MINUTES
SPECIAL MAGISTRATE CODE ENFORCEMENT HEARING
AUGUST 20, 2024
The hearing was called to order at 2:00 p.m. by Special Magistrate Kelley H. Armitage.
Present:
Special Magistrate Kelley H. Armitage, Code Enforcement Officer Curtis Bloomfield, Code
Enforcement Records Specialist Naiomi Charles, Joanne Brown, and Janet Graham,
Technical Writer.
Code Enforcement Records Specialist Naiomi Charles swore in staff and all persons who
would be speaking.

Curtis Bloomfield, Code Enforcement Officer with the City of Sebastian, identified himself
and his position with the City of Sebastian. Officer Bloomfield stated that on July 18, 2024
he inspected the property and found it to be in violation of City Code 66-3(11). He left the
door hanger and then posted the property that same day. He stated that this property
has been adjudicated in the past of being a repeat violator. By Florida Statute, the City
is not required to give them an extended period of time to cure the violation. The property
was posted with a Notice to Appear for this hearing. Certified Mail was also sent, and the
owners signed for that Certified Mail on July 24th. He has not had any communication
from the owners. He presented some photographs and showed them on the screen and
asked that they be marked as exhibits and made a part of the record. He stated that
people are living at the property, and he has not been contacted by the owners. Officer
Bloomfield stated that he inspected the property this morning and presented photographs
of the condition of the property this morning. He also presented a copy of the Order from
the last hearing signed by Special Magistrate Armitage and dated June 18th where the
City was given permission to enter the property and abate the property.
Officer Bloomfield stated that staff recommends an Order of no time to cure and to allow
the City to enter and abate the property in addition to presenting such costs of abatement
as a lien against the property and any other property owned by the listed owners. Staff

is also asking for administrative costs in the amount of $250.00 and a fine because of the
repeat violator status of $500.00, and any future violation of the same ordinance brought
before the Special Magistrate will be considered a repeat violation and may be subject to
additional fines in accordance with Florida Statute 162.
There being no one else wishing to speak on this matter, so ordered by the Magistrate.
