Announcements and Aaenda Modifications -- None V. Approval of Minutes -- Meeting Minutes from August 28, 2023 Everyone indicating they had reviewed the Minutes, Ms. Drumheller called for a motion. A motion approving the Minutes of August 28, 2023 as presented was made by Ms. Webster, seconded by Mr. Mauro, and approved unanimously via voice vote. VI. Public Input -None VII. Unfinished Business Item A: Current Proiects Update Easy Street Park: Mr. Vanmeir said the Park has been completed except for one ladder. Filbert Street Park: All parts and pieces are in but there is no definite date for installation of the playground. Friendship Park: Fences are currently being installed at the ballfield. Hardee Park: Mr. Vanmeir said he just ordered screened coquina to put around the walking trail to cover tree roots and help manage the sand from washing away. PARKS AND RECREATION ADVISORY COMMITTEE PAGE 2 MINUTES OF REGULAR MEETING OF OCTOBER 02, 2023 Mr. Vanmeir said he attended a meeting with the Parks & Recreation Department of Indian River County called Shape the Future which was the kickoff meeting of the County's Parks and Recreation Master Plan process. This meeting allowed everyone to share their interests in the parks throughout the county. His request was for more boat ramps, more pickleball courts and more open spaces in North County. Mr. Benton said there is another meeting being scheduled because that meeting was set on a night that City Council met and they were unable to attend. They are still working to find a date that works for everyone. He will make sure the date is posted on the City's website as soon as it's confirmed. Mr. Benton said one thing that's important is for the City to get a Community Center similar to the IG Center in the North County Area. Item B: Committee Member Park Updates The only committee report was by Ms. Drumheller, she said at Filbert Street Park there's a park bench that could cause splinters. Mr. Benton said the Facilities Department just completed an interior remodel of the Yacht Club. A third party did the floor but the rest was done by staff. He invited everyone to stop and see how much the remodel brightens the place. Item C: Upcominq Events at Riverview Park Mr. Vanmeir reported: Sebastian Homecoming Parade on Tuesday, October 10tn. Sebastian Craft Club Event on Saturday, October 14th- Community Night Out with the Sebastian Police Department on Thursday, October 19tn. The Boo Bash on Saturday, October 21st and Sunday October 22"d. The Halloween Costume Contest and Movie Night on Friday, October 27t"- The Junior Blue Water Open on Saturday October 28tn The Hiram Haul on Saturday, October 2P and Sunday, October 29th* Item D: Pickleball Discussion Mr. Benton said the City doesn't have Pickleball Court expansion in its capital projects at this time. The committee's discussion started after the capital projects were already put in the budget plan. He said staff will continue to research and look at options but hope the Parks and Recreation Master Plan of Indian River County may come into play as well. Mr. Benton explained that a certain amount of parking must be provided for the number of courts built. He stated that the land at the Airport isn't free the City pays around $7,000 a year. He said any property the city uses at the airport must be approved by the FAA; they want operations that are supportive for the Airport. PARKS AND RECREATION ADVISORY COMMITTEE PAGE 3 MINUTES OF REGULAR MEETING OF OCTOBER 02, 2023 Mr. Benton reported on the request made at the last meeting regarding an agreement between Pickleball University and Vero Beach. He said in 2019 the City of Vero Beach entered into a licensing agreement with them for the use of their courts at Pocahontas Park which gave Pickleball University full control over their courts. The agreement probably came into play because Pickleball University contributed somewhere in the amount of $250,000 in capital improvements for the courts. The University runs an operation out of the park; they have memberships which they have capped at 1,045 members. The annual membership fee for 2021/2022 was $325. Their drop -in rate in season is $15 per person and off season $10 per person. Ms. Drumheller said she is excited to hear there is discussion with the County because Sebastian has the biggest population and we should give the County some push back so they start sending some things up North County like they've done in Vero Beach. Dave Havens said he's confused about what the time frame will be to install more courts and which department he should contact to make the recommendation for more courts. Ms. Drumheller said this committee would be the one to recommend more courts to City Council. She said they are all in agreement that we need more courts but money is an issue. She suggested residents attend the Indian River County Parks & Recreation Master Plan meeting and ask for their help to bring more courts into the North County. Baily Walker, a member of the Sebastian High School Pickleball Club, said she's grateful for the courts in Sebastian but they are always filled and students have to wait until night to practice and its costing money for them to play under the lights. Randy Shooter asked how they will know if the committee is keeping this subject relevant and not just pushing it down the road. Ms. Webster responded by saying they need to come to the meetings. Ms. White said the committee realizes people want more pickleball courts but it's not only a money issue, there are only so many parks to put the courts in. She suggested they push the County because they have more room and probably the money to do it. Karen Pallon said there is a need for more courts. The courts are always filled. The residents are not interested in parking or restrooms they just want courts to play. Rosemary Cheman said Pickleball is different; it is a sport that brings the young and old together. Mr. Benton said he appreciated everyone for coming and welcomed anyone to call him anytime. He explained that the budget process starts in February or March and its finalized at the end of September. He explained the key funding used to for the existing courts were the Recreation Impact Fees. He said there aren't sufficient funds in the account now for anything of this nature. He said the courts we have now at the airport cost the city $650,000 — 700,000 three years ago. Today it will cost $1,000,000. PARKS AND RECREATION ADVISORY COMMITTEE PAGE 4 MINUTES OF REGULAR MEETING OF OCTOBER 02, 2023 He said the Capital Improvements Plan is a projection of the things that are needed in the future. He stated that items can be added yearly to that list, the City doesn't have to wait for six or seven years to add items. Mr. Benton wanted everyone to understand that the city has no control over where the County would put courts or if they are even willing to fund them. The County's Master Plan project will take 10 — 12 months to develop. The County will then have to figure out what the priority projects are then align the funding, so this is not an overnight fix either. Vill. New Business Item A: Committee member discussion and recommendation to Citv Council on plavaround desians for Creative Plavaround, located at Barber Street Sports Complex. Mr. Vanmeir reported that the City received three bids, the first from Playmore they came in with a bid of $349,990.88, the second from Game Time who provided two options; the first option came in at $342,586.00 and the second option at $331,003.00, the third bid was from Top One with a bid price of $356,865.00. All of the quotes are ADA compliant and three of the four systems are wheelchair assessable. Ms. Drumheller said Game Time option 2 has a lot of sensory items and openness making it easier for parents to see their children. Motion by Mr. Mauro and second by Ms. Webster to recommend Game Time option 2 to City Council and approved unanimously via voice vote. IX. Items for the Next Agenda and Date: October 23"d, 2023. Staff recommends that this Committee approves the Resolution as presented to be considered by City Council on October 25`h, 2023. Backaround: City Council had directed staff to research and compare the city's current fee structure for rental permit fees of Riverview Park, Community Center, Yacht Club and Park Pavilions. This Resolution provides updated fees based on staff's research of comparable municipalities to ensure that our fees are comparable due to rising costs and inflation and other market indicators. If Aaenda Item Reauires Expenditure of Funds: Total Budgeted: N/A Attachments: 1) Resolution No. R-23-33 RESOLUTION NO. R-23-33 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, ADOPTING UPDATED FEES AND PROCEDURES FOR OBTAINING PERMITS TO USE CERTAIN RECREATIONAL PARK AND FACILITIES PROVIDING FOR CONFLICTS; PROVIDING FOR SCRIVENEWS ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, City of Sebastian Code of Ordinances §74-6 Park Event Permits provides that fees for park events and conditions for park event permit approvals shall be established by Resolution of the City Council; and WHEREAS, due to rising costs and inflation and other market indicators, the City of Sebastian Parks and Recreation Department recommends that the fees for the rental of Riverview Park for park events and special events, Community Center, Yacht Club and Outdoor Pavilions be amended; and WHEREAS, the City of Sebastian Parks and Recreation Department is presenting these fees and reimbursements and procedures in accordance with City Code of Ordinances §74-6 and §74-7 for approval by the City Council, and WHEREAS, this Resolution shall amend Resolution No. R-10-15 as adopted and serve as supplementary guide for providing Rules, Regulations and Procedures when administering and granting recreational park and facility permit requests. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: SECTION 1. RECITALS. The above Whereas Clauses are true, correct, and are hereby adopted and incorporated herein as the legislative findings of the City Council of the City of Sebastian. SECTION 2. FEES FOR RIVERVIEW PARK EVENT PERMIT (75-300 Participants) A. Applications for park event permits shall be submitted to the Parks and Recreation Department, along with a non-refundable $400 application/permit fee per day and a $200 refundable security deposit to be refunded within 2 weeks after the use, if the required reimbursements are made and the facility is left in a clean and undamaged condition. In the event that the City, in its sole discretion, determines that cleaning or repairs are necessary after the permitted use, the deposit shall be forfeited. B. An application for facility use must be received at least two weeks prior to the date of the requested use, however, an application for a permit requiring City Council approval must be received at least two weeks before the next regular City Council meeting date which is prior to the date of the requested rental. C. Applications must include the following minimum information: 1) Name and address of permittee 2) Detailed description outlining the purpose of the event 3) A list of all vendors and others that will participate in event and guarantee that they meet all applicable permit or licensing requirements, and comply with all applicable laws, code provisions and duly promulgated rules and regulations governing the use of the subject facility. 4) A detailed site map showing placement of all vendors and activities within the property. D. Applicants shall meet with the Parks & Recreation Director or designee to discuss: 1) Provisions for traffic and parking, solid waste collection and removal, sanitary facilities, security, anticipated impact on use of the subject Recreation Facility by the general public, and any other implications for the public health, safety and welfare. 2) Need for City resources (staff and/or equipment) to adequately protect the public interest and the method of reimbursement. E. The Parks & Recreation Director shall approve the permit if it is determined that said event will not adversely affect the interest of the public, and an agreement is reached for governing mitigation measures, and financial responsibility therefore of the public welfare issues raised by the event. In the event the Parks & Recreation Director denies the permit, the applicant may appeal the decision to the City Manager and/or City Council. F. Alcoholic Beverages. Any request for alcoholic beverage use at a Park Event must be approved by the City Council and be a City -sponsored event. G. Police Service Requirement. The permittee for any function at which 75-150 attendees are anticipated, shall be required to hire 1 (one) Sebastian Police Officer to attend the function for security purposes at the rate established by the City Manager for City officers hired for private duty, unless waived by City Council. Events at which 151-300 attendees are anticipated shall be required to hire 2 (two) Sebastian Police Officers to attend the function. H. All general provisions for use of City Recreational Facilities as set out in the Code of Ordinances shall apply to Park Event permits. SECTION 3. FEES FOR RIVERVIEW PARK SPECIAL EVENT PERMIT (more than 300 participants) A. Applications for special event permits shall be submitted to the Parks and Recreation Department, along with a non-refundable $800 application/permit fee per day and a $400 refundable security deposit to be refunded within 2 weeks after the use, if the required reimbursements are made and the facility is left in a clean and undamaged condition. In the event that the City, in its sole discretion, determines that cleaning or repairs are necessary after the permitted use. B. Applications must include the following minimum information: 1) Name and address of permittee 2) Detailed description outlining the purpose of the event 3) A list of all vendors and others that will participate in event and guarantee that they meet all applicable permit or licensing requirements, and comply with all applicable laws, code provisions and duly promulgated rules and regulations governing the use of the subject facility. 4) A detailed site map showing placement of all vendors and activities within the property. C. The application must be received at least two weeks prior to the date of the requested use, however, an application for a permit requiring City Council approval must be received at least two weeks before the next Regular City Council meeting date which is prior to the date of the requested rental. D. Applicants shall meet with the Parks & Recreation Director, or his/her designee, to discuss: 1) Provisions for traffic and parking, solid waste collection and removal, sanitary facilities, security, anticipated impact on use of the subject Recreation Facility by the public general, and any other implications for the public health, safety and welfare. 2) Method of reimbursement if City resources (staff and/or equipment) are needed to adequately protect the public interest. E. City Council Approval. The Parks & Recreation Director, thru the City Manager shall forward the permit application to the City Council for their review. City Council has the sole authority to approve or deny any Riverview Park special event permit request. F. Alcoholic Beverages. Any request for alcoholic beverage use at a Special Event must be approved by the City Council and be a City -sponsored event. G. Police Service Reimbursement. The permittee for any special event must comply with the assignment of a police detail as required by the Police Chiefs evaluation of the event, at the rate established by the City Manager for City Police Officers hired for private duty, unless waived by City Council. H. All general provisions for use of City Recreational Facilities as set out in the Code of Ordinances shall apply to Special Event permits. SECTION 4. FEES FOR FRIENDSHIP PARK PAVILION RENTAL A. Applications for Friendship Park Pavilion rental permits shall be submitted to the Parks and Recreation Department along with a non-refundable $75 application/permit fee and $100 refundable security deposit to be refunded within 2 weeks after the use, if the required reimbursements are made and the facility is left in a clean and undamaged condition. In the event that the City, in its sole discretion, determines that cleaning or repairs are necessary after the permitted use, the deposit shall be forfeited. B. FEES FOR INDOOR PUBLIC USE FACILITY RENTAL (Community Center or Yacht Club) A. Applications for Community Center Rental permits shall be submitted to the Parks and Recreation Department, along with the rental fee and security deposit outlined in this Resolution. The application must be received at least two weeks prior to the date of the requested use, however, an application for a permit requiring City Council approval must be received at least two weeks before the -next Regular City Council meeting date which is prior to the date of the requested rental. Rates for Community Center and Yacht Club are as follows: Public Use Facility Community Center Yacht Club Resident Rates Four (4) hr. flat rate $300.00 Each additional hr. $40.00 Four (4) hr. flat rate $175.00 Each additional hr. $30.00 Non -Resident Rates Four (4) hr. flat rate $400.00 Each additional hr. $50.00 Four (4) hr. flat rate $250.00 Each additional hr. $50.00 B. A minimum deposit of Two Hundred Fifty Dollars ($250.00) must accompany each application for use of the Community Center and Yacht Club. This deposit is refundable within 2 weeks after the use, if a facility is left in a clean and undamaged condition by the permittee. In the event that the City, in its sole discretion, determines that cleaning or repairs are necessary after the permitted use, the deposit shall be forfeited. C. Applications must include the following minimum information: 1) Name and address of permittee 2) Detailed description outlining the purpose of the event 3) A list of all vendors and others that will participate in event and guarantee that they meet all applicable permit or licensing requirements, and comply with all applicable laws, code provisions and duly promulgated rules and regulations governing the use of the subject facility. 4) A detailed site map showing placement of all vendors and activities within the property D. In accordance with the Code of Ordinances, in the event that the proposed use may include activities involving gambling, alcoholic beverages, the use of a facility after 11:OOpm, selling of goods/services, or if an admission charge is to be assessed, then the City Manager shall not issue a use permit until directed to do so by the City Council. No alcoholic beverages of any type may be brought on to the premises, dispensed or otherwise consumed without prior authorization of the City Council. No admission fee or other charge may be imposed by the permittee unless expressly authorized in the use permit. Prior to issuance of the permit, the City Council shall make a determination that the proposed admission charge or other fee is not intended to further a commercial purpose. E. The Permit shall be issued by the Parks and Recreation Director and may only be issued in the name of an adult or legally organized organization. Any adult obtaining a permit on behalf of a group comprised of minors shall be held responsible for the supervision of each minor participating in the Event. F. The applicant shall disclose the nature of the proposed activity and the anticipated need for extra work by City personnel. If it is determined that the permittee will cause extra work by City personnel as a result of the proposed use, an additional fee shall be charged in order to fully cover such cost. G. No decoration of any type shall be permitted without prior approval. Any decoration utilized must be removed by the permittee. No nails or staples may be used to hang decorations. H. The permittee shall not, under any circumstances remove any chairs, tables or any other equipment from the facility. I. The permittee shall bear the responsibility for the control of the lights, thermostats (specifically turning off after events, and other equipment in the facility. Further the permittee shall bear responsibility for the unlocking and subsequent securing of the doors of the facility. J. The permittee is solely responsible and answerable to the City for damages to any injured person for any and all accidents or injuries to persons or properties resulting from the use of the facility during the permitted period. The permittee shall ensure that the facility is left in the same condition as it was in prior to the permitted use. K. Police Service Requirement. The permittee for any function at which 75-150 attendees are anticipated, shall be required to hire 1 (one) Sebastian Police Officer to attend the function for security purposes at the rate established by the City Manager for City officers hired for private duty, unless waived by City Council. L. Non -Profit Organizations: In the event that the applicant is a school, church, or other tax exempt entity, as defined by the Internal Revenue Service Cod, the charges for use of the Sebastian Community Center or the Sebastian Yacht Club shall be one-half (1/2) the regular rate. M. All general provisions for use of City Recreational Facilities as set out in the Code of Ordinances shall apply to Indoor Public Use Facility Rental permits. SECTION 7. CONFLICT. All Resolutions or parts of Resolutions in conflict herewith are hereby repealed. SECTION 8. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re - lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of further action of City Council by filing a corrected copy of same with the City Clerk. SECTION 9. EFFECTIVE DATE This Resolution shall take effect upon adoption. The foregoing Resolution was moved for adoption by Council Member .
