HomeMy WebLinkAbout2024 - First AmendmentFIRST AMENDMENT TO FISHE FLYING CORP AIRPORT TERMINAL WING LEASE THIS FIRST AMENDMENT TO AIRPORT LEASE AGREEMENT (hereinafter "Lease") by and between the City of Sebastian, a municipal corporation of the State of Florida, located at 1225 Main Street, Sebastian FL 32958 (hereinafter "Landlord") and Fishe Flying Corp, a corporation of the State of Florida, DBA Wings Airline Academy (Wings AA) doing business at Sebastian Municipal Airport (hereinafter "Tenant"), is hereby amended as follows: WHEREAS, Landlord is the owner of certain real property located in Indian River County, Florida; and WHEREAS, the certain property is being used for the operation of the Sebastian Municipal Airport (hereinafter referred to as the "Airport"); and WHEREAS, the Landlord agreed to lease such property under the terms of the original Lease to Tenant; entered into on May 1, 2019; and WHEREAS, the Tenant wishes to modify sections of the Lease as outlined herein; and WHEREAS, the Landlord and Tenant are mutually agreeable to said modifications. NOW, THEREFORE, in consideration of the mutual covenants hereinafter provided, the receipt and sufficiency of which are hereby acknowledged, the Parties have agreed as follows: A. Schedule "A" of the Lease is hereby amended to add the following: 6. Leased premises shall include one (1) Office Space of approximately 232.5 sf. in the lobby of the Airport Administration Building. Utility costs are included in the rent charge. B. Section 4 of the Lease is hereby amended to read as follows: 4. RENT (a) As additional rent, Tenant shall pay $61.45 monthly, in advance, for the use of Office Space in the Administration Building Lobby. CPI increases will continue for this space with the existing anniversary date of March 1 of each year. EXECUTIVE SUMMARY Current tenant Fishe Flying Corp, doing business as Wings Airline Academy, is operating under a recently extended Lease for one office wing in the Terminal at the Sebastian Municipal Airport. They have been using one additional office space as a Dispatch Office, off of the lobby area of the Terminal Building. This Office Space was originally under a separate, temporary lease that has expired. This Amendment will properly align the separate office under the existing Terminal Wing lease and run concurrently with that set of offices. Staff is seeking approval of the attached Amendment to the Lease and authorization of signatures. RECOMMENDATION Staff recommends City Council approve the First Amendment to the Terminal Wing Lease for Fishe Flying Corp. at Sebastian Municipal Airport, replacing an expired lease for one office space, and to authorize the City Manager to execute appropriate documents.
