Eckis, P.E~ City Engineer/Public Wdrks Director FROM: Jerry Thomas Assistant Public Works Director Bid Specifications Three Gang Flail Mower It is my recommendation that we accept the bid £rom the Alamo Group for the Terrain King Flail Type Mower. On a comparison of the bid specifications by telephone, we excluded gear type pumps and Turner did not meet those specifications. They use a gear type and we speci£ifed a piston type. The gear type pump is not acceptable, they are cheaper and ! feel that the piston pump operation is more compatible to our needs. Alamo Group cools in the frame, Turner has a cooling radiator out in the front and I feel it is more to service and break down. Turner company is not predominate in the south, they have one machine in service right now down at the county landfill. They have made approximately 50 changes in their pieces of equipment in the last few years and I do not think they have all the problems resolved. I also have some concerns about the availability of parts. They're parts depot is in Atlanta and there are no dealers that stock any parts of any magnitude in the South so we would have to go to Atlanta for parts. The Alamo Group machine we can get parts from the John Deere dealer here locally. One item worth mentioning, we have one of these Alamo machines in service right now and have had very good results. This equipment is highly special/zed and is FCC approved, which is necessary to gather evidence admissable into legal proceedings. This equipment must be of quality to insure proper evidence and dependable as officers' lives could foresee, ably depend on it. This surveillance equipment by its nature, is the type we may not wish to highly publicize through bidding procedures, included is a letter from LEA indicating other departments who have purchased this equipment with a waiver of bidding procedures. Pursuant to city code section 2-64(j), the city council may waive the bidding procedure on specific contracts for good cause. RECOMMENDED ACTION Grant a waiver of bidding procedure and authorize the purchase of a LEA6307 Surveillance System from Law Enforcements Associates, Inc. in the amount of $3,750. Historically, City Council has approved waiver of the rental fee for these functions. The City has received a letter from Florence Phelan, Vice President, Sebastian Area Civic Association, inc., requesting a waiver of the rental fee for use of the Yacht Club on December 11, 1992 by the association for the purpose of distributing donation checks to the local charitable organizations. In accordance with Resolution No. R-89-20, not for profit use is half the regular fee, therefore, the request for a full fee waiver must come before City Council. The Sebastian Area Civic Association has a security deposit on hold with the city. RECOMMENDED ACTION Move to approve request for full rental fee waiver for the Sebastian Area Civic Association for use of the Yacht club for distribution of donation checks to the local charitable organizations. ORDER FINDING VIOLATION Respondent at a violation hearing conducted by the Code Enforcement Board of the City of Sebastian on October 21, 1992 regarding violation of ~he Code of ordinances of the Cl~y of Sebastian prohibiting/describing unlawful deposit of junk vehicle. $peciflcally the violation involved Chapter 12, Section 31. FINDINGS OF FACT The Board determined upon the evidence presented that junk vehicle was stored unlawfully in violation of the above-referenced ordinance. CONCLUSIUNS OF LAW The above-referenced individual was found to be in violation of said ordinance and no fine was levied. The alleged violator has thirty (30) calendar days to correct the violation. If the been corrected, a fine of $25.00 per day is violation has not imposed. 1.
