Final Notice and Public Explanation of a Proposed Activity at risk for flooding – Fort Pierce, FL To: All interested Agencies, Groups, and Individuals, The U.S. Department of Justice (DOJ), Bureau of Justice Assistance (BJA) has prepared an 8-Step Decision-Making Process review per DOJ’s Flood- plain Management and Wetland Procedures (28 CFR 63.6) and in compliance with Executive Order (EO) 11988 (Floodplain Management), as amended by EO 13690 (Establishing a Federal Flood Risk Management Standard and a Process for Further Soliciting and Considering Stakeholder Input), which amended EO 11988 in January 2015. Based on the 8-Step Decision-Making Process, BJA has determined that the Proposed Action will not adversely impact floodplains or lead to the development of floodplains. Proposed Action Description: The purpose of the Proposed Action is to enhance current trainings offered at the Treasure Coast Public Safety Train- ing Complex to meet the needs of first responders in Florida and throughout the Southeastern United States. Expanding the existing facility would allow Indian River State College (IRSC) to establish the first regional All Hazards training center of its kind. IRSC would use BJA funding to add a confined space and structural collapse training area, a trench collapse rescue train- ing area, a firefighter training tower, an obstacle course, and would expand an existing mock village. The site is already developed with the first phase of the urban mock village, buildings associated with the public safety training facility, parking areas, and roads. Some of the area affected by the project is paved, while other areas are unpaved with grass ground cover. Portions of the Proposed Action are in a 500-year floodplain and are imme- diately adjacent to an 100-year floodplain and a regulatory floodway (view FEMA Maps at the project location). As such, the project has a 0.2% high risk of flooding per year. DOJ BJA considered and dismissed the following alternatives to the Proposed Action: • No Action Alternative: The No Action Alternative would result in the training facility continuing to exist in its current state. The capacity of the training facility would not be expanded and IRSC would not increase the types of training offered. The No Action Alternative would not address the needs of public safety agencies and first responders in need of training in the Southeast US. • Nature Based Approaches: EO 13690 requires federal agencies to consider nature-based approaches when developing project alter- natives. “Nature-based approach” is an umbrella term for project features designed to mimic, restore, manage, and conserve natural processes to increase resilience. Nature-based approaches were considered as alternatives to the Proposed Action. However, no viable nature-based alternatives were identified that would still meet the needs of the Proposed Action. • Alternate Site: Since the Proposed Action is specifically proposing to expand the IRSC training facility, it was not practical to consider other sites for these new training course elements since many of these components would be integrated with existing training facilities (for example, a mock village is already in place at the site and the Proposed Action seeks to upgrade and expand the existing mock village). Other site options would have been cost-prohibitive as they would have likely required relocating existing training facility components. Much of Fort Pierce and the IRSC campus are located in a floodplain, making it diffi- cult to identify suitable locations outside of a floodplain. An alternative site for the new components of the training facility would not meet the needs of the Proposed Action, since those new components would not be integrated into the existing facility effectively and trainees would potentially have to travel between multiple sites. Although there are no practicable methods to design or modify the Proposed Action to fully avoid the risk of potential impacts to property and lives, based on the best available information for the site, the following actions would minimize potential impacts: • Flood Insurance: As a means to minimize the property/monetary value that may be lost as a result of a flooding event, IRSC would maintain flood insurance after facility expansions have been completed. In addition, the training facility components that would be added to the site would not be considered permanent structures as they would not require permanent foundations and would be moveable (for example, the expansion of the mock village would consist of shipping containers serving as mock buildings). This would provide IRSC the flexibility to adapt the layout of the training facility as needed based on flood impacts in the future, and as a result, minimize potential property impacts. • Restricting Use During Flood Events: The training facility would not be used during flood events since it is not a residential facility with permanent occupants. The facility’s intermittent use would minimize the potential for loss of life during a flood event. • Avoiding Increasing Impervious Surface: The Proposed Action would not change the amount of impervious surface on the site and none of the training facility components added as a result of the expan- sion would be considered permanent structures. The flood moderation value would be minimally impacted. Following publication of the early notice for this proposal, one public comment was received. The public comment was not related to the impact of the proposal on floodplains or the impact of flood risk on the proposal and therefore did not impact BJA’s determination that there is no practicable alternative to locating the action in the floodplain. It is BJA’s determina- tion that due to 1) the identification of sufficient mitigation, 2) the lack of practicable alternatives, and 3) the importance of the Proposed Action to address the needs of first responders and public safety agencies in the Fort Pierce community and the Southeast US; the importance of the Proposed Action in the floodplain outweighs the requirements of EO 11988 and EO 13690 to avoid direct or indirect support of floodplain development and reduce the risk of flood loss. This notice provides people who may be affected by activities in the flood- plain and those who have an interest in the protection of the natural envi- ronment an opportunity to express their concerns and provide information.
