Dear Mr. Griffin: The St. Johns River Water Management District has received your Standard Environmental Resource Permit application. Upon preliminary review of the proposed project, the following technical information is required to sufficiently review the possible impacts the project may have on the surrounding area. This information is being requested pursuant to the authority vested in the St. Johns River Water Management District under subsection 373.413(2), Florida Statutes (F.S.), and sections 40C-4.101 and 40C-4.301, Florida Administrative Code (F.A. C.). In order to expedite the review of your application, please use the application number referenced above on all correspondence and submit three (3) copies of all requested information unless otherwise indicated by a specific information request. The total drainage basin areas used for the calculation of the water quality treatment volume and for the nutrient loading analysis, do not match the basin acreages shown on the post -development drainage map. For instance, the basin map shows that basins Airport Drive East B, Airport Drive East C, Hangar A, and Maintenance Building B all drain to the proposed dry retention area, and the combined acreage of these basins is 7.7 acres, whereas your calculations use total acreages of 4.19 acres (water quality treatment volume analysis), and 5.39 acres (nutrient loading analysis). The impervious areas do not match up either. Please review and revise. [40C-4.301 (1) (e),(i), F.A.C.] 2. The table used for calculating the total phosphorus loading is unclear. Please contact staff to discuss and explain this table. [40C-4.301 (1) (e),(i), F.A.C.] 3. The closest soil boring in the geotechnical report to the proposed dry retention area appears to be boring B-3 which has a seasonal high water table estimate at 10- inches below the land surface. Moore VERO BEACH OVIEDO JACKSONVILLE FORT WCOY BUNNELL seasonal high estimate at 14 inches below the surface. The elevations in the area where the dry retention is proposed are 21 to 22 ft. NGVD. Given the estimated seasonal high water table elevations just referenced, it appears that the proposed retention area is below the seasonal high groundwater table. Please revise the design assumptions, or provide additional borings in the area of the proposed retention area to more accurately determine the seasonal high water table elevation. [40C-4.301 (1) (1); 40C-42.026 (1) (c), F.A.C.] 4. Please provide the details of how the parameters input in to the Ponds model where estimated. Additionally, the fillable porosity of 30 percent appears to be more appropriate for type A sands which are not present in this project area. [40C-4.301 (1) (1); 40C-42.026 (1) (c), F.A.C.] 5. The curve numbers chosen for the site are based on type D soils for all basins, which does not appear appropriate for those basins where the seasonal high water table is estimated at 2 feet and more below the land surface. Please revise the soil type assumptions and associated curve numbers for these basins. [40C-4.301 (1) (b),(e),(i), F.A.C.] 6. The Maintenance Building A basin in the pre -development ICPR model is routed to node XSB when it appears that it should be routed to node XSA. Please clarify and revise if applicable. [40C-4.301 (1) (i), F.A.C.] 7. The pre -development ICPR model doesn't appear to account for the existing 12-inch diameter pipe at outfall 2. Please include this pipe in the model as it can be a restriction in the flow over the channel that is currently used. [40C-4.301 (1) (b), (i), F.A.C.] 8. Please remove the notation "Not released for Construction" from the construction plans. This permit application is for construction of a project. If the final construction plans are not available yet, then please provide them when they are available so that the permit application may be completed. [40C-42.025 (10), F.A.C.] 9. The District received application number 42-061-68172-13 on April 1, 2009 for the same project area that your proposed project is in. Please clarify which application (this one or the one received on April 1, 2009) is actually proposed as the District cannot permit two different and conflicting construction projects in the same location. 140C-4.301 (1) (i), F.A.C.] Please be aware, that suggestions or other direction provided by District staff are offered to assist applicants in complying with District rules. However, applicants bear the burden of demonstrating that their application meets the applicable rule requirements. Although District staff may provide suggestions to applicants that would allow staff to recommend approval of an application to the District Governing Board or senior staff, the final decision regarding the issuance or denial of a permit is up to the District Governing Board or senior staff. Applicants are hereby advised that the Governing Board and senior staff are not bound by previous statements or recommendations of District staff regarding an application. If the applicant desires to dispute the necessity for any information requested on an application form or in a letter requesting additional information, he or she may, pursuant to 373.4141, F.S, request that District staff process the application without the requested information. If the applicant is then unsatisfied with the District's decision regarding issuance or denial of the application, the applicant may request a section 120.569, F.S. hearing pursuant to Chapter 28-106 and section 40C-1.1006, F.A.C. Please be advised, pursuant to subsection 40C-1.1008, F.A.C., the applicant shall have 120 days from receipt of a request for additional information regarding a permit or license application undergoing review by the District to submit that information to the District. If an applicant requires more than 120 days in which to complete an application, the applicant may notify the District in writing of the circumstances and for good cause shown, the application shall be held in active status for additional periods commensurate with the good cause shown. Any application which has not been technically completed within the given time period following a request for additional information by the District shall be subject to denial. The requested information or written request showing good cause for additional time may be submitted to the District at any time prior to the denial of the application. Denial of an application due to failure to submit requested additional information shall be a denial without prejudice to applicant's right to file a new application. In addition, no construction shall begin on the proposed project until a permit is issued by the St. Johns River Water Management District. This is pursuant to subsection 40C-4.041(l ), F.A.C., which states in relevant part, "... unless expressly exempt an individual or general environmental resource permit must be obtained from the District under chapters 40C-4, 40C-40, 40C-42, 40C-44 or 40C-400, F.A.C. prior to the construction, alteration, operation, maintenance, removal or abandonment of any dam, impoundment, reservoir, appurtenant work or works...".
