It is the policy of the City of Sebastian to maintain a work place that is free from the effects of drug
and alcohol abuse. This policy is written in conjunction with the Federal Drug -Free Workplace Act
of 1988, Regulation 28 CFR, Part 83; the State Drug -Free Workplace Act, Florida Statute 112.455
and 440.102; and the U.S. Department of Transportation, Office of Drug and Alcohol Policy and
Compliance, Regulation 49 CFR Part 382.
The City will not employ alcoholics or drug abusers whose current use of such substances prevents
them from performing their job duties or constitute a direct threat to the property or safety of others.
Applicants who are scheduled for pre -employment drug tests and do not wish to take the test, will be
advised that their application will be withdrawn.
Employees are prohibited from the use, sale, dispensing, possession, manufacturing, and
distribution of a controlled substance, or alcoholic beverages on City premises or work sites. In
addition, employees are prohibited from the off- premises use of alcohol and possession, use or sale
of illegal drugs when such activities adversely affect job -performance, job safety, or the City's
reputation in the community. Employees will be subject to disciplinary action, including and up to
termination, for violation of this policy.
All employees may be subject to drug and alcohol testing for post -accidents during City work time,
return -to -duty, follow-up, or for reasonable cause or suspicion.
Department of Transportation employees (Commercial Drivers License - CDL) are subject to random
drug and alcohol testing. DOT employees are also subject to testing for a motor vehicle accident
where 1. There is a fatality; or 2. The driver is cited for a moving violation AND either: a) The
vehicle is towed from the scene; or b) Someone is medically evacuated from the scene. Additional
testing for return -to -duty and follow-up may be applicable, as well as testing for reasonable cause or
suspicion.
Drue Testing
During the testing procedure, employees will have an opportunity to report to the specimen collector,
his/her use of either a prescription or non-prescription medication.
The current drug screening panel tests eight (8) drugs: amphetamines, barbiturates, benzodiazepines,
cannabinoids, cocaine, methaqualone, opiates, and phencyclidine. One specimen shall be collected to
be used for two (2) procedures. The confirmation test uses a second analytical procedure which must
be different in scientific principle from the test. If the result of the second test comes back positive,
the employee must notify the laboratory if they intend to file any administrative or civil action as a
result of the drug test results. Employees have the right to consult with the testing laboratory for
technical information regarding prescription and non-prescription medication that may affect the
results of the tests.
All information relating to any alcohol or drug test is confidential unless written authorization is
obtained from the applicant or employee, or if the records become the subject of an administrative or
judicial proceedings. A list of employee assistance programs, drug counseling, and local alcohol and
drug rehabilitation programs may be obtained from the Administrative Services Department.
With your help and assistance, the City of Sebastian will continue to be a safe and drug free
workplace.
All employees must notify the City of Sebastian, Administrative Service Director of any criminal
drug statute arrest or conviction occurring in the workplace or outside of the workplace within S days
of such arrest or conviction.
