The City has reviewed your request for both wet and dry retention ponds placed
within the right of way (ROW) on Dryden Avenue. After much consideration, the
City is unable to approve either proposal. Safety concerns and precedent setting
play heavily into the City's decision, While we discussed the dry retention plan
as a possible alternative, the dry retention appears to come within 10 feet of the
side of Dryden Ave and the landscaping is then placed in that 10' area. This
occurs for the whole length of the road.

Rebecca and I took a quick look at your "Dry -Retention" plans yesterday. We have not come up with a recommendation
on this proposal to date. Preliminarily we still have concerns with the idea. As shown, the dry retention appears to come
within 10 feet of the side of Dryden Ave and the landscaping is then placed in that 10' area. This occurs for the whole
length of the road.
At this time, we will talk some more intemally and with our City Attorney, but both the dry and wet retention ROW uses
seem to have issues that are not making us comfortable. Rebecca and I will back to you shortly.

We have run the calculations and the'p *posed drainage pond allows us to `' o
meet the requirements of SJRWMD. The proposed pond is a 2' deep dry
retention system and would extend the length of the Dryden Avenue south ROW
as discussed in the meeting. I have also included the proposed landscape
that we would install along Dryden Avenue.

I have reviewed your site plan and request for the Sebastian City Council to consider using right-
of-way along Dryden Avenue for wet detention of storm water,
While your staff has made inference to the City allowing Publix to use right-of-way as a basis for
expanding outside of the project's boundaries, a closer understanding of the Publix situation
yields several key differences that cannot be applied to the Crossroads Plaza situation. As a
result, this letter is to inform you that your request to be placed on the Council agenda is denied,

I The City may be open to selling a portion of the right-of-way; however, based on requirements by WRWIVID the
required retention may pose unacceptable dge public safety concerns should the area be located too close to the
eof the road. More design and technical information is required should this suggestion be considered.

Site Plan Review:
1. Correct Section and Range number on cover sheet. (Should be Section 22 &
Range 38E)
2. Survey: Provide explanation for 59 of difference between Surveyor Calculated
distance and Deed Description distance on Parcel 2 — 253.34' (D) vs 202.73' (C).
3. Survey: Provide recorded Abandonment of Easement documents for any of the
easements that will be eliminated. (Will need before landclearing permit released)
Do you need a utilities easement in front along CR 512?
4. Survey: If 12' ROW has been conveyed to IR County, please submit revised
survey with adjusted acreage and distances.
5. Accessible ramps per FDOT index 304 with brick red domes: Please keep, but
remove reference to Brevard County requirements. Correct zoning is CG and
Land Use is CG. Change required front building setback to 6 feet. Correct
building height to reflect submitted elevation using finished grade to roof
ridgeline as distance.
6. Please provide a traffic impact statement, using projected, foreseeable uses. A
traffic impact study shall be required if trip generation thresholds are met.
7. Site Data: Revise site area if ROW has been conveyed to county. Building area
(19709) does not match proposed building square footage (19,991). Building area
calculated from the square footage of each unit from the architectural floor plans
plus the electrical room total 19,830. Covered walkway areas count towards
building area. Adjust figures and percentages accordingly.
8. Parking Data: How was 18,509 SF of retail area calculated? (in relation to
building area — minus restaurant unit) ADA requirements for H/C parking are 1
space for every 25 spaces. Five handi-capped spaces required for 113.
9. Is the outside seating area being used by the restaurant? If so, seating area will
need to be added to restaurant parking calculations.
10. Provide environmental study/survey.
11. Provide site lighting plan. Decorative lighting poles are encouraged.
12. Provide information and/or recorded documents regarding any proposed
easements or agreements with adjacent property owner (Sunoco) regarding
eastern access and Stormwater Tract C on Parcel 2. Is this stormwater tract being
shared with new Sunoco site plan?
13. Provide a stormwater maintenance schedule and indicate on plan. Provide any
de -watering information and a soil erosion plan. Indicate a Dewatering Permit
(from the City's Engineering Department) under Permits Required, if necessary.

Landscape Review:
1. Landscape Legend: Viburnum Hedge is required to be 24" O.C. at planting along
CR 512 (vs. 30" as noted, which is OK for sides and rear). Please modify
"Appropriate alternative varieties may be substituted by annroval from the Citv of
Sebastian Growth Management Director".
2. Landscape Data: Per site plan, CR 512 frontage is 506`, which requires 5 canopy
and 6 understory trees per 100 LF. Please adjust calculations accordingly. There
is not any credit given for understory trees.
3. Existing Tree Credits: Change total credit for trees over 4-10 inches DBH to 46
(vs. 48).
4. Provide details regarding barricades and protective measures during construction
regarding tree protection for existing trees to remain, as required and described in
Section 54-3-14.6.
5. Regarding Section 54-3-14.11(c)(1): verify off-street parking areas are landscaped
with a minimum of 15 sq. ft. of landscape area for each parking space. Each
landscape area shall be a minimum of 50 square feet.

Architectural Review:
1. Per Section 54-4-21.B.3(c)(2)i, Overlay District requirements -verify the awnings
do not exceed 25% of the area of any single fagade (front and rear).
2. Per Section 544-213.3(c)(1) — Buildings with facades fronting on more than one
street shall have similar design considerations (e.g. roof treatment, building
articulation, entrance features, and window placement) and consistent detailing on
all street frontages. Please provide similar roof features on the north elevation
(rear) as the front, regarding the flat roof appearance. All roof mechanical
equipment is required to be concealed from view on all sides. (The requested
additional roof features may help with this requirement)
3. Provide proposed building and roofing colors.

• Fire protection may be required. Applicant should contact the Indian River County
Department of Emergency Services at 562-2028, ext. 3001, for fire protection
requirements.
• Applicant must install a double detector check valve on fire sprinkler system or fire
system.
• Contractor must call for utility locations 48 hours prior to construction. Water and sewer
facilities can be located through Sunshine State One at 1-800-432-4770.
• Line extension fees and/or account charges must be paid for connection to water and
sewer.
• Floor drains, storm drains, swimming pool drainage, etc., that collect waste that is not
generated from potable water, are not allowed to be connected to the County sewer
system. A set of plumbing plans must be submitted to the County for verification.
Applicant must provide separate treatment system for any waste not generated from
potable water. Treatment system must be permitted through the Environmental Health
Department.
• Glued joint PVC construction is not allowed for water, or sewer mains. Specification of
construction material must be PR-200 for pipe sizes less than 4" diameter, and C-900 for
pipe sizes greater than or equal to 4" diameter.
• For your information regarding the Solid Waste Disposal District, an assessment for solid
waste shall be paid at the time construction of the parcel has been completed,
immediately prior to obtaining a Certificate of Occupancy. For further details, contact
Donna Stark at 567-8000, ext. 1294.
• All commercial services greater than 5/8" diameter or serving more than one customer
must be reviewed and approved by Indian River County Utilities and the Department of
Environmental Protection (DEP). In certain cases, a Utility Construction and/or DEP
permit may be required. If a DEP permit is not required, applicant must provide written
notification from the DEP.
• Contractor must call for utility locations 48 hours prior to construction. Water and sewer
facilities can be located through Sunshine State One at 1-800-432-4770.

All on -site flow wells not in use must be abandoned and plugged. St. Johns River Water
