HomeMy WebLinkAbout01-31-2023 Union MinutesCITY OF SEBASTIAN INTERNATIONAL UNION OF POLICE ASSOCIATIONS, AFL-CIO LOCALS 6054 AND 6056 WAGE ARTICLE NEGOTIATIONS MINUTES OF THE MEETING JANUARY 31, 2023 Present: Nicholas Voglio, Union Representative, Local 6054 and 6056, International Union of Police Associations of Police Associations, AFL-CIO Paul Carlisle, City Manager, City of Sebastian Ken Killgore, Administrative Services Director, City of Sebastian Cynthia Watson, Human Resources Director, City of Sebastian Manny Anon, Jr., City Attorney Joseph Vergnaud, Union Representative Dave Hemp, Construction Specialist Kim Maison, Union Representative Janet Graham, Technical Writer (ON THE RECORD AT 2:11 P.M.) Mr. Carlisle opened the meeting regarding the general employees and supervisors of the City of Sebastian. The others sitting at the table identified themselves and their positions as follows: Cynthia Watson, Manny Anon, Jr., Joseph Vergnaud, Kim Maison, Nick Voglio, and Dave Hamp, and Ken Killgore. Mr. Voglio stated that the reason he suggested that the Union's contract be used was in order to streamline the negotiations. Their goal is to leave the contract at the status quo coming into these negotiations, obviously salary being something that has to be agreed upon. He and his people recognize that fact, and he does not want the City staff to think that there are substantial changes to the articles. He added that he would like to implement the Evergreen Study, if possible, in trying to get the employees' pay rates up to what they should be. Mr. Carlisle made an opening statement that he will have to go back and review this agreement, as he was just presented the Union's draft of the contract today, and the changes made were not tracked in the document. After discussion, it was agreed that the parties would work off of the City's proposed contract dated December 15, 2022. Article 1: Union Recognition — Mr. Anon recommended that the two position classifications be separate, meaning general employees first and then the other designation. After discussion, this article was tabled until the next meeting. Article 2: Management Rights -- Tentatively agreed upon PAGE 2 Article 3: Bargaining Unit Representation/Bulletin Boards -- Tentatively agreed upon except for Subsection 3.2. Article 4: Dues Deduction — Tentatively agreed upon. Article 5: Rights of Employees — Tentatively agreed upon. Article 6: No Strike — Tabled until next meeting. Article 7: Hours of Work and Overtime — Tabled until the next meeting. Article 8: Seniority/Layoff/Recall — Tabled until the next meeting, specifically: Subsection 8.5 (b) the last sentence shall read: "... ten 10) calendar days..." Subsection 8.5 (c), to the wording in the first sentence shall be added "...that they are qualified to perform" The balance of this article is tentatively agreed upon. At this point, Mr. Voglio stated that a potential problem exists because the four Union representatives have been working off the Union contract from 12-15-2022. Mr. Carlisle asked for clarification of the changes (either red, green or bold). Mr. Voglio stated he did not make any changes in green; those changes came from the rank and file. Any bold changes are his. Article 9: Miscellaneous Leave — Tentatively agreed upon except: Subsection 9.1(c) (3) shall read "Part-time employees receive 2 consecutive days (based on their shift hours, not to exceed 40 hours.)" Subsection 9.2 — Where (d) is struck, (a) becomes (d) and (f) becomes (a). Subsection 9.6, Military Leave (a) — Mr. Anon believes this wording is redundant and he suggested other wording. He will review this section and let everyone know what he suggests. After researching this item, Mr. Anon stated this statute pertains to active duty and active duty for training, which are two different things. He added that someone will only get orders if they are on active duty. He added there is no "statement" from the military. There is what is called the "battle assembly schedule," and the soldier knows throughout the whole month when he is going to be off. He suggested adding "or the battle assembly schedule signed by the commander or from the appropriate military commander." Subsection 9.7 (b) (2) shall drop the phrase "Except under unusual circumstances ..." Subsection 9.7 (b) (3) -- Mr. Voglio requested that the wording remain the same as the City's version of the contract. Mr. Carlisle stated he is not certain whether the Department Head without consulting with the City Manager has the authority regarding this item. After discussion, Mr. Carlisle stated he wanted to give this item more thought. (OFF THE RECORD AT 3:20 P.M.) PAGE 3 (BACK ON THE RECORD AT 3:27 P.M.) Subsection 9.9: Personal Leave — Tabled until the next meeting. Article 10: Sick Leave Tentatively agreed upon except: Subsection 10.2 — Tabled until next meeting. Subsection 10.3 — Tabled until next meeting. At this point, there was discussion regarding the Evergreen Study and the spreadsheet related to that study.
