R-24-03 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, APPROVING A SPECIAL USE PERMIT PURSUANT TO LAND DEVELOPMENT CODE SECTION 54-2-3.1 FOR A SMALL RV PARK TO BE LOCATED AT 608 DAVIS STREET WITHIN THE RIVERFRONT OVERLAY DISTRICT'S CWR (COMMERCIAL WATERFRONT RESIDENTIAL) ZONING DISTRICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; PROVIDING FOR SCRIVERNER'S ERRORS; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR AN EXPIRATION DATE. WHEREAS, Sydney L. Allison, property owner, has filed an application for approval of a special use permit to operate a small RV Park with a mix of RV pads with full utility hookups, cottage rentals, and an amenity center to be located at 608 Davis Street in the Commercial Waterfront Residential zoning district; and WHEREAS, the Planning and Zoning Commission held a quasi-judicial public hearing in accordance with Section 54-2-3. 1 (a)(2)d of the City's Land Development Code on February Is', 2024, and recommended unanimously to approve the request with specified conditions. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, AS FOLLOWS: Section 1. FINDINGS. Based upon the evidence presented, the City Council of the City of Sebastian determines that the following conditions are satisfied: a. The requested RV Park use will not be detrimental to the public safety, health or welfare, or be injurious to other properties or improvements within the immediate vicinity in which the property is located based on criteria established in the Land Development Code; and b. The proposed RV Park would be consistent with the purpose and intent of the respective district, and can be demonstrated to be similar in nature and compatible with the uses allowed in such district; and C. The requested use is consistent with the Comprehensive Plan and the Code of Ordinances. Section 2. SPECIAL USE PERMIT APPROVAL. The City Council of the City of Sebastian does hereby approve a special use permit for Sydney L. Allison to develop and operate a RV Park at 608 Davis Street, subject to the following special conditions: (1) The special use is granted for a mix of RV pads and cottages as initially shown on the 8/9/2023 Conceptual Plan for Sebastian RV Park not to exceed 13 total rental pads and/or units. Any proposed increase to that amount will require additional approval by City Council; and (2) The maximum length of stay shall be limited to 90 days on site; and (3) A traffic analysis regarding maneuverability through the intersections and driveways, along with a report on the condition of the existing local streets with regards to the length and weight of the Recreational Vehicles shall be submitted with the site plan, and any off -site improvements that may be warranted completed before issuance of the project's Certificate of Occupancy; and (4) A full tree survey is required with submittal of the site plan that includes a construction tree preservation plan and a long-term tree maintenance plan to be approved as part of the site plan; and (5) The RV Park shall be in compliance with all applicable Environmental Health Department and Florida Statute regulations that apply to RV Parks and cottage rentals; and (6) No RV Pads or cottages shall be constructed on the parcel east of Indian River Drive; and (7) All property lines abutting residential uses shall be screened in accordance with the Type "A" opaque screening standards established in LDC Section 54-3-14.16; and (8) Stand-alone tent camping is prohibited; and (9) A minimum of one car parking space shall be provided for the RV pads, two parking spaces for the cottages, and eight spaces for the amenity center; and (10) A full utility hook-up shall be provided for each RV pad; and (11) The size of the cottages for rent shall not exceed 1,250 square feet in size. Section 3. SEVERABILITY. If any section or part of a section of this Resolution is declared invalid or unconstitutional, the validity, force and effect of any other section or part of a section of this Resolution shall not thereby be affected or impaired unless it clearly appears that such other section or part of a section of this Resolution is wholly or necessarily dependent upon the section or part of a section so held to be invalid or unconstitutional. Section 4. CONFLICT. All resolutions or parts of resolutions in conflict herewith are hereby repealed. �q Section 5. SCRIVENER'S ERRORS. Sections of this resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of further action of the City Council by filing a corrected copy of same with the City Clerk. Section 6. EFFECTIVE DATE. This Resolution shall take effect immediately upon its adoption. Section 7. EXPIRATION DATE. The special use permit will expire three (3) years from the day of the effective date if the RV Resort is not operational by that time.
