Suite 400 St. Petersburg, Florida 33701 (727) 895-2150 telephone Dorri 131) Planner \d Lwn PLANNING AND ZONING COMMISSION City of Sebastian, Florida Application for Site Plan Approval: Dollar General Retail Store FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER THIS CAUSE came on for public hearing before the Planning and Zoning Commission of the City of Sebastian on December 6, 2012, and based upon the testimony and all of the evidence presented, the Planning & Zoning Commission enters the following: FINDINGS OF FACT 1. R.K.M. Development Corporation, who has a purchase contract on the vacant property located at 9200 Sebastian Boulevard, Lot 4, Sebastian Crossings Commercial Subdivision, and also identified as Indian River County Parcel 31-38-22-00003-0000-00004.0, has requested approval of a site plan for the property which includes a 9,100 square foot retail building along with required parking, drainage and landscaping. 2. Public notice of the hearing by the Planning and Zoning Commission was published on November 21, 2012, in the Press Journal, a newspaper of general circulation in the City of Sebastian. Notice of this hearing was also mailed to all property owners within four hundred (400) feet of the subject property, as shown in the records of the Property Appraiser of Indian River County, in accordance with the requirements of the Land Development Code. 3. The following agencies and staff reviewed the proposed site plan: Planning and Zoning Division of the Community Development Department of the City of Sebastian, Indian River County Utilities Department, Indian River County Fire Department, Indian River County Environmental Health, St. Johns River Water Management District, Indian River County Traffic Engineering Division, Sebastian Police Department, Sebastian Building Director, Sebastian Public Works, and Frank Watanabe, Sebastian Consulting Engineer. 4. Mr. Herb Green, P.E., Project Manager, Cadjazz Engineering, presented the application to the Planning and Zoning Commission. Dorri Bosworth, Planner, Community Development Department, provided additional information. r5 5. No one from the public spoke in favor of or in opposition to the project. 6. City staff recommended approval of this application, with conditions. CONCLUSIONS OF LAW Based upon a careful consideration of the evidence presented, and the applicable provisions of the Land Development Code of the City of Sebastian, the Planning and Zoning Commission determines that the requirements for granting approval of the site plan have been satisfied. Based upon the foregoing Findings of Fact and Conclusions of Law, a motion was made by Commissioner Domenic Durr, and seconded by Commissioner Rick Carter to approve the site plan for Dollar General, 9200 Sebastian Boulevard, for a 9,100 square foot retail building and requisite parking, drainage and landscaping, in accordance with staff recommendations as follows: L Approval of the applicant's request to reduce the west side perimeter landscape strip from 10 feet to 5 feet; 2. Applicant to provide a Traffic Impact Analysis (TIA) to Indian River County Traffic Engineering Department for their review and approval, along with implementing any required roadway improvements before a Certificate of Occupancy/Completion is issued. 3. Applicant to provide recorded copies of the Cross Access Easement expansion and Sidewalk Easement documents before a Certificate of Occupancy/Completion is issued. The motion was approved by the Planning and Zoning Commission by a vote of 7 in favor and 0 against. Therefore, the requested site plan was approved with the above stated conditions. QUASI-JUDICIAL PUBLIC HEARING — SITE PLAN — DOLLAR GENERAL — 9200 SEBASTIAN BOULEVARD, SEBASTIAN CROSSING COMMERCIAL SUBDIVISION — 9100 SF RETAIL BUILDING AND SITE IMPROVEMENTS — CG (COMMERCIAL GENERAL) ZONING DISTRICT City Attorney Ginsburg read the agenda item. Chmn. Dodd asked the Commissioners if they had any exparte communications to disclose. There was none. He opened the hearing, and then swore in anyone that was going to offer testimony. Mr. Herb Green, P.E., civil engineer and representative for the developer/applicant, stated the project was fairly straight -forward, and the lot was part of an approved master plan for the Sebastian Crossings Commercial Subdivision. They were agreeable with staffs recommended conditions of approval [as listed in the staff report], and had met all Land Development Code requirements. Ei cc a c as 0 PLANNING AND ZONl4a'G COMMISSION ``VW MINUTES OF REGULAR MEETING OF DECEMBER 6, 2012 Ms. Bosworth reviewed and discussed items that staff, the city's consulting engineer, and Mr. Green had worked on, including aligning the Sebastian Boulevard access driveway with the driveway on the Sebastian Crossroads Plaza property and applicable easement, construction of an off -site sidewalk, also needing an additional easement, a Traffic Impact Analysis study the County Traffic Engineering Department required, and the applicant's request to reduce the west side perimeter landscape strip to 5 feet. Recorded easement information and approval of the TIA would be needed before a Certificate of Occupancy/Completion was issued. Mr. Dodd had concerns with the access road in that traffic from Advance Auto would be using Dollar General's parking aisles to get to Sebastian Boulevard. Ms. Bosworth explained that the access road was designed by the subdivision developer to accommodate cross traffic from all four lots and an easement was recorded for that purpose. Mr. Qizilbash had questions regarding a north buffer for the residential subdivision. Mr. Carter was happy with the proposed building elevations, and asked questions regarding the alignment of the access driveways. Mr. Roth had questions regarding the location of the irrigation well, consultants and jurisdictions who reviewed the plan, construction and materials of the cross access driveway, and the photometric plan. Mr. Green addressed his concerns and questions, and stated the base of the driveway would be re -used with a new surface. Mr. Reyes discussed with Mr. Green relocation of a power pole, elevation grades by the dumpster, parking lot drainage, and truck access. Staff noted a truck access plan was provided separately. Chmn. Dodd opened the Public Input. No one spoke in favor of or against the project. Staff recommended approval of the site plan with the conditions as noted in the staff report. MOTION by Durr/Carter to approve the site plan application for Dollar General with the staffs recommendations [for conditions]. The attached acquisition agreement was executed between CRF Panther and IRC at the time of the CR 512 Widening Improvements and development of the subdivision. A traffic study was not requested or approved by the City of Sebastian, as I recall, because the developer was directly working with county staff on required turn lanes, access drives, and property acquisition for ROW and stormwater, and we assumed execution of the agreement was also IRC's approval of the design and concurrency requirements. Because of the turning lane and median cut already provided for the commercial subdivision with the 2006 road construction, staff does not foresee additional improvements being required, but will implement, if necessary. 15. Additional considerations: As shown on the survey, there is an existing asphalt roadway within the 50-foot wide cross -access easement that connects all four lots of the subdivision, with a connection to Sebastian Crossing Boulevard on the east side of the applicant's property. Across the boulevard exists another cross -access roadway through Crossroad Plaza of Sebastian, LLC's vacant property, which is used by Burger King and Sunoco patrons. The two access roads did not line up across the street from each other. Because of the closer proximity to the intersection of Sebastian Boulevard (CR512), the City's consulting engineer, Mr. Frank Watanabe, PE, requested the access road driveway on Dollar General's property be relocated, a shift to the north, to align with the Crossroad Plaza access road driveway. The applicant has complied. However, the shift to the north has now moved the access road out of the 50-foot wide cross access easement. The applicant is in the process of compiling a document which will expand or add to the existing easement as needed for the new driveway, and the document will be recorded. A copy of the recorded document will be needed before the Certificate of Occupancy is issued. (See Note #20 on Sheet 4, Site Geometry Plan) 7 `■d 11qW The applicant is providing an off -site improvement constructing a public sidewalk along Sebastian Crossing Boulevard which will connect to the existing sidewalk along CR 512. However, in order to meet FDOT's design standards, the sidewalk will need to cross a small area of their property in the southeastern corner. The applicant is also in the process of compiling a sidewalk easement document, and a copy of the recorded document will be needed before the Certificate of Occupancy is issued. (See Note #20 on Sheet 4, Site Geometry Plan) Section 54-3-14.11(a) of the LDC states "If an existing landscape strip is provided on the adjacent lot, the required landscape strip may be reduced to five feet in width upon the recommendation of the planning and growth management director and approval of the planning and zoning commission." in order to accommodate delivery truck and emergency vehicle turning radii, the applicant has requested that the west side perimeter landscape strip be reduced to 5 feet, taking into consideration that future development on the adjacent lot will provide the additional 5 foot landscape buffer. The amount of required trees and hedge material is not being reduced. IRC Fire Department, IRC Utilities Department, and Environmental Health Department comments have been addressed. 24. Consulting Engineer's review: Applicant has addressed all comments. 26. Conclusion: The proposed 9,100 SF retail building site plan is consistent with the Comprehensive Plan, Land Development Code, and CR512 Corridor Overlay District Requirements. 26. Yesterday, we sent Herb a revised rendering with a new color palette based on a conversation he had with you, commenting that the only real issue with the proposed seemed to be in the the color selection. However, after receiving the written comments today, we noticed additional embellishments have been requested on the North elevation? As stated in the comments, this is not an "Primary Facade", so that is the reason no accents were originally added. However, we understand the concern of the staff and hope that a compromise will be entertained. Obviously, additional roof accents on the North Elevation will further increase the design cost to the developer. However, if we were to meet in the middle and provide the same awnings, shutters, etc. on the rear (keeping the roof unchanged), would that suffice? Please take a moment to look at the new proposed renderings, with modified North Elevation and color palette. Any feedback you can offer would be greatly appreciated. We were very impressed with how much you researched and familiarized yourself with our Land Development Code. Most of staff comments are minor clean-up items, and usually a staff report for a new, out -of -area civil engineer would be much lengthier. Let me address some of your recent concerns and questions: 1. 1 spoke to our city attorney and he verified that you did not need to replat to increase, or add to, the existing platted cross access easement. An easement document should be drawn up by your legal personnel and recorded at the Indian River County Courthouse. The dedication on the existing recorded plat reads ".......hereon and does hereby dedicate as follows..... (6) The cross access easement to the lot owners within the plat for construction and maintenance of an access road." Our city attorney would like to review the new easement document before it is recorded. We will inform the Planning and Zoning Commission that the city will need a copy of the recorded easement before the Certificate of Completion is issued for the project. 2. 1 received your telephone message regarding questions concerning construction of the sidewalk along Sebastian Crossing Boulevard. See Sheet 4 note # 6 for staffs suggestion to add a note to the site plan sheet that a sidewalk will be installed through a separate ROW Permit submitted to the Engineering/Public Works Department with specific construction and installation details. If the sidewalk is designed to be wholly within the city's SCB right-of-way, a sidewalk easement will not be necessary. After the sidewalk is constructed, maintenance will be the city's responsibility. Mr. Frank Watanabe, and our Public Works Director, Mr. Jerry Converse, can assist with design issues. 3. Because the daily traffic trip information noted on the site plan is over a 100 trips per day, Indian River County's traffic engineer is requesting a traffic study. Before you contact her, I will research the subdivision files, and site plan files for the Advance Auto store, and the un-built mini storage project to see how this was previously handled. I may have a memo or agreement, or statement from the county that states daily trips for the subdivision was already taken into account when CR512 was recently widened and improved. The subdivision owners deeded property to the county for additional right-of-way they needed.
