HomeMy WebLinkAboutF - ITB #24-06 Rehabilitation of Alpha Aprons at Sebastian Municipal Airport Addendum 3Page 1 of 4 ADDENDUM NO. 3 March 19, 2024 ITB 24-06 Rehabilitation of Asphalt Aprons at Sebastian Municipal Airport The original Invitation to Bid shall remain in full force and effect, except as modified herein, which shall take precedence over any contrary provisions in the prior documents. This addendum is being issued to address questions received. SECTION 1: QUESTIONS 1. Question: What is the daily liquidated damages rate? Answer: Please see Section II, Revision/Clarification to Solicitation 2. Question: In reference to question 4 on addendum #2. “What is the minimum required base thickness beneath proposed new asphalt.” The answer stated only refers to the minimum base thickness required next to the hanger/driveway. What is the minimum base thickness required for the rest of the project? Answer: The rest of the area has sufficient base that will not be disturbed , only working the area to a 2” maximum depth. The base in place is estimated to be approximately 12”, determined from a recent adjacent project. 3. Question: The plans do not clearly identify grades within the work zone; to build this correctly we need % rise/fall within the work zone and a reference to where the break point is located. Could this be provided? Answer: Grades must be confirmed by contractor before start of work. 4. Question: On sheet G1.3 in the phasing schedule, in the description of work it states that runway 10- 28 will be closed and to place a lighted X. In impact summary next to it, it states “airport will be open to all takeoff and landing operations on runway “10 -28”. Please clarify if there will be a runway closure. Answer: Runway 10-28 will only be closed on an as-needed basis, with 24 hours’ notice, depending on type of scheduled work at the southern Alpha Apron. There is no impact related at the north apron. 5. Question: In the bid documents it states there is to be a 5 -year warranty from the date of acceptance. This will add an exorbitant amount of cost to this project. The warranty cost would essentially be the cost to replace the entire project. Especially considering all base work was done by others. Would there be a consideration for a standard 1 year warranty? Answer: Please see Section II, Revision/Clarification to Solicitation Finance Department Procurement Division 1225 Main Street Sebastian, FL 32958 (772) 388-8231 Page 2 of 4 6. Question: In “Statement of Bidders Qualifications" requests experience in pre -engineered metal building construction work. Is pre -engineered metal building construction experience a requirement for this bid? Answer. No. Please see Section III, Attachments, for a revised form. 7. Question: Could you please provide DBE Form 2, DBE Subcontractor Identification Affidavit and DBE Form 3 Letter of Intent to Perform as a Subcontractor? Answer: Please see Section III, Attachments, for the DBE Forms. SECTION II: REVISION/CLARIFICATIONS TO SOLICITATION  Page 15, Section 2.39, Liquidated Damages, has been revised to read: 2.39 LIQUIDATED DAMAGES The contractor agrees to the use of liquidated damages in the event the contractor fails to perform by the provisions herein. The Contractor hereby agrees, as part consideration for awarding the Agreement, to pay the City the sum of One -Hundred Dollars ($100.00), for each and every calendar day that the Contractor shall be in default after the time stipulated in the Agreement for completing the Work. The Contractor and City acknowledg e and agree that said sum is not a penalty but liquidated damages for breach of contract On the occasion where the contractor is in default of the Agreement, or any material provision thereof, or fails to remedy any deficiency in performance, the City may procure the necessary supplies or services from an alternative source and hold the contractor financially responsible for any excess costs incurred. The difference between the Bid price of the product or s ervice and the actual price paid may be deducted from any current or future obligations owed to the contractor as liquidated damages.  Page 21, section 3.10, Warranty, has been revised to read: 3.10 WARRANTY The contractor shall warrant and guarantee all goods, labor and services for a period of no less than two (2) years from the date of acceptance and shall replace or repair all defects in material or workmanship during the warranty period. The contractor shall bear all labor, product replacement, mobilization, and transportation costs for warranted goods and services. Labor shall be warranted for no less than two (2) years from the acceptance date and all rework shall be at no cost to the City of Sebastian. A “No Charge” invoice shall be submitted on all warranty repairs detailing the replaced goods including dimensions and quantity. The contractor shall respond to all warranty requests within twenty -four (24) hours of notification. Repeated failure to meet the established and repair timeframes will be considered unsatisfactory under the terms of this agreement. Excessive instances of unsatisfactory service shall be cause for default. Warranty repairs must be accomplished within the service response time of twenty -four (24) hours and shall be fully completed to the satisfaction of the project manager and City within seven (7) working days. Suggested guidance for use in determining if good faith efforts were made by a Bidder is included in 49 CFR Part 26, Appendix A. A list of the efforts that a Bidder may make and the Owner may use in making a determination as to the acceptability of a Bidder's efforts to meet the goal as included in Appendix A are as follows: A. Soliciting through all reasonable and available means e.g. attendance at pre-bid meetings, advertising and/or written notices) the interest of all certified DBEs who have the capability to perform the work of the contract. The bidder must solicit this interest within sufficient time to allow the DBEs to respond to the solicitation. The bidder must determine with certainty if the DBEs are interested by taking appropriate steps to follow up initial solicitations. B. Selecting portions of the work to be performed by DBEs in order to increase the likelihood that the DBE goals will be achieved. This includes, where appropriate, breaking out contract work items into economically feasible units to facilitate DBE participation, even when the prime contractor might otherwise prefer to perform these work items with its own forces. C. Providing interested DBEs with adequate information about the plans, specifications, and requirements of the contract in a timely manner to assist them in responding to a solicitation. D. (1) Negotiating in good faith with interested DBEs. It is the bidder's responsibility to make a portion of the work available to DBE subcontractors and suppliers and to select those portions of the work or material needs consistent with the available DBE subcontractors and suppliers, so as to facilitate DBE participation. Evidence of such negotiation includes the names, addresses, and telephone numbers of DBEs that were considered; a description of the information provided regarding the plans and specifications for the work selected for subcontracting; and evidence as to why additional agreements could not be reached for DBEs to perform the work. (2) A bidder using good business judgment would consider a number of factors in negotiating with subcontractors, including DBE subcontractors, and would take a firm's price and capabilities as well as contract goals into consideration. However, the fact that there may be some additional costs involved in finding and using DBEs is not in itself sufficient reason for a bidder's failure to meet the contract DBE goal, as long as such costs are reasonable. Also, the ability or desire of a prime contractor to perform the work of a contract with its own organization does not relieve the bidder of the responsibility to make good faith efforts. Prime contractors are not, however, required to accept higher quotes from DBEs if the price difference is excessive or unreasonable. E. Not rejecting DBEs as being unqualified without sound reasons based on a thorough investigation of their capabilities. The contractor's standing within its industry, membership in specific groups, organizations, or associations and political or social affiliations (for example union vs. non-union employee status) are not legitimate causes for the rejection or non- solicitation of bids in the contractor's efforts to meet the project goal. F. Making efforts to assist interested DBEs in obtaining bonding, lines of credit, or insurance as required by the recipient or contractor. ITB #24-06 G. Making efforts to assist interested DBEs i n obtaining necessary equipment, supplies, materials, or related assistance or services. H. Effectively using the services of available minority/women community organizations; minority/women contractors' groups; local, state, and Federal minority/women business assistance offices; and other organizations as allowed on a case-by-case basis to provide assistance in the recruitment and placement of DBEs. NOTE: The items set forth above are merely suggested criteria and the Owner may specify that you submit additional information on certain other actions a Bidder took to secure DBE participation in an effort to meet the goals. A Bidder may also submit to the Owner other information on efforts to meet the goals.
