HomeMy WebLinkAboutR-24-41 Stormwater Fee IncreaseRESOLUTION NO. R-24-41 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AMENDING CHAPTER 102, ARTICLE V. OF THE CITY OF SEBASTIAN CODE OF ORDINANCES, PROVIDING FOR CLARIFICATION, UTILITY FEE CREDITS AND ESTABLISHMENT OF STORMWATER FEES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sebastian presently owns and operates a stormwater system which has been developed over a number of years to serve the purpose of collecting, treating and discharging storm and other surface waters; and WHEREAS, the City is currently in the process of expanding, constructing and improving the stormwater systems functionality; and WHEREAS, in order to provide for the expansion construction and improvements to the stormwater systems, to provide for the health safety and public welfare of the citizens of the City of the Sebastian, it is now proposed to increase the existing fee by an increased amount of four dollars per month totaling a forty-eight dollar increase per year per developed residential property (ERU); and WHEREAS, if enacted, the new proposed fee will now be fourteen dollars per month per (ERU) for a total of one hundred and sixty- eight dollars annually. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: SECTION 1. RECITALS The above recitals are true, correct, and are hereby adopted as the legislative findings of the City Council of the City of Sebastian. SECTION 2. AUTHORIZATION OF INCREASED FEE The City Council of the City of Sebastian hereby authorizes the increase of the stormwater fee to fourteen dollars per month per (ERU) for a total of one hundred and sixty- eight dollars annually. SECTION 3. CONFLICTS All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4. SEVERABILITY In the event a court of competent jurisdiction shall determine that any part of this Resolution is invalid, the remainder of the Resolution shall not be affected and it shall be presumed that the City Council of the City of Sebastian did not intend to enact such invalid provision. It shall further be assumed that the City Council would have enacted the remainder of this Resolution without said invalid provision, thereby causing said remainder to remain in full force and effect. SECTION 5. SCRIVENER'S ERRORS Sections of this Resolution may be renumbered or re - lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of further action of City Council by filing a corrected copy of same with the City Clerk. SECTION 6. EFFECTIVE DATE This Resolution shall take effect upon adoption. Section 102-125 of the Code of Ordinances provides that the City Council may establish the Sebastian Stormwater Utility fee by Resolution in any fiscal period post 2018-2019 if passed by a supermajority. The proposed increase is four dollars per month totaling a forty-eight dollar increase per year per developed residential property (ERU). Per Resolution No. R-24-41, the new proposed fee will be fourteen dollars per month per (ERU) for a total of one hundred and sixty-eight dollars annually. Staff is seeking approval of Resolution R-24-41, with a supermajority vote. RECOMMENDATION City staff recommends that City Council adopt and approve Resolution No. R-24-41 ATTACHMENTS: 1.
