I am following up with regards to the TCO and the eventual CO for the Dollar General Sebastian. The conditions per the TCO are
as follows:
1. Final inspection of landscaping ...... Ron our superintendent will be calling in to Dorri Bosworth for the landscape final
today.
2. Final survey...... mailed to your office on 5/8/2013
3. Outstanding fees to Solid Waste .... $2005.86 check mailed 5/8/2013 and Ron paid the re -inspection fee in person
4. Final Backflow certification..... e-mailed to your office.

Terms And Conditions
Definitions On this Airbill, "we," "our," "us," and "FedEx"
refer to Federal Express Corporation, its employees, and agents.
"You" and "your" refer to the sender, its employees, and agents.
Agreement To Terms By giving us your package to deliver,
you agree to all the terms an this Airbill and in the current
FedEx Service Guide, which is available upon request. You
also agree to those terms on behalf of any third party with an
interest in the package. If there is a conflict between the
current FedEx Service Guide and this Airbill, the current FedEx
Service Guide will control. No one is authorized to change
the terms of our Agreement.
Responsibility For Packaging And Completing Airbill
You are responsible for adequately packaging your goods and
properly filling out this Airbill. if you omit the number of
packages and/or weight per package, our billing will be based
on our best estimate of the number of packages we received
and/or an estimated "default" weight per package as
determined by us.
Responsibility For Payment Even if you give us different
payment instructions, you will always be primarily responsible for
all delivery costs, as well as any cost we incur in either returning
your package to you or warehousing it pending disposition.
Limitations On Our Liability And Liabilities
Not Assumed
e Our liability in connection with this shipment is limited to the
lesser of your actual damages or $100, unless you declare a
higher value, pay an additional charge, and document your
actual loss in a timely manner. You may pay an additional
charge for each additional $100 of declared value. The
declared value does not constitute, nor do we provide, cargo
liability insurance.
u In any event, we will not he liable for any damage, whether
direct, incidental. special, or consequential, in excess of the
declared value of a shipment, whether or not FedEx had
knowledge that such damages might be incurred, including
but not limited to loss of income or profits.
o We won't be liable:
— for your acts or omissions, including but not limited to
improper or insufficient packing, securing, marking, or
addressing, or those of the recipient or anyone else with
an interest in the package.
— if you or the recipient violates any of the terms of
our Agreement.
— for loss of or damage to shipments of prohibited items.
— for loss, damage, or delay caused by events we cannot
control, including but not limited to acts of God, perils of
the air, weather conditions, acts of public enemies, war,
strikes, civil commotions, or acts of public authorities
with actual or apparent authority.
Declared Value Limits
o The highest declared value allowed for a FedEx Envelope or
FedEx Pak shipment is $500. .
e For other shipments, the highest declared value dllowed is
$50,000 unless your package contains items of extraordinary
value, in which case the highest declared value allowed
is $1,000,
o Items of extraordinary value include shipments cpntafning
such items as artwork, jewelry, furs, preciou4*'me'tals ne'go-
tiabte instruments, and other items listed in the current FedEx
Service Guide.-,
e You may send more than one package on this Airbill and fill
in the total declared value for all packages, not to exceed
the $500, $1,000, or $50,000 per package limit described above,'

Hello Mr. Rowe — The City Attorney and Manager wanted to FYI our City Council about this easement at
a meeting before it was signed and sent to you. This was done last night, and the original signed
document is being mailed Fed -Ex to you today for delivery tomorrow (a copy is attached). It will still need
the Grantor's signature, recording at the Indian River County Courthouse, and a copy returned to us along
with a copy of the recorded Access Easement. Receipt of these two documents will allow us to sign -off
the Planning and Zoning Final inspection portion needed in part for the project to receive its Certificate of
Occupancy to open. Thank you for your help with this matter.
To all — The new landscaping looks good, the signs are sharp, and the finished site is a wonderful
additional to the city — a gateway project meeting all the intentions of our C512 Overlay District. Thank
you all for your due diligence.

Hi Herb — Thanks for sending the documents to review. The access easement looks good. I would like to
run the sidewalk easement thru our City Attorney's office. I think an acceptance signature from the city
may need to be added to the document since we are agreeing to maintenance, and since this will be an
easement on top of an existing easement granted to the residential subdivision to the north, will they need
to review and sign acceptance?? I'll get direction and forward any comments. Our attorney will be his
office tomorrow (Wednesday).

SIDEWALK EASEMENT AGREEMENT
THIS SIDEWALK EASEMENT AGREEMENT (the "Agreement") is entered into this
day of May, 2013, by 512 SEBASTIAN NNN, LLC, a Florida limited liability company,
hereinafter referred to as "Grantor" in favor of the CITY OF SEBASTIAN, hereinafter referred to
as "Grantee" and is made in reference to the following recitals and facts:
A. Grantor is the owner of that certain real property located in Indian River County,
Florida, being more particularly described as follows:
Lot 4 of the Sebastian Crossings Commercial, as per plat recorded in Plat
Book 22, Pages 73 through 76, inclusive, of the Public Records of Indian
River County, Florida (hereinafter"Property").
B. Grantor desires to create non-exclusive, perpetual easements for the location and
use of a sidewalk connection in favor of the Grantee subject to the terms and conditions set forth
below.
NOW, THEREFORE, in consideration of the promises contained herein and other
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, it is agreed
as follows:
1. Recitals. The statements contained in the recitals of facts set forth above are
true and correct and the recitals by this reference are made a part of this Agreement.
2. Exhibits. The Exhibit attached to this Agreement is by this reference made a
part hereof. Any sketch included in the Exhibit is for information purposes only and is intended
to depict the legal description pertaining to the easement granted herein.
3. Grant of Easement. Grantor does hereby grant to the Grantee a perpetual,
non-exclusive easement for purposes of maintaining and using a sidewalk as presently
constructed thereon for pedestrian foot traffic and other customary uses thereof to be located
within that portion of the Property more fully described and set forth on Exhibit "A" attached
hereto (the "Sidewalk Easement").
4. Covenant Runninq With the Land. It is expressly understood and agreed that
the terms, covenants and conditions of the easements shall be covenants running with the land,
which shall burden the Sidewalk Easement.
5. Use of Easements. By its acceptance of the easement hereto, Grantee agrees
that the use of the Sidewalk Easement shall be such that it does not interfere with the Grantor's
use of the property, and/or their successors, tenant and assign's use of the property, to the
extent that such use is not inconsistent with the easement rights granted herein.

6. Modification. There are no other agreements, promises or undertakings
between the parties except as specifically set forth herein, no alterations, changes, modifications
or amendments shall be made to this Agreement except in writing, to be recorded in the public
records of Indian River County, Florida.
7. Govemina Law. This Agreement and all matters and issues collateral thereto
shall be governed by and construed in accordance with the laws of the State of Florida.
8. Severability. In the event that any term or provision of this Agreement becomes
illegal or unenforceable, the remaining terms and provisions shall nevertheless be valid, binding
and subsisting.
9. Headings. Headings are for convenience of reference only and shall not affect
the interpretation or construction of this Agreement.

DECLARATION OF ACCESS EASEMENT AGREEMENT
THIS DECLARATION OF ACCESS EASEMENT AGREEMENT (the "Agreement") is
entered into this day of May, 2013, by 612 SEBASTIAN NNN, LLC, a Florida limited
liability company, hereinafter referred to as "Declarant" and is made in reference to the
following recitals and facts:
A. Declarant is the owner of that certain real property located in Indian River County,
Florida, being more particularly described as follows:
Lot 4 of Sebastian Crossings Commercial, as per plat recorded in Plat
Book 22, Pages 73 through 76, inclusive, of the public records of Indian
River County, Florida (hereinafter" Property" ).
B. Declarant desires to amend and extend upon its Property the cross access
easement established by Plat Book 22, Pages 73 through 76, inclusive, of the public records of
Indian River County, Florida (hereinafter " Plat" ) for the benefit for the Lots as identified in the
Plat, subject to the terms and conditions set forth below.
NOW, THEREFORE, in consideration of the promises contained herein and other
valuable consideration, the Declarant does hereby declare as follows:
1. Recitals. The statements contained in the recitals of facts set forth above are
true and correct and the recitals by this reference are made a part of this Agreement.
2. Exhibits. The Exhibit attached to this Agreement is by this reference made a
part hereof. Any sketch included in any Exhibit attached hereto is for information purposes only
and is intended to depict the legal description pertaining to the easement granted herein.
3. Grant of Easement. Declarant does hereby declare and grant an easement for
reasonable access, ingress and egress over the paved driveway presently or hereafter
constructed for such purpose to be located within that portion of the Property more fully
described and set forth on Exhibit "A" attached hereto (the "Cross Access Easement"). The
Cross Access Easement shall be nonexclusive, and shall be to provide for the passage of motor
vehicles and pedestrians between such Lots as identified and set forth in the Plat among and
contiguous to the dedicated cross access easement shown on the Plat.
4. Covenant Running With the Land. It is expressly understood and agreed that
the terms, covenants and conditions of the easement shall be covenants running with the land,
which shall burden the Cross Access Easement.

5. Use of Easements. The use of the Cross Access Easement shall be such that it
does not interfere with the Declarant's use of the Property, and/or their successors, tenants and
assign's use of the Property, to the extent that such use is not inconsistent with the easement
rights granted herein.
6. Modification. There are no other agreements, promises or undertakings by the
Declarant except as specifically set forth herein, no alterations, changes, modifications or
amendments shall be made to this Agreement except in writing, to be recorded in the public
records of Indian River County, Florida.
7. Goveming Law. This Agreement and all matters and issues collateral thereto
shall be governed by and construed in accordance with the laws of the State of Florida.
8. Severability. In the event that any term or provision of this Agreement becomes
illegal or unenforceable, the remaining terms and provisions shall nevertheless be valid, binding
and subsisting.
9. Headings. Headings are for convenience of reference only and shall not affect
the interpretation or construction of this Agreement.

acceptance from Indian River County of the February 2013 [received by City of Sebastian 3/8/13 and

Traffic Engineering staff have no objection to the proposed trip generation as shown on the
attached, although the City of Sebastian needs to approve the distribution as the project is
within their jurisdiction. In addition, the requirement to analyze intersections and/or links are
determined by the amount of project trips assigned to the link and or intersection approach as
well as the operating capacity of the link as follows:
Intersection analysis (required at collector and arterial intersections on significant links, where
links are operating at eighty (80) percent or greater of Level -of -Service "D" and an approach
link assigned eight (8) or more project peak season/peak hour/peak direction trips for a two-
lane roadway or fifteen (15) or more project peak season/peak hour/peak direction trips for a
four -lane (or wider) roadway). Link Analysis is determined based on the same criteria.
The roadways and intersections shown to be analyzed on the attached Link and Signal Analysis
Determination seems to be beyond our code requirements. Intersections/links shown may be
able to be eliminated. Please revise in accordance with our aforementioned requirements and
resubmit.

Hi Herb — From our discussion last week, and I apologize if this was not clearly communicated by me, the addition of Magnolias
and/or palm tree clusters would compensate for the non -conforming Southern Red Cedars, so that they wouldn't have to be
removed/replaced.
Currently, 35 canopy trees planted on site do not meet code, or the approved plan: 25 (all) of the Slash Pines are Florida Grade
No. 2, and do not meet the canopy requirements. The approved plan also required 10 Southern Red Cedars @ minimum 12 ft in
height, which only 8 were planted all @ 8 ft high. [The 13 Live Oaks are OK.]
The addition of the Magnolias and palm trees will be considered compensation for the Cedars. We still will need a plan to cover
the non -conforming pines. They can be removed and replaced with a different species, or clustered with additional Grade No.1
pine trees to get a good canopy. This will require a cluster of at least two pines trees, most likely three.
If the canopy tree deficiencies are addressed adequately, staff will sign off on the existing hedge and berm.

required 10 Southern Red Cedars @ minimum 12 ft in height, which only 8 were planted all @ 8 ft high.

The addition of the Magnolias and palm trees will be considered compensation for the Cedars. We still
will need a plan to cover the non -conforming pines. They can be removed and replaced with a different
species, or clustered with additional Grade No.1 pine trees to get a good canopy. This will require a
cluster of at least two pines trees, most likely three.
If the canopy tree deficiencies are addressed adequately, staff will sign off on the existing hedge and
berm.

Please see attached landscaping plan for additional materials palm clusters at the entry sidewalk &
magnolias at the southeast, southwest, & western boundary for better framing to offset landscape
material shortfalls and berm installation. The contractor says that we will have to pull the existing trees
to regrade the berm so it may be best to install additional trees and filler shrubs in lieu of pulling
everything and regrading berm. Please let me know if Staff will be okay with these additional materials
as offset so I can authorize installation of the additional trees.

Use of metallic colors (i.e.: gold, silver, bronze, chrome, and other extraordinarily
bright colors) and use of garish colors, Such as fluorescent colors (e.g. hot pink,
shocking yellow), is prohibited. Trim colors shall not exceed ten percent of the surface
area of any one building facade elevation.
(4) Roof colors (requirements for roofs that are visible from as roadway and/or residentially
designated area). These colors consist of natural mill finish, white, light neutral colors
in the warm range, blue, and a limited number of earth -tone colors. Mixing or
alternating colors of metal panels is prohibited. For non-metal roofs, other than
natural variations in color or color blends within a tile, the mixing or alternating of
roof color in the same roof material is prohibited. Colors and color blends shall not be
contrary to the intent of this code. Color for roofing which is glared, slurry coated, or
artificially colored on the surface by any other means shall be limited to the same
colors as appi-med for metal roofs.
(5) Natural finish materials. The color regiments listed abo-ve shall not apply to the colors
of true natural finish materials such as brick, stone, terra cotta, concrete roof tiles,
slate, integrally colored concrete masonry units, copper, and wood. Color commonly
found in natural materials are acceptable, unless such material has been artificially
colored in a nianner which would be contrary to the intent of these requirements.
Black, gray, blue, or extremely dark colors for brick, concrete masonry units, roofing
wood or stone is prohibited. This provision shall not prohibit the use of colors for
natural finish roofing materials that match those colors approved for metal roofs,
(6) Awning colors. Awning colors may include base building colors and/or secondary
building colors and/or trim colors. However, secondary building colors and trim color
.area used for awnings shall be included in the percentage limitation on the secondary
building color and trim C0101- Surface area of a facade.
(7) Overlay District master color list, The Overlay Districts master color list and approved
color board shall be maintained and made available by the planning and growth
management staff, The list can be mailed or faxed upon request.

' NOTE: The hedgeand berm combination shall provide a visual screen four feet high
above the grade of the project site parking area. Hedge material shall provide, full
screening to the ground; therefore, a inix of myrtles and shrubs with similar leafing
characteristics shall not be used for hedge material unless a double row arrangement
is used. At the time of a certificate of occupancy (CO) for the project site, the
combination of berming and hedging shall provide a four -foot visual screen, subject to
city sight distance requirements. Undulations in the berm and corresponding hedge
height are encouraged.
Hedge shrubs shall be planted no further apart than 24 inches on center along the
length of the buffer strip, to form a hedge that appears continuous as viewed from the
roadway being buffered.
Berms shall have a slope no steeper than three horizontal to one vertical, and shall be
continuous along the length of' the buffer strip, except where berm modifications may
be necessary for tree preservation as determined by the planning and growth
management director or his designee.
Clustering of trees along the buffer strip is encouraged, and uniform spacing of trees
is discouraged, except where used to emphasize a particular planting theme or
development style. Hedge plantings may be asymmetrical, and a buffer wall not to
exceed four feet in height except as specified below, is allowed within the middle
one-third of the buffer strip's width (measured perpendicular to the road being
buffered) if landscaping material is planted on each side of the wall,

and thoroughfare plan road buffer as described above, with the additional requirement
that the buffer shall include a six-foot opaque screen consistent with specifications in

See. 54-4-21.13.1. Intent.
As a significant business and residential center and a major entranceway into the City of
Sebastian, the corridor will have an attractive, well maintained, orderly and uncluttered
appearance. The corridor will be characterized by impressive vegetation and landscaping-,
complementary buildings and signs with enhanced designs and aesthetic appearances; and a
safe transportation system that accommodates inass transit.. pedestrians, bicycles, and other
transportation alternatives, as well as automobiles.
The boundaries of the CR 512 Overlay District shall include all the properties which abut
CR 512 and that are located within the city limits of the City of Sebastian, If any additional
segments of CR 512 are subsequently duly annexed into the city, land development along the
said newly annexed segment shall be consistent with the city's land development code,
including this article. In the CR 51-2 Overlay District, the following special regulations and
exemptions shall apply to new development and redevelopment,

(a) Prohibited areNtectural sfYles. The following are prohibited:
(1) Corporate signature or commercial prototype architecture, unless such is consistent
with these special corridor requirements. Examples of such prohibited architecture
include flat roofed convenience stores, gas stations, and canopies for gas stations, car
washes, and drive through facilities.
(2) Any kitsch architecture (such as a building that does not resemble a typical structure),
including structures or elements that resemble an exaggerated pla tit, fish, edible food,
or other such items such is giant oranges, ice cream cones, dinosaurs.

without walkways, shall be used to subdivide parking areas into parking bays with not
more than 30 spaces, provided that no more than 15 spaces shall be in all uninter-
rupted row. A portion of the required landscaping for interior parking spaces may be
relocated so as to emphasize entrance corridors or special landscaped areas within the
general parking area.

(d) Parking lot landscaping requirements, Landscaping shall be provided around the
perimeter of off-street parkingareas, loading areas, or other vehicular use areas pursuant to
the following standards-
(1) A landscape strip at least tell feet in width shall be located between the abuttific,
property lines and parking, loading or other vehicular use :area except where permitted
driveway openings are to be provided. Where drainage or other utility easement exist
along property line--,, the landscape strip shall be located between the parking, loading
or other vehicular use area and the utility or drainage easement. Landscape strips
located in easements may be adjusted upon the recommendation of the planning and
growth management director and city engineer.

(2) A hedge shall be planted within the landscape area and shall be an minimum of three
feet in height and form a solid and unbroken visual screen immediately upon planting,

curbing or other wheel stops are installed to insure no greater overhang of tile

(e) Specifications for lilring plant materials
(I) 'Frees, Immediately after planting, all trees shall be minimum of eight feet in beigtht,
have a minimum diameter of one and one-half inches or as circumference of four and
seven -tenths inches D1311, and shall have a minimum of five feet of clear trunk space
if necessary to preserve a safe sight distance for traffic safety. Trees shall be of as
species having all average mature crown of greater than 20 feet and having trunks
that can be maintained with over six feet clear wood. Trees or palms havingan average
mature crown spread of less than 20 feet may be substituted by grouping the same so
as to create the equivalent of a 20-foot crown spread. Such a grouping shall count as
one tree toward meeting the tree requirement for any provisions herein.
Fifty percent of the trees shall be native and drought tolerant.
If palms are used, they shall constitute no more than 35% of the total tree require-
ments for any provisions herein and shall have a minimum of six feet of clear wood.
No tree species shall account for more than 50`'0 of the total number of trees,
(2) Shrubs and hedges. Shrubs and hedges shall be used to complement the tree planting.
Individually planted shrubs shall be a minimum of 24 inches in height immediately
after planting. Shrubs planted for required hedges shall meet the minimum height
