Mayor Conyers called the meeting to order at 7:00 p.m. 2. The Pledge of Allegiance was recited. 3. ROLL CALL Present: Mayor W.E. Non-Agenda Items Jeffrey Home - Request for Fence Around Basketball Court - Schumann Park - Adjacent to Lutkemeier Property at Schumann Drive and Kildare Drive (City Manager Letters dated 12/10/90 and 10/5/90, Horne Letter dated 12/10/90) Mr. Horne was not present at this time, therefore Council referred this item to the City Manager to contact Mr. Home. Pelican Island Jaycees - Request Half Fee ($12.50) and A/B - Use of Yacht Club for Weekly Club Meetings - Wednesdays - 8:00 p.m. - Security On Hold (P~ior Approval Has Been Given in Six Month Increments) (Reservation Request) MOTION by Oberbeck/McCollum I move we approve the Pelican Island Jaycees use of the Yacht Club at the half fee. VOICE VOTE on the motion carried 4-0. B. Agenda Items Eric John, 136 Sue Avenue, Whispering Palms, requested that FDOT extend their Master Plan to cover Whispering Palms. Jeff Home arrived at the meeting at this time so Council addressed his item. Mr. Horne explained the request of Mrs. Lutkemeier for a fence adjacent to the Schumann Park basketball court to protect her property. A brief discussion ensued and Council instructed staff to look into the cost of erecting such a fence and bring it back to a future meeting. 2 City Council Workshop January 2, 1991 Page Three 91.003 91.004 90.226 Vice Mayor Oberbeck requested an overlay to review and Councilman McCollum requested that the City Attorney provide a comment as to the city's liability if Mrs. Lutkemeier put up "no trespassing" signs. The City Attorney advised that any fence not be placed too close to the court or the city might be considered negligent. 7. WORKSHOP ITEMS Review Proposed FDOT Improvements to U.S. 1 Medians (no backup) Christopher LeDew, District Safety Engineer, District 4, FDOT, Gave a history of the Master Plan for U.S. Highway 1 and presented illustrations. A brief discussion ensued and Vice Mayor Oberbeck recommended certain amendments. Mr. LeDew said he would inform the City Manager of any changes that are made and would provide the City Council with a set of final plans for review. Review Ordinance No. 0-91-01_- Political Signs Deferred from 12/12/90 (Staff Recommendation dated 12/26/90, O-91-1) Subsequent to discussion and amendments to the proposed ordinance to remove certain restrictions on private properties, motion was made as follows: MOTION by Oberbeck/Powell I move we authorize the Attorney to prepare the ordinance with revisions as brought to his attention tonight and Get it back to us in its revised form. Mayor Conyers called recess at 7:57 p.m. and reconvened the meeting at 8:07 p.m. Ail Council members present at roll call were present when the meeting reconvened. Morchesky Industrial Subdivision Sand Mining Permit - Direct Attorney to Draft Resolution and Set Public Hearing on 1/23-791 (Staff Recommendation dated 12/18/90, P & Z Memo dated 8/16/90, Application, Plans Under Separate Cover) MOTION by Oberbeck/Powell I move we direct the City Attorney to draft the resolution for the permit for the Morchesky property and set the public hearing for January 23, 1991. The City Attorney stated that he may not have sufficient backup documents for the Morchesky or Flatt sandmining to prepare the resolution in a timely manner. Collier Creek Commercial Park Subdivision Preliminary Plat - Direct City Attorney to Draft Resolution (Staff Recommendation dated 12/20/90, P & Z Memo dated 12/17/90, Application, Plans Under Separate Cover) Discussion took place on possibly requiring an access to the rear of the property. The Director of Community Development recommended that although an additional access would not be a requirement of the Code, Council express its concern for an alternate access in its motion and stated that the applicant is aware that this is a concern of staff. MOTION by Oberbeck/Powell I move we direct the City Attorney to draft a resolution for the preliminary plat for Collier Creek PUD and waive Section 20A-17.1 and allow the construction of the sidewalk on one side and bring it to the attention of the developer that I'd like to see some form of egress to the rear of the property along the property lines for a safety factor when he submits his building plans. ROLL CALL: Mayor Conyers Councilman McCollum Vice Mayor Oberbeck Councilman Powell aye aye aye aye MOTION CARRIED 4-0. 5 City Council Workshop January 2, 1991 Page Six 91.009 G. 90.086 91.010 90.086 River Oaks Final Plat - Direct Cit~ Attorney to Draft Resolution (Staf~ Recommendation dated 12/21/90, Application, Plat Under Separate Cover) The Director of Community Development presented a map illustrating the subdivisions within San Sebastian Springs; discussion took place on final plats for River Oaks, Creek Island and San Sebastian Lakes; and Randy Mosby, Mosby and Associates, responded to questions from Council. MOTION by Oberbeck/Powell I move to direct the City Attorney to draft the resolution to approve the final plat for Unit IV, River Oaks, subject to the above conditions as stated in the agenda packet (see attached). MAYOR'S MATTERS Street Striping - Newly Paved Streets (Conyers Recommendation dated 12/27/90, City Manager Recommendation dated 12/19/90, Proposal dated 12/17/90) MOTION by Oberbeck/Powell I move to direct the City Manager to go out to bid for the centerline striping for Easy Street, Main, Fleming Street and Barber Street. In response to the City Manager, Vice Mayor Oberbeck reiterated that his motion included centerline and stop bars but excluded edging. The City Manager requested that staff be allowed to use its judgment regarding including other types of painting such as arrows, etc. ROLL CALL: Councilman McCollum Vice Mayor Oberbeck Councilman Powell Mayor Conyers aye aye aye aye MOTION CARRIED 4-0. Other Matters Mayor Conyers requested updates on proposed cemetery maintenance and stated that the City Attorney would give a written opinion on signature of contracts. The City Manager said the bid notice for cemetery maintenance is nearly completed. COUNCIL MATTERS A. Vice Mayor Oberbeck Vice Mayor Oberbeck said he had received a letter from an employee regarding employee holiday celebrations and would submit it to the Clerk's office for distribution to Council for next week. City Council Workshop January 2, 1991 Page Nine Vice Mayor Oberbeck questioned the condition of Councilman Rondeau. Council extended its regards to him and offered any assistance it may lend. B. Councilman McCollum None. C. Councilman Powell Councilman Powell requested an update on the HRS letter of non-compliance. The City Manager said he would report under his matters. D. Councilman Rondeau None. 10. CITY ATTORNEY MATTERS The City Attorney read a certified letter he received from Harry Thomas, Jr. regarding a past auto accident which requests him to direct the Police Department to issue a citation, which he stated, he does not have the authority to do. Council concurred that he take no action but that the City Manager forward the letter to the Chief of Police. The City Attorney said he would be attending an institute from January 7 through January 11, 1991 and that Attorneys Torpy and Driscoll will attend the January 9, 1991 City Council meeting. 91.015 89.048 Report on Time Extension Request for Collier Place PUD (no backup) The City Attorney stated that he has prepared a draft ordinance and avigation agreement for Collier Place and that staff will bring it to Council for review once any revisions are made by staff or the applicant. 11. CITY MANAGER MATTERS 91.016 90.293 Report on City Fuel and Oil Storage Facilities - Deferred from 12/19/90 Special Meeting (no back~p) The City Manager reported on the letter of non- compliance from HRS regarding fuel and oil storage tanks at the city garage and recommended that Council authorize him to draft a compliance letter to advise City Council Workshop January 2, 1991 Page Ten 12. HRS that the city is preparing to go to bid to correct violations and that the city will implement better record keeping at the facility. Vice Mayor Oberbeck stated that Envirex of Vero Beach is willing to do an operational audit at no cost to the city and turned over the name to the City Manager. Mayor Conyers commended City Council and staff for producing such a large amount of activity in 1991.
