As coordinator for the Sebastian River Classic £undraiser
for the teen center, I recently attended a meeting with
several presidents of local car clubs that would like to
attend the April 13th. event, attending
The question was raised as to the legality of persons
brln beer. This was not an unusual request

lng over six hours in the park watching over their vehicles
and eating lunch. I have attended many shows of this type
and have not seen seen any problems caused by those drinking
beer. Most ~a~ticipants are older, more mature persons who
are responsible citizens.
Since beer will not be sold in the park, I wish to request
that council waive the ordinance for the day, so that those
lowed to drink it in the park, as lon~

information along to those participating.

Gentlemen:
Thank you for allowing me to be a part of the City Council Agenda for February
13, 1991.
I wish to present to you what I feel is an urgent need to place a RAILWAY
BRIDGE STRUCTURE at the intersection of County Road 512 so that our Community
may be unhampered in its future, especially now that we are developing our
great riverfront heritage, and most certainly now, for large numbers of people
will be accessing our beautiful river area via-512.
There is interest in this Community regarding solving rail-traffic crossings
which, according to the Chief Engineer of the Florida East Coast Railway, will
become more congested in this decade with the addition of a second track
through our town, along with the appearance of longer and more-frequent
trains.
There is interest, likewise, in the Federal and State Community in solving
this rail-crossing issue for our historic riverfront town. I am now currently
in contact with both Senators and House Representatives in Washington, D.C.
as well as Tallahassee regarding our city's need for a railway structure. Hy
research, documented thoroughly by computer, shows that a railway structure is
both feasible and possible at Sebastian's Route 512 and U.S. Highway One
location.
It is my hope that the Council will help Sebastian continue to blossom and
grow as the beautiful city that it is, unhampered by lack of forsight, and
ready to manage the growth of the Twenty-First Century.

PROPOSED RAILIdAY STRUCTURE FACT SHEET
- Indian River County will begin to widen County Route 512 in late Spring
1991. The segment to be initially constructed will be the length of Route
512 which begins at its intersection with County Route 505 (Roseland Road)
and running east to its intersection with Powerline Road.
- Indian River County is expecting to create a "Twin Pair" out of Route 512
from Powerline Road running east to U.S. Highway One; construction is
expected to begin on this "Twin Pair'" system by late 1991.
- The Florida East Coast Railroad (FECRR) is projecting a need for a separate
second track running through Sebastian by the end of the 1990's.
- If the "Twin Pair" is constructed, and if the expected congestion and
traffic-backups created by longer and more-frequent trains is solved in the
future by creating railway bridges over the "Twin Pair" system, the maximum
bridge clearance that can be obtained at the northern leg of the system will
be only ]3.05 feet (inadequate for interstate traffic).
- if the projected congestion is not solved with a railway bridge, Florida
Department of Transportation (FDOT) may be tempted in the future to install a
raised cloverleaf system for automobiles, stagnating the Sebastian Riverfront
area underneath it (Indian River County Engineering Department projects a
]990 cost for such cloverleaf at $3 million * ).
- if a single railway bridge is constructed over the existing Route 5]2, the
cost of a bridge allowing 6 lanes of traffic underneath would be $] million,
according to the FECRR ( this cost would pay for the projected double track
situation ).
- The existing grade difference between the TOP of the existing railroad ties
at Rout 5]2 and the TOP of the existing crown of U.S. Highway One is 9.09
feet.
- To obtain a ]6.5 foot interstate clearance underneath a railway bridge
constructed at Route 5]2, the existing railway at that location would need to
be elevated 12.4! feet.
- The 43,]00 cubic yards of dirt which would be obtained from the excavation of
the existing Route 5]2 ( from the segment beginning at Louisiana Avenue and
running to the existing crown of U.S. Highway One ) would be used to berm th~
raised railway along its .3 ~ required slope.
- The resulting road segment of Route 512 which would run from Louisiana Avenu~
to Old Dixie Highway would be a gentle 1.5 ;[ slope.
- The Indian River County Engineering Department is presently contracting with
the FECRR to close the existing BayStreet Railway Crossover (an existing,Tw
ROSELAND HOSPITAL EMERGENCY ACCESS ROUTE) to be allowed to create a new i
Pair" Crossover.

SUMMARY STATEMENT
The Golf Course Superintendent requests a waiver of the bidding ~
procedure on the purchase of twenty two (22) tons of 16-4-8 ~
fertilizer containing IBDU. Par-Ex Professional Products is the only
company licensed to market IBDU in the U.S. The area distributor is
Kaiser Estech of Ft. Pierce and the cost of twenty two (22) tons of
fertilizer is $5,574.80 delivered in bulk. PursUant to City Code
section 2-63 (j)the city Council may waive the bidding procedure
as bids shall not be required for items that are available as a
matter of commercial reasonableness from one source only.
RECOMMENDED ACTION
Move a waiver of bidding procedure be granted pursuant to City
Code section 2-63 (j) and the Golf Course be given authority to
purchase twenty two (22) tons of 16-4-8 fertilizer with IBDU
from Kaiser Estech of Ft. Pierce in the amount of $5,574.80.

Waiver of Bid Procedure For 22 Tons of Fertilizer
I would like to waive the bid procedure in purchasing 22 tons of
16-4-8 fertilizer with IBDU.
This fertilizer with IBDU can only be purchased through Par-Ex
Professional Products. The local distributor for this is Kaiser
Estech Fertilizers in Ft. Pierce.
The cost of 22 tons delivered in bulk form is $5,574.80

IBDU has unique characteristics which
make it the best source of slow-release
nitrogen available to the turfgrass profes-
sional. And only the Par Ex brand of
fertilizers has it.
Where did it come from?
The need to fertilize rice fields in lapan
challenged scientists there to develop a
slow-release nitrogen source that would
not readily dissolve in water. Mitsubishi

SECTION I
That the City of Sebastian does herewith vacate, abolish,
'abandon and discontinue all that portion of land previously
dedicated for easement and described as follows:
The north five feet of Lot 8 and the south five feet
of Lot 9, Block 95, Unit 2, Sebastian Highlands,
according to the plat thereof, recorded in PBI 5/35,
Public Records of Indian River County, Florida.
SECTION II
All resolutions or parts of resolutions in conflict herewith
are hereby repealed. ~
SECTION III
This resolution shall be recorded in the public records of
Indian River County, Florida.
SECTION IV
This resolution shall be in full force and effect
immediately upon its passage.

WEEKEND DUTy RESPONSIBILITIES~
The City Manager shall prepare a check list of responsibilities
and activities to be performed by the individual assigned
"weekend duty". The "weekend duty" check list will include
unlocking and cleaning public rest rooms, displaying the American
flag where appropriate, inspecting the Community Center and Yacht
Club and cleaning as necessary, emptying waste baskets and
cleaning rest rooms at police facilities, inspecting all City
parks for litter and emptying trash cans as required and other
~duties as assigned.
COMPENSATION:
For call out duty on Monday through Friday or call out at times
other than the regularly assigned hours on Saturdays, Sundays and
holidays each employee shall be compensated over time as provided
for by collective bargaining contract or policy.
For each holiday, each employee on "weekend duty" will be
compensated on an over time basis as provided by collective
bargaining agreement or policy. For each Saturday and Sunday,
each employee shall be compensated in compensatory time off the
following Thursday and Friday. Since the schedule for each
Saturday and Sunday will be set for five hours and twenty minutes
each day, the compensatory time off will, in most cases, be at
the rate of .eight (8) hours (5.3 hours at time and one half is 8~
hours).

The Florida Department of Community Affairs ("DCA") has notified
the city that Sebastian is the recipient of a 1991 Florida Growth
Management Award. The award recognizes the City for preparing
the best overall local Comprehensive Plan for a small
municipality (under 50,000 population). The DCA will present
this award to the city at a ceremony on Friday, March 15, 1991 at
8:00 a.m., at the Florida State Conference Center in Tallahassee,
FL. It is appropFiate that the Mayor receive the award in behalf
of the city. Section 2.05 of the Sebastian Charter permits
reimbursement of the Mayor or any member of city Council to
attend a function on city business provided that the entire city
Council allow the expense. Section 112.061 Florida Statutes
provides a maximum per diem, transportation and lodging expenses.
RECOMMENDED ACTION
Move to approve Mayor W. E. Conyers' travel expenses on March 14
and 15, 1991 to attend the awards ceremony of the Department of
Community Affairs to receive an award in behalf of the City of
Sebastian.

OPTION "C" would appear to be the most feasible from an economic
point of view. Public Works (Parks Dept.) would pick up an
additional maintenance worker on a full time basis, and the
Cemetery Sexton on a part-time bas~s. The total cost of the
contract is $18,600. Elimination of expenses such as fertilizer,
electricity and other non-personnel expenses will save
approximately $10,790.00 resultin~ in additional costs to the
City of $7,810.00.

Additional Information for Cemetery Operations
The Sebastian Municipal Cemetery contains approximately 9.3 acres
located to the east of U.S. Highway 1 and is maintained by two
(2) full time city employees, a Cemetery Sexton and a Maintenance
Worker I.
In fiscal '90 the Cemetery was subsidized by the General Fund
some $39,525., in fiscal °89 by some $41,072., and in fiscal '88
by some $43,725. Details of this information are listed as

The City of Veto Beach operates an 11 acre cemetery maintained by
four (4) personnel. During 1990 the general fund contributed
some $46,626. for operating costs, in 1989 some $63,000. and in
1988 some $60,000 was contributed. Vero Charges $432 for a City
Resident and $540. for a County Resident per cemetery lot
compared to Sebastian's charges of $200 per individual City
Resident, $325 per legal County Resident and $400 per lot for all
others.
The City of Melbourne operates a 17 acre cemetery on three
different sites which are maintained by two (2) full time
personnel. The cost of a cemetery lot is $400.for a city
resident and the operation is funded entirely by the general
fund.

The applicant, Carl Julian, has submitted a request to the City Council to
extend the Conceptual Development Plan for St. Sebastian Planned Unit
Development. The existing Conceptual Plan expired December 31, 1990, under

Mr. Julian is requesting a 90 day extension to accomplish the following,
1. Submit a revised overall Conceptual Development Plan. (See Attached
Plan) This Conceptual Plan will not conflict with the existing approved
plan but, significantly enhance the plan to reflect the following:
a. The extension of Gibson Street to be consistent with the City's
Adopted Future Thoroughfare Map.
b. Designate approximately 40 acres for a campus of Indian River
Community College.
2. Submit a Preliminary Development Plan for 20 acres, (directly north of
City Hall) in order to construct multifamily (apartments) units. One
reason for the delay in presenting this request to the City Council was to
meet with Treasure Coast Regional Planning Council concerning the status
of St. Sebastian's Development of Regional Impact (D.R.I.). After meeting
with the Director of T.C.R.P.C., Mr. Dan Curry, it was apparent

that the D.R.I. still runs with the land but, the owner must submit what
is known as a substantial deviation to the D.R.I. The developer has
already started this process which, in application fees alone will cost
the owner $35,000. I would like to point out some of the positive
features that will be accomplished by granting this extension,
Submittal of the Preliminary Development Plan will allow the
owner to proceed with construction of the infrastructure within
the PUD. At that time, under the terms of the agreement adopted
by Resolution R-90-18, the owner will reimburse the City
approximately $135,OO0 for Main and Gibson Street.
The City is also in need of this type of development to provide
affordable housing (apartments).
Since the owner will have to construct a lift station to
connect With the North County Sewer, the City may wish to
coordinate with the owner to jointly tie in with the new Police
Facility and City Hall.
After the meeting with Treasure Coast Regional Planning Council, it's
clear that in order to facilitate both the D.R.I. process and to submit a
Preliminary Development Plan that would be consistent with the City's Land
Development Code, the applicant should be granted an extension of 120 days
(April 30, 1991) instead of 90 days (March 31).
The owner is aware that any extension and subsequent approvals will be
conditioned upon the PUD being in compliance with the upcoming Airport
Zoning Ordinance.

Dear Mr. Cooper:
This letter is to confirm the content of recent discussionsbetween
you and Mr. Peter Jones, our Project Architect/Planner for the
subject project.
That is:
(1) We respectfully request a ninety (90) day time extension of our
current deadline date with the City for submittal of our
revised Conceptual Plan for the St. Sebastian PUD.
Attached is a diagram reflecting the basic elements of our
conceptual plan and designating an area of approximately 22
acres (east of the extension of Gibson Street) as the subject
of the first phase of our development. We plan approval for.
that particular parcel in the very near future.
You will note the revisions to our Conceptual Plan do not
conflict with the terms of the Development Order previously
approved for the project. They do reflect, however,
significant enhancement of the overall plan. I.e.:
(a) Extension of Gibson Street through to its ultimate
connection with Roseland Road, this pursuant to the
Major Thoroughfare Plans of both the City and the
County;

Designation (PS) of forty (40) acres set aside for a
campus of Indian River Community College; and
(c)
Appropriate planning and design consideration in
recognition of the City's pending Airport Study.
(2) Our progress to date includes:

of Main Street and the current northerly extension of
Gibson Street next to City Hall;
Meetings and field work with Treasure Coast Regional
Planning Council pursuant to updating the D.R.I. study

Michael Busha of the Treasure Coast Regional Planning
Council in Palm City, FL];
Preliminary engineering studies and design work for a
major lift station for the first elements of our project
and which, subject to final agreement by the City, may
be utilized by the City's new Police Station and City
Hall Complex; and

Our offer to donate forty (40) acres of the project to
Indian River Community College for a Sebastian Campus.
[Our discussion with the College regarding details of
the implementation of our offer and their acceptance
are currently on hold pending City approval of our
revised Conceptual Plan].
(3) A general'Statement of our near term intentions for the project
is as follows:
(a)
Within ninety (90) days, to submit a complete package
for City approval of our revised P.U.D. Conceptual Plan,
all in accord with provisions of the City's Land
Development Code and recently adopted Comprehensive
Land use Plan;
(b)
Shortly thereafter, to submit a package for City
approval, per Code and Comprehensive Land use Plan,
of our Preliminary Development Plan for the approximately
22 acres designated as Phase I-A of our overall
development plan; and

Following 'City approval of our Preliminary Development
Plan for Phase I-A, to begin site work on same shortly
thereafter. This would include the further extension
of Gibson Street north and arrangements with the County
and others for the construction of a major sewer system

have a minimum of four (4) years experience. Currently the code requires
a Journeyman to have a minimum of three (3) years experience.

COUNTY, FLORIDA, AMENDING ARTICLE VII OF THE CODE OF
ORDINANCES OF THE CITY OF SEBASTIAN PERTAINING TO
CONTRACTORS~ AMENDING SECTION 7-91 TO AMEND THE
DEFINITION OF JOURNEYMEN TO INCREASE THE LENGTH OF
MINIMUM EXPERIENCE FROM THREE YEARS TO FOUR YEARS~
PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH~ PROVIDING FOR INCLUSION IN THE CODE
OF ORDINANCES OF THE CITY OF SEBASTIAN~ PROVIDING A
SEVERABILITY CLAUSE~ AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the construction industry is a matter substantially
affecting the public interest; and,
WHEREAS, to protect the health, safety and general welfare of
the public, it is necessary to ensure that individuals and entities
engaged in the construction industry are duly qualified and that
construction is performed in accordance with the Code of Ordinances
of the City of Sebastian; and,
WHEREAS, certain measures can be taken to better regulate the
construction industry and enforce the laws and ordinances enacted
to protect the public health, safety and general welfare; and,
WHEREAS, the City Council of the City of Sebastian has
determined that the length of minimum experience that a person must
have to be classified as a journeymen should be extended from three
years to four years.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that:
Section....1.
Section 7-91 of the Code of Ordinances of the City of
Sebastian is hereby amended by revising the definition of
journeymen to read as follows:
,'(4) ~ are those who qualify after four (4) years
minimum experience, and shall only perform work in the plumbing and
electrical trades while employed by, and serving under the
supervision of, a certified plumbing or electrical contractor."
Section 2. CONFLICT. Ail ordinances or parts of ordinances
in conflict herewith are hereby repealed.
~ CODIFICATION. It is the intention of the city
Council of the City of Sebastian, Indian River County, Florida,
and it is hereby provided that the provisions of this ordinance
shall become and be made a part of the Code of Ordinances of the
city of Sebastian, Florida; that the sections of this ordinance
may be renumbered or relettered to accomplish such intention; and
the word ,,Ordinance" may be change to ,,Section", ,,Article" or other
appropriate designations.
Section 4. SEVERABILITY. In the event a court of competent
jurisdiction shall hold or determine that any part of this_~
Ordinance is invalid or unconstitutional, the remainder of the
Ordinance shall not be affected and it shall be presumed that the
city council of the City of Sebastian did not intend to enact such
invalid or unconstitutional provision. It shall further be assumed
that the city Council would have enacted the remainder of this
Ordinance without said invalid and unconstitutional provision,
thereby causing said remainder to remain in full force and effect.
Section 5. EFFECTIVE DATE. This Ordinance shall become
effective immediately upon its adoption.
