The City Council of the City of Scb,~stian met at 7:00 o'clock p. m.,
Janu:~ry 2, 1946. President of 'the ~ouncil, Y. ~t. ~iddleton presided ard
i~'. the absence of the City Clerk, the City Attorney acted as Secretary of
of the meeting. Present wer~ Councilmen ~!ddleton, Sembter, Turlington,
and Bohannon and City attorney ~ltchell.
The city. financial st:~tement for the month of December, 1945, was
~lr. ~iiddleton. reported that funds had been forwarded to Guaranty
Trust Company of New York in payment of the interest due January 1, 1946,
upon outst=nding city bonds.
Discussion was had with regard to the sale of city owned lots to the
Methodist Church of Sebastian.
~ir. Baughman, u visitor, discussed the proposed widening of Louisiana
~venue and a gener:~l discussion of this matter followed.
The status of the municipally owned airport property was considered ~nd
discussed.
~ discussion was had with respect $o the insurance of city property and
the bond of the City Clerk. Upon motion by ~.fr. Demb!er, seconded by ~r.
Turlington, and unanimously adopted, it was ordered that the ~f:~yor and the
President of the City Council ascertain if insurance on the City Personal
property and the bond of the City Clerk had been duly written and wa~, in
effect and, if not, that the same be secured a~d placed ~n effect irm~.~di:~tely
with the Clerk's bond to be in the amount of ~ 3000.00 and the insurance of
the city personal properSy to be in the amount of ~ 1,000.00.
.~ discussion was had on tb,~o condemnation of' vacant buildings in the city
and which buildings constitute dangerous nuisances.
Councilman ~ohan~on introduced the following desolution and ~oved its
adoption, to-wit:
V,~[~REAS, there has been irregularity in the collection of interest
upon delinquent taxes due the City and no fixed policy now exists with re-
spect to the amount of such interest to Oe charged and collected, and it is
advisable that a fixed policy in such regard be adopted; therefore,
BE IT RESOLVED that no interest be charged upon delinquent taxes
assessed and levied for the years prior to the taxes asses~:;ed ~nd levied
for the year of 1945, provided such dellr, quent taxes are paid prior to the
City filing suit to foreclose such delinquent tax leins and prior to the
s~le by tho City of t~x certificates representing such tax leins.
B~ IT FURTH[~R RESOLVED that beginning with taxes assessed and
levied for the year 1945 and for taxes ~ssessed and levied in all subsequent
years, interest be charged upon delin0uent taxes for such years from the
date on which the same become delin0uent, namely, on april 1, t~ the yea:~
next succeeding the year for which such taxes are ,.~ssessed and levied, at
the rate of 12% per annum for ~he first year of such delinquencey, 10% per
annum for the second year of such delinouenc~ and 8~ per annum for the
period of delinquency from and after such second year.
The motio~ for 2he adoption of the resolution being duly seconded by
~'~r. Turlington, the resolution was unanimously adopted upon roll call
by the following votes:
AYES: Bohannon, Sembler, Turlington and ~fiddleton.
