Dear Mayor Powell and Council Members,
Due to a prior commitment':, I am unable Lo attend this e~en~ng's
council meeting. I did however, wa~t to comment on two items.
Item #F under the Con~ent Agenda suggests a price of $28,000 for
a point of sale computer ~yst, em for the golf course, while I
really do not know the .~t. ent of the equipment needed, this
amount seems excessive, so I urge the Council to take a careful

Clarification Regarding Finance Bid Procedure
There has been some questions concerning the procedure on the
Finance Renovation Bid which, this memorandum should clarify
the procedure and staff's recommendation.
In the past, renovations have been accomplished by either:
(1) Hiring individual subcontractors and the City acting as
the General Contractor. This method is acceptable and
requires a member of staff (usually myself) to cooridinate,
and monitor the job.
(2) Hiring a general contractor or bulling contractor to
construct all of the renovations as a "Turn Key Job".
There has been some concerns expressed in the past regarding
the City acting as a general contractor. In order to
determine which method would be benefical to the City. staff
prepared two separate bids for the Finance Department
renovation. One bid was advertised for a General Contractor
to perform all tasks (Carpentry, Painting, Carpet, Ceiling
Tiles, Air Conditioning, etc.) and supply all materials
involved with the renovation of the Finance Department.
Staff also requested bids on individual subcontractors such
as painting, drywall, electrical, acoustical ceiling,
carpentry, carpet and cabinet work. Due to the minimal
expense on items such as plumbing, hardware, glass and air
conditioning ducts, bids were not requested.
While the bid for the finance renovation bid was being
prepared, it was determined that the new police facility

needed a bid for cabinet work. In order to save costs, staff
incorporated the police cabinet work within the cabinet bid
of the subcontractor as an add alternate and included the
police cabinet work within the General Contractor as a deduct
alternate.

Ordinance shall not be affected and it shall be presumed that the
City Council of the City of Sebastian did not intend to enact such

invalid or unconstitutional provision. It shall further be
assumed that the City Council would have enacted the remainder of
this Ordinance without said invalid and unconstitutional
provision, thereby causing said remainder to remain in full force
and effect.
Section 5. EFFECTIVE DATE. This Ordinance shall take
effect immediately upon final passage.

SUMMARY STATEMENT
A scrivener's error has been discovered in the body of recently
recorded vacation of easement Resolution No. R-92-12, adopted by
City Council at its February 26, 1992, Regular Meeting.
The City Attorney's office has prepared Resolution No. R-92-27
which will, by its adoption, amend Resolution No. R-92-12 and
correctly approve the vacation of easement between Lots 4 and 5,
Block 1, Unit 1, Sebastian Highlands.
Upon execution, this resolution will be recorded with the Clerk
of the Circuit Court.

Mr. Wayne Kroegel is requesting the City Council to approve his request to
utilize Riverview Park on May 23. 1992 for an annual picnic for the Early
Settlers of Lower Indian River County. Staff has no objections to the use
of the park for the annual picnic but. Mr. Kroegel has requested the City
Council's permission to supply chairs. P.A. system, and City personnel to
set up this event. Even though this is a worthwhile event, staff would
have serious concerns setting a precedent by allowing City personnel and
equipment to be utilized by private organizations.
RECOMMENDED ACTION
Move to approve the request by Wayne Kroegel to utilize Riverview Park on
May 23, 1992 for the Early Settlers of Lower Indian River County's annual
picnic but, respectfully deny their request to utilize City equipment or
personnel. This approval is subject to the following conditions:

No vehicles within the park.

relative to the use of RiverView park by the Early Settlers of Lower Indian River
County:
We would like approval to use the park from 9:00 AM to 1:00 PM on
May 23, 1992, for the purpose of holding our Annual Picnic
We would like to have the City's Public Works Department set up 20 tables and
approximately 100 chairs in the park for that day, for our use. We think and
hope this could be accomplished by a minimum number of people from your
PWD crew.
We would like to know if you can please provide us with a microphone and set it
up for us.

The Board of Adjustment, at its special meeting of April 27, 1992,
approved a motion to recommend to City Council the appointment of
alternate John Price to the full time position which will be vacated by
Walter Shields at the expiration of his term on 5-21-92. The Board also
made a motion to recommend the appointments of Cranford Sproul and Donald
Elsessor to the two alternate positions (in anticipation of the vacancies
created by moving Fred Buechling and John Price to regular member
positions).
RECOMMENDED ACTION
Move to approve the appointment of John Price as a full time member to the
Board of Adjustment for a three year term to expire 5-21-95; move to

In accordance with City Council direction and procedures gleaned
from a meeting of the City Manager, Director of Community
Development, all board secretaries and me relative to board
appointments and terms, I am enclosing applications for Walter
Golembeski and Kenneth Meguin.
These applicants applied to serve on other boards, however, when
asked on page two of the application form were they interested
in serving on other boards they both responded that they were.
These applications were not able to be seen by the Board of

SUMMARY STATEMENT
The Planning & Zoning Commission reviewed and approved the conditional use
permit and site plan (Phase I) for the United Church of Christ on April 2,
1992. The City Clerk's office on April 8, 1992, received an appeal from
Mr. and Mrs. Butch regarding the Planning and Zoning Commission's decision
of April 2, 1992. After reviewing the letter of appeal, I have contacted
the appellants and informed them to be prepared to be specific on how they
are aggrieved by the Planning and Zoning Commission's decision, i belive
there are two issues (1) the use of the property, and (2) the fifty foot
ingress/egress easement noted on the subdivision plat.
The use factor stems from the subdivision covenants restricting the use to
single-family. I have informed Mr. Butch that this would be a civil
matter and also informed him of Paragraph 9 of the covenants which allows
Dr. Fischer the right to annul, waive, change or modify any of the
covenants, reservations and restrictions contain as to any lot and said
plat. Due to the church site plan meeting all the criteria set forth in
the conditional use permit, there should be no basis for an appeal
regarding the use of the proerty for a church.

Regarding the ingress/egress easement, I have the following comments
regarding the 50 foot ingress and egress easement:
Phase I of the church site plan which was approved by the Planning &
Zoning Commission, indicates only two (2) parking stalls within the
ingress/egress easement but, is located on Lot 5, west of the curbcut.
Since this easement is for the adjoining lots to gain access through
Lot 4 and the church owns all the lots to the west of the curbcut,
two parking stalls do not affect the owners east of the curbcut.
Phase I of the site does indicate three (3) handicapped parking stalls
outside the easement and the maneuvering is located within the
easement. Maneuvering does not affect the ingress or egress of
vehicles that would traverse this easement.
The church will be required to obtain letters of non-objection from
adjoining lot owners prior to the Planning and Zoning approving Phase
II parking or redesign the parking outside the easement.
I have reviewed this matter with Mr. Richard Torp¥, Assistant City
Attorney, and he has concurred with my assessment of this matter.

SUMMARY STATEMENT
At its regular workshop meeting of February 5, 1992, the City Council
reviewed the possibility of relocating the historical house of Laura
Jackson within the City of Sebastian City limits. Although there was no
specific location approved, City Council did concur that this would be an
appropriate historical house to be placed within the City of Sebastian and
directed staff to help Mr. VanDeVoorde in his endeavor.
Staff has reviewed the request of Mr. VanDeVoorde to locate the structure
at the Police Station site of U.S. #1 and have determined that this
location would be suitable only if some of the large oak trees were to be
trimmed in order for the building to be brought in due to the structure
being a two-story building.
Staff would recommend the City Council review the location of the Schumann
site that was approved by City Council pursuant to Resolution R-88-18 for
the Sebastian River Area Historical Society, Inc. Enclosed in your packet
is a vicinity map and a proposed site plan indicating the building
location and parking. Even though the Historical Society has not pursued
this location actively, it appears the special use permit is still valid
with no expiration date.

Dear Mr. McClary, Mayor, and Council members:
I am the personal representative for the estate of Laura Jackson,
who died September 2,1991. Part of her estate is a wood frame
home, built we believe, in 1910, which has to be moved from it's
current location. I believe this home is a historical site, and
should be preserved for the future, both because of it's age and
because it was Mrs. Jacksons's.
The Sebastian Historical Society has agreed to be responsible for
operating the house, either as a historic site, or a museum.
However, we need a piece of land to place it on. I believe a
choice site would be Main Street and U.S. #1 in Sebastian, where
the police station is currently located, since it is centrally
located within the historic district, close to other historic
sites, and has easy transportation access for tourists.

A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA,
GRANTING TO THE SEBASTIAN RIVER AREA HISTORICAL
SOCIETY, INC., A SPECIAL USE PERMIT PURSUANT TO SECTION
20A-2.6, LAND DEVELOPMENT CODE~ PROVIDING AN EFFECTIVE
DATE.
WHEREAS, The Sebastian River Area Historical Society,
Inc., has applied to tbs City of Sebastian, for a Special
Use Permit pursuant to Section 20A-2.6, Land Development
Code of the City of Sebastian, and,
WHEREAS, the proposed use of a residential structure for
a museum on land that is zoned Residential (RS-10), and,
WHEREAS, museum use is not a permitted or a conditional
use in the zoning classifioation of tbs land sits; nor is this
#
use a special exception, and,
WHEREAS, the only manner in which tbs proposed use can be
authorized by the City is through the procedure of "Special Use"
pursuant to said Section 20A-2.6, and,
WHEREAS, the proposed use is not barred by the City of
Sebastian Comprehensive Land Use Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS=
1. Tbs City Council has held a Public Hearing on the
Application on Wednesday, March 23, 1988, and heard
testimony of all interested parties, and having considered
said evidence, the City Council finds and determines as
follows=
(A). The proposed use does not violate the Comprehen-
sive Land use Plan or other applicable rule or regulatlon~
(B). The granting of this special use will not be
detrimental to the public safety, health or welfare or be injuri-
ous to other properties or improvements within the immediate
vicinity in which the subject property is located. (See Exhibit A
description).
(C). The use requested is consistent with the purpose
and intent of the respective district, and can be demonstrated to
be similar in nature aha compatible with the uses allowea in such
di~trict.
2. This special use is granted with the understanding that
the specifics of the proposed structure must otherwise comply
with all applicable ordinances, rules and regulations, of the
City of Sebastian.
3. This Resolution shall be effective immediately upon
final passage.

SUMMARY STATEMENT
At its regular workshop meeting of February 5, 1992, the City Council
reviewed the request of Mr. Edward Kennedy to vacate the alley located
west of the existing Community Center between lOth (Madison Street) and
11th (Jackson Street) Street. The City Council did concur with staff's
recommendations to vacate the alley and directed the City Attorney to
draft an ordinance.
RECOMMENDED ACTION
Move to approve first reading of Ordinance O-92-10 and set public hearing
for June 10. 1992.

AN ORDINANCE OF THE CITY OF SEBASTIAN, INDIAN
RIVER COUNTY, FLORIDA, VACATING A CERTAIN
ALLEY LOCATED WEST OF THE EXISTING SEBASTIAN
COMMUNITY CENTER ~DJACENT TO THE 11TH STREET
RIGHT-OF-WAY; PROVIDING FOR THE PRESERVATION
OF CURRENTLY EXISTING PUBLIC UTILITY
EASEMENTS; PROVIDING FOR RECORDING; PROVIDING
FOR REPEAL OF ORDINANCES OR PARTS OF

WHEREAS, the City Council of the City of Sebastian, Indian
River County, Florida (hereinafter the "City Council"), has
determined that the alleyway located west of the Sebastian
Community Center, adjacent to llth Street, in the City of
Sebastian, Indian River County, Florida, (the "Alley"), no longer
serves the public interest and necessity; and
WHEREAS, the City Council, on behalf of the City of Sebastian,
has determined that it would be in the best interests of the city
of Sebastian and its residents to vacate the Alley.
NOW, THEREFOREt BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that:
Section 1. VACATION OF ~LLEY. The City of Sebastian,
Indian River County, Florida, hereby vacates the certain Alley
located in the City of Sebastian, Indian River County, Florida,
more specifically described as the twenty foot (20') alley lying
in Block 5 of OCEANBREEZE HEIGHTS, according to the plat thereof,
filed in Plat Book 2, Page 7, Public Records of Indian River
County, Florida.
Section 2- PRESERVATION OF EASEMENTS. Notwithstanding any
provision contained in this Ordinance to the contrary, the vacation
of the Alley as described in Section I of this Ordinance shall not
operate to terminate any public utility easements currently
existing in said Alley unless the public utilities which currently
have an interest in such public utility easements shall consent,
in writing, to the vacation of any such public utility easements.
SeCt.~on...3, RECORDINg. The City Clerk is directed to
present this Ordinance to the Clerk of the circuit for Indian River
County, Florida, for recording in the Public Records of Indian
River County, Florida.
Section 4. SEVERABILITY. In the event a court of
competent jurisdiction shall hold or determine that any part of
this Ordinance shall not be affected and it shall be presumed that
the City Council of the City of Sebastian did not intend to enact
such invalid or unconstitutional provision. It shall further be
assumed that the City Council would have enacted the remainder of
this Ordinance without said invalid and unconstitutional provision,
thereby causing said remainder to remain in full force and effect.
Section 5. EFFECTIVE DATE. This ordinance shall become
effective immediately upon its adoption.

SUMMARY STATEMENT
Eleven bids were received for the Finance area renovations. One was from a state
certified general contractor with a base bid $42,223.00 plus alternate bid #1 of an
additional $1,500.00 to install 1/2" plywood underlayment over the existing floor.
Also included in the bid is an additional $6,352.00 for cabinetwork at the ~
.station. This gives a net bid for Finance renovations of $37,371.00. The Total of all
low bids from the various sub contractors for the Finance area is $30,613.00 with no
bids offered for acoustical ceilings or carpet and vinyl base. The estimated cost of
these items is $5,000.00. Additionally, no sub-contractor specifications were drawn
for glass windows and wall inserts, but was included in the general contractors
proposal. Adequate funds are budgeted in the Capital Projects Fund.
