Fuel & Oil Storage Tanks
On Friday, December 14, 1990, the City received two (2) timely
and comprehensive proposals from State licensed consulting firms
regarding the City's fuel and oil storage tanks. In addition, we
received a proposal sent by Fax on Friday afternoon. However,
this proposal was not complete. Also, we received a fourth
proposal on Monday morning, but it too was late and incomplete.
The proposals were in response to the City's request to provide
certain services to remove fuel and storage tanks which are no
longer in compliance with new federal law. Additionally, because
of the storage and use of fertilizer, pesticides and other
chemicals at the golf course, we asked that the proposals include
an environmental compliance audit, a preliminary containment
assessment plan (PCAP) and a preliminary contaminant assessment
report (PCAR). The proposal from Missimer & Associates, Inc., of
Palm Beach Gardens appears to be the most complete and cost
effective. The following comparison indicates costs outlined in
the report. Not included are: disposal of any contaminated soils
excavated upon tank removal, electrical connection for the new
pumps, wash down areas for equipment and vehicles at both the
golf course and the central garage or any concrete pads for the
fueling areas.

We have copied the proposals of Groundwater Technology, Inc. and
Missimer & Associates, Inc., for your review. Staff recommends
acceptance of the Missimer proposal for removal and installation
of tanks at the City garage, removal of the tank at the sign
shop and removal and installation of tanks at the golf course,
plus the environmental reports outlined in the Missimer proposal
for the golf course. If the Missimer proposal is accepted, we
will ask them for a fee proposal to write plans and
specifications for the wash down areas at the central garage and
golf course.

I met recently with Mr. Gary Purdy of HRS - Indian River County
Public Health Unit, to discuss the fuel and oil storage
facilities owned and operated by the city. Also at this meeting
were Jerry Thomas, Acting Public Works Director, Tony clopein,
Vehicle Maintenance Superintendent, Jim DeLarme, Golf Course Pro-
Manager, and Chris McCarthy, Golf Course Grounds Superintendent.
At request,
our Mr. Purdy inspected all City owned storage tanks
and the meeting was held to discuss ~s f~ndings and the City's
approach on ensuring compliance with trent regulations.
The City has asked four (4) State certified and licensed
contractors to submit proposals regarding the City's fuel and oil
storage facilities and management. These proposals are due at
10:00 a.m., on Friday, December 14, 1990. The following outline
represents the City's approach in addressing present and future
compliance with applicable regulations~

Statement of Qualifications
Dear Mr. McCleary:
Thank you for considering Missimer & Associates, Inc. (M&A) to
provide the professional environmental services required for the
various tasks required to bring each of the above referenced
facilities into regulatory compliance. The comprehensive scope of
services outlined in the attached proposal includes: removal of the
existing underground storage tanks; installation of new above ground
storage tank systems; the design and installation of the effluent
disposal system at the garage facility and: an environmental
compliance audit of the golf course maintenance barn facility.
In common for each facility is the removal of the petroleum storage
tank system and the preparation of the required FDER Closure
Assessment at the above referenced facility. All work will be
performed in accordance with the Petroleum Contamination Cleanup
Criteria outlined in Chapter 17-770 FAC.
As requested, M&A has separated out each facility by task to assist
in the City's proposal evaluation process. Mr. Patrick G. Smith has
been selected as Project Director, with Mr. Jim McGrath as Project

I. INTRODUCTION
This proposal was prepared to remove one (1) 5,000 and
one (1) 1000 gallon underground storage tanks (UST), and
associated piping at the referenced facility. The two (2)
existing tanks will be removed and disposed of as per current
local, state and National Fire Protection Association (NFPA)
codes.
The proposal includes tank excavation and disposal,
backfill and compaction, and resurfacing to existing grade.
Additionally, a Missimer & Associates, Inc. (M&A) qualified
geologist will be on site to monitor the hydrocarbon content
of the soil during excavation.
II. SCOPE OF WORK
The scope of work is divided into two tasks. In Task I,
M&A will coordinate and supervise the tank excavation. All
debris and existing tanks will be removed and disposed of
properly upon completion. Excavations will be backfilled with
clean fill material, compacted, and resurfaced to existing
grade. Regulatory agency inspection of the tank removal
operation will be performed by a representative from the
indian River HRS office.
During the excavation of the tanks, soil samples will be
collected and analyzed with an Organic Vapor Analyzer (OVA)
equipped with a Flame Ionization Detector (FID) as Task II.
Color photographs will be used to document the tank removal
and excavation. A determination will be made as to whether
or not the soil from the excavation can be used as fill or
will have to be disposed of in a manner consistent with state
and local policies. Chapter 17-770 Florida Administrative
Code (FAC) "Petroleum Contamination Site Cleanup Criteria"
defines excess soil contamination as "all soils saturated
with petroleum or petroleum products and those soils that
cause a total hydrocarbon reading of greater than 500 ppm on
an OVA instrument with a flame ionization detector". A
representative groundwater sample from the excavation pit
will be collected and analyzed for gasoline and diesel
constituents.
In Task III, M&A will prepare a FDER Closure Assessment
Form 17-761.900(6) to be submitted to the Indian River HRS
office for review and approval.

completion of the project, whichever comes first. Payment is
to be made within 30 days of the invoice date and late
invoices may be charged at a rate of 1-1/2% per month beyond
30 days. In the event'it becomes necessary to retain
attorneys to collect any amounts owed under this contract,
then Missimer & Associates, Inc., shall be entitled to all
costs plus a reasonable attorney's fee.

I. INTRODUCTION
This proposal was prepared to assist in installing
one (1) 6000 gallon and one (1) 2000 gallon above ground
steel tanks and associated piping mounted within an approved
concrete containment vessel at the referenced facility.
II. SCOPE OF WORK
Installation activities will consist of providing
the labor, materials and equipment as required to furnish and
install one (1) 6000 gallon and one (1) 2000 gallon above
ground steel storage tanks on steel saddles and construct an
epoxy coated reinforced concrete vessel. Additionally,
suction pumps, stainless steel cabinets, high hose retrievers
and all necessary piping, valves and fittings from tanks to
suction pumps will be installed, tested and inspected as
required by Chapter 17-762 FAC (Florida Administration Code).
III. PROGRAM COSTS
Program Costs are as follows:

I. INTRODUCTION
This proposal was prepared to assist in developing the
minimum design specifications and obtain the required
permitting for an approved wash-down recovery system to be
installed at the proposed City of Sebastian Central Garage
facility.
As proposed, the local HRS representative will not
permit the installation of the system that calls for
utilization of a floor.drain collection system, routing
through an oil/water separator and into the 900 gallon septic
tank. According to a representative from the Florida
Department of Environmental Regulation (FDER), the wash-down
water generated is classified as two waste streams, untreated
domestic effluent and industrial waste. FDER regulations do
not permit mixing of the two waste streams and industrial
wastes cannot be discharged directly to the groundwater.
Therefore, the installation of an alternative wash-down
water recovery and disposal system will be required to
satisfy the state and lcal agencies. One available system
that M&A recommends the installation of an equipment steam
cleaning containment area that includes a sump and piping to
one oil/water separator system and supply piping from the
holding tank to a mobile type steam cleaner capable of
approximately 4-6 gallons per minute with the clean water
recycled for reuse. The oil/water separator and supply water
holding tank shall be sized to accommodate the steam cleaner
output in a closed loop system. As a result, the quantities
of wash-down water generated that is required to be pumped
out and properly disposed of, is significantly reduced.
II. SCOPE OF WORK
The scope of work is divided into two tasks. In Task I,
M&A will act as the City of Sebastian's principal
environmental consulting representative and coordinate all
the necessary parties, including the City's design engineer,
the Indian River County HRS representatives, and the FDER
district office personnel in Orlando, to develop an approved

wash-down recovery system. In addition, Task I will include
all work ~equired to obtain the necessary state and local
permits to install and operate this facility.
M&A will outline a detailed scope of work for the
installation of the approved system, develop a comprehensive
subcontractor's bid specifications document, assist in
selecting the qualified responsible bidder, and ensure all
service components are properly tested and made operational
as Task II.
III. PROGRAM COSTS
Program costs are as follows:
M&A will provide these services based on their current
fee schedule, a copy of which is enclosed.

underground storage tank (UST) and associated piping at the
referenced golf course club house facility. In addition,
this proposal was prepared to remove one (1) 500 gallon UST
and one (1) 250 gallon above ground tank and associated
piping at the referenced maintenance barn facility. The
three (3) existing USTs will be removed and disposed of as
per current local, state and National Fire Protection
Association (NFPA) codes.
The proposal includes tank excavation and disposal,
backfill and compaction, and resurfacing to existing grade.
Additionally, a Missimer & Associates, Inc. (M&A) qualified
geologist will be on site to monitor the hydrocarbon content
of the soil during excavation.
Ii. SCOPE OF WORK
The scope of work is divided into two tasks. In Task I,
M&A will coordinate and supervise the tank excavation. All
debris and existing tanks will be removed and disposed of
properly upon completion. Excavations will be backfilled
with clean fill material, compacted, and resurfaced to
existing grade. Regulatory agency inspection of the tank
removal operation will be performed by a representative from
the Indian River HRS office.
During the excavation of the tanks, soil samples will be
collected and analyzed with an Organic Vapor Analyzer (OVA)
equipped with a Flame Ionization Detector (FID) as Task II.
Color photographs will be used to document the tank removal
and excavation. A determination will be made as to whether
or not the soil from the excavation can be used as fill or
will have to be disposed of in a manner consistent with state
and local policies. Chapter 17-770 Florida Administrative
Code (FAC) "Petroleum Contamination Site Cleanup Criteria"
defines excess soil contamination as "all soils saturated
with petroleum or petroleum products and those soils that

cause a total hydrocarbon reading of greater than 500 ppm on
an OVA instrument with a flame ionization detector". A
representative groundwater sample from the excavation pit
will be collected and analyzed for gasoline and diesel
constituents.
In Task III, M&A will prepare a FDER Closure Assessment
Form 17-761.900(6) to be submitted to the Indian River HRS
office for review and approval.

INTRODUCTION
The objective of environmental audits for golf course
facilities is to determine the degree or status of the
facility's compliance with many of the complex environmental
regulations. Measuring site activities against established
regulatory standards is a cost effective way of managing
risks and minimizing liabilities.
Environmental regulation of an operating facility
generally results from an intent to control:
Materials entering the facility, such as hazardous
materials or solvents;
Materials, personnel, activities, and conditions
occurring on-site, such as worker right-to-know,
processes, or spills of fuels or other materials;
Impacts on site attributes, such as wetlands or
zoning considerations; and
Emissions and wastes leaving the site, such as air
emissions or wastewaters.
The majority of environmental regulations addressed
during an environmental audit can be appropriately
categorized as follows:

Increasingly, the environmental agencies have shifted
from a discipline by discipline approach to a multi-media
approach to environmental regulation. The multi-media
concept is typified by the requirements of SARA Title III,
hazardous waste minimization programs and multi-media agency
inspections. For these reasons, a multi-media environmental
audit continues to be the best way to manage risks and reduce
liability exposures.
Clearly, some of these categories will not be applicable
to all facilities. Specifically asbestos, and underground
storage tanks are not included in this scope of work.
Proposed Procedures
To address the compliance of the client's facility, it
has been determined that a single individual with multi-media
experience in the above listed categories can perform the
audits. This is much more cost effective than sending a team
of professionals to perform the same service.
The first activitY performed by the auditor will be the
pre-visit audit request.
Typically, this will be a several page request for
specific information about each facility. The information
received will allow the auditor to familiarize himself with
the environmentally significant activities at each facility
and any unusual activities or conditions that may exist.
Subsequently, the site will be visited. Four primary
functions are performed during the site visit:

Personnel interviews,
Facility inspection, and
Management debriefing.
Records Review
One of the primary objectives of the records search is
to identify compliance requirements specified on permits and
other documentation. If the facility is regulated according
to the OSHA Hazard Communication Standard (Employee Right-to-
Know), the written Hazard Communication Program and Training
Records will be audited for compliance. Applicable state air
permits, annual PCB records, and hazardous waste records will
be carefully reviewed for the facility. SARA Title IIi
reporting - both the Emergency and Hazardous Chemical
Inventory annual report and the Toxic Chemical Release (Form
R) annual report - for the facility will be carefully
evaluated. Compliance with local pretreatment standards in
the form of agreements or permits to discharge to the POTW
will be examined.
If applicable, the facility's NPDES permit will be
reviewed for compliance. All hazardous waste records,
compliance reporting, and manifests will be carefully
reviewed for compliance with local, state, and federal
regulations. RCRA Contingency and Spill Prevention, Control
and Countermeasure (SPCC) Plans will be reviewed to determine
whether they are current and complete.
Attachment II at the end of this proposal is a list of
items which may be examined in the records review. It is
attached as an illustration, emphasizing that certain items
may not be applicable to the facility. Similarly, this list
is not all inclusive. There may be additional items
considered during and subsequent to the site visits.
2.0 Personnel Interviews
Interviews with various personnel will be conducted to
verify that procedures and practices described in the records
do exist and are functional. The interviews are also
important because employees are frequently able to pinpoint
concerns not apparent in the records.
3.0 Facility Inspection
During the site inspection, the auditors will look for
deviations from approved operating procedures and other
regulatory driven practices. Storage and handling practices
for hazardous materials and hazardous wastes will be examined
to evaluate the proper use and labeling of containers. The
transformers at the facility will be examined to determine if
the proper labels are used. The transformers will be cross-
checked with the PCB records and annual reports to determine
if the documentation properly matches the requirements.
Processes will be examined to determine if they are being
operated in accordance with their respective permits.
4.0 Management Debriefing
Upon completion of the audit, the auditor will
informally review the findings with the City Managers, the
golf course superintendent and other designated persons. The
debriefing serves three purposes:

It provides a forum to clarify any inconsistencies
or misinterpretations which might occur during the
audit;
It provides the auditors the opportunity to request
additional information essential to complete the
audit which is not available at the facility, i.e.,
a permit or other item needed to evaluate
compliance in an area may be kept at the facility's
headquarters; and
There may be an important non-compliance item which
should be immediately reported to management in
order that they may begin corrctive action prior
to receiving the written report.
5.0 Report Preparation
A written report will be prepared for the facility
presenting the findings of the audit with respect to the
facility's compliance status. Included in the report will be
recommendations for follow-up/corrective action where
deficiencies have been noted. Two copies of each report will
be presented to the client.

I. INTRODUCTION
This Preliminary Contaminant Assessment Plan (PCAP) was
prepared to assist the City of Sebastian in complying with
state and local regulations concerning the alleged
contamination of the soil and groundwater, at its golf course
maintenance facility, Sebastian, indian River County,
Florida. The allegations of contamination are based on
observations of an Indian River County HRS inspector of
improper discharge of wastewater to the ground and
groundwater.
This proposal is designed to be the first phase in
identifying the types and concentrations of those
contaminants in the soil and groundwater immediately adjacent
to the pesticide storage shed, the major source. This
information is a prerequisite for developing a more detailed
contaminant assessment plan (CAP) for defining the extent of
contamination at this facility.
II. SCOPE OF WORK
The scope of work proposed by M&A includes the following
tasks:

preliminary contamination assessment report (PCAR).
TASK I
Installation of a temporary well point for soil and
groundwater sample collection and analysis will be Task I.
The 2-inch diameter temporary monitor well will be hand
augured, screened within the water table, and installed
adjacent to the pesticide storage shed in a downgradient
direction. The exact location will be determined in the
field with the approval of the Indian River County HRS
representative. The installation of the well will be
preceded by collecting a composite sample of the soil from
land surface to the soil water interface. A representative
groundwater sample will be collected from this well point.
Both the soil and groundwater samples will be sent to a state
certified laboratory and analyzed for organochlorine and
organophosphorus pesticides. Additional parameters may be
added based on the findings of the Environmental Compliance
Audit.
The Indian River County HRS representatives will be
notified at least 48 hours in advance of well installation
and sampling. All sampling for this project will be in
accordance with Missimer & Associates, Inc. Generic Quality
Assurance Plan (Florida Department of Environmental
Regulation QAP #870468G).
TASK
A Preliminary Contaminant Assessment Report (PCAR) will
be prepared which will include all data collected,
interpretations, conclusions, and recommendations for further
action, if required, tO comply with state and local
regulations. The report will be submitted to the Indian
River County HRS within 60 days of their approval to proceed
with this plan.
III. PROGRAM COSTS
Program costs are based on M&A's best estimate of the work
to be performed. Actual charges will be invoiced in
accordance with our current fee schedule, a copy of which is

FOR PROFESSIONAL SERVICES
The attached Terms and Conditions for Professional
Services is incorporated in and made a part of this proposal.
Indemnification for Pollution Related Claims; In view of
the uncertainties involved in solving environmental problems,
the abnormal degree of risks of claims imposed upon the
CONSULTANT in performing such services, and the unavailability
of adequate and affordable liability insurance, for $ 10.00
and other good and yaluable consideration, the receipt and
sufficiency of which is hereby acknowledged, the CLIENT agrees
to indemnify the CONSULTANT as follows:
For claims involving pollution, toxic substances,
asbestos, or hazardous wastes, CLIENT agrees to release,
indemnify and hold harmless CONSULTANT and its officers,
directors, employees, agents, consultants and subcontractors
from all liability, claims, demands, damages, losses, and
expense, including, but not limited to, claims of CLIENT and
other persons and organizations, reasonable fees and expenses
of attorneys and consultants; and court costs, arising out of
the performance of this Agreement. Such indmnification
includes claims which arise out of the actual, alleged, or
threatened dispersal, escape, or release of chemicals, wastes,
liquids, or gases which are irritants, contaminants
or pollutants, or the failure to detect the presence of such.
This paragraph shall not apply if CONSULTANT'S grossly
negligent acts or omissions or intentional misconduct or
willful disregard of its obligations caused the claim. In no
event shall CONSULTANT'S aggregate liability exceed the
greater of $100,000 (One Hundred Thousand Dollars) or the
compensation under this agreement whichever is greater.
Billings by Missimer and Associates, Inc. are sent out
near the first day of the month. These invoices cover costs
incurred during the preceding month. Payment is expected
within 30 days of the invoice date and we reserve the right to
charge late invoices at a rate of 1-1 1/2% per month beyond 30
days. In the unfortunate event that legal action is necessary
to collect invoices, the costs incurred in the legal
collection process will be paid to the prevailing party.

SPECIAL CONDITIONS FOR REMOVAL OF PETROLEUM STOI~AGE TANK
SYSTEMS=
if the regulatory agency representative determines that
there is enough soil or groundwater contamination to warrant
further evaluation in accordance with Chapter 17-770, FAC,
related activities will be handled as an extra to this
contract. Removal of excessively contaminated soil removed
beyond the amount required for tank removal or any soil or
water samples analyzed by a state certified laboratory, will
be charged based on time and materials. If there is sludge
remaining in the tank, acquisition and laboratory analysis of
a sludge sample will be made per Florida Department of
Environmental Regulation (FDER) protocol.
Customary charges for tank removal related activities
include the following:
Pumpout, transportation and disposal of the non-
hazardous contents of the tanks and/or free floating
product within the excavation pit will be charged at
the rate of $ 1.50 per gallon plus a $ 800.00 service
charge.
Transportation and disposal of non-hazardous tank
sludge by a licensed waste hauler will be charged at
the rate of $ 160.00 - $ 300.00 per drum.
On-site stockpiling of excessively contaminated soils
or non-hazardous petroleum tank sludge is site
specific and will be charged on a time and materials
basis.
Transportation and disposal of excessively
contaminated soils by a licensed waste hauler for
thermal processing will be charged at the rate of
$ 50.00 - $ 75.00 per ton.
Furnish additional clean fill to replace contaminated
soil at the rate of $ 6.00 - $ 8.00 per ton.
Analysis of excessively contaminated soil sample(s)

Dear Mr. McClary:
Groundwater Technology, Inc. (GTI) is pleased to present to
you the attached cost proposals for each of four City of Sebastian
facilities. The costs are based upon visits made to each site
prior to proposal preparation.
The cost proposals do not include disposal of contaminated
soil (if encountered) since the quantities are unknown.
The waste water reclamation systems proposed in the following
estimates are closed loop systems designed to recycle oily water.
Wash water is pumped from a collection pit, into one of two storage
tanks where sand and heavy particles settle to the bottom. The
storage tank sizes range from 1,000 to 3,000 gallons at flow rates
of 15 to 45 gpm. The water then flows by gravity to a second tank
where it is aerated and/or chemically treated. Lastly, the water
is pumped from the second tank through a basket strainer, solid
separator, and two filter tanks. The system is pressure activated,
therefore operating only when there is a water demand. The process

During visitation at the golf course maintenance building,
paint and pesticide containers were observed on-site. GTI
therefore recommends conducting an audit to meet the requirements
of SARA Title III. SARA Title III is a legislative program ]~own
as the Emergency Planning and Community Right-to-Know Act. The act
is intended to encourage emergency planning and to provide the
public with information concerning chemical hazards. A proposal to
conduct an audit will be prepared and submitted upon your request.

Removal and disposal of tank contents, if applicable, will be
$1.80 per gallon.
Costs do not include excavation, removal, and disposal of
contaminated soil and/or groundwater.
Removal and disposal of hazardous tank contents, if
applicable, will be an extra charge. Any sludge or residue
product removed from the tanks will be drummed, sampled, and
left on-site pending disposal by an authorized waste hauler.
Hazardous waste will be analyzed per RCRA guidelines before
removal from the job site.
Contractor is not responsible for damage to on-site
underground utilities not identified by the client.
