SUMMARY STATEMENT
Returning to City service, one of my priorities was to complete negotiations with
the Veto Beach Police Department for a Mutual Aid Agreement and to present it to the
City Council for approval. With the assistance of Assistant City Attorney, Rick
Torpy, attached you will find such an agreement.
In brief this proposed agreement authorizes the Veto Beach Police Department and the
Sebastian Police Department to assist each other in dealing with specific events
(See Section 2) and it enables voluntary cooperation of various investigations (See
Section 3). This agreement, in my opinion, best serves the needs of our Department
to enhance our protection of Sebastian's residents. I reco~end the Council approve
this Mutual Aid Agreement.
REC~4ENDED ACTION
Review proposed agreement and, if appropriate, instruct Attorney
Nash to draft a resolution.
MUTUAL AID AND VOLUNTARY COOPERATION, AGREEMENT
WHEREAS, the subscribed law enforcement agencies are so
located in relation to each other that it is to the advantage of
each to receive and extend mutual aid in the form of law
enforcement services and resources to adequately respond to (1)
intensive situations including but not limited to emergencies as
defined under Section 252.34(2), F.S. and (2) continuing, multi-
jurisdictional law enforcement problems, so as to protect the
public peace and safety, and preserve the lives and property of
the people; and
WHEREAS, the CITY OF SEBASTIAN, and the CITY OF VERO BEACH
POLICE DEPARTMENT, have the authority under Part I of Chapter 23,
Florida Statutes (1987), the Florida Mutual Aid Act, to: (1)
enter into a requested operational assistance agreement for the
requesting and rendering of assistance in law enforcement
intensive situations and emergencies, and (2) a voluntary
cooperation agreement for assistance of a routine law enforcement
nature that crosses jurisdictional lines;
WHEREAS, the law enforcement agencies of Indian River
County, Florida, are charged with the investigation of criminal
offenses occurring within their respective jurisdictions,
including, but not limited to, violations of the Florida
Comprehensive Drug Abuse Prevention and Control Act; and
WHEREAS, each law enforcement agency may, from time to time,
require additional resources to efficiently and expeditiously
pursue such criminal investigations; and
WHEREAS, criminal activity occurring within the jurisdiction
of one local government oftentimes impacts upon criminal activity
occurring in adjacent jurisdictions; and
WHEREAS, the citizens of Indian River County can best be
served by an organized and unified approach to the investigation
of criminal activity; and
NOW, THEREFORE, in consideration of the mutual cevenants
hereinafter contained, the undersigned parties hereto agree as
follows:
SECTION 1. DEFINITIONS,~,,,
"Police" shall mean the Police of the City of Vero
Beach, Florida, or the City of Sebastian, Florida.
"Agency" shall mean the office of the City of Vero
Beach Police Department, Vero Beach, Florida, or the
city of Sebastian Police Department, Sebastian,
Florida, and that department or agency of an
incorporate municipality situated wholly within Indian
River County, Florida, which is charged and empowered
with the duties of law enforcement within the
jurisdictional limits of such municipality.
"Law Enforcement Officer" shall mean any person
certified as a full-time or part-time law
enforcement officer by the Criminal Justice Standards
and Training Commission of the State of Florida who
has met all of the minimum requirements for training
as set forth in Chapter 943, Florida Statutes (1989),
as amended, and is employed as a police officer or
public safety officer by a municipality situated wholly
within Indimn River County, Florida, or as a police
officer of indian River County, Florida.
"Participating Agency" shall mean any agency operated
by a party tc this Agreement.
"Party" shall mean any incorporated municipality
situated wholly within Indian River County, Florida, who
has entered into this Agreement as evidenced by the
appropriate execution of this Agreement.
"Requesting Agency" shall mean an agency which seeks
assistance from another law enforcement agency.
"Responding Agency" shall mean a law enforcement
agency which directs its personnel to leave its primary
area of jurisdiction in response to a request for law
enforcement assistance initiated by the law enforcement
agency having primary jurisdiction in the area to which
the responding agency's personnel are directed.
"Emergency" shall mean any situation or set of
circumstances in which life or property is in imminent
danger.
PROVISIONS FOR OPERATIONAL ASSISTANCE.
Therefore, be it known that the aforesaid law enforcement
agencies hereby approve and enter into this Agreement whereby
each of the agencies may request and render law enforcement
assistance to the other, to include but not necessarily be
limited to dealing with civil disturbances, large protest
demonstrations, aircraft disasters, fires, natural or man-made
disasters, sporting events, concerts, parades, escapes from
detention facilities, and incidents requiring utilization of
specialized units.
SECTION
PROVISIONS FOR.,,VOLUNTAR~,,,.,.COOPERATION~,
In addition each of the aforesaid law enforcement agencies
hereby approve and enter into this Agreement whereby each of the
agencies may also request and render law enforcement assistance
to the other dealing with any violations of Florida Statutes to
include, but not necessarily be limited to, investigating
homicides, sex offenses, robberies, assaults, burglaries,
larcenies, gambling, motor vehicle thefts, drug violations
pursuant to Chapter 893, F.S., backup services during patrol
activities, and inter-agency task forces and/or joint
investigations.
SECT_~_QN 4. POLICY~ND PROCEDURE.
A. In the event that a party of this Agreement is in need
of assistance as set forth above, it shall notify the agency head
or his designee from whom such assistance is required. The
agency head or designee whose assistance is sought shall evaluate
the situation and the agency's available resources, consult with
his/her supervisors if necessary and will respond in a manner
he/she deems appropriate. The agency head's decision in this
regard shall be final.
B. The resources or facilities that are assigned by the
assisting agency shall be under the immediate command of a
supervising officer designated by the assisting agency head.
Such supervising officer shall be under the direct supervision
and command of the agency head or his designee of the agency
requesting assistance.
C. Where investigative priorities arise during a law
enforcement operation which may require enforcement action by the
investigating agency and which require crossing or jurisdictional
lines, the investigating agency supervisor or his designee on
duty shall notify the on duty supervisor of the jurisdiction
wherein investigation is required and request enforcement
assistance. The supervisor or his designee shall evaluate the
situation, consult with his/her appropriate supervisor and if
required ensure that proper requested enforcement assistance is
rendered.
D. Should a violation of Florida Statutes occur in the
presence of an officer representing his/her respective agencies
in furtherance of this Agreement he/she shall be empowered to
render enforcement assistance and act in accordance with the law.
SECTION 5. ~OWERS, PRIVILE~ES~ IMMUNITIES AND COSTS.
A. Members of the City police departments enteringing into
this agreement when actually engaging in mutual cooperation and
assistance outside of their respective jurisdictional city limits
under the terms of this Agreement, shall, pursuant to the
provisions of Section 23.127, Florida Statutes, have the same
powers, duties, rights, privileges and immunities as if they were
performing their duties in the political subdivision in which
they are normally employed.
B. Each party agrees to furnish necessary equipment,
resources and facilities and to render services to each other
party to the Agreement as set forth above; provided however, that
no party shall be required to deplete unreasonably its own
equipment, resources, facilities, and services in furnishing such
mutual aid. (The re~lesting agency may compensate or reimburse
the assisting agency for assistance under Section 2 of this
Agreement only, under terms specified in the agreement, or may
provide as follows in C and D:)
C. The agency furnishing any equipment pursuant to this
Agreement shall bear the loss or damages to such equipment and
shall pay any expense incurred in the operation and maintenance
thereof.
D. The agency furnishing aid pursuant to this section shall
compensate its appointees/employees during the time such aid is
rendered and shall defray the actual travel maintenance expenses
of such employees while they are rendering such aid, including
any amounts paid or due for compensation due to personal injury
or death while such employees are engaged in rendering such aid.
E. Ail of the privileges and immunities from liability,
exemption from laws, ordinances and rules, and all pension,
insurance, relief, disability, workers' compensation, salary,
death and other benefits which apply to the activity of such
officers, agents, or employees of any such agency when performing
their respective functions within the territorial limits of their
respective public agencies shall apply to them to the same
degree, manner, and extent while engaged in the performance of
any of their functions and duties extraterritorially under the
provisions of this Mutual Aid Agreement. The provisions of this
section shall apply with equal effect to paid, volunteer, and
reserve employees.
F. Nothing herein shall prevent the requesting agency from
requesting supplemental appropriations from the governing
authority having budgeting jurisdiction to reimburse the
assisting agency for any actual costs or expenses incurred by the
assisting agency performing hereunder when assistance is
requested under Section 2: Provisions For Operational Assistance.

SECTION6. INDEMI~IFICA~ION-
Each party engaging in any mutual cooperation and
assistance, pursuant to this Agreement, agrees with respect to
any suit or claim for damages resulting from any and all acts,
omissions, or conduct of such party's own employees occurring
while engaging in rendering such aid pursuant to this Agreement,
to hold harmless, defend and indemnify the other participating
party and its appointees or employees, subject to provisions of
Section 768.28, Florida Statutes, where applicable, and provided
such party shall have control of the defense of any suit or claim
to which said duty to indemnify applies.
SECTION 7. LIABILIT~ INSURANCE.
Each party shall provide satisfactory proof of liability
insurance by one or more of the means specified in Section
768.28(14), Florida Statutes, in an amount which is, in the
judgment of the governing body of that party, at least adequate
to cover the risk to which that party may be exposed. Should the
insurance coverage, however provided, of any party be cancelled
or undergo material change, that party shall notify all parties
to this Agreement of such change within ten (10) days of receipt
of notice or actual knowledge of such change.
SECTION 8~ EFFEQTIVE DATE.

b. In addition to the terms set forth in paragraph "a" of
this section, this agreement shall only become in full force in
effect upon ratification, by proper adoption of a resolution by
the City Council of the city of Sebastian.
SECTION 9. CkNCELLATION.
This Agreement may be cancelled by any party upon delivery
of written notice to the other party or parties. Cancellation
will be at the direction of any subscribing party.

SUMMARY STATEMENT
On June 14, 19S9, the City Council adopted Ordinance 0-89-08, which
approved the Conceptual Development Plan for Collier Place Plan Unit
Development. The Land Development Code requires the applicant to submit a
Preliminary Development Plan within 18 months from approval of the
Conceptual Development Plan. At the City Council's regular meeting of
December 12, 1990, the new owners at that time, Mr. Edgar Schlitt and
Erwin Berlin requested a time extension of the Conceptual Development Plan
for the P.U.D. After reviewing the request, the City Council directed the
City Attorney to draft an ordinance to grant a time extension for the
Collier Place Plan Unit Development, provided, there was wording within
the ordinance concerning the upcoming new airport zonin~ law. After two
months working with the applicants' attorney, Mr. Charlie Nash received a
Certificate of Sale from the applicants' attorney indicating that Mr.
Schlitt and Mr. Berlin no longer have ownership interest in the property,
Since the Conceptual Development Plan for Collier Place P.U.D. has expired
and there is no formal request by the current owner to show good cause to
extend the Conceptual Plan, staff recommends that the City Council hold a
public hearing pursuant to Section 20A-4.9 (E)(i) of the Land Development
Code to consider terminating the Conceptual Development Plan.
RECOMMENDED ACTION
Move to direct the City Attorney to draft an ordinance to terminate the
Conceptual Development Plan for Collier Place P.U.D.

Please be advised that Attorney Fred T. Gallagher provided me
with a copy of the Certificate of Sale entered in the mortgage
foreclosure action against Ed Schlitt and Irwin Berlin, et al., a
copy of which is enclosed with this letter for your reference.
Attorney Gallagher advises me that the attorney representing the
people who now own the property as listed on the Certificate of
Sale is Ms. Jan A. Yellen, 1104 Ponce deLeon Boulevard, Coral
Gables, FL 33134.
I recommend that a report be made to the City Council advising
the City Council that Mr. Schlitt and Mr. Berlin no longer have
an ownership interest in the property in question and, therefore,
there is no need at this time to pursue passing proposed
Ordinance No. 0-91-02.
Should you have any further questions regarding this matter or if
you need any further action taken by me in this regard, please do
not hesitate to contact me. Otherwise, I will close my file in
this matter. .

SUMMARY STATEMENT
The United States Coast Guard Auxiliary provides courtesy marine
vessel examinations as part of its effort to improve boating
safety. The Coast Guard Auxiliary wishes to use the Sebastian
Yacht Club parking lot to conduct its examinations and to post
temporary signs informing the public of these examinations.
There is no fee for the examination and the United States Coast
Guard Auxiliary provides the courtesy examination as a public
service through its volunteers.
RECOMMENDED ~CTION

vessel examinations at the sebastian Yacht Club.

I have very active in the Coast Guard Auxiliary for 15 years doing
patrols out of Sandy Hook and Manasquan Coast Guard Stations in New
Jersey, also doing between 100 and 300 Vessel Examinations yearly for
13 years and also active in the Public Education Courses in Boating
and Sailing Safety Courses and now I have transferred into Floti].la 56
and have been appointed the new Vessel Examination Officer in charge
of all Vessel Examiniers in Flotilla 56 and would like very much to get
busy getting the boats in our area examined to let the public know what
equiptment is required aboard their boats to meet the State and Federal
Regulations. With your help I hope to get most of our Vessel Examiniers
out at our Vessel Examination Stations located at different launching
ramps to assisst the public, we will ask if they wish to have their boat
examined and also inform them of our Boating Safety Courses where they
will recieve a certificate on the completion of the course.
To do this seeing that we are an all volunteer and non-profit organiz-
ation very low on funds we are hopeing that. you could have 4 signs made
for us by the road department or whoever it is that does this for the
city. The signs should be approxmately 3 to 4 feet wide by 3 feet long,
these signs should read:

When I lived in New Jersey I asked Somerset County for the Flotilla I
belonged to there and was successfull and I am hopeing I will be just
as successfull in my new State and City and I enjoy serving the public

I would like to discuss:
The City of Sebastian form a Design Competition of all interested
architects whose principal place of business is located in Indian
River County, to produce Presentation Quality Drawings and
Renderings of the Sebastian Riverfront and surrounding areas; and
further, entrants use the Report of the Sebastian Riverfront
Committee as the Design Guide for the Competition, for the express
the purpose of Public Exhibition of said Drawings and Renderings
at the July 4th, 1991 Celebration in Sebastian, Florida; and
further, that the City of Sebastian seek public input, by asking
registered Sebastian voters to cast "ballot" expressing their
choice; and further, that Sebastian City Council be directed to
follow the express wishes of the registere~ Sebastian voters on
that day.

SUMMARY STATEMENT
At the Regular Meeting of March 27, 1991, Councilman Peter Holyk
volunteered to serve as Sebastian's representative on the Indian
River County Property Acquisition Committee. After reviewing the
committee meeting schedule for the Acquisition Committee,
Councilman Holyk has encountered a conflict with his inflexible
professional schedule and therefore, respectfully requests a
realignment of appointments be considered.
RECOMMENDED ACTION
Review appointment of City Councilman to various committees.

I would like to discuss:
While alternatives to the Rt 512/US 1 dilemma are being examined,
that Sebastian exercise all possible restraint in connecting
existing Sebastian roads to existing Roseland roads to respect
the expressed wishes of the Roseland Property Owners Association,
to control increased traffic through their bedroom community.

a member of the on the committee in January~JlmJ~9~. I
never heard from anyone until after April 12. 1990. due to the fact
that I was pictured in the paper at US Sl and Hain Street at the
'Rampless Curb'. I got a call then, only to tell me I should not
do this. One week later, we had our first meeting in two years.
The next meeting was November 16, 1996.
We have worked with the City in many ways to make places access['b'le
for all people. As I have asked at meetings, 'Why can't we have
monthly meetings'? We send letters out noT knowing for months if
anyone even reads thee, let alone what was done about it. if any-
thing. I feel this is not the way to keep informed.
This is the 1990's and we are trying to help each other make Sebas-
tian a place that everyone can enjoy living in.
I find that the word 'HANDICAPPED COHHITTEE' a work of the 1950's
and 60's. I am not HANDICAPPED. and anyone that knows me will tell
you so. Some of the other committee members fight each day much
more than I do. We all know we are PHYSICALLY CHALLEEGEDt every
hour of each day,k pushing to do a good job at whatever needs to be
done.
But to be HANDICAPPED i~ unacceptable. Therefore, I truly hope you
will agree with me and decide to rename this Commit~ee what i~
really is~ SEBASTIAN PHYSICALLY CHALLENGED ~VALUATION COHHITTE~.
