SUMMARY STATEMENT
On May 10, 1991, the City received six (6) bids for the
construction of the Sebastian Police Station. The apparent low
bid for the project is Mark Construction Company of Longwood,
Florida for a total bid of $935,000. Also on May 10, 1991,
Architect Design Group ("ADG") presented a construction estimate
of $693,204. While this construction estimate included all items
for the building and site, it did not include an estimate for the
ad, alternate for landscaping. In other words, the apparent low
base bid of $895,000 is some $201,800 over the architect's
estimate.
ADG representatives have met with officials of Mark Construction
Company to identify areas of the construction which could be
eliminated or reduced in order to substantially reduce the cost
of the project. On May 15, 1991, staff met with ADG
representative, Bill Hagert to review potential areas of
reduction. Attending that meeting were, Chief Earle L. Petty,
Larry Napier and myself. I have added a left hand margin note to
the list presented by ADG, which is enclosed for your
information.
I must point out that the City will be faced with other costs as
we proceed with constructing a new police station: IRC traffic
impact fees, connection to public sewer system, telephone system,
communications equipment, and furniture.

At this writing, staff is not prepared to make a recommendation.
We have asked ADG representatives to be present at the City
Council Meeting to review the project, the bids and the
alternatives. Basically, we have three options: a) negotiate a
lower price with the apparent low bidder, b) re-bid the entire
project with a less expensive construction standard, or c)
identify additional funding sources and award the bid to the
apparent low bidder.

RESOLUTION NO. R-91-19
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, ENDORSING THE EFFORTS OF INDIAN RIVER
COUNTY TO HOST THE FILMING OF MOTION PICTURES WITHIN
INDIAN RIVER COUNTY; PROVIDING FOR REPEAL OF
RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners of Indian River
County has adopted a Resolution which extends an invitation to
the motion picture industry to film on location in Indian River
County; and
WHEREAS, the City Council of the City of Sebastian wishes to
express its desire to provide to such production companies as may
choose to film in the County its cooperation and assistance; and
WHEREAS, the City Council of the City of Sebastian regards
the motion picture industry as a compatible and desirable
industry for Indian River County.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Sebastian, Indian River County, Florida, that:
Section 1. ENDORSEMENT. The City Council of the City of
Sebastian hereby endorses the efforts of the Board of County
Commissioners of Indian River County to extend an invitation to
the motion picture industry to film on location within Indian
River County.
Section 2. CONFLICT. All resolutions or parts of
resolutions in conflict herewith are hereby repealed.
Section 3. SEVERABILITY. In the event a court of
competent 3urisdiction shall hold or determine that any part of
this Resolution is invalid or unconstitutional, the remainder of
the Resolution shall not be affected and it shall be presumed
that the City Council of the City of Sebastian did not intend to
enact such invalid or unconstitutional provision. It shall
further be assumed that the City Council would have enacted the
remainder of this Resolution without said invalid and
unconstitutional provision, thereby causing said remainder to
remain in full force and effect.
Section 4. EFFECTIUE DATE. This Resolution shall take
effect immediately upon its adoption.

THE P I LM INDUSTRy
The motion picture, television and recording industry
is booming in Florida. Several factors have contributed to
Florida,s emergence as a mo=ion picture and television
production center, the fir=t and most obvious i~ the mild,
Sunny weather which p=rmit~ filming year-round. Florida
offers a variety of excellent shooting locations from
gleaming cities to small Southern towns, unspoiled beaches
to steamy jungles. Florida is a right-to-w~rk ~=ate with
an expanding t)ooi of talent and tschni=al held as
evidenced by the 2,000 member Florida Motion Picture and
Television A~sociation, and the 33 local film liaison
offtues assisting production on a one-to-one basis.
Perhaps 'th: mos~ important factor propelling Florida
as a rising star is the state,= desire ~o succeed and its
willingness to "go that extra mile" to attract productions
away f~om Hollywood and New York.
Florida is committed to the film industry. The
Department of Commerce facilitates the film industry
through the Pilm Bureau in Tallahasses. Over th~' past 10
ymara, the Film BUreau has led the nation in innovative
approaches to attract movie and t~levision productions to
the state. Florida is now ranked third, behin~ California
and New York, in the number of productions and revenues
from budgets.
Acccording to ~tati~tios compiled by the Film Bureau,
an e~timated $220 million was spent on film proJect~ shot
in Florida in 1989. This included &6 major, productions,
comDrim=d of feature films and television Dr~ject~ in
addition to 15,325 TV commercials, training film.,
=e¢or~ing projects and MTV style video~. Through Segt=mber
1990 that figure increase~ to $~4 million.
Why do' we want this activity? Generally, of the
budgets for film, television and advertising, 40% to 60%
of ~hat money stays in the lo,al ¢~mmunity in the way cf
Jobs. trades, and support servioe~ ~uch a~ hotal~, mote!~,
restaurants, and transportation. In othe~ words, the money
stays and they leave without any impact on infrastructure;
such as road~, water, sewer or schools.

The Film Bureau has recognized 37 countie~ in Florida
as film liaison offices each with its own office and
professional experienced mtaff. Indian River County is one
of those film offices. To further upgrade our presence
nationally the state has instituted a program called

to respond to the industry in a more timely

Ready office has the commitment of thmir local government,
plus t~e suDpor~ of the Florida Film Bureau and their

2) Co,unity A~essment and Presentation, $) Site Location
InVentory, 4) Support Group Inventory and 5) Local
Government Support. Please refer to the handout for brief
description of each category.
We appreciate the opportunity :o meet with you today.
We are asking for your (Economic Development Council)
support in addressing the last requirement...to approve
our program and to request t_he County Commission, through
~Caro!yn Eggert, to adopt a re~olution as a "film
friendly" community. (Please see exhibit as a sample
resolution.)
Within five years, Florida will be doing over $1
billion in production sta~ewide, competition for the
industry is intense, wi~h all 50 ~tatem now boamting that
they are the "ideal" location for motion picture,
=~lmvision, videotape and music production. Proper
preparation and re~pons~ oa~ make the critical difference
in a community favor. As thQ industry grows Camm~a Ready
will become a highly ~e~lrable and profitable designation.
Many Volunteer hours have gone into the organization
and p~eparatlon of our quest to become a Camera Ready
=~mmunty, A preliminary package for certification will be
reviewed in Tallahaseme in April. We will be ready for an
audit and si~e visit by the Film Bureau in June.
In clo~ing, the entertair~ment industry was made for
Florida, It's a cl.an, glamorous, high wage indus=~
that not only con~rlbutes to the state and local economy,
but also provides immeasurable "free" ~ublicity for a

SUMMARY STATEMENT
Attached is Resolution No. R-91-17 relating to Cemetery lot rates as
reviewed by City Council at the workshop meeting of May 1, 1991. City
code section 8-26 mandates the rates be set by resolution of the City
Council. The rates were determined to be fair and reasonable compared to
those charged by private and municipal cemeteries in the surrounding area.
The current rate resolution provides for no charge for cremation burials
or corner markers. The proposed resolution providea, for estab!ish.ment of
these charges.

RESOLUTIONS OR PARTS OF RESOLUTIONS IN
C0NFLICTHEREWITH; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sebastian, Indian River County, Florida,
owns and operates a municipal cemetery; and
WHEREAS, the City has previously established rates with
respect to cemetery lots in said municipal cemetery by resolution,
as required by Section 8-26 of the Code of Ordinances of the City
of Sebastian; and
WHEREAS, the City Council for the City of Sebastian has
determined that due to substantial increases in the population of
the State of Florida in general, and in Indian River County in
particular, there exists the possibility that burial space in the
municipal cemetery will be exhausted; and
WHEREAS, the City Council has further determined that existing
rates for cemetery lots in the municipal cemetery are substantially
below those charged by private and municipal cemeteries in the
surrounding area; and
WHEREAS, the City currently has no rates for cremation burials
or corner markers; and
WHEREAS, the City Council has determined that in order to
assure adequate burial space for the residents of the City of
Sebastian, existing rates must be increased to amounts comparable
to those of other cemeteries in the surrounding area and rates must
be established for cremation burial and corner markers.
NOW, T~EREFORE, BE IT RESOLVED BY T~IECiTY COUNCIL OF THE CITY
OF SEBSATIAN, INDIAN RIVER COUNTY, FLORIDA, that:
Section 1. CITY RESIDENTS. The price for burial space for
legal residents who reside in the corporate limits of the City of
Sebastian, and in the unincorporated area of Indian River County
known as Roseland, shall be as follows:
(a) $400.00 per individual lot;
(b) $200.00 per 4-foot x 4-foot cremation lot.
Section 2. COUNTY RESIDENTS. The price for burial space for
legal residents who reside in Indian River County, other than
individuals residing in Sebastian or in Roseland, shall be as
follows:
(a) $500.00 per individual lot;
(b) $250.00 per 4-foot x 4-foot cremation lot.
Section 3. OUT-OF-COUNTY RESIDENTS. Burial space may be
purchased by individuals not residing in Indian River County on an
.availability basis and the price for such burial space shall be as
follows:
(a) $600.00 per individual lot;
(b) $300.00 per 4-foot x 4-foot cremation lot.
Section 4. SERVICES INCLUDED. The purchase price for burial
space includes sodding of the grave site and perpetual care, but
does not include the cost of installing a suitable concrete

foundation for grave markers as required by Section 8-34.1 of the
Code of Ordinances of the City of Sebastian.
Section 5. OPENING OR CLOSING GRAVE OTHER THAN DURING NORMAL
HOURS. The fee for opening or closing a grave other than during
regular working hours, including weekends and holidays, shall be
$35.00.
Section 6. CREMATION BURIALS. The fee for cremation burials
shall be as follows:
(a) $15.00 per cremation burial;
(b) $20.00 per cremation disinterment;
(c) $35.00 per cremation burial and disinterment.
Section 7. CORNER MARKERS. The fee for corner markers with
last name and initials of the deceased shall be $11.00.
Section 8. CONFLICT. Ail resolutions or parts of resolutions
in conflict herewith are hereby repealed.
Section 9. SEVERABILITY. In the event a court of competent
jurisdiction shall hold or determine that any part of this
Resolution is invalid or unconstitutional, the remainder of the
Resolution shall not be affected and it shall be presumed that the
City Council of the City of Sebastian did not intend to enact such
invalid or unconstitutional provision. It shall further be assumed
that the City Council would have enacted the remainder of this
Resolution without such invalid and unconstitutional provision,
thereby causing said remainder to remain in full force and effect.
Section 10. EFFECTIVE DATE. This Resolution shall take
effect immediately upon its adoption.

August 17th, 1991. At the present there is no rain date
anticipated. At the proposed rally we would have a Christian
band, local talent and special speakers. We would also
like to run a concession stand. We plan to sell Hamburgers,
Hot Dogs and Cokes.
This would be an all day event, as we would require
setup and cleanup time. There will be other churches in-
volved and the public will be invited. We assure you that
the park will be clean when we leave.

At the Regular City Council Meeting of May 8, 1991, the City
Council deferred action on a proposal from Dobson, Bjerning,
Duffey & Rosenfield in the amount of $25,000 to serve as the
City's computer consultant. At that time, it was a consensus of
City Council to seek other proposals. Subsequently, I discussed
the selection process with City Attorney, Charles I. Nash who
recommended that the process in Section 473.317 "Competitive
Negotiation" be utilized when selecting an accounting firm to
serve as the City's computer consultant. This process is similar
to the engagement of engineering or architectural consultants
which utilizes the basis of qualifications rather than fees as
the criteria used to select the consultant. Since City Council's
concern was on the amount of fee rather than the qualifications
of the firm, I have asked Dobson, Bjerning, Duffey & Rosenfield
to submit another proposal which would provide for various
alternates in evaluating the City's needs. The City is not
required to engage an accounting firm to provide computer
consulting. However, the computer system must perform to very
specific accounting requirements for governmental fund accounting
and i believe it to be in the best interest of the City to
utilize our auditors, if we can afford to do so, for this work.

An independent evaluation of both software and hardware systems and their

Since our firm is not associated with any vendor of computer hardware or software
products, we are able to provide you with an objective, independent viewpoint in
the evaluation of these products.

submit a formal engagement letter covering the objectives, scope, approach,
benefits, timetable, client assistance, and expected project reports.

Dear Rob:
Thank you for the opportunity to offer the expertise and
experience of Masteller, Moler & Mayfield, Inc. relative to the
proposed referenced project. We propose to provide you with
the necessary survey, study, design plans and engineering
services to complete the following scope of work:
PHASE I - LOUISIANA SURVEY
Phase I consists of the following surveying services:
Determination of exisiting centerline location
throughout the Louisiana Corridor
Determination of existing right-of-way boundaries
Location of all topographic features visible within
30' each side of the existing centerline
Development of typical existing topographic
cross-sections
every 100 LF through the Louisiana Avenue Corridor
Horizontal location of all major intersections
PHASE.II - SCHUMANN DRIVE. DRAINAGE SURVEy
Phase II consists of the following survey services:
Topographic survey adequate to verify drainage shed
boundaries
Horizontal and vertical location of all existing
drainage structure and pipe invert locations within
affected areas as delineated on attached Figure #2

~SE III - ENGINEERINGSTUDY/PRELIMINARY DESIGN
RECOMMENDATIQNS FOR b0UISIANA AVENUE
Phase iii will consists of a preliminary evaluation of
existing right-of-way as determined by survey base
plans. This Phase will also include an evaluation of
the existing horizontal and vertical alignment including
the intersections of Louisiana Avenue/Main Street and
Louisiana Avenue/County Road 512. Specific items which
would be studied would be impacts of potential
realignment of substandard curves through the Louisiana
corridor and delineation of potential right-of-way which
may be required to correct any deficiencies. In
addition, a Prelimiary Master Stormwater Management
System would be evaluated including identification of
stormwater outfall locations along with analysis of
their capacity. This stormwater management analysis
would include a cursory review of effective permitting
criteria as may be imposed by the St. Johns River Water
Management District and other applicable agencies. Any
potential parcels which may be required for stormwater
management or stormwater treatment would be identified.
All of the information outlined above would be
assimilated in an engineering report and submitted for
review. Attachments to the report would include
exhibits recommending preliminary alignment adjustments;
potential right-of-way acquisition; stormwater
management/treatment facilities; and stormwater outfall
locations.
PHASE IV - ENgiNEERING DESIGN FOR SCHUMANN
DRAINAGE IMPROVEMENTS
DRIVE
Phase IV will include development of a detailed
Engineering Drainage Study and drainage map which would
formalize drainage shed boundaries as delineated in
attached Figure #2. Comprehensive stormwater management
calculations are included within this phase. Peak
discharge rates will be determined from the stormwater
management calculations. Peak discharge rates will be
utilized to develop conveyance pipe size and finalize
drainage structure design. All drainage structure and
outfall pipes within the effected area as delineated
within Figure #2 would be addressed. Detailed
construction plans and specifications for the
reconstruction of all systems redesigned would be
included in this Phase. These plans would contain plan
location and profiles for all drainage structure and
outfall pipes effected.

We propose to perform the above scope of services for
Phases I through IV of the "Project" for the total lump sum fee
of $36,500.00.
PNAS~ V -.CONSTRUCTION I~SPECTION~CONTRACT.ADMIN.
We shall complete the necessary inspection and contract
administration during construction of this project for
Schumann Drive drainage improvements as required by issued
permits and/or as desired by you. Inspection for the
project shall be sufficient to permit us to issue the
required certifications as required by .applicable
regulatory agencies. We shall perform Inspection Services,
Certifications and Contract Administration at hourly rates
as specified in Section (d) of this proposal, with a
budgeted amount of $ 2,950.00. This amount is not
included in our lump sum fee quoted above.
Fee is payable $3,650.00 as retainer with billing monthly
based on the estimated percentage of the total project services
completed to that date. The retainer will be deducted from the
final invoice.
For any and all subcontract services invoiced through our
office, there will be a minimum 10% surcharge of the face
amount of said subcontractor's invoice, in order to cover the
costs associated with administration and coordination of the
subcontractor's services.
Any and all items not specifically set forth in this
proposal are excluded. In addition, any expansion of the scope
of work or major revisions which may be required by any new
rules or regulations enacted subsequent to the date of this
proposal, are not included.
In addition, the following items are stipulated:

However, should the need arise for additional engineering
design work by virtue of revisions or redesign required by you
or any governmental reviewing agencies, then additional
billing will be based on the fee schedule included hereinafter
under Item (d), or this Contract can be renegotiated to the
satisfaction of both parties.

Payment of all fees for services rendered shall be paid
within thirty (30) days of billing. Commencing on the
thirty-first day, interest shall be added to the unpaid balance
at the rate of one and one-half percent (1-1/2%) per month or a
total of eighteen percent (18%) per annum. In the event that
the matter of delinquent payments shall be turned over to legal
counsel for collection, legal fees incurred for collection
shall be added to the outstanding amounts due.
The original plans, designs and documents prepared by
Masteller, Moler & Mayfield, inc. shall be the sole property of
that firm. Owner/Client agrees that until payment is made in
full, he, she, or it shall have no proprietary interest in any
copies of the plans, designs and/or documents prepared by
Masteller, Moler & Mayfield, Inc. In the event of non-payment
of outstanding fees by Owner/Client, Masteller, Moler &
Mayfield, Inc. shall have the absolute right to request return
and/or withdrawl of any and all plans, designs and documents
submitted to Regulatory Agencies or other parties on behalf of
the Owner/Client.
d) AdditiQnal Work Performed
Any and all work performed, other than that specifically
contracted for within this general contract, shall be billed at
the following job classification and rates:

Nevertheless, no representations or warranties are made as
to the success, approval or the issuance of permits on any

Moler & Mayfield, Inc.
Backcharges will not be accepted by Masteller, Moler &
Mayfield, Inc. unless we provide written agreement covering all
corrective action and the total amount of the backcharge
necessary to accomplish the corrective action.
f) Reimbursables

developed during the project execution is included within
the fees quoted above for: 1) all permit applications; 2)
all approval applications; and '3) client/owner unless
otherwise stipulated. All other photo copies, prints and
facsimile transmissions will be billed at the following
rates: Photo copies $0.25/sheet; blueline prints 24" x 36"
$1.25/each; reproducable mylars 24" x 36" $10.00/sheet;
and facsimile transmissions 8-1/2"x 11" $1.50/page and
8-1/2" x 14" $1.75/page.

City, County and State regulations relative to the proposed

While binding upon the parties, their successors or
assignees, this Contract may not be transferred or assigned
without the consent of both parties. The Owner/client has the
right to terminate this Contract within ten (10) days written

WHEREAS, the Code of Ordinances of the City of Sebastian
currently provides that bid, payment and performance bonds may be
required at the discretion of the City Manager; and
WHEREAS, Florida general law requires bonds for contracts in
excess of $100,000 and provides that bonds for contracts with local
governments of less than $200,000 may be waived by local
governments; and
WHEREAS, the City Council for the City of Sebastian, Indian
River County, Florida, has determined that it is in the best
interests of the City of Sebastian to require bonds for bids and
contracts in excess of $100,000 and to provide for the waiver of
said bonds for bids or contracts which are more than $100,000 but
less than $200,000.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows:
Section 1. Paragraph (b) of Section 2-64 of the Code of
Ordinances of the City of Sebastian, Florida, is hereby amended in
its entirety to provide as follows:
"(b) Bid bonds. Bid bonds shall be required
on al~'"'bids"of more than $100,000. The bid
bond required under this paragraph shall be
included in the bid specifications. Notwith-
standing the foregoing, the city council may,
upon written application made prior to the
time for submitting bids, for good cause
shown, waive the bid bond required hereunder
for bids of more than $100,000 but less than
$200,000. Unsuccessful bidders shall be
entitled to a return of surety after final
action. A successful bidder shall forfeit any
surety required hereunder upon failure on his
part to enter a contract within ten (10) days
after receipt of a proposed contract from the
city, unless such time period is extended by
the city."
Section 2. Paragraph (i) of Section 2-64 of the Code of
Ordinances of the City of Sebastian, Florida, is hereby amended in
its entirety to provide as follows:
"(l) Payment and performance bonds. Any
person entering into a formal contract of more
than $100,000 with the city shall be required,
before commencing work under said contract, to
execute and deliver to the city a payment and
performance bond with a surety insurer
authorized to do business in the State of
Florida as surety and acceptable to the city.
The bond required under this paragraph shall
be included in the bid specifications.
Notwithstanding the fore-going, the city
council may, upon written application made
prior to the time for entering a contract, for
good cause shown, waive the payment and
performance bond required hereunder for
contracts of more than $100,000 but less than
$200,000."
Section 3. CONFLICT. Ail ordinances or parts of ordinances
in conflict herewith are hereby repealed.
Section 4. CODIFICATION. It is the intention of the City
Council of the City of Sebastian, Indian River County, Florida,
and it is hereby provided that the provisions of this Ordinance

shall become and be made a part of the Code of Ordinances of the
City of Sebastian, Florida; that the sections of this Ordinance
may be renumbered or relettered to accomplish such intention; and
the word "Ordinance" may be changed to "Section," "Article" or
other appropriate designations.
Section 5. SEVERABILITY. In the event a court of competent
jurisdiction shall hold or determine that any part of this
Ordinance is invalid or unconstitutional, the remainder of the
Ordinance shall not be affected and it shall be presumed that the
City Council of the City of Sebastian did not intend to enact such
invalid or unconstitutional provision. It shall further be assumed
that the City Council would have enacted the remainder of this
Ordinance without such invalid and unconstitutional provision,
thereby causing said remainder to remain in full force and effect.
Section 6. EFFECTIVE DATE. This Ordinance shall become
effective immediately upon its adoption.

The development of the Barber Street Sports Complex includes a
reorientation of the existing softball field which will require
the acquisition of two (2) residential building lots along the
northern p~rtion of the property. One lot is owned by General
Development Corporation and is the subject of current
negotiations. The other lot is privately held and has recently
been listed for sale by Florida Lifestyle Real Estate, Inc. The
City has attempted to acquire this lot on several occasions over
the past two (2) years. In January, in anticipation of
negotiations, we asked a local realtor to provide data to us
regarding the sale of comparable residential building lots in the
Sebastian Highlands. The average sales price of the eleven (11)
lots analyzed is $10,409 per lot. On April 26th, subject to
conditions outlined in an addendum, I made an offer on this lot
in the amount of $7,500. This offer was accepted by Mr. & Mrs.
John A. Sorensen on May 1, 1991. The addendum included a
condition that the contract is contingent upon the City receiving
the express written approval of the City Council and the
signature of the Mayor. The City Attorney has already approved
the contract.

SUMMARY STATEMENT
The City of Sebastian was apprised by the Sebastian River Watershed Action
Committee (SRWAC) that up to $10,OOO.OO in funds were available to the
City during fiscal year 1990-1991, from a program operated by the St.
Johns River Water Management District known as SWIM (Surface Water
Improvement and Management). These funds will be used to provide
improvements to conservationally sensitive areas within the City. The
$10,OOO.OO in State funds must be matched by the City. The City is
expected to match funds through inkind services and dollars for the
improvements.
The attached documents identify a series of improvements to the Riverview
Park which will provide surface water run-off retention and groundwater
filtration to the Indian River. Preliminary engineering estimates are
for a retrofit facility of the nature identified in the attached
documents, costing approximately $31,OOO.O0 in total.
While the St. Johns River Water Management District has assured the City
of Sebastian and the Watershed Action Committee of its tentative agreement
to provide the City with $10,OOO.OO for this project, the City Council has
yet to formally approve the expenditures required. In addition, bids will
be required for labor and materials. City staff has prepared the
accompanying document for your review of the construction details.

The following points are abtracted to summarize the bulk of the
information provided therein.
Problem Statement:
Sebastian recently employed Mosby & Associates, Inc. to perform an
engineering, topographical and design study to determine improvements to
Riverview Park.
The site review and soil investigation revealed:
100% of the surface water sheet flows without retention or
pretreatment directly into the Indian River. Drainage from
surrounding streets -- Indian River Drive, Harrison and Coolidge
Streets, and Fellsmere Road -- collects and runs off into the river in
this area.
Substances harmful to the ecosystem are discharged into the
Indian River, unchecked. The adjacent street system around Riverview
Park is a primary source of the pollutants.
The existing open drainage ditch fronting Indian River Drive at the
park is fundamental to the site's overall drainage system. However,
it is unsightly and poses a safety hazard to passersby.
The proposed project will remedy the conditions found by the engineer and
provide the City with a physical example of responsible surface water
management, in the form of a retrofit treatment train facility,
permanently constructed and installed.
Completion Schedule=
Project completion is targeted for mid-October 1991, to comply with the
timeframe established by the State (SWIM funds must be used by the end of
the fiscal year in which they are awarded).
Cost:
While SWIM funding has tentatively been agreed upon, the City Council will
receive formal acknowledgment and commitment from St. Johns River Water
Management District within the month of May. Construction start-up is
contingent upon Council's approval to allocate the $21,OO0.O0 local
match portion required by St. Johns River Water Management District in
order for Sebastian to receive any SWIM funds.

RECOMMENDED ACTION
1. Move to authorize allocation of the local match funds, amount not to
exceed $21,OO0.O0 for the R±vervlew Park Improvement Project, required by
St. Johns River Water Management District for distributions through the
Surface Water Improvement and Management (SWIM) Program. The City of
Sebastian Budget adopted for the fiscal year ending September 30, 1991
includes a line item allocation for public parks under Fund: 002 - Capital
Projects, sufficient to meet the SWIM proposal requirements.
2. Move to direct staff to begin the bid process to select contractors
for labor and materials~ work to start upon bid approval by City Council.

-'This proposal is submitted to the St. Johns River Water
Management District (SJRWMD) as the formal ~eguest for
funding for a Surface Water Improvement and Management
Program (SWIM) Demonstration project at Riverview Park,
Sebastian, Florida. Prepared by the Sebastian River
Watershed Action Committee (SRWAC, or Committee), in
collaboration with the City of Sebastian, the proposal
specifically addresses the issues of stormwater management in
a local riverfront district of critical ecological concern.
Grant Authority:
1. SWIM Surface Water Improvement and Management Program
Florida's Surface Water Improvement and Management (SWIM) Act
of 1987 targeted specific state waterbodies as priorities for
restoration, preservation and protection. The Indian River
Lagoon is among the designated priority waters. Six
community-based Watershed Action Commmittees (WACs) may
access available monies of the SWIM Trust Fund, to seek and
demonstrate feasible solutions for correcting or limiting
perceived problems concerning the lagoon. The SJRWMD, as
regional lead authority contracting through the Florida
Institute of Technology (FIT), is empowered to allocate a
portion or-{he SWIM Trust funds toward selected WAC projects
recognized as significant to particular areas of the lagoon.
2. SRWAC Sebastian River Watershed Action Committee
The Sebastian River Watershed Action Committee consists of
concerned citizens that are interested in improving
management of the nonpoint pollutant sources (surface water
runoff) from the Indian River drainage basins and tributary
areas. The St. Sebastian River, whose mouth is at the Indian
River and which forms the border between Indian River and
Brevard Counties, is one such tributary.
Deriving its name from the Sebastian River, the committee
makeup is that of individuals residing and working in either
county, proximate to the Sebastian and Indian Rivers. Listed

Riverview Park Site:
Encompassing the entire block bounded by U.S. Highway One,
Fellsmere Road, Indian River Drive and Harrison Street, this
3.3 acre park was dedicated by the City of Sebastian in 1985.
The City developed the park in cooperation with financial
assistance from the State's Department of Natural Resources'

Florida Recreation Development Assistance Program (FRDAP).
Its companion facility, the .85 acre eastern annex, lies
across Indian River Drive at Fellsmere Road, and borders the
Indian River. Together, the two park sites afford some of
the finer vistas to the Indian River found in the north
county. Riverview Park and the annex provide passive
recreational opportunities, along with picnic shelters and
picnic tables, benches, barbeque pits and a more recently
built (1989) restroom facility. No facilities are provided
or planned for active marine recreational uses.
Conservation Concerns~
-.In compliance with the development mandates contained in the
Conservation Element of Sebastian's Comprehensive Plan
(adopted by Ordinance No. O-89-19 on March-28, 1990), the
City intends to control and protect local water resource
quality. Pursuant to Chapter 163.3177 (6)(d), F.S. and
Chapter 9J-5.O13 (2), F.A.C., specific policies of the
Conservation Element (Chapter 6) read:
Goal 6-1: Conservation. The coastal community of
Sebastian shall conserve, protect, and appropriately
manage the City's natural coastal resources in order to
enhance the quality of natural systems within the
community.
Objective 6-1.2: Water ~ and Ouantitv [...] the
City shall amend its land development regulations and
include performance criteria designed to conserve and
protect the quality of current and projected future
water sources and surface water run-off. The land
development regulations shall include administrative and
site plan review provisions which require that water
supply and quality issues be coordinated with State,
regional, and County governments having jurisdiction.
[...].~he City shall coordinate with the St. Johns River
Water ~Management District for purposes of using
resources available through the Surface Water
Improvement Management (SWIM) program in order to
enhance water quality especially surface waters which
are directed to the Indian River Lagoon. [...]
Polic~ 6-1.2.1: Water Oualltv. Surface Water Management
and Land Use. Land development regulations shall
incorporate the following performance standards in order
to protect the quality of the City's water resources and
to conform with policies of the Hutchinson Island
Planning and Resource Management Plan:
a. Surface water management systems shall be designed

and constructed to retain or detain with filtration,
as a minimum the stormwater run-off generated from
the first one-inch of rainfall over the entire site.
The stormwater design standard shall be predicated

Problem Statement:
Sebastian has recently undertaken an engineering
topographical and design study to determine improvements to
the existing park site layout in Riverview Park's eastern
annex along Indian River Drive between Harrison Street to the
south and Coolidge Street to the north. (The engineering
plans are included as Appendix A.)
During the site review and soil investigation, the engineer
identified that, in conflict with the policies of the
Comprehensive Plan, surface water discharge is adversely
impacting the Indian River Lagoon water quality. The
consultant found that:

directi.on, with no retention and no pretreatment,
directl-~ into the Indian River. Drainage from
surrounding streets--Indian River Drive (County-owned),
Harrison and Coolidge Streets, and Fellsmere Road (City)
-- collects and runs off into the river in this area.
Substances harmful to the ecosystem are discharged into
the Indian River, unchecked. The adjacent street system
around Riverview Park is a primary source of the
pollutants.
The existing open drainage ditch fronting Indian River
Drive between the two parks is fundamental to the site's
overall drainage system. However, its commonly wetted
state is indicative of a need for structural

reconfiguration, to correct the safety hazard its
exposure poses to passersby, and the eyesore created by
pooled water stagnating within it. Because of the area's
high water table condition relative to the park's own
topography, the existing ditch was installed in an
attempt to achieve the desired objectives of good
groundwater percolation and dry retention, as mandated by
SJRWMD and Indian River County for sites located within
high hazard coastal areas. Remaining paramount is the
requirement to provide for an acceptable alternative to
the ditch, supplying the necessary on-site or nearby
water storage, capable of drawing down the water table to
below-parksite levels, and allowing for steady
groundwater filtration.
Three. SWIM Project Description
~ Objectives:
The primary objectives of the proposed project are:
Decrease the quantity of existing runoff from the site by
retrofitting drainage structures and the site's
topography to provide for the on-site retention of the
first three-quarter inch (3/4") of stormwater runoff.
This action complies with and exceeds SJRWMD regulations
for on-line and off-line stormwater treatment and
retention, as specified for the site's distance from the
Indian River Lagoon. (City of Sebastian Comprehensive
Plan. Policies 6.1, 6-1.2, 6-1.2.1.)
Improve the quality of runoff by providing for treatment
through grassed retention ponds, existing grass swales
and strategic emplacement of a perforated pipe located
within an exfiltration trench.
Reduce the pollution loads from the street system
surrounding Riverview Park.
Demonstrate the effectiveness of an on- and off-line
treatment train, including stormwater retention ponds and
a properly maintained exflltration trench to drain
standing water.
Provide a physical example of responsible stormwater
management facilities for public display and education.
Project Method:
1. Scope: Engineered Solution (Treatment Train):
The consultant deemed one method of redress as the most cost
effective, efficient and feasible, concurrent with
development of Riverview Park's eastern annex: Construction
of a retrofit stormwater treatment train. While permanently
mitigating an existing water quality condition at Riverview
Park and the Indian River Lagoon, this project will also
physically demonstrate a sound filtration process, serving
both to educate the public and to promote similar
applications along the waterfront.
The planned site improvements and drainage structures are
detailed below:
Retention Ponds: Riverview Park West and the Indian
River Drive right-of-way contain sufficient space for
retrofit retention ponds. Disruption of existing
facilities on-site will be minimized. Construction of
the grassy retention ponds (two covering approximately
18,O00 square feet in the northeastern corner of the 3.3
acre Riverview Park West) will necessitate partial site
clearance and transplantation of affected trees, grading
and sodding.
Surface Water Runoff Reduction: Waterflow from Harrison
Street, Fellsmere Road and the two intersections
at the latter streets and Indian River Drive will be
routed into the proposed retention ponds for containment
and treatment of sediments and toxins. Runoff currently
occurring at the 1OO% rate, directly into the Indian
River, will be slowed through the treatment train and
reduced by retaining the first 3/4" of stormwater runoff
(the portion most heavily polluted). This is a retrofit
system to which the City has committed, overdesigned to
standards higher than required for a'retroflt. Retention
and treatment of this amount of runoff conforms to the
water quality and quantity standards set by SJRWMD for
new construction within high hazard areas. The system
will provide the capability to retain the first 1/2"
runoff, off-line~ 50% of the off-line retention and
treatment (or 1/4") will occur on-line, for the total
3/4"
Exflltration Trench: Treated groundwater will empty into
the Indian River through a perforated pipe located within
an exfiltration trench within the Indian River Drive
right-of-way (ROW), As a County ROW, Indian River Drive
must meet the drainage criteria for a 25-year, 24-hour

storm event (9" of rainfall). The exfiltration trench
will replace the existing drainage ditch in the ROW
between the two park sites. Perforations throughout the
trench's length (262 it.) will continue to draw the water
table down, as does the existing ditch, but will allow
constant groundwater percolation, drainage and surface
drying. The proposed exfiltration trench is designed to
be flushed clean via cleanouts with a fire hose under
normal conditions, when necessary.
2. Products:
--.Four products comprise the Rlverview Park SWIM Project's
basic community benefits:
Permanently constructed retrofit stormwater management
facilities, creating a treatment train through retention
areas and an exflltration trench.
Stormwater runoff, meeting or exceeding SJRWMD's, the
City of Sebastian's and Indian River County's
requirements for high hazard coastal areas draining into
Class II waters.
Reduction, by 80-95%, in the level of toxins affecting
the quality of stormwater discharged directly into the
Indian River, measureable at the exfiltration trench to
the 5% level of significance.
Physical, educational display signage and project
documentation.
3. Tasks,
The work to be performed in conjunction with this project
includes the following tasks (for the sake of clarity and
continuity,~tasks related to the overall park development
project, but outside the scope of the specific project, are
shown in aggregate):
* Consultant Selection: Completed Site Survey, Design
Drawings & Permit Applications (Appendix A).
* NOTES: The site survey reflects current site
conditions with topographic details of the site.
Scaled design drawings and specifications suitable
for construction of the project have been prepared,
and illustrate that the proposed stormwater
management facilities comply with and exceed the
City's, Indian River County's and SJRWMD's codes and

regulations. Permit Applications to Indian River
County and the SJRWMD have been filed by the
consultant and are awaiting final approval.
Bid Process: The City of Sebastian will prepare,
advertise and receive bids for material and labor costs.
The entire job will be bid at one time, identifying tasks
and timeframes specific to this project.
Construction, Upon obtainment of permits and bids,
construction must be completed. A complete breakdown of
construction activities is displayed under Project
Schedule.
Building Inspections: Throughout and following
construction, all facility structures must undergo and
pass inspections by the city of Sebastian Building
Department to ensure compliance with applicable
regulations.
Public Education: A graphic display, posted near the
project site at the Park, will describe the stormwater
management improvements. Documentation of these
facilities, including photographs made of the different
construction activities will be prepared and provided to
local school districts and to SJRWMD for public
distribution·
Follow-Up and Evaluation, The project will provide a
permanent retrofit facility within an existing park, as
well as structures required for new construction within
an adjoining area. Scheduled in connection with routine
park maintenance, the City of Sebastian shall authorize
inspections and reports of the condition of the new
retention ponds. The SRWAC shall have the responsibility
to evaluate quality of water exiting the exfiltration
trench.-
Four. SWIM Project Schedule
Provided that the City commences work as planned, in the
immediate future, project completion is targeted for
September 1, 1991. This retrofit phase of the overall park
development must be finished prior to completion of other
user-oriented amenities in Riverview Park East.

Five. ~WIM Project Budget
The City of Sebastian City Council reserves the right to
approve all City-related proposals and must obtain bids for
the project. Thus, a complete cost analysis of the total
project has not yet been made. However, initial estimates
bring the price into the $30,000 range for design and
construction of the retention and drainage system.
In general, SWiM funds ($10,000) are proposed solely for the
purchase of materials (for the exfiltration trench);
all other requirements will be fulfilled through local
contributions. It is understood that SWIM funds are
supplemental to those from other sources. The City of
Sebastian ~hall obtain the expense balance through available
alternatives, including in-kind services. Indian River
County has agreed to the proposed demonstration project and
also agreed to participate in its implementation.

experience. With the exception of engineering and design
services, no bids have been acquired. The engineering
consultant provided the City of Sebastian with a
preliminary breakdown of construction activities and
related expenses. Some of the costs were presented to
the City in the aggregate for the total job; the SWIM

The SWIM project is recognized as equalling approximately
60% of the acreage for the total project, or .78 acre of

The Building Department received an inquiry concerning a vacant lot being
prepared to be cleared of its trees for construction of a single family
residence. The inquiry was specifically concerning a tree that was
categorized as a specimen tree pursuant to Section 2OA-14.4 located at 831
Gladiola Avenue (Lot 6, Block 339, Sebastian Highlands). An inspection of
the property reveals a slash pine tree in excess of 20 inches in diameter.
Section 20A-14.4 of the Land Development Code requires all trees that are
20 inches or more in diameter, except those listed in section 2OA-14.12
(prohibited trees) shall be considered a specimen tree and shall not be
remo-ed except for extraordinary circumstances and only by final permit
approved by the City Council. The tree is located on the lot which will
encroach into the proposed building location. The applicant is requesting
the City Council to approve the removal of the tree in order to construct
the proposed single family residence.

1. The city shall take possession of this property upon

nine (9) months unless extended in writing by CAV Corp.
Consideration for this interim period includes: the payment of

2. The purchase price for the property is $485,000.
3. That CAY Corp. will finance the City's purchase of this
property over a five (5) year period at 9 1/2 per cent per annum

4. That interest income for CAY Corp. be deemed tax exempt
from Federal Income Tax by written opinion of bond counsel to be
appointed by the city Council. The city is to bear the sole
expense for the bond counsel.
5. The purchase price of $485,000 is subject to
confirmation as "fair market value" as determined by two (2)
State certified real estate appraisers (Section 475.501 .FS).
The independent appraisers are to be engaged by the city. If both
appraisals indicate the fair market value of less than $485,000
then the purchase price will be lowered to the average of the two
(2) appraisals.

SUMMARY STATEMENT
On February 28, 1991, the City received bids for various contracts at
the Barber Street Sports Complex. On March 13, 1991, upon staff
recommendation, the City Council made bid awards for the project.
Included in the bid awards was one for the irrigation system to Jordan
Sprinkler Systems, Inc., of Vero Beach. The City had received three
(3) bids for the irrigation system. The apparent low, Automatic Rain,
excluded twelve (12) sprinkler heads as specified and was therefore
disqualified. The second low, Jordan Sprinkler, was for $3,005. The
City has had considerable experience with Jordan who has done
projects at the City Cemetery, Barber Street Sports Complex, Schuman
Park, and many others. We believe they were well qualified to do the
work and recol~ended approval of their bid. The third bid United
Irrigation was over $700 higher (23%) than the Jordan bid and was
rejected. After the project began, we discovered that Jordan
Sprinkler Systems, Inc., did not hold a current Sebastian Contractors
License. In reviewing the matter with them, they assumed they were
qualified due to reciprocity between Indian River County and the City.
Last year, however, the City changed its licensing requirements and
allowed current license holders to be grandfathered. Jordan Sprinkler
was not aware of this and did not qualify. We have no reason to
believe that Jordan was acting in anything but good faith and allowed
him an opportunity to become qualified by the May 14, 1991
Construction Licensing Board Meeting. Jordan failed to qualify to
obtain a city license.
In reviewing our options, we find that we can contract with the
Municipal Golf Course which has qualified individuals on staff who are
capable of doing this job. We could rebid the project, but the project
is already delayed six (6) weeks due to the licensing problems with
Jordan Irrigation. We could also work with United Irrigation, but we
do not recommend a bid award to them due to their price. Under any
event, Jordan has not met the specifications which require a City
Contractors License.
Move to terminate the bid award to Jordan Sprinkler, Inc., which
was approved by the city Council on March 13, 1991 and direct the
City Manager to proceed with installing the sprinkler system for
