The Planning & Zoning Commission has approved the site plan for the change of use at this location and has recommended to the City Council to approve the special use permit for Mel Fisher. Mr. Fisher has indicated to staff that he is willing to work with the City regarding the building facade and to change the appearance to keep within the intent of the riverfront study theme. Due to the proposed use (commercial museum) is not specifically mentioned as a permitted or conditional use within the zoning code, this use would have to be approved pursuant to Sec. 20A-2.6 of the Land Development Code. RECOMMENDED ACTION Move to approve resolution R-91-26. APPLICATION. FOR SPECIAL USE PERMIT In accordance with Section 20A-2.6, Land Development Code, the city Council may, in its sole discretion, grant a special use permit in any district for a use which is not provided for :in the zoning regulations. All such uses shall not he otherwise illegal, and shall not be specifically prohibited pursuant .to the comprehensive plan or other applicable law.or The City 'Council shall not grant any special use permit under this section, unless it shall make £indings based upon the evidence presen~ted to it in each case that~ 1) The granting of the permit will not be detrimental to the public safety, health o~ welfare or be injurious to other properties or improvements within the vicinity in which the property is located! and 2) The use requested is consistent with the purpose and intent of the respective district, and can be demonstrated to be simlla~ in nature and compatible with the uses allowed in such district. WHEREAS, the City staff has determined that the Applicants' application for a special use permit should be approved subject to certain conditions; and WHEREAS, at its regular meeting on July 11, 1991, the Planning and Zoning Commission recommended approval of the Applicants' request for the granting of a special use permit for the operation of a museum facility on a tract of land the Applicants own located in the City of Sebastian; and WHEREAS, the City Council has considered the recommendations and comments of the Planning and Zoning Commission and the City staff; and WHERE~B, the City Council has conducted a public hearing after compliance with the provisions of Section 20A-2.6 D of the Land Development Code of the City of Sebastian to afford the input of comments and evidence from all interested persons, citizens and affected persons'; and WHEREAS, the City Council has determined that the granting of the special use permit to the Applicants will not be detrimental to the public safety, health or welfare or be injurious to other properties or improvements within the immediate vicinity in which the Applicants' property that is the subject of the special use permit is located; and WHEREAS, the City Council has determined that the use requested by the Applicants, that is, the operation of a museum facility, is consistent with the purpose and intent of the zoning district where the Applicants' property that is the subject of the special use permit is located and is similar in nature and compatible with the uses allowed in that zoning district. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that: Section 1. SPECIAL USE PERMIT. The application for the issuance of a special issue permit for the operation of a museum facility submitted by Melvin A. Fisher and Dolores E. Fisher, individually, for the real property located at 1322 U.S. Highway 1, in the City of Sebastian, Indian River County, Florida, being more particularly described as follows: "Lots 13~, 14, 15, 16 and i7, Block 1, Hardee's Subdivision No. B, according to the Plat thereof, as recorded in Plat Book 4, Page 74, Public Records of St. Lucie County, Florida; LESS AND EXCEPT THEREFROM the following described portion of the aforesaid Lot 13, described as follows: Beginning at the Northwest corner of said Lot 13, run Southeasterly on the Westerly line of said Lot 13 a distance of 5 feet, thence run Northeasterly to a point on the Northerly line of said Lot 13, said point being 9 feet Easterly of the Northwest corner of said Lot 13, thence run Southwesterly a distance of 9 feet to the Point of Beginning, is granted, subject to the requirements and conditions contained in this Resolution. CONDITIONS OF APPROVAL ANDCONTINUATION OFT HE The approval of the city Council of the application of the Applicant for a special use permit that is the subject matter of this Resolution and the continuation of such special use permit until its expiration as provided for in this Resolution is conditioned on the continuous satisfaction of, and compliance with, the following requirements by the Applicants or their successors and assigns: Compliance with the provisions of all applicable federal and Florida statutes, rules and regulations, county ordinances and the ordinances and resolutions of the City of Sebastian, including, but not by way of limitation, all sections of the Land Development Code. ~on 3. EXPIP~TION OF THE SPECIAL USE PERMIT. The Special Use Permit granted to the Applicants pursuant to this Resolution 3 shall expire on such date that the subject property ceases to be used primarily as a museum. Section 4. CONFLICT. All resolutions or parts of resolutions in conflict herewith are hereby repealed. Se~on 5. SEVERABILITY. In the event a court of competent jurisdiction shall hold or determine that any part of this Resolution is invalid or unconstitutional, the remainder of the Resolution shall not be affected and it shall be presumed that the City Council of the City of Sebastian did not intend to enact such invalid or unconstitutional provision. It shall further be assumed that the City Council would have enacted the remainder of this Resolution without said invalid and unconstitutional provision, thereby causing said remainder to remain in full force and effect. Section 6. EFFECTIVE DATE. This Resolution shall take effect immediately upon final passage. This proposed ordinance had been previously reviewed, even though informally, by the City Attorney Mr. Charles Nash. I have included a copy of Indian River County's ordinance regulating garage sales which basically, allows three (3) garage sales per year for an individual without obtaining any type of permit. After reviewing approximately five (5) other city ordinances regulating garage sales, I have taken the basic requirements from those ordinances and incorporated them into this proposed ordinance. I would suggest that Planning and Zoning take the proposed ordinance into categories and vote on each issue to determine whether or not the majority of the commission would recommend City Council on any one item. The following are the basic requirements of this ordinance~ 1. Do you wish to regulate garage sales by ordinance? If so, do you wish a permit to be issued by the City of Sebastian? 3. If a permit is required, is $2.00 reasonable? Do you wish'to allow signs (on premise and off premise) for the use of a garage sale? 5. How many times do you want a garage sale to be permitted? Planning & Zoning June 28. 1991 'Page 2 Definitions~ The term "garage. sale" as used in this article shall be construed as the layout, display and sale of articles or new or used items of personal property in a yard. garage. driveway, porch.'patio, or real estate lot, regardless of the location where such items may be viewed by the public, and where such sale is not subject to the occupational license provisions of this chapter; provided, however, that the definition of a garage sale shall not apply to the isolated and casual sale of single items of personal property such as an automobile, bicycle, lawn furniture or items of a similar nature. The term "person" as used in this article shall include individuals, children, firm's, associations, joint ventures, partnerships, estates, trusts, business trusts, syndicates. fiduciaries, corporations, and all other groups or combinations. Display of sale items.~ signs advertising sale. (a) Articles or items for sale may be displayed from sun up to sun down. At the conclusion of the garage sale. all unsold articles and items shall be removed or packed in such a manner as not to be visible from any public street or from the abutting properties. (b) Signs .or posters, which may be directional signs, shall be permitted to advertise a garage sale. Any sign or poster shall not exceed four (4) square feet in area; shall not be placed in any public right-of-way; and shall be removed immediately at the conclusion of the garage sale. Signs placed on lots other than the applicant must have consent of the property owner. (c) Display of sale items of personal property shall be exhibited or displayed on the private property where the residence is located, not closer than 5 feet to the front or side property lines and shall not be placed in the public right-of-way. Parking. The person conducting the garage sale shall provide for the parking of vehicles in such a way as to avoid creation of a hazardous or unsafe condition or any congestion of public streets as a result of the garage sale. (a) The City Council of the City of Sebastian may enact by resolution reasonable rules and regulations to implement and carry out the provisions of this article. (b) In addition to all other available legal and equitable remedies, the City Council of the City of Sebastian may bring suit to restrain, enjoin, or otherwise to prevent the violation of this article. Permit required. It shall be unlawful for any person to conduct a garage sale within this city without first securing a garage sale permit from the Building Official to do so. Permit application. The application form for the garage sale permit shall contain the following information: 1. The date of the application; 2. The name and residence address of the applicant; 3. The site, by street address number, where the garage sale is to be conducted by the applicant; 4. A statement by the applicant that he or she understands that the garage sale permit will expire in seventy-two (72) hours from the time and date of its issuance and that the permittee understands that he or she is entitled to conduct only one (1) garage sale pursuant to any such permit within any such six-month duration and that only one (1) garage sale shall be conducted at the same garage sale site during any such six-month duration; 5. A signature line for the applicant. 6. By making application for such garage sale permit, accepting said permit and conducting such sale, the owner or leasee of the property to whom such permit is granted, authorizes any code enforcement officer of the City of Sebastian %o enter upon the property for the purposes of determining that such sales being conducted in accordance with the provisions of this article. A garage sale permit shall be issued by the Building Official in the name of the permittee and shall designate the site, by street address, where the garage sale shall be authorized to be conducted by such permittee. Limitation on number of garage sales. Not more than one (1) garage sale shall be conducted at the same site within this city during any such six-month duration. Duration. No such garage sale shall be .conducted over a period of more than seventy-tWo (72) hours.' Permit numbering and garage sale information. Exception for organizations. churches, charitable and non-profit Definition: "Charitable, nonprofit, or veterans' organization" means an organization which has qualified for exemption from federal income tax as an exempt organization under the provisions of s. 501(c) of the Internal Revenue Code of 1954 or s. 528 of the Internal Revenue Code of 1986, as amended~ which is engaged in charitable, civic, community, benevolent, religious, or scholastic works or other similar activities; and which has been in existence and active for a period of 3 years or more. It is proposed.to reorganize the department by eliminating the two current Lieutenant's positions and replace them with a Captain (Deputy Chief), and a Senior Sergeant who would serve as a coordinator for the Uniform Division. There would also be a senior Investigator who would serve as a coordinator for the Investigative Division. This creates at the second level of organization a clear chain of conmand and clarifies the mission and goals of each division. Under the proposed reorganization the Captain would be in direct line with the Chief of Police and have under his span of control the following four supervisors or coordinators; 1. In brief, .the PhOne would be assigned to Emergency Mana§ement for their use when needed, also for use by the Police Department on an as needed basis, i would recommend that the phone be used by the City Manager on a daily basis, rather than have it sitting on a shelf. This would assure that the phone is in good working order at all times and a full charge on the battery should we lose power. In an emergency situation the phone would then be given to Emergency Management or the Police Department for their use. Vero Beach, 569-5355, to inquire about.the suggestion made by Vice-Mayor Oberbeck to use the Fraternal Order Of Police rate scale for cellular phone service. Mr. Fisher indicated that the F.O.P. rate was for members only, not for use by a government'agency. Mr. Fisher indicated .that since the cellular phone was for city use, we'would qualify for the State of Florida plan, that would bill the city directly and that the rate for cellular phone use is the lowest in cost of any plan avail- able in the State of Florida. The rates are; $15.00 per month basic charge and .24¢ per minute day rate and .17¢ per minute night rate, and this includes; 1. Detailed Billing 2. Mobile' Mail 3. The committee members agreed and unanimously endorsed his proposal. This phone's primary and priority usage would be by our Emergency Team for telephone line back-up communications during ~storm-induced local phone outages. The intent being that the radiophone could reach over the local landline area. A secondary utilization, during other periods, would be in support of mobile/remote City administration and police activities. WITNESSETH: WHEREAS, Florida Statutes 336.025 grants the COUNTY the authority to levy, in addition to other taxes allowed by law, a local option gas tax upon every gallon of motor fuel and special fuel sold in the COUNTY and taxed und'er the provisions of Chapter 206, Florida Statutes; and WHEREAS, pursuant to said enactment, the COUNTY may establish by interlocal agreement with one or more of the municipalities located within Indian River County reprosenting 'a majority of the ineorpor~ted area population within the COUNTY, a distribution formula for dividing the proceeds of the local option gas tax among the COUNTY government and all eli~dble municipalities within Indian River County; and WHEREAS, the 'CITY is a municipality located within Indian River County, Florida, and the CITY represents that the CITY is eligible to receive a portion of the local option gas tax as imposed by the Indian River County Local Option Gas Tax Ordinance, and desires to jointly establish with the COUNTY a distribution formula pursuant to Florida Statutes 336~025(3) (a) (1). This agreement shall, take effect on September 1, 1991, and shall terminate on August 31, 1996. If, during the term of this agreement, any party hereto becomes ineligible to receive a share of the local option gas tax for any reason, any funds otherwise undistributed because of ineligibility shall be distributed to eligible governments within COUNTY in proportion to other monies distributed pursuant to Paragraph 1 herein and the share shall be calculated pursuant to the formula contained within ParaL,~aph 9. herein. 5. By execution of this agreement, neither the COUNTY nor the CITY will be deemed to have waived any rights or remedies they may have available under the laws of the State of Florida. 6. This agreement shall be executed in duplicate and 'eaoh fully executed contract shall be deemed an original instrument. 7. Upon adoption of an ordinance levying the local option Kas tax by the COUNTY, the COUNTY shall provide the State of Florida Department of Revenue the distribution proportions established by this a~reement. 8. A copy of this a~reement and all subsequent amendments hereto shall be recorded in the Public Records of Indian River County, Florida~ upon its execution by all parties hereto. 9. The attached ordinance and sample .Interlocal Agreement has been prepared to effect the continuance. The LOGT distribution formula will remain the same as previously applied and is as follows: Percentage of total revenue allocated to each eligible entity = 1/3 of the entity's percentage of total equivalent lane miles of road + '1/3 of~ the entity's percentage, of transportation expendStures over the previous five year + 1/3 of the entity's total percentage of population residing in the area based upon the 1990 census. Initially, a two cent LOGT was approved. In 1986, the LOGT was increased to six cents county-wide. Enclosed is a copy of Indian River County Ordinance 86-32 which increased the LOGT and authorized levy of the tax until August 31, 1991. To develop a distribution formula, the County and City staffs met on several occasions. A formula considering transportation expenditures over the past five years, population, and equivalent lane miles of roadway was developed. At this time, the County and'five municipalities must decide on extending the LOGT program for another five years or notify the Department of Revenue of the County's intention. The County Public Works Department staff is of the opinion that the program should be extended and the current distribution formula is adequate. The exterior of a building or structure shall not be considered in harmony with the site and general character of the impacted area unless the following criteria are complied with: a. The plan for the proposed building or structure is in conformity with and, in general, contributes to the image of the City as a place of beauty, spaciousness, balance, taste, fitness, charm and high quality. The proposed building or structure is not, in its exterior design and appearance, of inferior quality such as to cause the nature of the local environment %o materially depreciate in appearance and value. The Proposed building or structure is in harmony with the proposed developments on land in the general area, with the comprehensive plan for the City, and with any precise plans adopted pursuant t° the comprehensive plan. The proposed building or structure is appropriate in relation to the established character of other structures in the immediate area or neighboring areas in respectto significant design features such as material or quality or architectural design as viewed from any public or private way. However, at the requ of the FAA, I have obtained two additional forecasts for comparison purposes with aim of selecting one for use in the project. The two additional forecasts are those prepa~ by the FAA and presented in their Terminal Area Forecast (TAF) for Fiscal Years 19' 2005, and those to be presented as final in the Continuous Florida Airport System Plann Process (CFASPP) for the Treasure Coast Region now under preparation. All thi forecasts are presented on the attached sheets. Our review of the forecasts permits the following observations: Although we expected the Apogee forecasts to represent high activity lew the TAF projections are higher. The local-itinerant split in the TAF projections does not seem appropri; given the relatively high use of training activity at the Airport. This lea, the forecasts as somewhat suspect. The CFASPP forecasts, adjusted to reflect the results of an acoustical court survey, are the most recent projections available, and the local-itinerant sl seems appropriate.. Based on the foregoing, I recommend that the CFASPP projections, as adjusted, be utili~ in the master plan study. They present conservative yet reasonable values for plaxm purposes.
