Review City Board Appointment Procedures and Direct City Attorney Accordingly (City
Clerk Transmittal, Code Sections, R-94-51)
The Mayor announced that the subjects to be discussed are: Reviewing some of the
procedures and appointment to the various City advisory boards.
The City Attorney asked the Council for their input on matters that concern them.
After discussion among the City Attorney and the City Council it was decided that the
following item should be added, included and changed:
Alternate members receive consideration.
Removal of sitting member of various boards.
Procedures for appointing and filling vacancies.
All boards under one article in separate sections.
The Mayor suggested that R-94-51 be refined and use it for the lead section of the article.
Various complaints against Board Members discussion followed and it was noted that
there is no specificity directed to Board Members relating to behavior, decorum,
demeanor, etc and what would be acceptable standards for Board Members.
The interviews by Boards of the City stated "MAY" be interviewed. It was suggested
that "WILL or SHALL" replace "MAY''. Should a candidate not appear before the City
Council or a City Board for an interview they should not be considered; however, a
legitimate excuse will be acceptable.
The City Attorney presented to the City Council a draft of items that she has been
working on. She plans to update every week and it will be available in the City Managers
office.
Being no further discussion the meeting ADJOURNED at 6:45 p.m.

CITY MANAGER MATTERS
Mr. Frame announced that there are three "tryout" chairs at the rear of the chambers. He
requested that persons trying the chairs note which one they prefer. He advised the City Council
that a Special Meeting will be held on the 29th of January to be convened as the City Council
sitting as the Community Redevelopment Agency. This meeting will comply with the
requirements put forth by the State relating to the grant. The Citizens' Advisory Task Force has
submitted recommendations to be considered. He submitted a report from Ralph Hahn and
Associates, Inc., relating to findings at the Police Department Building. He noted he had perused
it and the bottom line in the recommendation range from $156,000 up to $214,000 potential cost
of improvements. He has no comment at this time it will be reviewed and assessed. He spoke on
Airport matters at this time: runway 4-22 is anticipated to have the final inspection on January
15th, and if approved the runway will be reopened. This should lessen the number of noise
complaints. Flight Standards has been contacted and a meeting with an inspector will be
scheduled. In the area of Laconia and Winn Dixie, a temporary detour is now there to reroute the
traffic between Lansdown and Rosebush to facilitate the construction of Roseland Road extension
into the existing portion of Laconia. Anticipation of Winn Dixie should be approximately April
1997.

Ordinance No. 0-97-01 was read by the City Attorney by title only and the Mayor opened
the Public Heating at 7:37 p.m.
The City Manager explained the purpose of this Ordinance was to establish legal
representation, on behalf of the Code Enforcement Board, that will be performed by the
City Attorney as opposed to outside counsel. The staff will take the role of presenting
matters before the Code Enforcement Board or if required Special Counsel could be
brought in for that purpose.
This ordinance will take effect immediately upon adoption and the Board Secretary should
send a letter to Attorney Lulich informing him of the action of the City Council.

Mr. Frame explained the ordinance is to try to be responsive to parking on public property
of vehicles with signs "For Sale".
The Mayor recognized Julio Carosi who spoke relating to parking on the road leading into
the airport on the west side just offor on Roseland Road. It must be determined if this is
County or City.
A1 Goelz asked who will enforce this ordinance. It was determined at this time that Code
Enforcement would have enforcement powers.

The City Manager stated that back in October 1996 the Council took action on how to
pay for professional golf lessons for the golf pro and the assistant golf pro. He noted that
the payment should be retroactive.
MOTION by Taracka/Damp
Recommend the approval of the retroactive payment to Mr. Greg Gardner as
reflected in the itemization which was attached to the November 20th agenda package for
the time period of October 24, 1995 through August 28, 1996.
The Mayor questioned the City Manager if the amendment of an appropriation should be
included in the motion of $1,107 for this fiscal year. The City Manager stated that if
needed this would be appropriate. The motioned and seconder agreed to this addition.

The Mayor deferred to the City Attorney. Mrs. Settles noted that the City Code does not
establish any procedures for appeal of Planning and Zoning decisions to the City Council.
The petitioner's appeal is limited to an interpretation of the present City Code concerning
the establishment of liquor stores and bars. There is a prohibition in the Code against
these within 100 feet of a residential district. The P&Z adopted this position that tNs
district is not a residential district it is a Commercial District that allows Residential use.
Therefor the 100 foot prohibition did not apply in this case. That is the limit of appeal that
has been brought the Council this day. Any members of the public that speaks must limit
their evidence to what is on appeal and that is an interpretation of the City Code
concerning the prohibition of bars and package stores within 100 feet of a residential
district.
The issue before the Council is whether COR is a commercial district or a residential
district. That is the only item that should be considered at this time.
Public input will be allowed on statutory interpretation only.
The Mayor recognized Mr. Alan French, property owner, 925 Indian River Dr., Sebastian,
Fl. 32958. He questioned the intent of the COR district and the protection ora residence.
He noted that this district COR is not clearly written in the Codes.
The Mayor then recognized Larry Driver who stated that COR is commercial first and is
allowed as explained at the P&Z meeting. He noted that the rental of property is a
commercial venture.
Steve Philipson, owner of the property located at 920 U.S. Hwy. 1, asked the Council to
note the recommendation of the Community Development Director on page 4 of the P&Z
minutes of December 19, 1996. He then referred to the Land Development Code page 55
and 56. He also verified with the City of Veto Beach and Indian River County that
commercial districts also include residential. He elaborated.

The members of the City Council each gave the reasons for their findings.
The City Attorney stated that Mr. French's property (apartments) is in COR district and
the bar is in the GC (General Commercial). Cd2 allows bars and lounges as a conditional
use and one of the conditions is that they shall not be 100 feet away from a residential
district. The apartments are in the Commercial, Office and Residential District (COR) not
the bar.
Discussion followed - if residential is considered commercial in COR district.
The Mayor recognized Mrs. Kilkelly who noted that she as a P&Z member voted against
this; due to the fact that she sees the COR district as a buffer between commercial and
residential. She feels COR is a commercial and residential district.
The City Manager spoke to the subject of a single zoning district for the Riverfront area.
A well defined set of performance standards needs to be developed. In his opinion COR is
a commercial district. Staff summarized.
Mayor Cartwright in her summation stated that the use is allowed in the CG district the
question is whether or not we (Council) interpret COR as Commercial or Residential.

I move to deny the appeal and uphold the P&Z definition that COR
is a Commercial District.

The City Attorney recommended that another motion is in order at this time; the motion
should include a denial of the conditional use. The Mayor questioned the denial of the
conditional use because the Council did not approve the conditional use. She stated this
item had to go back to P&Z. The Attorney stated that item can be remanded to P&Z for
their consideration.

I move to uphold the appeal and remand this question back to P&Z for further
consideration.
The City Attorney read from the Code that the vote of the City Council overrides the
Planning and Zoning Commission. This item will not be returned to P&Z.

Mr. Halloran asked that "remand this question back to P&Z for further consideration" be
deleted from the motion and Mr. Taracka agreed.
The City Attorney note that Mr. Halloran should take action which would be denial of the
conditional use, and reasoning would be the interpretation to be included in the motion.
Mr. Halloran: "Please include in the motion based on the understanding that this is
residential district, my interpretation." Mr. Taracka seconded this addition.
The original applicant, by this action: overrode the granting of the conditional use. He
now must appeal to Circuit Court.
