At the request of Mayor Conyers, Ron Harsh, 986
Montrose, Sebastian, presented a request for use of
Riverview Park for a fundraiser car show for the
benefit of Teens AGainst Boredom on April 13, 1991 in
con3unction with a 5K run and dance party at Captain
Hiram's River Raw Bar.
MOTION by Powell/Oberbeck
I move we place Mr. Harsh's suGGestion on the
agenda.
VOICE VOTE on the motion carried 4-0.
MOTION by McCollum/Oberbeck
I move we allow Teens Against Boredom to use the
park on April 13, 1991 for a car show.
Mr. Harsh was advised to meet with staff to discuss
parking of cars in the park, to come up with a rain
date and submit it for approval and to contact the
Health Department regardinG sale of food in the park.

Bob Gray, Merit Badge Counselor for Troop 598,
presented members of the troop and explained that
attendance at a Council meeting and addressing a
letter to a governmental body are requirements for a
merit badge.
Mr. Gray read a letter from a scout requesting
consideration for school bus stop shelters and Mayor
Conyers said he would look into it..

submit updated corporate papers. It was determined
that insurance requirements had been meet.
The City Manager advised that Council instruct the
City Attorney to draft a resolution as part of its
motion.

January 23, 1991 and to direct our City Attorney to
prepare a resolution.

B. Agenda Items
Arther R. Martella, 120 Lancaster Street, Sebastian,
Fritz Walter, 103 Lancaster Street, Sebastian,
addressed Council regarding street improvements in
Unit 17. Mr. Walter also questioned whether anything
can be done by the city regarding an unfinished
house. The City Manager requested the house
location.
Russell Jaquays, Yellow Cab of Sebastian, requested
that Council authorize a Police Department background
check on Dan Michael. Attorney Torpy responded that
there is no provision in the Code of Ordinances for a
background check.

Deborah Fisher, Southeast Recycling Corporation,
Melbourne, questioned the definition of refuse
dumpsters. It was the consensus of Council that
it was not the intent of the ordinance to include
temporarily placed recycling bins used by non-profit
groups.
Mayor Conyers called recess at 7:57 p.m. and
reconvened the meeting at 8:13 p.m. Ail members
present at roll call were present when the meeting
reconvened.
Paul Mitchell, 124 Hinchman Avenue and Todd Smith,

Attorney Torpy said, although he did not draft this
ordinance, generally Council can adopt ordinances
that protect the health, safety and. welfare of its
citizens and that a deluge of signs can impede
vision.

The City Manager detailed the proposed Golf Course
parking lot and related improvements, explained that
site plan approval from Planning and Zoning must be
obtained and requested approval to go out to bid.

section of Carnival Terrace which would increase the
cost by $4,000.

if appropriate, direct staff to proceed with

Mayor Conyers announced his forum every Monday from
noon to 2:00 p.m. in City Hall; said he was sending a
letter to service people in Saudi Arabia; discussed
the proposed cemetery maintenance contract, in
particular he noted a list of duties the sexton
performs given to him by the Manager and suggested
that this be looked into further. He requested that
the City Manager copy the list of duties to Council.
Mayor Conyers said he and Darryl Thompson agreed that
there should be an SOP procedure regarding holiday
celebrations and that he had discussed this with the
City Manager.

Councilman Powell requested that Council members
receive the bid package on the proposed cemetery
maintenance before any decision can be made.

Fourth of July Committee (Letter from Vickers
dated 1/3/91)
The City ManaGer reported that Ken Vickers was
resigning as Chairman of the 4th of July Committee
and that he'd attempt to put out feelers for a
replacement.
Police Station Status Report (Chief Petty) (No
Backup)
Chief Petty gave a status report on the new police
facility and stated that construction could begin in
March.
The City Manager explained the permitting processes
that must be undertaken and discussion ensued on the
possibility of contacting adjacent property owners
for cooperation in construction of a lift station for
the area. Council concurred that the City Manager
should contact those property owners.
Being no further business, Mayor Conyers adjourned
the meeting~ ~.

It is with regret that I must inform you that I will not be
able to participate as expected in the 1991 celebration. My
level of direct involvement in the daily operation of my
business will not allow sufficient time for such an event.
O~n McCu~ker does expect to remain as Treasurer for 1991 and
has all the financial records. I have all other information
from last year in terms of parade, booths, press releases,
etc. and will set aside some time to go over the records
when the council has appointed a Chairman.

To whom it may concern;
On April 13th, 1991, a group of local business owners wishes
to use Riverview Park for a custom & classic car show.
This event will be part of other activities which will be held
in the community to raise funds for the Sebastian Teen Center.
The first event will be a 5K Run early Saturday morning, and
will be held at the Barber St. Sports Complex. The car show
is scheduled to run from lOam. to 4pm., and will include enter-
tainment and concessions involving the local schools and local
teens. Classic and custom cars will be displayed on the park
grounds. There will be no other driving allowed on the grounds
during the car show.
A 5O's - 60's Sock Hop is planned for later that evening at a
local resturant.
All money raised during this three-event show will be presented
to the Teens Against Boredom group for use in remodeling the
library for a temporary teen center. Local businesses will donate
prizes, printing and advertising expenses for the event, making
this a community-wide effort to help our teens.
It is our hope that the city of Sebastian will lend us additional
assistance if needed, and will approve our use of the park on
Saturday, April 13th. for the event, which we hope will become
an annual activity.
At this time, the proposed name for this event is the 1st. Annual
Sebastian River Classic. Should you have any questions, please
call me at 589-4138, and thank-you for your consideration.

RE: Need for covered shelters at school bus stops
I live in Sebastian and go to Sebastian River Middle
Junior High School.
My friends and I ride the school bus to school.
often rains every morning and there is no covered
shelter at any bus stops in the City.
It
Sometimes I go to school with wet clothes or my parents
have to drive and get me to change clothes and then take
me to school.
The City Council and the School Board should be able to
work together to come up with some sheltered bus stops.
If you could give any suggestions or approaches to this
problem, it would be greatly appreciated by all the
school kids.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN,
INDIAN RIVER cOm~T~, ~LO~/DA, that~
Section 1~. Section 20A-5.9 of the.Sebastian Land Development
Code is hereby amended in its entirety to read as follows:
"Section 20A-5.,9. W~TJ~AND FENCES.
A. General Provisions.
Permit Required. Except as provided in para-
graph 4, it shall be unlawful for any person,
association, corporation or other entity to
install, erect, alter, or locate a fence or
wall within the City without first obtaining a
fence permit for such activity. Notwithstanding
the foregoing, a fence permit shall not be
required for the replacement or repair of an
existing fence or wall unless the replacement
or repair cost exceeds 50 percent (50%) or more
of the value of the fence or wall before its
repair or replacement.
Application Procedures. Application for a
fence permit under this section shall be made
to the Building Official and sha~l include the
followings
(a)
A survey prepared by a licensed surveyor
of the State of Florida;
(b)
The location, length and height of the
proposed fence or wall; and
(c)
A description of the materials contained
in the proposed fence or wall.
Issuance of Penaits. The Building Official
shall issue a fence permit to an applicant
under this section upon his finding that the
proposed fence or wall.is in compliance with
the provisions of this article and all other
pertinent state and local regulations, and upon
payment of the appropriate fee as set forth in
Section 7-20 of the Code of Ordinances. Fence
permits issued under this section shall be
subject to all other rules and regulations
pertaining to fence permits in general.
Exemptions from Fence Permit Requirement.
No fence permit shall be required hereunder for
the installation, erection, alteration or
location of the following structures:
(a) Portable dog pens or slabs with
permanent posts in or upon the
ground;
(b) Trellis structures that do not form
a barrier.
Said structures shall, unless otherwise provid-
ed herein, be subject to all other requirements
for fences and walls contained in this section.
5. Construction to withstand Forces of Nature.
Ail fences and walls shall be constructed to
withstand the force of wind and to allow, and
not inhibit, divert or alter, the free flow of
surface water from the natural course it fol-
lowed prior to installation of the fence or
wall.
Posts and SuDDortino ~hers. If the posts
or supporting members of a fence or wall are
placed in or upon the ground, the posts orsup-
porting members shall be treated or composed of
materials resistant to decay, corrosion and
termites.
Maintenance. Ail fences and walls shall be
maintained in good repair, in a non-hazardous
condition, and shall not be allowed to become
dilapidated.
B. Types of Fences and Walls Pe~itted.
Fences and walls shall be constructed and/or composed of
at least one (1) of the following groups of materials.
Termite resistant specie wood or wood
which has been treated to resist rot
and termites;
(2)
Steel posts and wire fabric of a minimum
of 11½ gauge galvanized or other
noncorrodible metal;
(3) Ornamental iron;
(4) Concrete or masonry;
(5) Plastic;
(6) Hedges and hedge rows.
C. Residential Area L~m~tations and Restrictions.
General Rule. Fences and walls not exceeding
six (6) feet in height may be placed along the
boundary of a lot on that portion of the lot
lying behind the front setback line and behind
the front of the main structure. Fences and
walls placed in front of the main structure
shall not exceed four (4) feet in height.
Corner Lots. Notwithstanding the provisions
of paragraph 1, fences and walls four (4) to
six (6) feet in height may be located to the
front of the front setback line along the
boundary of the secondary front yard of an
improved corner lot. Only those fences and
walls placed along the boundary mr the primary
front yard of an improved corner lot must be
located behind the front setback line.
(a)
Secondary front yard. For purposes of
this paragraph, the term "secondary front
yard" shall mean the yard of an improved
corner lot located between the street and
the side of the main structure facing the
street where the primary entrance to the
main structure is not located.
(b)
Primar~ front yard. For purposes of
this paragraph, the term "primary front
yard" shall mean the yard of an improved
corner lot located between the street and
the side of the main structure facing the
street where the primary entrance to the
main structure is located.
visibility Triangles. Visibility triangles,
within which nothing shall be erected, placed,
parked, planted or allowed to grow in such a
manner as to impede vision between a height of
two (2) feet and eight (8) feet above the
centerlines of intersecting trafficways, shall
be provided as follows=
(a)
Vision clearance at street, alley and
driveway intersections. A visibility
triangle shall be required at all
trafficed intersections. No wall, fence,
hedge, or structure within the visibility
triangle shall exceed a height of two (2)
feet above the elevation of the abutting
street measured at the centerline.
(b)
Dimensions of visibility triangle. The
sides of the visibility triangle shall be
thirty (30) feet at street-to-street
intersections and fifteen (15) feet at
all other intersections. These distances
shall be measured along the well defined
edge of travelways from their point of
intersection. Where no well defined edge
of pavement exists, a probable edge of
pavement shall be established from the
existing centerline of the. travelways,
Using twelve (12) foot travel lane(s) for
dedicated streets, eight ~(8) foot half
width for all dedicated alleys and
utility easements, and five (5) foot half
width for single driveways.
Visibility triangles are further defined by the following
diagram.

Trellis Structures. Trellis structures that
do not form a barrier may be erected at any
location on a lot except within visibility
triangles. Such trellis structures need not
satisfy the height limitations and
restrictions for residential fences and walls
provided in this subsection C.
D. Fences within Easements.
General Rule. It shall be unlawful for any
person, association, corporation or other
entity to erect a fence or wall within any
drainage easement unless a fence permit for the
fence or wall is obtained prior to the erection
of the fence or wall, and the fence or wall is
constructed of the materials listed in
paragraphs (1), (2) and (5) of subsection B.
Permitted Fences or Walls. Any fence or
wall proposed to be installed within a utility
or drainage easement that accesses, abuts or
provides the City or utility company with a

maintenance area to lot line ditches, canals,
drainage tracts, or drainage right-of-ways, may
be of a permanent or temporary nature.
However, if the City or utility company should
later determine that removal of the fence or
wall is necessary for the installation, repair
or replacement of the drainage or utility
facility, the property owner shall be required
to remove the fence or wall within five (5)
days of his or her receipt of written demand
for removal from the City or utility company.
Ail costs incurred in the removal and
replacement of the fence or wall shall be the
responsibility of the property owner.
Maintenance. With the exception of drainage
ditches maintained by others, the property
owner shall be responsible for the maintenance
of all property within a utility or drainage
easement regardless of the placement of the
fence or wall. The City may remove any fence or
wall within the easement, as needed, in cases
of emergency.
E. Prohibited Fences and Walls.
General Rule. It shall be unlawful to erect,
construct, install or maintain the following
structures~
(a)
A fence or wall within six (6) feet of
a fire hydrant;
(b)
A fence or wall within any street
right-of-way;
(c) An electricity charged fence or wall;
(d)
A fence or wall in a dilapidated condition
which appears to be neglected, unkempt, or
in substantial disrepair, in whole or in
part, and as a consequence thereof is either
unsound, hazardous or ineffectual;
(e)
Any fence or wall containing hazardous
substances such as broken glass, barbed wire,
(except as provided in paragraph (2) below),
spikes, nails, or similar materials designed
to inflict pain or injury to any person or

animal. Any fence constructed of such
material shall be deemed to be a public
nuisance.
2. Barbed Wire Fences. Barbed wire fences
may be permitted by the Planning and Zoning
Commission in commercial and industrial
districts if the proposed fence is a minimum of
six (6) feet and a maximum of eight (8) feet in
height and topped with barbed wire of not more
than three (3) strands; provided, that the
lower strand of barbed wire is not to be placed
lower than six (6) feet six (6) inches from the
ground nor angled outward.
F. Required Screens For Garbage, Refuse Dumpsters.
Notwithstanding anything to the contrary contained
in this Section, all garbage, refuse dumpsters,
regardless of the siting on the property, shall be
screened on at least three (3) sides by masonry
wall, fencing, or other materials permitted
hereunder, at least six (6) feet in height, and
rendering the view of said dumpster opaque
from adjacent properties and public right of ways.
Ail proposed refuse, dumpster screens must be
approved by the Building Official through the
issuance of a fence permit pursuant to the
application procedures set forth in subsection A."
Section 2. CODIFICATION. It is'the intention of the City
Council of the City of Sebastian, Indian River County, Florida, and
it is hereby provided that the provisions of this Ordinance shall
become and be made a part of the Land Development Code of Ihe Ciey
of Sebastian, Florida; that the sections of this Ordinance may be
renumbered or relettered to accomplish such intention; and the word
"Ordinance" may be changed to "Section," "Article" or other
appropriate designations.
Section 3.~.. CONFLICT.
Ail Ordinances or parts of Ordinances
in conflict with the provisions of this Ordinance insofar as they
conflict are hereby repealed.

Section 4. SEVERABILITY. In the event a court of competent
jurisdiction shall hold or determine that any part of this
Ordinance is invalid or unconstitutional, the remainder of the
Ordinance shall not be affected and it shall be presumed that the
City Council of the City of Sebastian did not intend to enact such
invalid or unconstitutional provision. It shall further be assumed
that the City Council would have enacted the remainder of this
Ordinance without said invalid and unconstitutional provision,
thereby causing said remainder.to remain in full force and effect.
Section 5. EFFECTIVE DATE. This Ordinance shall become
effective immediately upon its adoption.

Indian River Yellow Cab, Inc., has filed an application for a
permit and certificate of public convenience pursuant to the
Sebastian City Code regulating vehicles for hire. While the
application itself is attached, the complete file is available
for public inspection at the City Clerk's Office. Pursuant to
the City Code, the City Council is to set a public hearing on the
application, which is not less than ten (10) days nor more than
fifteen (15) days subsequent to the filing of the application.
The application date is the date the application is formally
received by the City Council which, in this case, is January 9,
1991. Therefore, the public hearing date could be the next
following regular City Council Meeting of January 23, 1991.
RECOMMENDED ACTION

At its Regular Meeting of December 12, 1990, the City Council
adopted two (2) motions which would prohibit the payment of
expenses of perspective or new employees. At that time, the City
Council inadvertently failed to place the matter on the Agenda by
unanimous consent as required by Resolution No. R-89-99.
Therefore, the City Council should re-enact these motions within
correct procedure.
RECOMMENDED ACTION
"Move we strike any incentive for moving expenses with regard to
job applicants to the City of Sebastian" and "move we discontinue
paying travel expenses for interviews to applicants".

REGULATE THE PLACEMENT AND REMOVAL OF
POLITICAL SIGNS ON PRIVATELY OWNED PROPERTY IN
RESIDENTIAL AND NONRESIDENTIAL DISTRICTS;
PROVIDING FOR INCLUSION IN THE LAND
DEVELOPMENT CODE OF THE CITY OF SEBASTIAN;
PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.

Section 1. Section 20A-15.3 of the Sebastian Land Development
Code is hereby amended in part to read as follows:
Section 20A-15.3:
"Political Sign. Any sign urging the election or
defeat of any candidate seeking any political
office, or urging the passage or defeat of any
ballot measure, but does not include any billboard
owned or maintained by a commercial firm or
advertising company.
Public Property. All publicly owned property,
including streets, rights-of-way, easements, and
everything affixed thereto and thereover."
Section 20A-15.6B of the Sebastian Land
is hereby amended in its entirety to read as
Section 2.

Section 20A-15.6B:
"B.1.
Political Signs. Political signs shall not
be posted on or over any public property, as
defined in Section 20A-15.3.
Political S~gns in Residential Districts.
Political signs in residential districts are
allowed subject to the following provisions:
(a)
NO sign shall exceed sixteen (16) square
feet;
(b) No sign shall be illuminated;
(c) Each sign shall be free standing;

Each sign shall be located wholly on private
property, placed there only with the
consent of the property owmer;
(e)
Each sign shall be placed at least five
(5) feet from all rights of way and sidewalks;
(f) No sign shall exceed five (5) feet in height;
(g)
No sign shall not be placed on or attached
to any tree or utility post.
Polltical Signs in Nonresidential Districts.
Political signs in nonresidential districts
are allowed subject to the following
provisions:
(a) No sign shall exceed twenty (20) square
feet;
(b) No sign shall be illuminated;
(c) Each sign shall be freestanding;
(d)
Each sign shall be located wholly on
private property, placed there only with
the consent of the property owner;
(e)
Each sign shall be placed at least five
(5) feet from all rights of way and
sidewalks;
(f) No sign shall exceed ten (10) feet in
height;
(g) No sign shall be placed on or attached to
any tree or utility post.
~ Time Limits. It shall be unlawful
for any person to post a political sign more
than thirty (30) days prior to the election
in which the candidate's name or the issue
will appear, and it shall be unlawful to fail
to remove a political sign within five (5)
days after the election in which the
candidate is eliminated or elected or the
issue is approved or disapproved.

Removal Bond. Prior to the placement of a
political sign or signs, a bond or cash
payment of $25.00 shall be posted with the
City. The security may be forfeited in whole
or in part for any of the following:
(a)
Failure to remove all signs within the
applicable five (5) day period for
removal;
(b)
Placement of signs upon public property
or upon any tree, utility pole, or
similar object;
(c)
Placement of signs upon private
property without the express consent of
the property owner;
Authorizing placement of a sign or
allowing a sign to remain in violation
of this section for more than two (2)
days after notification of the
violation by the building official or
his designee.
Prima Facie Evidence. Political signs placed
in violation of this section which advertise
a particular candidate or ballot measure
shall be prima facie evidence of the
placement or authorization of the placement
of the sign by the candidate or the president
of the committee supporting or opposing the
ballot measure, as applicable.
Removal of Illegal Siqns. The building
official shall order the immediate removal of
any political sign found posted within the
City in violation of this section. If the
sign is not removed within two (2) days, the
building official or his authorized agents
shall remove the political sign.
Reimbursement for Removal Expense. The
candidate or the president of the committee
supporting or opposing the ballot measure, as
applicable, shall reimburse the City for any
and all expenses of removal inourred by the
City over and above any bond or cash deposit
coverage.

9. Violations. Any violation of the provisions
of this paragraph shall be subject to
punishment by a fine not to~ exceed Five
Mundred and 00/100 Dollars (S500.O0), or by
imprisonment in the county jail not to exceed
sixty (60) days, or by both such fine and
imprisonment."
Section 3. CONFLICT. All Ordinances or parts of Ordinances
in conflict with the provisions of this Ordinance insofar as they
conflict are hereby repealed.
Section 4. CODIFICATION. It is the intention of the City
Council of the City of Sebastian, Indian River County, Florida, and
it is hereby provided that the provisions of this Ordinance shall
become and be made a part of the Land Development Code of the City
of Sebastian, Florida; that the sections of this Ordinance may be
renumbered or relettered to accomplish such intention; and the word
"Ordinance" may be changed to "Section", "Article" or other
appropriate designations.
Section 5. SEVERABILITY. In the event a court of competent
jurisdiction shall hold or determine that any part of this
Ordinance is invalid or unconstitutional, the remainder of the
Ordinance shall not be affected and it shall be presumed that the
City Council of the City of Sebastian did not intend to enact such
invalid or unconstitutional provision. It shall further be assumed
that the City Council would have enacted the remainder of this
Ordinance without said invalid and unconstitutional provision,
thereby causing said remainder to remain in full force and effect.
Section 6. EFFECTIVE DATE. This Ordinance shall become
effective immediately upon its adoption.

The City has engaged Mosby & Associates, Inc., to design
improvements to the Golf Course including a paved parking lot and
a sewer connection from the clubhouse to the lift station
operated by Indian River County Utilities. This site plan also
includes improvements to the starting area which would be
relocated to an area between the clubhouse and the cart barn.
This site plan should be reviewed by the City Council prior to
authorizing the project for bids. If approved, staff will
proceed with the required notices to bid the project.
RECOMMENDED ACTION
Review the proposed improvements at the Sebastian Municipal Golf
Course and, if appropriate, direct staff to proceed with bidding
the project.

~UMMARY STATEMENT
On November 28, 1990 the city Council approved the F-91 Street
Improvement Program. At that time, City Council authorized some
$200,090. for street improvements. Not included in this estimate
were construction costs for bicycle path, engineering for
Louisiana and Schuman Drive projects, or any construction for
Louisiana or Schuman Drive projects. Further, we have issued an
RFP for consulting engineers which are due on December 21, 1990.
We have recently reviewed additional streets and request city
Council's consideration of including these streets in the F-91
program. Most of these improvements are in the section of Unit
17, Sebastian Highlands, which has not been accepted by the City.
However, the city has been making emergency repairs in other
sections of Unit 16 & 17 and these streets need attention since
they are deteriorating rapidly. While we would bill General
Development Corporation for this work, we must recognize that the
collection of these funds will depend entirely upon GDC's fate in
Federal Bankruptcy Court. One street in the following list,
Coply Terrace is in Unit 11 but the balance of the streets are
all in Unit 17. The following lists those streets we propose to
include in this year's program:

As the holiday season is coming to a close, it appears to be the
appropriate time to bring up a subject that affects all City Employees.
I am talking about the Departmental Christmas Parties.
Each Department needs this party to exchange gifts, have a buffet
lunch, Or just a snack table, prior to the Christmas Holiday.
This year there were discrepancies in what the various Departments
were permitted to do. The Public Works Department was required to relinquish
their breaks and regular lunch period so they could start their party 1~
hours before quitting time. The Building Department was allowed to take
lunch, but could nol~ start their party until 1½ hours before quitting
time. The Cl.erk's Office was allowed lunch and their snack table was set
up and ready by 8:30 in the morning.
As an employee of the Public Works Department, I certainly don't want
these (morale booster) parties stopped, I' just want the same guidelines for
all City Employees, regardless of department.
Do we take lunch or not? Do we start the party 1½ hours before quitting
time or first thing in the morning? Do we have the party on the last work day
before Christmas or the day of our choice, to make it more convenient for
our department? Do we allow alcoholic beverages or not? The City S.O.P.

states there will be no drinking of alcohol on City property or on
City time. Do the employees get paid for the full day or only up to
the time the party starts? These are just some of the questions that need
to be answered by regulations for holiday festivities within the
Departments. These should not interfere witk the regular City-Wide
Christmas Party, as some departments are unable to have a regular
scheduled party due to the conflicting work hours (i.e. Police
Department and the Golf Course).
Mr. 'Oberbeck, I am asking, as a City employee, that guidelines,
in writing, be in effect before the next holiday season approaches so
we know what is expected of us in the planning for these get-togethers.
Maybe next year will truly be a season of joy and giving, and
not of petty bickering and jealousy between Departments. We all work
for the same City- Let's Try To Get Along.

level of direct involvement in the daily operation of my
business will not allow sufficient time for such an event.
Dan McCusker does expect to remain as Treasurer for 1991 and
has all the financial records. I bare all other information
from last year ~n terms of parade, booths, press releases,
etc. and will set aside some time to go over the records
when the council has appointed a Chairman.
