and recommedation are based on the following
reasoning:
It is not likely such a Committee will be allowed to
function with regulatory powers before the entire issue is
subjected to a great amount of additional study and
discussion. Even then, the chances are small of it being
authorized to proceed with regulatory powers, especially
with no local experience to act as a guide for
expectations and in view of the complications involved in
folding such regulatory powers in with the existing
Planning and Zoning Cc~mission process.
The Citizens Cc~mittee for a Beautiful Sebastian has done
an excellent job in formulating a set of very w~rthy goals
and objectives on the matter. It has also outlined a very
useful body of substantive infomation and guidelines,
much already proven to be effective in other towns and
cities. If an Architectural Review Cc~nittee does not go
forward in sc~e capacity, albeit advisory only, the
worthwhile work of the Citizens Cc~mittee will not be
utilized to its fullest.
Regulatory "teeth" should not be lightly formed or given
to any public body, at least not without the exercise of
judgment as fully informed as possible. Authorizing a

Committee is allowed to function in an advisory role oould
provide that information.
Settling on the "Advisory vs. Regulatory" issue sooner
rather than later will allow further constructive
discussion to proceed regarding the body of substantive
guidelines.
Until the role of the prospective Architectural Review
Cc~mittee is defined procedurally in context with other
elements of the City's government, I believe we may be
wasting our time discussing substance.

This memorandum is a revision of~ my December 7, 1989 memorandum
to you.
I am pleased to present the proposed budget amendment for your
consideration. The budget amendment is a result of several
events including an analysis of actual year end balances in
relation to budgeted beginning year balances, over $91,000 of
unbudgeted County Option Sales Taxes collected in F-89,
additional funding of $90,000 from indian River County for the
Barber Street Sports Complex, carry over items which should be
rebudgeted such as the Barber Street Sports Complex, Public Works
Compound, construction of a records vault, additional capital
needs such as furnishing and equipping the records vault,
constructing improvements for City parks and relocating the
Community Development Department to the north annex building.
Additionally, the Public Works Department has put together a
comprehensive improvement plan for the Cemetery which would be
eligible for expenditure from the Cemetery Trust Fund. Finally,
the County Option Gas Tax Fund would be amended to provide for
the street improvement program as approved by the City Council
and to provide for a traffic circulation study.
GENERAL FUND RESERVES
AS shown in the attached Beginning Year Fund Balance Analysis for
General Fund, the actual beginning fund balance (unaudited) is
$946,947. This is some S188,064 more than estimated. In simple
terms, in fiscal - 89 the City over collected revenues by
approximately 12% yet under expended its General Fund by some 9%.
A fund reserve as high as 30% (20% reserves plus 10%
contingencies) is permitted by'State law and, in my opinion,
reserves should be no less than 10%. The proposed amendment would
place the General Fund reserves ( cash on 9/30/90 ) at
approximately $721,000 or 18.3%.0'd-~/~'~9'9'~

GENERAL FUND REVENUES
The proposed budget amendment would utilize an additional
$175,750 of General Fund reserves. Additionally, we expect an
increase of $14,000 from construction board revenues for a total
of $189,750.
GENERAL FUND EXPENDITURES
The budget amendment provides approximately $79,050 for
additional personnel, $3,500 additional expense for competency
board exams and a transfer of $107,200 to the capital Improvement
Fund expenditures for a total of S189,750. The personnel requests
are outlined in separate memorandum.
CAPITAL PROJECTS
The proposed capital projects budget amendment includes funding
from Indian River County of $90,000 for the Barber Street Sports
Complex and fund reserves of $161,000 (including $91,256 from
County option Sales Tax collected in September 1989. )
Expenditures would be increased by $8,500 for the Police Station
to bring the Police Station budget to S500,000, the Barber Street
Sports Complex would now be budgeted at S180,000 to include the
unexpended carry over from F-89 plus the County funding, City
Hall renovations would be increased by $20,000 to S50,O00 to
include renovations for the Community Development Department, and
the records vault, .a 1989 project, is budgeted at $16,000.
CAPITAL IMPROVEMENT FUND
The proposed budget amendment provides for various improvements
for several departments. The $107,200 in revenues is a transfer
from General Fund.
The proposal provides for S16,000 to equip and furnish the
records vault and would increase the recording equipment for the
City Clerk's Office by $1,000 in order to acquire new recording
equipment for the City Council Chambers. Additionally, we
contemplate purchasing a new telephone system for City Hall to
coincide with the remodeling project.
The proposed Capital Improvement Fund amendment also provides an
additional $5,000 for a computer and printer for the City
Manager's Office, an additional $2,500 for the Police Department
to purchase sidearms for all sworn personnel and an increase of
$20,000 in the Park Department to accomplish all projects on the
approved improvement list.
The Community Development Department's relocation would
necessitate additional equipment including a copy machine,
additional furniture, a computer and printer and another vehicle.
The final item in the proposed Capital Improvement amendment
would be for City buildings to provide for storm shutters to be
used in the case of severe weather.

COUNTY OPTION GAS TAX
The County Option Gas Tax Fund would be amended in two (2) areas.
The current budget of $345,570 for street improvements is below
the available funds and approved program. The current
improvement program provides for S410,000 for F-90 and a $60,000
carry over from F-89. This amendment also provides for $80,000
for a traffic circulation study as provided in the City's
Comprehensive Plan.
CEMETERY TRUST FUND
The proposed amendment provides for a $48,000 program for
Cemetery improvements. These are outlined in the attached
memorandum from Dave Fisher.
GOLF COURSE FUND
The budget amendment contemplates increases for the Golf Course
Fund of $35,140 for additional personnel (please see separate
memorandum) and for $4,000 for removable storm shutters for the
Clubhouse building.

SUMMARY STATEMENT
Upon review of the year end financial statements (unaudited) and
as a result of several events including indian River County
funding for the sports complex, approval of the street
improvement priorities for F-90 and a relocation of the
Community Development Department, it is appropriate that City
Council should consider an amendment to the fiscal - 1990 budget.
The amendment would modify the following funds: General Fund,
Capital Projects Fund, Capital Improvement Fund, County Option
Gas Tax Fund, Cemetery Trust Fund and Golf Course Fund.
RECOMMENDED ACTION
Move to adopt Resolution No. R-89-67 providing for changes to
the fiscal year 1989/1990 budget.

A RESOLUTION OF THE CITY OF SEBASTIAN, iNDIAN RIVER
COUNTY, FLORIDA, PERTAINING TO AN AMENDMENT TO THE
FISCAL YEAR 1989/1990 BUDGET; PROVIDING FOR CHANGES TO
THE GENERAL FUND, CAPITAL PROJECTS FUND, CAPITAL
IMPROVEMENT FUNDS, COUNTY OPTION GAS TAX, CEMETERY
TRUST FUND, AND GOLF COURSE FUND; PROVIDING FOR REPEAL
OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Sebastian enacted
Resolution No. R-89-46 on September 20, 1989 adopting the annual
budget of the City for the Fiscal Year beginning October 1, 1989
and ending September 30, 1990; and
WHEREAS, the City Council has determined that certain
amendments to the annual budget are necessary in order to promote
the general health, safety, and welfare of the citizens of the
City of Sebastian.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows:
SECTION 1. BUDGET AMENDMENT. The Finance Director is
hereby authorized and directed to make the budget amendments to
the General Funds, Capital Projects Fund, Capital Improvement
Fund, County Option Gas Tax, Cemetery Trust Fund, and Golf Course
Fund as further described in Exhibit "A" to this Resolution, and
incorporated herein. The Finance Director is further authorized
and directed to allocate additional revenue to such funds as
further described in Exhibit "A"
SECTION 2. CONFLICT. Those provisions of Resolution No.
R-89-46 which are in conflict with the provisions of Exhibit "A"
to this Resolution are hereby repealed. The remaining provisions
of Resolution NO. R-89-46 shall not be affected by the enactment
of this Resolution. All other resolutions or parts of
resolutions in conflict herewith are hereby repealed.
SECTION 3. EFFECTIVE DATE. This Resolution shall take
effect immediately upon final passage.

General Fund balance. A beginning fund balance as high as 30% is
permitted by State law and, in my opinion, a beginning fund
balance should be no less than one (1) month operating expense or
approximately 8%. The proposed budget amendment would reduce the
$905,178 beginning balance by $187,000 for a revised beginning
fund balance of $718,000 or approximately 18.2%. Of this
S187,000, some $80,000 would go to General Fund for various
personnel expense and some $107, 200 would go to Capital
Improvement Fund for various capital outlays.

REQUEST FOR BUDGST AMENDMENT
· CEMETERY IMPROVES
Pursuant to our discussions, this is to formally request an
amendment to our current approved budget in order to
construct capital improvements at the cemetery.
We currently have $18,000 in the FY 89/90 budget to do
capital improvements at the cemetery. Our most recent plan
calls for an additional $30,000 for an approved budgeted
amount of $48,000. We understand these funds are currently
available in the cemetery trust fund.
