CITY ATTORNEY DANIEL KILBRIDE THE CITY CLERK READ THE NOTICE OF PUBLIC HEARING AS IT APPEARED IN THE VERO BEACH PRESS JOURNAL, DECEMBER 18 AND 29, 1983, TO CONSIDER THE ADOPTION OF AN AMENDMENT TO ORDINANCE 0-81-9 DATED MAY 11, 1981, PROVIDING FOR REPEALING OF EXHIBIT "A" TO ORDINANCE 0-81-9, DATED MAY 11, 1981; CLARIFYING THE CITY'S RIGHTS UPON A TRANSFER OF THE FRANCHISE; PROVIDING FOR SEVERABILITY CLAUSE: PROVIDING FOR A CONFLICT CLAUSE: PROVIDING FOR AN EFFECTIVE DATE. THOMPSON, CITY RESIDENT, 12'5~. ~MAIN STREET SEBASTIAN~ ~_~ STATED THAT HE WAS OF THE OPINION THAT RESTRICTS GENERAL DEVELOPMENT CCJ~O~J~rION FRO~4 SELL~A~U~THIS CAPITAL WATER PLAN TO ANY OTHER CORPORATION. HE ALSO REMARKED 7H]T ACCORDING 70 HI~ C~LCULATIONS, GENERAL DEVELOPMENT CORPORATION WILL BE MAKING APPROXIMATELY $12 MI~O~ _90LLA~ PROF~ AND FEELS THE PROPERTY OWNER SHOULD NOT COUNCILMAN SZELUGA WAS OF THE OPINION THAT THE GENERAL DEVELOPMENT UTILITY EXPANSION FRANCHISE REQUEST HAD NEVER SEEN BROUGHT BEFORE ~H~T~9~NCIL PRIOR TO THIS PUBLIC HEARING. AFTER SOME DISCUSSION, THE MAYOR AND OTH~R COUN~MEMEBERS INDICATED THAT THIS EXPANSION FRANSHISE PROPOSAL WAS ORIGINALLY PRESENTED mY ~R~G KISELA, REPRESENTATIVE, GENERAL DEVELOPMENT UTILITY, AT THE WORKSHOP MEETING HELD ON~EgE[~B~R 7, 1983 AND FIRST READING HELD AT THE REGULAR COUNCIL MEETING OF DECEMBER 1~,~3..~ ATTORNEY KILBRID_E EXPLAINED THAT THE WATER FR~ANCHISE IS A PRIVATE ENTERPRISE THAT IS BEING SELL IT TO THE'~i~Y IF T~E~ CHOOSE IO~T~ SO~O~E ELSE. THE cIr~'b~ M~.I~ UONCERN IS TO REGULATE AFTER A LENGTHY--~ISC~N,--E'A-RL M'A~TEL'L-ER, TJTTY EN~TfNEE~, ST-A*TED--?H~iT'A~'~ER ANALYZING THE ENTIRE SITUATION, IT IS HIS SUGGESTION THAT THE MAYOR AND COUNCIL CONSIDER A FRANCHISE EXPANSION FOR ALL 17 UNITS. HE ALSO COMMENTED THAT THE CITY HAVE THE ABILITY TO PURCHASE THE WATER SYSTEM AT A LATER DATE AND THEREFORE, AN AMENDMENT BE MADE TO THE ORDINANCE, ALLOWING THE CITY AT ANY TIME, BE GIVEN FIRST REFUSAL TO PURCHASE THE SYSTEM. CITY ATTORNEY KILBRIDE STATED THAT HE WILL DISCUSS WITH GREG KISELA, REPRESENTATIVE, GENERAL DEVELOPMENT UTILITY, WHERE TO INSERT THE LANGUAGE "THE CITY HAS THE RIGHT OF FIRST REFUSAL". MAYOR FLOOD STATED THAT WE WILL TRY TO HAVE THIS AMENDED BEFORE THE SECOND READING AND WOULD BE AN AGENDA ITEM FOR THE NEXT REGULAR COUNCIL MEETING, JANUARY 11, 1984. MR. PRIORE, CITY RESIDENT, COLUMBUS STREET, SEBASTIAN, RECOMMENDED THAT A MORATORIUM BE SET DURING THE INTERIM, SINCE NEW RESIDENTS CONSTRUCTING NEW HOMES WILL BE PUTTING IN A WELL AND WATER SYSTEM. IN RESPONSE TO MR. PRIORE'S RECOMMENDATION, ATTORNEY KILBRIDE SUGGESTED THAT A MORATORIUM WOULD NOT BE APPROPRIATE AND THAT A STANDARD INFORMATION HANDOUT BE PREPARED INFORMING POTENTIAL PROPERTY OWNERS THAT WATER WILL BE COMING, THE PRICE AND THAT THEY WILL BE REQUIRED TO HOOK UP. DANIEL BLAIR, BUILDING OFFICIAL, STATED THAT AT THE PRESENT TIME ALT.. SEPTIC TANK PERMITS ARE ISSUED AS TEMPORARY PERMITS THROUGH THE DEPARTMENT OF ENVIRONMENTAL HEALTH. HE EXPLAINED THAT THE AGREEMENT THE CITY NOW HAS WITH THE DEPARTMENT OF ENVIRONMENTAL HEALTH IS ONLY GOOD FOR AN ADDITIONAL 90 DAYS, AT WHICH TIME THE CITY MUST PROVIDE A UTILITY CONTRACT, SHOWING THAT WATER WILL BE SUPPLIED TO UNITS 1-17, SO THE CONSTRUCTION OF 3 BEDROOM, 2 BATH HOMES CAN CONTINUE TO BE BUILT ON AVERAGE SIZE LOTS. HE STATED THAT IF A WATER UTILITY CONTRACT IS NOT PRESENTED WITHIN 90 DAYS, PERMITS WILL NOT BE ISSUED. THERE BEING NO FURTHER DISCUSSION, PUBLIC HEARING CLOSED: 8:1~ P.M.
