GENE HARRIS COUNCILMAN RICHARD SZELUGA COUNCILMAN KENNETH ROTH COUNCILMAN PETER VALLONE MAYOR JIM GALLAGHER ATTORNEY THOMAS PALMER NONE COUNCILMAN SZELUGA LED THE COUNCIL AND AUDIENCE IN THE PLEDGE OF ALLEGIANCE. MA OR 'GALLAGHER STATED THAT~T~ERE W~RE FOUR ~T~MS TO BE AIRpoRT GOLF COURSE LEASE, -32~4~EMO-0P~N FIR~ IORDINANCE, ADDED TO THE AGENDA; #31 #33 RECOMMENDATION FROM TREASURE COAST REGIONAL MAYOR GALLAGHER ALSO ANNOUNCED T~k~T~TH~_~D OPENING FOR THE GOLF COURSE TRACTOR WOULD BE HELD AT THE JANUARY 15, .~i~,~3NCIL MEETING. HE ALSO ANNOUNCED THAT THERE WOULD BE TWO PUBLIC HEARINGS, ON TH~FEDERAL REVENUE SHARING BUDGET, AND AN ORDINANCE AMENDING SECTION 11-19, ~RO~IB~2~ING LARGE OPEN FIRES AT THE JANUARY 15, 1986 MEETING. ~ ~ MAYOR GALLAGHER ASKED FOR COMMENTS F~ THE PUBLIC AND THERE WERE NONE. MOTION BY VICE MAYOR HARRIS, SECONDED BY COUNCILMAN SZELUGA TO APPROVE ANNEXATION OF CHESSER'S GAP AND FOR ATTORNEY PALMER TO DRAFT THE ORDINANCE. ALL AYES: MOTION CARRIED. THE COUNCILMAN VALLONE QUESTIONED WHETHER THE CHESSER'S STILL OWNED THE LAND. DR. FISCHER SAID PROPERTY HAD BEEN TRANSFERRED. ATTORNEY PALMER STATED THAT WE WOULD ONLY NEED A COPY OF THE NEW DEED SINCE THE ANNEXATION REQUEST WAS MADE WHEN THE CHESSER'S OWNED THE LAND. PETITION FOR VOLUNTARY ANNEXATION OF INCiTCO REALTY, INC. MOTION BY VICE MAYOR HARRIS, SECONDED BY COUNCILMAN VALLONE TO APPROVE THE ANNEXATION OF INCITCO REALTY, INC. AND FOR ATTORNEY PALMER TO DRAFT THE ORDINANCE. ALL AYES: MOTION CARRIED. ROLL CALL VOTE: AYES: VICE MAYOR HARRIS COUNCILMAN SZELUGA COUNCILMAN ROTH COUNCILMAN VALLONE MAYOR GALLAGHER MOTION CARRIED. MEMO FROM CAROL CARSWELL, FEY FINANCE DIRECTOR, RE: BACK RENT AND INSURANCE: RICHARD A LETTER WAS RECEIVED FROM RICHARD FEY'S ATTORNEY STATING THAT MR. CONTINUE TO PURSUE SITE PLAN REVIEW FOR A BAIT AND TACKLE SHOP. FEY WOULD NOT MAYOR GALLAGHER ALSO ADVISED..C~NC3.~~M~.~_~EY HAS NOT PROVIDED AN INSURANCE POLICY AND IS BEHIND IN HIS ~L~E AGR~M'~T\~q ~HE CITY AND RECOMMENDED THAT MR. FEY'S AGREEMENT WITH THE CITY Bi~E~.M2NATED I~IIATELY. MOTION BY VICE MAYOR HARRIS, ~05-DED BY COU~qILMAN SZELUGA TO TERMINATE THE LEASE ALL AYES: LEASE AGREEMENT HAS BEEN TERMINATED. MAYOR MOTION CARRIED. FEY AND HIS ATTORNEY STATING THAT THE BOARD. GALLAGHER STATED THAT HE HAD RECEIVED A MEMO FROM THE CITY CLERK STATING THAT IS THE ALTERNATE COURSE ADVISORY MOTION BY VICE MAYOR HARRIS, SECONDED BY COUNCILMAN VALLONE TO SEND THIS MATTER THE GOLF COURSE ADVISORY BOARD FOR THEIR RECOMMENDATION. AYES: VICE MAYOR HARRIS COUNCILMAN ROTH COUNCILMAN VALLONE MAYOR GALLAGHER NAYS: COUNCILMAN SZELUGA MOTION CARRIED. TO APPOINT A MEMBER TO THE AIRPORT ADIVSORY BOARD. MOTION BY VICE MAYOR HARRIS, SECONDED BY COUNCILMAN VALLONE TO SEND THIS MATTER TO THE AIRPORT ADVISORY BOARD FOR THEIR RECOMMENDATION. ALL AYES: MOTION CARRIED. REQUEST FROM PARKS AND RECREATION RE: ALLOCATION OF FUNDS FOR A SECRETARY COUNCILMAN VALLONE STATE~..~HA~ IT.WAS,.NOT HIS~INTENTION TO HAVE A PEBSONAL SECRETARY OF HIS OWN~ BUT TO HAVE HARD COPY OF THE MINUTES FROM THE PARKS AND RECREATION MEETNGS. HE WAS TRYING TO COMPLY WITH THE SUNSHINE LAWS, BUT FELT THAT THE PARKS AND RECREATION COMMITTEE WAS IN COMPLIANCE SINCE THERE WAS A MEMBER TAKING MINUTES. MOTION BY COUNCILMAN ROTH, SECONDED BY VICE MAYOR HARRIS TO DENY THE REQUEST ALLOCATION OF FUNDS FOR A SECRETARY FOR PARKS AND RECREATION. ALL AYES: MOTION CARRIED. FOR CITY COUNCIL WORKSHOP MEETI~ MINUTE~ JANUARY 8, 1986 PAGE 3 LETTER FROM COUNTY COMMISSION RE: NORTH COUNTY REGIONAL WASTEWATER SYSTEM MOTION BY COUNCILMAN VALLONE, SECONDED BY VICE MAYOR HARRIS TO LET COUNTY KNOW THAT THE CITY IS INTERESTED IN PARTICIPATING IN THE NORTH COUNTY REGIONAL WASTEWATER SYSTEM. COUNCILMAN SZELUGA STATED THAT THE CITY OF SEBASTIAN SHOULD GET INVOLVED IN ITS OWN SYSTEM AND MAKE THE MONEY THAT CAN BE MADE ITSELF. MAYOR GALLAGHER AGREED WITH COUNCILMAN SZELUGA. HE SAID CITY RESIDENTS ARE ALREADY PAYING ENOUGH TAXES TO SUPPORT NORTH COUNTY RESIDENTS. COUNCILMAN ROTH ALSO AGREED THAT THE CITY WAS BEING BY-PASSED BY THE COUNTY. HE SAID IF WE WERE GOING TO DEVELOP A SYSTEM IT MUST BE DONE SOON, BECAUSE THE CITY CAN'T SURVIVE AND GROW WITH 15~000 LOTS USING PRIVATE WELLS AND SEPTIC SYSTEMS. MOTION BY VICE MAYOR HARRIS, SECONDED BY COUNCILMAN ROTH TO POSTPONE ANY ACTION ON THIS MATTER UNTIL THE FEASIBILITY STUDY IS COMPLETED BY THE COUNTY AND CITY COUNCIL HAS A GHANCE TO REVIEW IT. MOTION BY COUNCILMAN ROTH, SECONDED BY COUNCILMAN SZELUGA TO APPROVE THE USE OF ALOCHOLIC BEVERAGES BY THE INDIAN ASSOCIATION AT THE COMMUNITY CENTER ON FEBRUARY 9, 1986. ALL AYES: MOTION CARRIED. AIRPORT - GOLF COURSE LEASE AGREEMENT JOHN VAN ANTWERP SPOKE TO THE COUNCIL ABOUT HIS WORK WITH THE FAA TRYING TO FINE TUNE THE CITY'S AGREEMENT WITH THEM. HE SAID THAT BY REQUEST OF THE FAA THE PROPERTY APPRAISAL AHS BEEN REVISED UP SLIGHTLY AND GIVES A BOTTOM LINE GOLF COURSE TO AIRPORT AGREEMENT OF ABOUT $38,000 A YEAR, THE ACTUAL FEE BEING $34,496. UNTIL DECEMBER '86. AT THAT TIME THE FEE WILL BE ADJUSTED FOR A FIVE YEAR PERIOD. IT WAS DECIDED TO RESCHEDULE THIS ITEM FOR THE JANUARY 15, 1986, COUNCIL MEETING. MEMO - OPEN FIRE ORDINANCE MAYOR GALLAGHER STATED THAT HE HAD BECOME AWARE THAT THE FORESTRY DEPARTMENT HAD CERTAIN CRITERIA THAT THEY USE IN ALLOWING FIRES AND THAT MAYBE THE CITY CAN WORK WITHIN THESE CRITERIA INSTEAD OF A BLANKET PROHIBITION; WE MAY BE ABLE TO AUTHORIZE THE CODE ENFORCEMENTS TO ORDER FIRES EXTINGUISHED WHEN THEY FEEL THE NEED ARISES. PERMISSION WOULD STILL HAVE TO BE GAINED FROM FIRE DEPT. ALL AYES: MOTION CARRIED. MRS. REID WAS ASKED TO CANCEL THE PUBLIC HEARING ADVERTISEMENT AND PUT NOTICE THAT THE PUBLIC HEARING HAS BEEN CANCELLED ON THIS ORDINANCE AND THAT THERE IS A REVISED ORDINANCE. ATTORNEY PALMER BEGAN TO READ THE ORDINANCE AND DISCOVERED HE HAD THE OLD ORDINANCE. MAYOR GALLAGHER READ THE REVISED ORDINANCE, BY TITLE ONLY, OF THE CITY OF SEBASTIAN AMENDING SECTION 11-19 OF THE CODE OF ORDINANCES AND THEREBY PROHIBITING THE BURNING OF CERTAIN SUBSTANCES, REGULATING CERTAIN RESIDENTIAL BURNING AND LAND CLEARING FIRES; PROVIDING FOR VARIANCES; PROVIDING AN EFFECTIVE DATE. C~S ~. ~ ~ MOTION BY COUNCILMAN VALLONE, SECONDED BY COUNCILMAN ROTH TO AMEND THE INCLUDE "PENDING BACKGROUND CHECK". MOTION, TO ALL AYES: MOTION CARRIED. MAYOR GALLAGHER EXPRESSED CONCERNS ABOUT INSURANCE LIABILITY AND THE LACK OF CITY SUPERVISION OF HIS ACTIONS. ATTORNEY PALMER STATED THAT HE WOULD HAVE TO OBTAIN HIS OWN INSURANCE SINCE CITY CODES STATE THAT INDEPENDENT CONTRACTORS ARE NOT COVERED. MAYOR GALLAGHER ASKED CHIEF NAPPI IF HE WOULD CONTACT TROY COX AND HAVE HIM COME INTO THE POLICE STATION AND HAVE HIM FILL OUT A FORM FOR A BACKGROUND CHECK, CHANGING THE WORK EMPLOYEE TO INDEPENTENT CONTRACTOR. MAYOR GALLAGHER STATED THE MOTION AGAIN, SAYING THE MOTION WAS TO APPROVE THE CONTRACT WITH MR. TROY COX; THE CONTRACT YET TO BE WRITTEN; PENDING BACKGROUND CHECK BY POLICE DEPARTMENT.
