Mayor Harris called the meeting to order at 7:00 P.M. 2. Councilman McCarthy led the Pledge of Allegiance. 3. Invocation was given by Bishop Anthony Varano. 4. ROLL. ~ALL Present: Vice Mayor Kenneth Roth Councilman Robert McCarthy Councilman George Metcalf Councilman Peter Vallone Mayor L. Gene Harris Attorney Thomas C. Palmer 5. PROCLAMATIONS/~NNOUN~MENT~ Mayor Harris requested that another proposed property that he referred to as the Boone property next to the Chamber of Commerce be placed on this agenda. MOTION by Vallone/Roth I move we add the proposed sale of the Boone property to this agenda. ROLL CALL: Councilman McCarthy - Aye Councilman Metcalf - Nay Councilman Vallone - Aye The roll call was not continued since it takes unanimous vote to place an item on the agenda. Mayor Harris requested that the repair of replacement of the Engineering Department copy machine be placed on this agenda. MOTION by Vallone/Metcalf I move we place "Repair or Replacement of Copy Machine for Engineering" on this agenda under New Business. ROLL CALL: Vice Mayor Roth - Aye Councilman McCarthy - Aye Councilman Metcalf - Aye Councilman Vallone - Aye Mayor Harris - Aye MOTION CARRIED. Workshop for evaluations of City Manager applications were scheduled for Friday, January 8 at 3:00 P.M. and Saturday, January 9 at 10:00 A.M. Interviews for City Engineer were tentatively scheduled for January 25th or 26th starting at 3:00 P.M. Councilman Vallone withdrew item 87.297 Boat Trailer Parking. Councilman Metcalf withdrew item 87.022 Sand Mining. Councilman Metcalf withdrew Consent Agenda item D, his request to attend a one day seminar in Orlando Florida on January 25, 1988. Mayor Harris presented Sally Maio with a plaque for Employee of the Quarter for October through December 1987. Vice Mayor Roth apologized to Arthur Lemire for remarks made at a previous meeting. 6. COMMITTEE REPQRTS Councilman Metcalf discussed the Commercial Industrial Development data that the Equal Opportunities Council would distribute the following week. 7. INTRODUCTION OF BU~Ii~SS FROM THE PUBLIC Mayor Harris opened the Introduction of Business from the Public at 7:21 P.M. Bill Markham recommended that Council make the public aware of the current Airport Master Plan before the March election. Evan Fitzgerald discussed the idea of a boat ramp south of the Sebastian River bridge on U.S. 1 and Indian River Drive. Will Conyers stated that he was running for the available Council seat. Judy Reed recommended more activities for the youth of Sebastian. Arthur Lemire recommended a resolution to repair the potholes in the City. Jean Roberts requested sidewalks and a reduction of speed limits in the vicinity of Pelican Island Elementary. Mayor Harris said he would contact the Police Department regarding reducing speed limits in the vicinity of Schumann and Barber. Mayor Harris closed the Introduction of Business from the public at 7:50 P.M. 8. OLD BUSINESS: A. Letter ~o Pos~ Buckley re: ~i~port Master Plan A discussion of the proposed letter to Post, Buckley regarding the master plan took place. Councilman McCarthy said the Council had previously been told the airport was unsafe and he said let us say for the record that the airport is safe. John Van Antwerp said the lights are working but need to be upgraded. He recommended Council get professional advice on merits of the paving program. Mayor Harris said this item would be postponed while a cost study of item 4.7 for repair of lights is considered. Mayor Harris instructed the Airport Manager to write a letter to the D.O.T. regarding the 6.8 Million Dollars the Governor has been reported to be giving to the City of Sebastian for the airport. B. Award B~d for 3/4 Ton Pickup ~ Vehi_~le Maintenance MOTION by Metcalf/McCarthy I move we accept the recommendation of staff and award the Bid to Don Reid Ford for the 3/4 ton pickup truck in the amount of $9849.00 ROLL CALL carried 5-0. MAYOR'S MATTERS 11. 12. 13. Mayor Harris said there are two old Public Works military trucks that the department would like to offer for sale. Mayor Harris instructed the City Clerk to advertise for proposals. CITY COUNCIL MATTERS Councilman Metcalf said Planning and Zoning should receive copies of the updated Comprehensive Land Use Plan. Councilman Metcalf said Pete Knowles should be invited to attend the Council evaluations of City Manager applications. Councilman Metcalf said a letter of appreciation should be sent to the screening committee for the City Manager applications. CITY ATTORNEY'S MATTERS None. NEW BUSINESS Repair Or Replacement of Copy Machine for Engineering Department MOTION by McCarthy/Roth I move we approve a line item transfer of approximately $1500 to purchase a copy machine for Engineering. ROLL CALL: Councilman Metcalf - Aye Councilman Vallone - Nay Vice Mayor Roth - Aye Councilman McCarthy - Aye Mayor Harris - Aye MOTION CARRIED. Attorney Palmer went through each item in the memo from Municipal Code and explained how it relates to the following Ordinances. 88.001 88.002 88.003 MOTION by Metcalf I move we ask the City Clerk to notify Municipal Code that the City accepts their offer to use additional funds to bring codes up to date. The City clerk said the funds can be applied to future recodifications. The City Attorney concurred. MOTION died for lack of a second. A. ORDINANCE NO. O-88-01 AN ORDINANCE OF ~{E CITY OF SEBASTIAN, FLORIDA, REPEALING ARTICLE VIII OF CHAPTER 7 OF THE CODE OF ORDINANCES, CONSISTING OF SECTIONS 7-110 THROUGH 7-125, PERTAINING TO MINING AND EXCAVATION. Attorney Palmer said this old code is superceded by the Land Development Code and is a housekeeping matter. No changes were made. B. ORDINANCE NQ, 0-88-02 AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING SECTION 17-1.1 OF THE CODE OF ORDINANCES OF THE CITY AND THEREBY INCREASING THE SURCHARGE ON COURT COSTS FROM $2.00 TO $3.00 UNDER CHARTER 943, FLORIDA STATUTES; ALSO REPEALING SECTION 17-3 AS TO CURFEW FOR MINORS, THE SAME BEING UNCONSTITUTIONAL. Attorney Palmer said this relates to item #19 of the Municipal Code memo. No changes were made. C. ORDINANCE NQ. 0-88-03 AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING PARAGRAPH (A) OF SECTION 2-93, PARAGRAPH (D) OF SECTION 2-94, AND SECTION 2-98 OF ARTICLE V IN CHAPTER 2 OF THE CODE OF ORDINANCES OF THE CITY OF SEBASTIAN, FLORIDA, AND THEREBY UPDATING THE LIST OF SUBJECT MATTER JURISDICTION OF THE CODE ENFORCEMENT BOARD, AMENDING LIMITATIONS ON REAPPOINTMENTS TO THE BOARD, AND REFERRING TO A RENUMBERED FLORIDA STATUTE AS TO RULES AND REGULATIONS. Attorney Palmer said this relates to items #4 & ~5 of the Municipal Code memo. He said the Building Official wanted item (a)(2) changed from Building Code to Technical Codes. 6 88.004 D. ORDINANCE NO. 0-88-04 88.005 88.006 88.007 AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING SECTION 2-3 OF THE CODE OF ORDINANCES AND THEREBY REMOVING THE PROVISION THAT THE CITY ENGINEER SHALL BE APPOINTED BY THE CITY COUNCIL AND SHALL BE APPOINTED BY THE CITY MANAGER; ALSO AMENDING THE TITLE TO ARTICLE II, CHAPTER 2 AND SECTION 2-15 OF THE CITY CODE AND THEREBY ELIMINATING THE DECLARATION THAT THE MAYOR'S OFFICE IS A FULL-TIME POSITION AND THE DECLARATION THAT THE MAYOR IS THE CHIEF EXECUTIVE OFFICER OF THE CITY; AND THEREBY SPECIFYING THAT THE CITY MANAGER IS THE CHIEF EXECUTIVE OFFICER OF THE CITY; PROVIDING AN EFFECTIVE DATE. Attorney Palmer said this changes every reference to the Mayor to City Manager except declaring a state of emergency. Discussion took place on Charter changes but no changes were made. E. ORDInAnCE NQ, O-88-0~ AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, TRANSFERRING TO ~E CITY MANAGER ALL OF THE MAYOR'S RESPONSIBILITIES UNDER THE CITY OF SEBASTIAN'S STANDARD OPERATING PROCEDURES; PROVIDING AN EFFECTIVE DATE. Attorney Palmer said this amends the S.O.P. transferring the Mayor's duties to the City Manager. No changes were made. F. ORDINANCE NO. 0-88-06 AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING PARAGRAPH A OF SECTION 20A-11.2, SUB-PARAGRAPH (C)(1) OF SECTION 20A-11.2, SUB-PARAGRAPH (C) (3) (A) OF SECTION 20A- 11.2, PARAGRAPH B OF SECTION 20A-11.3, PARAGRAPH (C)(1) OF SECTION 20A-11.3, SUB-PARAGRAPH (D)(1)(A) OF SECTION 20A- 11.3, SUB-PARAGRAPH (D)(3) OF SECTION 20A-11.4, AND SUB- PARAGRAPH (B)(1) OF SECTION 20A-11.4, ALL IN THE CITY'S LAND DEVELOPMENT CODE, AND THEREBY DELETING REFERENCES TO SPECIFIC PROVISIONS OF VARIOUS PROVISIONS OF CHAPTER 163, FLORIDA STATUTES; PROVIDING AN EFFECTIVE DATE. Attorney Palmer said this applies to ~s 22 through 28 of the Municipal Code memo. No changes were made. G. RESOLUTION NO.,. ~-~8-03 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, SETTING THE FEES FOR SITE PLAN REVIEW OF ALL SITE PLANS INCLUDING MAJOR SITE PLANS, MINOR SITE PLANS, AND MAJOR OR MINOR MODIFICATIONS TO SITE PLANS; REPEALING RESOLUTION NO. R-84-10. 88.008 88.009 88.010 88.011 88.012 88.013 No changes were made. H. RESOLUTION NO. R-88-04 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, SETTING THE FEES FOR SIGN PERMIT APPLICATIONS. No changes were made. I. RESOLUTION NO. R-8~-Q5 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, SETTING THE FEES FOR DEVELOPMENTS OF REGIONAL IMPACT. Discussion took place on actual costs for a DRI. No changes were made. J. RE$OLUTIQ~ NO. R-88-0~ a RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, SETTING THE FEE FOR MINOR SUBDIVISIONS. No changes were made. K. ~Q~UT~QN ~ ~-~_~-07 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, SETTING MISCELLANEOUS FEES FOR ACTIONS PERTAINING TO THE LAND DEVELOPMENT CODE AND GENERAL CODES OF THE CITY. There was question by the Building Official as to charging $60.00 for his written opinion. Attorney Palmer said this was the recommendation of Planning and Zoning. L. RESOLUTION NO. R-~8-08 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, SETTING THE FEE FOR APPLICATIONS FOR HOME OCCUPATION LICENSES. No changes were made. M. RESOLUTION NO. R-~8-09 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, SETTING THE FEE FOR APPLICATIONS FOR SPECIAL USE PERMITS. No changes were made. 8 88.014 N. RESOLUTION NQ, R-88-kQ 88.015 88.016 88.017 88.018 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, SETTING THE APPLICATION FEES FOR THE FILING OF PLANNED UNIT DEVELOPMENT CONCEPTUAL DEVELOPMENT PLANS, PRELIMINARY DEVELOPMENT PLANS AND FINAL PLANS. No changes were made. O. RESOLUTION NQ. R-88-11 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, SETTING A NEW FEE FOR APPLICATIONS FOR SAND MINING PERMITS AND REPEALING RESOLUTION R-81-17. Attorney Palmer said at the request of the Building Official he had amended the resolution "1) The fee for filing an application for a sand mining permit is the same for site plan approval." Attorney Palmer also said this sets out a new application form. P. RESOLUTIQN NQ, R~-8~-12 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, ADOPTING THE JOB DESCRIPTION OF THE OFFICE OF CITY MANAGER; PROVIDING AN EFFECTIVE DATE. The Job Description was amended to read as follows: Under Ma~Qr FunctiQr~ "direct otherwise" was stricken and replaced with "employ a personnel director". Under Illustrative Duties "otherwise directed by the City Council" was stricken and replaced with "the City employs a personnel director". Mayor Harris called a recess at 9:40 P.M. The meeting was recalled at 9:47 P.M. Ail members present before the recess were present at recall. Q. RESOLUTION NQ. R-88-13 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, REPEALING THE JOB DESCRIPTION FOR THE MAYOR. NO changes were made. R. RESOLUTION NO. R-88-14 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, REPEALING RESOLUTION NO. R-86-64 AND PROVIDING THAT THE CITY MANAGER SHALL HIRE ALL DEPARTMENT HEADS EXCEPT AS OTHERWISE SPECIFIED iN THE CITY CHARTER; PROVIDING AN EFFECTIVE DATE. 9 88.019 88.020 Vice Mayor Roth said he disagreed with the Finance Director and Chief of Police being under the City Council. Attorney Palmer said R-88-14 is in compliance with the Charter. Councilman Vallone concurred with Vice Mayor Roth. Discussion of a Charter change in September or November took place. Vice Mayor Roth said he believed the Sebastian Property Owners were the only group granted free use. Vice Mayor Roth suggested that the City Clerk contact Marge Szeluga to obtain documentation regarding use of the Yacht Club for the Sebastian Property Owners' Association when the property was deeded to the City by GDC. 10 88.021 Rgquest from ~olonial Dames for Use ~f Yacht C~ub - 1/9/88 and 3/12/88 n ~ Fee Waiver Betty Bock said the group had meager dues and only meet twice a year. MOTION by Vallone/Metcalf I move we approve the request of the Colonial Dames for full fee waiver at the Yacht Club on 1/9/88 and 3/12/88 only. Councilman McCarthy suggested that the City Clerk again contact the groups who feel they had free use and claim they have not been informed of the recent Council decision to charge a half fee to all non-profit groups.
